    NEW YORK, Aug 28 (Reuters) – A federal judge denied Donald Trump’s attempt to move his already decided New York state hush money case to federal court, in a setback on Friday for the U.S. president’s effort to erase his criminal conviction.

    Manhattan-based U.S. District Judge Alvin Hellerstein’s ruling came after a three-judge panel of the 2nd U.S. Circuit Court of Appeals directed ​him to review more closely how the Supreme Court’s decision in July 2024 giving Trump broad immunity from prosecution affected ​the New York case.

    In denying Trump’s effort to move the case to federal court, Hellerstein wrote that ⁠the case concerned the president’s personal conduct, not his official acts. Trump was convicted in May 2024 for concealing a $130,000 hush money payment ​to porn star Stormy Daniels, whose claim to have had a sexual encounter with him could have upended his 2016 presidential campaign.

    “Paying hush ​money to an adult film star or engaging in a cover-up of an embarrassment are not subsumed in presidential immunity,” Hellerstein wrote.

    Jurors convicted Trump, a Republican, on 34 felony counts of falsifying business records, in a case brought by Manhattan District Attorney Alvin Bragg.

    Trump has denied Daniels’ claim and defeated Democratic candidate ​Hillary Clinton in the election. He has also asked a New York state appeals court to void his conviction, and has said the ​case was brought for political reasons.

    His lawyers filed a notification with the court on Friday indicating that they would appeal Hellerstein’s decision.

    “President Trump will be ‌filing a ⁠powerful appeal, and will continue defeating Democrat weaponization at every turn,” a spokesman for Trump’s legal team said in a statement.

    TRUMP ASSERTS PRESIDENTIAL IMMUNITY

    The Supreme Court decision, Trump v. United States, said presidents are immune from prosecution over official acts, and prosecutors cannot use evidence of official acts even in criminal cases involving private behavior.

    Trump said that should doom his hush money conviction because jurors heard evidence from his ​first White House term, including ​testimony from former White House ⁠communications director Hope Hicks.

    Hellerstein, who was appointed by former Democratic President Bill Clinton, had twice previously rejected Trump’s attempt to move the case, agreeing with Bragg that it involved private behavior.

    But the appeals court ​said Hellerstein should review whether the disputed evidence “relates to acts taken under color of the Presidency.”

    TRUMP RECEIVED ​NO JAIL TIME

    The ⁠trial judge in the hush money case, Juan Merchan, sentenced Trump on January 10, 2025, to an unconditional discharge, with no jail time or fine.

    Merchan said that punishment, which left the conviction on the books, would avoid a disruption to Trump’s second White House term, which began on ⁠January 20, ​2025.

    Trump faced four criminal cases, and Bragg’s was the only one that went to ​trial. He denied wrongdoing and pleaded not guilty in all four cases.

    The three judges on the appeals court were appointed to the bench by Democratic presidents. Bragg is ​also a Democrat.

    Younger workers are more pessimistic and cynical about how artificial intelligence will affect their jobs than older employees, according to a recent survey.

    Generation Z Americans are the most critical of AI, with only a third of young employees speaking positively about its impact on the workplace, Glassdoor found in an analysis of workers’ attitudes toward AI. By comparison, 47% of Gen X workers — people born between 1965 and 1980 — were high on AI.

    “This was surprising, because generally we expect younger workers to be more comfortable and optimistic about technology,” Glassdoor senior economist Chris Martin told CBS News.

    Martin suspects younger workers’ negative views of AI stem from fears that it will hurt their job and career prospects.

    “There is a growing body of evidence that AI is displacing entry-level jobs that are more exposed to AI,” he said. “The coming years are going to be more difficult for them because AI is changing the way they work, and they may not have access to jobs that workers did 20 years ago.”

    Many workers expressed concerns about being replaced by AI, while others resented being forced to integrate AI tools into their workflows, according to Glassdoor, an online career research site. Some also said their firms were too focused on AI versus the core business. A smaller share of workers was critical of employers using AI to communicate with staff or even using it to snoop on them.

    Older workers, who are typically higher up on their employer’s org chart and more settled in their roles, tend to view large language models as complementary to their work, Martin explained.

    “They see more benefits from AI,” he said, noting that AI can make errors or invent facts, requiring oversight from more experienced employees.

    “An expert worker can easily identify and discard those mistakes, whereas a younger or less-experienced worker may have a harder time telling legitimate facts from hallucinations,” Martin said.

