Trump is setting the stage to contest the midterms. Here’s how

    2026-10-31T10:31:26.379Z

With only days to the election, time is running out for some of the more extreme pre-election doomsday scenarios that have percolated as a result of President Donald Trump’s chronic and unfounded rhetoric about widespread fraudulent voting.

He has not declared a national emergency to nationalize elections, something he refused to rule out.

His efforts to weaponize the US Postal Service against mail-in voting failed, at least this time. Millions of Americans have already voted early and by mail.

As the voters who want to vote on Election Day prepare to cast their ballots, the focus is turning to the casting of ballots and beyond.

Multiple recent news stories might have caused concern for voters.

Dolly Parton’s sister Stella, for instance, raised alarm in a social media post that a voting machine had changed her vote. Experts told CNN voters need to be paying attention to their ballots, but it’s usually a stray touch or a long fingernail — user error, in other words — that can cause this type of mixup. Occasionally a mistake can result from a machine being improperly calibrated.

A series of bomb threats, likely called in from outside the country, disrupted some voting in Georgia and other states in 2024. Such shenanigans are going to be high on the list of things election officials are prepping for this year — anything from bad weather to network outages to swarms of bees.

Election workers game out all sorts of things and state election officials generally speak with one voice when they say that votes will be cast and counted accurately.

While most Americans still have faith in the system, the president does not.

There has been a lot of conjecture and worrying — some of it justified and some of it fanciful — about how exactly the Trump administration might go about contesting results of the 2026 midterm election.

Asked this week if he would respect the results, Trump included a caveat.

“I will if they are honest elections, yeah.”

Since Trump has alleged fraud even in elections he has won, the operating assumption should be that he will not think they are honest, especially if Republicans lose control of the House, the Senate or both.

He has even offered $1 million rewards to anyone whose tip leads to a conviction for election fraud, something the Republican election lawyer Ben Ginsberg said he views comically.

“If there was evidence of fraud, uh, they would have found it already,” Ginsberg told CNN’s Brianna Keilar this week. “So I take it more as sort of performance art right before the election.”

The Department of Justice has launched a last-minute effort to call congressional elections in California and Washington state into question based on dubious theories of fraudulent voting.

    From CNN’s report:

In California, the administration claimed there were 20,000 people who could be noncitizens on the rolls, while in Washington state, the administration alleged this week that 400 possible noncitizen voters had voted 1,500 times in past elections. The Justice Department sent letters to both states demanding they set aside the ballots of those the department claimed could be noncitizens — and sued California when the state said that the request ran afoul of its laws… The allegations have sparked questions about how the administration created its lists of voters who could be noncitizens — and criticism that its claims of tens of thousands of noncitizens voters have whittled down under scrutiny.

And, separately, the administration has ramped up its investigation of Rep. Ilhan Omar, the Somalia-born lawmaker from Minnesota, raising questions about whether Republicans could challenge her ability to be seated again in the next Congress.

Trump also directed the Department of Justice to get involved in Alaska’s Senate race, where he wants to weaponize Democrats’ efforts to game the state’s ranked-choice voting system.

The president got an apparent boost when the New York Times published a report that seemed to implicate Democrats in an effort to recruit a second candidate named Dan Sullivan to confuse voters. Never mind that the incumbent, Sen. Dan Sullivan, will be identified on the ballot as the incumbent and the Republican.

Ginsberg summarized the ensuing scandal for Democrats as “remarkably politically clumsy and embarrassing for (Democrat Mary Peltola’s) campaign. But Ginsberg added “there’s not an illegality here.”

That hasn’t stopped the DOJ from launching a criminal probe into how the second Dan Sullivan got onto the ballot, and Alaska’s Republican governor has said he might not certify results.

All of these cases are legal long shots, according to experts across the political aisle. And Trump’s election challenges have a poor record in court.

But all his efforts to allege fraud have some political currency.

“They’re just throwing all this stuff out there in an attempt to discourage people from believing in the system and trying to discourage people from coming out and registering to vote and then actually voting themselves,” Eric Holder, who was attorney general under President Barack Obama, told CNN’s Pamela Brown last week.

Unlike in previous elections, Trump now has a Department of Justice helmed by his former personal lawyer, Todd Blanche.

While Blanche has said the DOJ has no plans to contest election results in any state, he also won’t rule it out, as Fox News noted.

“Of course, I’m not going to say that,” Blanche told reporters in Virginia in October. “But am I planning my days around the election to be somewhere to not certify? Of course not, no, not at all.”

He may have no plans, but the federal government is doing more than in previous years to keep an eye on the election.

_CNN’s Gabe Cohen, Jeremy Herb and Dugald McDonnell have an extensive report for CNN subscribers on how players in the Trump administration have alleged, without evidence, widespread cheating and problems with voting machines. It also looks at what they can still do as voters head to polls._Read it here.

The system by which DOJ lawyers are sent to monitor how states monitor polling places and guarantee people have access to ballot boxes is nothing new and has been utilized by both Democrats and Republicans. But the Trump administration is more than doubling — to over 1,000 — the number of election monitors it is sending compared with the most recent midterm election. It’s also going to all 50 US states.

One thousand monitors in a nation of 330 million people is not many, and these monitors should be barred from interrupting voting at any polling place. But they could gather information for potential federal government challenges to any state’s election. The RNC also plans to ramp up its monitoring of polling places. Both parties traditionally send monitors.

FBI agents will be standing by

Federal law prohibits the deployment of the military or armed federal agents to polling places. FBI Director Kash Patel, however, has refused to rule out sending FBI agents to polling places. “I don’t know that we can’t legally do it,” he said at a recent Senate hearing.

But Patel said FBI agents would be on guard on Election Day. “We’re going to house our agents and intel analysts in our field offices for election security,” Patel said, adding, “We have election crisis coordinators manned at all 56 field offices.”

It’s to be hoped that there is no crisis of any kind at election places. And it’s a good thing for the FBI to be prepared. But the administration has also made a point of making claims of voter fraud when there’s no evidence.

For the record, current House Speaker Mike Johnson, a Trump ally who helped him challenge the 2020 election in Congress, said questions about whether Republicans could block the seating of lawmakers were “silly; of course we’ll have a peaceful transfer.”

Johnson said he will follow the Constitution and seat lawmakers whose victories are certified in their states.

“I may not like some of those outcomes, but that’s our system, and for anyone to suggest otherwise is absurd,” Johnson told CNN’s Manu Raju. He also predicted Republicans will keep control of the House, which is a minority view among people paying close attention to the election atmosphere.

In the Senate, contested elections have delayed the seating of senators in the past, most recently in 2008, in an extremely close race between Democratic Sen. Al Franken, who was ultimately declared the winner, and Sen. Norm Coleman, the Republican who lost. Ultimately, it is up to senators to seat their colleagues.

In that regard, everyone should hope for clear winners after Election Day.

None of this is to say Trump’s unprecedented efforts to influence the election haven’t already had an effect.

Republicans’ efforts to gerrymander themselves some new seats were more successful than those of the Democrats, but some of that could backfire in states such as Texas and Florida, where Latino voters who supported Trump in 2024 might this year shun the GOP. It’s also not yet clear what will happen in Southern states where some voters are angry about the Supreme Court’s gutting of Civil Rights-era protections for districts meant to give minority voters a voice in Congress.

Redistricting is expected to expand next year, and so are Trump’s efforts to curb voting by mail. In that regard, 2026 could serve as a dress rehearsal for the next presidential election, in 2028, when Trump won’t be on the ballot but his legacy will be on the line.