    Gender also factored into workers’ views of AI, Glassdoor found. In general, female employees were more negative: Only 21% of Gen Z women spoke positively about the technology, compared with 42% of Gen Z men.

    Separate research from LinkedIn shows that the AI-driven jobs boom is worsening the gender gap that female employees already face in the tech industry, with women underrepresented among new hires for AI jobs.

    Websites tied to Portland’s Rose City Antifa and the militant abortion-rights group Jane’s Revenge began going dark in the days after the State Department designated their Italy-based technology provider a global terrorist entity.

    Fox News Digital first reported this week that the State Department had designated Autistici/Inventati, known as the A/I Collective, as a Specially Designated Global Terrorist over its alleged support for violent far-left networks.

    “Today’s news demonstrates the extent to which the A/I Collective was the digital infrastructure of the global Antifa terror network,” a State Department official told Fox News Digital.

    “Just one day after the extremist collective was designated as a Specially Designated Global Terrorist, an untold number of servers and websites — used by far-left extremists to plot violent attacks, target federal agents, and conceal their crimes from law enforcement — have been shut down,” the official said.

    Among them was Rose City Counter-Info, a Portland-based website that the State Department says Rose City Antifa used to publish personal information about Immigration and Customs Enforcement personnel and organize violent activity against federal agents.

    The State Department said the group used the site to distribute an online flyer urging supporters to use laser pointers against Customs and Border Protection helicopters. Federal records show one man later pleaded guilty to aiming a laser at a CBP helicopter, forcing the aircraft to abort a planned landing.

    Jane’s Revenge also used A/I services to publish communiqués claiming responsibility for attacks on pregnancy centers and to incite copycat violence, according to the State Department. The group claimed responsibility for the May 2022 firebombing of a crisis pregnancy center in Madison, Wisconsin.

    The NoBlogs platform, which is hosted by A/I and contains thousands of sites, was intermittently unavailable Friday. Some individual pages remained accessible while others returned errors or timed out.

    The State Department has not said whether any U.S. agency directly disabled A/I infrastructure or whether the outages resulted from decisions by the collective, its vendors or its users after the designation.

    The sanctions action blocks Americans and U.S. financial institutions from doing business with A/I and freezes any assets it holds under U.S. jurisdiction.

    The State Department says A/I provided encrypted chat and email services, web hosting, secure video tools and anonymity services to violent left-wing groups in the United States and Europe. The department also said a media organization using A/I services disseminated material from Hamas, Iran’s Islamic Revolutionary Guard Corps, Hezbollah and other designated terrorist groups.

    A/I denied the allegations in a statement posted on a NoBlogs-hosted page.

    The collective described itself as “a small, volunteer-run, technology collective from Italy” that provides tools for “digital self-defense.”

    “We will not back down,” the group said. “Antifascism and anticapitalism are not terrorism. Protesting is not terrorism.”

    Federal judge says Trump discussing payoff to Stormy Daniels isn’t an official presidential action

    A federal judge again denied President Donald Trump’s legal effort to get his New York state criminal hush money case moved to federal court, a move that could have made it easier to reverse his conviction.

    District Judge Alvin Hellerstein said in a ruling Friday that Trump’s cited grounds were “neither new nor legally sufficient.”

    Hellerstein has previously denied Trump’s request to move the case, but a federal appellate court ruled last fall that the district court judge must reconsider in light of the landmark presidential immunity ruling in July 2024 from the US Supreme Court.

    The judge heard arguments from lawyers for Trump and prosecutors from the Manhattan District Attorney’s office at a hearing in February but did not issue a ruling until now. Friday, Hellerstein maintained his position that Trump’s acts as charged in the state’s case against him were private and unrelated to his federal office.

    “The People’s prosecution arises from President Trump’s private conduct surrounding the reimbursement of hush money payments to an adult film star,” Hellerstein wrote Friday. “That conduct, and the challenged evidence, bears no substantive relation to his position in federal office. To consider these facts to be ‘relating to’ a federal office would give the words a definition that is ‘so broad that it is meaningless.’”

    Trump immediately appealed Friday’s ruling.

    “The Supreme Court’s historic decision on Immunity, the Federal and New York State Constitutions, and other established legal precedent mandate that the Witch Hunt perpetrated by the Manhattan DA be removed to federal court, and immediately overturned and dismissed,” a spokesman for Trump’s legal team said in a statement.

    Lawyers for Trump have appealed his 2024 criminal conviction on 34 counts of falsifying business records tied to hush money payments to adult film star Stormy Daniels during the 2016 presidential election. Their separate efforts to get the case moved to federal court started before the state trial, so a federal judge could interpret federal preemption and presidential immunity. The federal track would also offer a faster route for his appeal to get to the Supreme Court.

    Despite the guilty finding, Trump was sentenced to unconditional discharge, meaning he faced no penalties and the conviction was essentially in name only. It did, however, make Trump the first president convicted of a felony.

    Months after his conviction, his lawyers tried again in the wake of the immunity decision that said presidents are protected from criminal prosecution for official acts and barred prosecutors from attempting to enter evidence involving official acts, even if they were pursuing alleged crimes involving that president’s private conduct.

    Trump’s defense team has long argued Trump can’t be prosecuted in connection to the hush money scheme because he’s protected by presidential immunity – he reimbursed his former personal attorney Michael Cohen while in office for a cover up scheme Cohen orchestrated during the 2016 election.

    In his latest ruling, the judge wrote, “There is no way that discussions regarding hush money payments to cover up the President’s relations with Stormy Daniels could be an official act. An affair, or a cover-up of an affair, is not within the “‘outer perimeter’ of the President’s official responsibilities.”

    For Trump, the debate is whether Manhattan prosecutors improperly introduced evidence involving White House staffers’ actions at the hush money trial that they allege was Trump’s crimes as an individual separate from his capacity as president.

    Hellerstein disagreed: “A president’s assistant can work on unofficial, personal matters for the president.”

    Last November, the 2nd US Circuit Court of Appeals kicked the case back to Hellerstein and said the district court must reconsider but didn’t weigh in on whether the SCOTUS decision should tip the scales for Trump.

    Trump’s lawyers also waited about two months to file that renewed request in federal court, first asking the state court Judge Juan Merchan to dismiss the conviction. Merchan denied the motion and Trump’s appeal of his conviction is still moving through state appellate channels.

    In February, Hellerstein called it a strategic decision to petition Merchan before the federal court. “You made a choice. You sought two bites at the apple,” he said, signaling Friday’s ruling back then.

    In his order Friday, Hellerstein said Trump waited too long to file the renewed request for removal in federal court. “Trump’s delay in filing for removal constitutes a “quintessential strategic decision,” and the “fact that he later came to view that decision as a poor one is not sufficient, by itself, to establish cause.”

    The state appeal is also ongoing and could advance to the New York’s Court of Appeals and potentially reach the US Supreme Court if Trump is unsuccessful at the lower appellate levels.

    Aug 28 (Reuters) – A federal appeals court said ​Kalshi cannot block Nevada gaming regulators from overseeing its prediction markets platform, raising the stakes in a nationwide battle over whether such platforms ​allow illegal gambling and who may regulate them.

    In a 3-0 decision, the 9th U.S. Circuit Court of Appeals in San Francisco said Kalshi was unlikely to show that the federal Commodity Exchange Act preempted Nevada from requiring a gaming license to offer contracts that let people bet on the outcomes of sports events.

    Friday’s decision creates a split with the 3rd ​U.S. Circuit Court of Appeals in Philadelphia, which in a divided April 6 ruling said New Jersey cannot regulate Kalshi’s platform.

    It increases the possibility that the ​Supreme Court may eventually decide whether states or the U.S. Commodity Futures Trading Commission should regulate the fast-growing prediction markets industry.

    The ⁠CFTC, under Republican President Donald Trump, has claimed exclusive oversight of prediction markets and challenged regulatory activity in nine states, including New York.

    At least four states — Nevada, Massachusetts, Michigan ​and Washington — have won court orders restricting Kalshi’s activities. New Jersey has until September 3 to appeal the 3rd Circuit decision.

    Kalshi and the CFTC did not immediately ​respond to requests for comment.

    “The court confirmed what has been clear since the beginning — that states regulate sports betting, and the CFTC has nothing to do with it,” said Nicole Saharsky, a lawyer with Mayer Brown who argued the case for the Nevada Gaming Control Board.

    Prediction markets offered by Kalshi, Polymarket, Coinbase (COIN.O), Gemini Titan (GEMI.O) and others have soared in ​popularity since the U.S. presidential election in 2024, when they fared better than pollsters in predicting Trump’s victory over Democrat Kamala Harris.