Dems’ dire warnings about threats to democracy face an uncomfortable reckoning after Alaska election report

Not one of roughly three dozen Democratic lawmakers contacted would denounce the alleged effort to mislead voters

By Robert Schmad Fox News Published October 31, 2026 4:00am EDT

Democrats Caught Cheating Right Before the Election

Ruthless breaks down explosive new reporting on an alleged Democratic scheme to manipulate Alaska’s Senate race by recruiting candidates to run against Dan Sullivan, raising serious questions for Mary Peltola and Chuck Schumer. Plus, King of the Hill returns with Bill Kristol facing Steve Schmidt, and Americans for Prosperity’s Katelyn Bledsoe joins the “progrum” to reveal what voters are saying about affordability, socialism, and the midterms.

NEW You can now listen to Fox News articles!

While prominent Democrats have spent years warning about threats to democracy, dozens of lawmakers and governors who endorsed Alaska Senate candidate Mary Peltola have declined to respond to Fox News Digital’s questions about a reported effort to confuse voters and potentially cost Republican Sen. Dan Sullivan his seat.

The New York Times reported Wednesday that aides to Democratic Alaska Senate candidate Mary Peltola helped recruit a man named Dan Sullivan to run in an alleged effort to draw votes from Republican incumbent Sen. Dan Sullivan – though Peltola’s campaign has denied involvement.

Fox News Digital reached out to 42 Democratic lawmakers and governors who endorsed Peltola to ask whether they would denounce the alleged effort to mislead Alaska voters.

As of publication, not a single one has responded.

Sen. Richard Blumenthal, for instance, stated that “voter suppression is poisonous, it is toxic to our democracy,” in 2022. His colleague, Sen. Chris Murphy, meanwhile, argued in April 2025 that “those of us who believe that the threat to democracy is urgent” need to “act like it.”

And Sen. Cory Booker said in December 2016 that “protecting American democracy is a calling far higher than party politics.”

Despite their outspoken defenses of democracy and insistence that protecting it should transcend party politics, none of these lawmakers responded to Fox News Digital’s questions about the alleged effort to mislead Alaska voters.

Sen. John Fetterman, a Pennsylvania Democrat who has made a name for himself by publicly breaking with his party on some issues, has also remained mum on the controversy.

Peltola has asserted that her campaign “has no involvement with either Sullivan campaign.” The Times, for its investigation, relied on text messages it obtained as well as interviews with former campaign staffers.

The Department of Justice filed a lawsuit against Alaska on Oct. 22 seeking to delay certification of the state’s Senate election if Republican Sen. Dan Sullivan loses and votes cast for the other Sullivan could have changed the outcome, pending an investigation into whether voter confusion played a role in the result.

Legal experts from across the political spectrum who previously spoke to Fox News Digital said that the case faces significant challenges, particularly as it relates to trying to infer voter intent from anonymous ballots and overcoming the sovereignty of states over their elections.

Among the other Democratic Senators reached by Fox News Digital were Sens. Adam Schiff, Alex Padilla, Maggie Hassan, Chuck Schumer, Catherine Cortez Masto, Angela Alsobrooks, Andy Kim, Brian Schatz, Ed Markey, Elissa Slotkin, John Hickenlooper, Jon Ossoff, Kirsten Gillibrand, Lisa Blunt Rochester, Mark Kelly, Michael Bennet, Ruben Gallego, Sheldon Whitehouse and Tammy Duckworth.

The U.S. House members reached by Fox News Digital included Reps. Alexandria Ocasio-Cortez, Chris Pappas, Brittany Pettersen, Eric Sorensen, Mike Levin, Hillary Scholten, Jared Huffman, Josh Harder, Pramila Jayapal, Sarah McBride, George Whitesides, Jonathan Nez and Marie Gluesenkamp Perez.

Former Sen. Sherrod Brown, who does not currently hold office but is running to retake his Senate seat, and Nevada Attorney General Aaron Ford, were also asked for their reactions on the reporting.

Democratic Govs. Wes Moore of Maryland, Gavin Newsom of California, as well as former North Carolina Gov. Roy Cooper – who is in the midst of a Senate campaign – were also reached for comment.

Peltola’s campaign did not respond to a request for comment.

At least one Democrat has publicly criticized the alleged tactic. Iowa Democratic gubernatorial nominee Rob Sand told Fox News on Sunday that “both parties are doing it and neither party should be doing it,” calling such efforts “manipulating the political system.”

After Election Day, all eyes in the political world could turn to Alaska.

Alaska has already been at the center of a roiling political controversy this week over how the second Dan Sullivan ended up on the state’s Senate ballot, which has sparked lawsuits, criminal investigations and threats to block certification of the election if incumbent GOP Sen. Dan Sullivan is defeated by Democrat Mary Peltola.

But the uproar about the Alaska Senate race could ratchet up to 11 if control of the Senate comes down to who wins in the state, one that election officials and experts say is unlike any other when it comes to voting.

That’s because it might take two weeks before a winner can be determined.

“Alaska does it different than everyone,” said Derek Tisler, counsel with the Brennan Center’s Elections and Government Program. “It’s such a unique state given its geography, given how remote it is and how expansive it is. So voters in all other 49 states are going to be a little confused about how things are done in Alaska when paying attention for the first time.”

There are several reasons why Alaska’s vote count could take longer than other states. For one, the state gives between 10 to 15 days for mailed ballots to be returned to the elections office (10 days if mailed within the US and 15 days from overseas). Secondly, the state uses a system called ranked choice voting to count votes, a process where the results won’t be finalized until after that 15-day period if no candidate receives 50% of the vote on the first ballot.

Should that occur, election officials and experts say it’s important for voters to remember that the process is supposed to take that long — especially because the waiting period can allow close elections to become a hotbed for misinformation over claims of cheating.

“If it does take these two weeks to find out the actual composition [of the results], this isn’t a ballot manipulation — it’s not an attempt to alter the results of the election,” said Russell Luke, a political science professor at the University of Alaska Fairbanks. “It’s simply how long it takes in Alaska. This is to be expected — it’s not extraordinary or outside the norm.”

Controversy swirled this week after The New York Times reported new details about Democratic involvement in getting Daniel J. Sullivan onto the Alaska Senate ballot, with the same name as the incumbent. Alaska GOP Gov. Mike Dunleavy launched an investigation into whether Democrats sought to confuse voters, and he said Thursday that if the probe finds “wrongdoing,” then certification of the Senate race results could be “stopped or changed.”

“We’re going to investigate,” Dunleavy, who launched a probe into the matter, told NewsNation. “We find out there’s wrongdoing and if that means that the certification then is stopped or changed, then that’s what happens.”

Election law experts say there is a path for Republicans to contest the results of the election through the courts, but that the governor’s certification of legitimate election results is not the way to do so.

“If any state authority — whether it’s a canvassing board or secretary of state or governor — wants to interfere with the rights of the voters by delaying or denying certification, the same thing will happen what’s happened in the past: Parties with standing are going to go to the court,” said David Becker, a former DOJ attorney and founder of the Center for Election Innovation & Research. “They’re going to get immediate relief.”

Derek Muller, an elections law professor at Notre Dame, said there’s a statute in Alaska law for a defeated candidate to contest an election in the event of misconduct, fraud or corruption to change the result of the election or “any corrupt practice as defined by law sufficient to change the results of the election.”

That standard would likely be a high bar for a defeated candidate to meet with the courts, Muller said, while also noting that it was a different process entirely than the governor trying not to certify the election.

If the governor refuses certification, Muller said, “the court can order somebody else to do it.”

    Trump’s lawsuit and Senate questions

The Trump administration has also threatened to block certification if Sullivan loses, with a preemptive lawsuit that was filed even before this week’s developments.