    Though best known for allowing ​sports wagers, Kalshi’s platform alone also lets people wager on elections, economics, the weather and cultural events such as who will win the Oscars.

    CFTC NOT A NATIONAL GAMBLING REGULATOR, ​JUDGE SAYS

    Kalshi ⁠and the CFTC have said sports event contracts are “swaps” under the 2010 Dodd-Frank financial reforms, affording the agency oversight through its authority to regulate national swaps markets.

    Circuit Judge Ryan Nelson, however, said Kalshi’s contracts have the hallmarks of sports betting, “a quintessential form of gambling” that the CFTC does not regulate.

    He also said Kalshi even advertised itself as “the first app for legal sports betting” in all 50 U.S. states.

    “It is difficult, then, to conclude that Congress intended to ​upend its decades of careful regulation ​of gambling based on broad definitions ⁠of the words used in a Wall Street Reform Bill,” Nelson wrote.

    “The CFTC is not a national gambling regulator,” Nelson added. “No one suggested it was until over a decade after the law was passed.”

    All three judges on Friday’s ​panel are Trump appointees. The appeals court judges who decided the New Jersey case were appointed by Republican presidents.

    “Calling ​a sports bet ⁠a ‘swap’ doesn’t make it one,” said Arizona Attorney General Kris Mayes, who in March filed criminal charges accusing Kalshi of running an illegal gambling business. “Financial reform legislation was never intended to strip states of their traditional police power over gambling, and I’m glad the court said so clearly.”

    Friday’s decision upheld a November 2025 ruling by Chief ⁠Judge Andrew ​Gordon in Las Vegas federal court, dissolving an injunction from seven months earlier that let Kalshi ​continue offering sports event contracts in Nevada.

    Gordon’s original injunction did not address Kalshi’s election contracts, which Nelson said are illegal under Nevada law and a much smaller part of Kalshi’s business. The ​appeals court returned the case to him to review those contracts.

    Cattle ranchers express concern about U.S. plan to boost foreign beef imports

    Cattle ranchers are speaking out against a Trump administration plan to temporarily waive higher tariffs on ground beef imports, arguing it will undercut their business and prevent them from rebuilding their dwindling cattle herds.

    President Trump announced on Truth Social last week that the U.S. will ease tariffs on up to 300,000 metric tons of ground beef imports— about 661 million pounds — allowing it to be sold at 25% below market price.

    The deal is scheduled to take effect on Sept. 1, according to a description of the proclamation on the White House website. It applies to lean beef trimmings, which can be blended with higher-quality domestic beef to create ground beef, according to Purdue University economists.

    U.S. beef prices have surged to nearly $7 a pound, up roughly 63 cents over the last 12 months and $2.93 a pound since 2021. The White House said that temporarily expanding imports will lower beef costs for consumers.

    “This action includes key safeguards to maximize cost savings while protecting American ranchers from foreign imports and giving space for American ranchers to grow the domestic herd,” the White House added.

    “Crazy input costs”

    Despite such reassurances, the plan to boost U.S. imports of foreign beef has drawn criticism from some cattle ranchers, who fear it could drive down the prices they receive for their cattle. Falling prices, compounded by rising production costs, would make it harder for ranchers to expand their herds — the main factor driving up beef costs for consumers.

    Shawn Harris, a rancher based in Georgia and a Democratic nominee for the state’s 14th Congressional District, said the plan could run cattle ranchers like him out of business.

    “Right now, we got crazy input costs when it comes to tariffs and diesel, fertilizer, everything,” he said in a recent interview with CBS News. “And now farmers are about to sell cattle, and we’re going to lose money on this deal.”

    The American Farm Bureau Federation, a trade group for the agricultural industry, said the timing of the Trump administration’s import plan is particularly concerning because the import window coincides with the peak sales period for farmers between September and November, when they have to make key decisions about their herds.

    Kimberly Ratcliff, CEO of Ratcliff Premium Meats, a ranching business that sells beef, thinks the Trump administration’s plan to temporarily ease tariffs and boost beef imports could offer relief to consumers in the near term. But it won’t help ranchers rebuild their herds and deal with high production costs, she said.

    Ratcliff, who sources cattle from producers in East Texas to turn into beef products, told CBS News that ranchers are being forced to make difficult decisions about whether to keep or sell their cows amid the market uncertainty.