The Justice Department is leaning into the Times’ reporting about Democrats’ involvement in recruiting Daniel J. Sullivan to run, arguing it will confuse voters, though the lawsuit is seen as a longshot likely to fail. The state Supreme Court previously ruled ahead of the primary that the non-incumbent Sullivan could be on the ballot.

The judge in the case is considering requests from Alaska election officials, Democrats and outside groups to dismiss the lawsuit, and a ruling could come as soon as this weekend.

There is also speculation about whether some Senate Republicans might try to prevent Peltola from being sworn in should her victory be certified by the state and she show up January 3 when the new session of Congress convenes.

Such a dramatic move has never happened before. President Donald Trump has been vocally complaining about the Alaska race, something that could spur like-minded senators to try to act. But there is no evidence at this point it might happen.

Senate GOP aides refused to address the possibility that there might be an objection to or effort to block Peltola’s swearing in should she win the Alaska Senate race — or even say if there is a procedural mechanism they could use to block her.

Senate practices dictate that when a state certifies an election, the senator-elect provides that certification to the Secretary of the Senate for review. That person is then sworn in, typically by the vice president, with the other members who won their races.

If a challenge is made to the accuracy of the election results, the matter is referred to the Committee on Rules and Administration for investigation. The committee’s eventual findings and recommendations would then go back to the full Senate, which could expel the individual on a majority vote should they find there was wrongdoing or an inaccurate count in the election.

This was last an issue when Sen. Mary Landrieu, a Democrat from Louisiana, was first elected in 1996. She was sworn in even as her opponent alleged voter fraud. A lengthy Senate investigation cleared her.

A more recent controversial race decision played out in the courts: In 2008, Sen. Norm Coleman, a Republican, had a 215-vote lead after the initial vote count in Minnesota. A recount gave a 312-vote lead to Democrat Al Franken. Months of legal wrangling followed. It wasn’t until June 2009 that the Minnesota Supreme Court declared Franken the winner.

Alaska has long been one of the slowest states for reporting election results.

It’s a simple matter of geography: The state is massive, with residents in far-flung areas where ballots have to be flown in to be counted because communities aren’t on the state’s roadway network.

“This was common in Alaska to wait weeks on end for results in close races, even before ranked choice voting,” said David de la Fuente, deputy director for politics and research at the moderate think tank Third Way. “Alaska is one of the few states in the country that a substantial part of their population does not get to their job via personal vehicle.”

That remoteness is why the state gives mail ballot deadlines of 10 and 15 days after the election, so long as they are postmarked by Election Day.

The US Supreme Court took up a case this year that could have ended that practice, requiring all ballots to arrive by Election Day, but the court ruled against a Republican challenge to the practice of accepting ballots arriving after Election Day in Mississippi.

Luke, the University of Alaska professor, said that while vote counting in Alaska has always been slow, ranked choice voting “certainly exacerbates the issue,” because the state waits for the 15-day deadline to run out before running the ranked choice voting tabulation, which is required if no candidate receives 50% of the votes.

Here’s how the process works: The votes of the fourth-place finisher are distributed among the top three vote getters, based on how voters rank the four candidates on the ballot. Then the votes of the third-place finisher are distributed to the top two vote-getters, which will put a candidate above the 50% threshold. (There is one other Republican, Gerald Heikes, on the ballot along with the two Sullivans and Peltola.)

“In this particular Senate race, that is the likeliest outcome — that neither candidate clearly receives a majority in the first round,” Luke said.

The same process could also play out in the state’s gubernatorial and House contests.

Ranked choice voting has been criticized by Republicans, including the president, who has questioned whether Peltola should be seated if she wins.

While some experts have argued that ranked choice voting actually protects the incumbent Sullivan — because voters can rank both Sullivans — the controversy could fuel efforts to end the use of ranked choice voting in Alaska.

In 2024, voters narrowly approved keeping the practice in a referendum. But it’s back on the ballot again in the state, meaning Alaska voters will be using ranked choice voting in the Sullivan-Peltola contest while deciding whether to keep the method for future elections.