    “Right now, it’s costing $1,100 a year just to keep a cow. That’s a lot of inputs to put in a cow when you’re unsure what the market’s going to do,” she said, adding, “They’re willing to take the price that they can get now.”

    White House spokesperson Anna Kelly said Mr. Trump has bolstered the U.S. agriculture industry by negotiating new trade deals, expanding ranchers’ and farmers’ access to foreign markets, lowering input costs, and other actions.

    Mr. Trump said on Friday on Truth Social that he is authorizing changes that would allow ranchers and farmers to process their own food. That would give them a potential workaround to working with large meatpacking companies.

    “Ranchers and Farmers have always been a number one priority for me,” Mr. Trump wrote. “They work very hard, are smart, efficient, and immaculately CLEAN, but for years I have heard that they have had a tremendous problem with the Big Processors, who many say are a nasty Monopoly. There are, essentially, 4 of them, a very non competitive number, and they make life miserable for our wonderful Farmers and Ranchers, and I can’t let that happen, can I?”

    Kelly, the White House spokesperson, did not offer details on how the measure will work. “The administration is drafting several policy actions to further support those who feed the world — stay tuned!” she said in an email to CBS News.

    Walmart reached an agreement with the U.S. government on Friday to settle a lawsuit that accused the discount retailer of unlawfully dispensing opioids from its pharmacies.

    “We are pleased to resolve this matter and will continue supporting the exceptional work our pharmacists do every day to provide outstanding patient care,” a Walmart spokesperson said in an email to CBS News.

    The Justice Department acknowledged the settlement in a separate statement. “We will continue to hold accountable companies and individuals whose unlawful prescribing, marketing, dispensing or distributing practices contributed to the opioid crisis and put American communities at risk,” a department spokesperson said.

    Walmart and the Justice Department did not disclose the settlement amount.

    The Justice Department sued Walmart in December 2020, alleging the company violated the Controlled Substances Act by filling thousands of invalid prescriptions and failing to report suspicious drug orders. Federal prosecutors alleged Walmart’s actions contributed to the opioid epidemic, a period spanning from 1999 to 2023 during which over 800,000 people died from opioid overdoses.

    The lawsuit came after a multiyear investigation by the Justice Department. If Walmart was held liable, it would have been forced to pay $67,627 for each unlawful prescription it filled and $15,691 for each suspicious order it failed to report, according to the Justice Department.

    Walmart’s website says it has nearly 4,600 pharmacies nationwide, where it fills prescriptions for generic drugs, insulin, GLP-1 medications and other drugs.

    Critics mocked former Vice President Kamala Harris after she warned Republicans are “trying to cheat” in the midterms while echoing President Donald Trump’s signature “too big to rig” rallying cry in a new video urging Democrats to turn out in force.

    “We are two months away from the midterms. Get out and vote. Let’s get everyone out to vote. They are cheating,” said Harris in a recorded video Thursday posted on X.

    “They are trying to cheat, and we have got to turn out in big numbers and be too big to rig. I’ll see you out there,” Harris added.

    Trump repeatedly used “too big to rig” during the 2024 campaign, after years of casting doubt on U.S. election integrity following his loss in the 2020 election. Harris is using the same phrase while accusing Republicans of trying to cheat in the 2026 midterms.

    “47 seconds. 15 jump cuts. She must be high as a kite,” wrote popular account End Wokeness.

    “Nice to know she’s still stealing Trump’s ideas,” said conservative commentator Shawn Farash.

    “Sounds familiar,” said Turning Point show host Jobob Taeleifi.

    In her video, Harris pointed to Monday’s Supreme Court ruling allowing parts of Trump’s mail-voting order to move forward while the legal fight continues. The court did not rule on whether the restrictions themselves are legal.

    A federal judge on Thursday again temporarily blocked the Postal Service from enforcing the new mail-ballot requirements, setting up another round of litigation over the policy ahead of November’s midterms.

    Harris urged Democrats to turn out in large numbers while arguing that Trump’s mail-voting policies could make it more difficult for some voters to cast ballots.

    “By the way, he votes by mail from Mar-A-Lago, but he doesn’t want you to vote by mail. Just this week the U.S. Supreme Court backed up the president’s agenda. He’s trying to make it more difficult for you to vote by mail,” Harris said in the video.
