    President Donald Trump is arguably the most pro-Israel president of modern times. So his Election Day announcement that the United States would end nearly $4 billion in annual aid to Israel was stunning.

    But as is often the case with Trump, the announcement — made on Fox News — was short on details and difficult to pin down. It could end up being less seismic in practice than the shock announcement might suggest.

    Still, Trump’s move was yet another intriguing twist in his relationship with Israeli Prime Minister Benjamin Netanyahu — his partner in the Iran war, which threatens GOP hopes in Tuesday’s midterm elections. And it comes at a critical political moment, with Israel in political limbo after there was no clear winner in last week’s election and uncertainty over Netanyahu’s future.

    The political dynamic in the US is also impossible to ignore. In a sense, Trump seems to be conceding a point to Democrats such as Michigan Sen. Abdul El-Sayed in implying that aid to Israel is becoming politically unsustainable in US politics.

    This underscores an extraordinary fracture in the long-lasting bipartisan pro-Israel consensus in Washington.

    And it goes beyond the question of how a new Democratic House or Senate would handle the issue after Tuesday’s midterms. The announcement points to an uncertain new era for Israel: Netanyahu has been aligned with Republicans in Washington through several administrations, but there has been significant domestic backlash to Netanyahu’s response in Gaza to the October 7, 2023, Hamas terror attacks, not only among progressives but also activists on the right of Trump’s MAGA movement.

    Growing uncertainty over whether there will be a congressional majority to back Israel and arms sales to its military will create huge future geopolitical implications for the Jewish state and US Middle East policy.

    Trump loves to shock, to create news around himself and to distract. So perhaps his announcement in an interview on Fox News was a political play on a day when many Republicans fear a stinging rebuke from voters.

    He certainly seemed to surprise the Fox anchors.

    “I have made a deal that we give Israel $4 billion a year, and we made a deal months ago that we’re stopping …. they’re fine with it because, you know, they’ve become a very successful country,” he said. Trump added that the US would help the Israelis if they needed it. “But by end of this year, we won’t be paying Israel.”

    The president appeared to be referring to annual US military aid to Israel, which amounts to just less than $4 billion a year under a deal made under former President Barack Obama in 2016. That arrangement is due to run through the end of 2028.

    Most of the funds are spent on buying weapons and equipment for the Israeli armed forces from exclusively US manufacturers, so the deal has significant implications for US businesses and employment. Attention is turning to what US and Israeli military cooperation will look like in future. Netanyahu told the Economist in January he wanted to “taper off” US military aid to Israeli within 10 years and that the shift was “in the works.”

    It’s hard to know whether Trump’s statement on Tuesday means that the US aid would stop immediately, a step that would be intriguing but would not amount to a strategic fracture between the allies. Foreign policy analysts who have served in both Republican and Democratic administrations have argued Israel is now such a powerful economy that it doesn’t need US aid to buy military equipment. The nexus between US arms manufacturers and Israel is expected to remain strong, and the militaries of the allies have recently worked together more closely than ever. That was the case even before the Iran war — for instance, when the Biden administration staged massive air and naval defensive operations to repel Iranian cruise missile and drone attacks in 2024.

    Brett McGurk, who was a senior White House and State Department official for four administrations, said the issue of US aid to Israel is deeply misunderstood. “I wouldn’t overstate the significance” of Trump’s remarks Tuesday, McGurk said.

    “Whether he’s talking about, we’re going to end the MOU when it ends in 2028, or we’re going to stop it right now, I don’t know,” added McGurk, a CNN global affairs analyst and author of the new book “Brink” about his role negotiating hostage releases in the Gaza crisis.

    Israel and the Palestinians are now a domestic US issue

    Trump’s announcement came as tens of millions of Americans are voting after an election campaign that showcased the new intertwining of the issue of Israel and the Palestinians in domestic US politics.

    It was extraordinary to hear him apparently reacting to opposition to US aid to Israel from Democrats like El-Sayed, whom he’s subjected to a torrent of anti-Muslim rhetoric. The Michigan Democrat has argued that Americans are paying more for groceries because of a war the US is fighting at the behest of Israel.

    “Why should we suffer the slings from lunatics like an El-Sayed when they (Israel) don’t need it?” Trump told Fox and Friends. “It’s a bad talking point because you’d say — ‘Why don’t we give everybody $4 billion?’”

    The Israel issue caused a weekend clash between El-Sayed and his former Democratic primary foe Haley Stevens, who then endorsed his GOP rival, Mike Rogers. Stevens objected to an ad by a left-wing influencer featuring a couple in a supermarket blaming higher prices on Israel. El-Sayed denounced the ad, which his team said was not affiliated with the campaign. But the showdown encapsulated the schism over Israel that could complicate any new Democratic congressional majorities.

    Progressives may interpret Trump’s shift as a validation of their positions. “Even a broken clock can be right twice a day,” El-Sayed said Tuesday, according to the Wall Street Journal. Others, however, argue that critiques of Israel’s government too often cross over into antisemitism — a charge candidates like El-Sayed deny.

    Trump may also be seeking a political win for himself. Ending US aid to Israel would speak to Trump’s “America First” instincts and hostility to the use of American wealth to support foreign nations. His argument that he’d use unspent cash to pay down the deficit is less convincing, given ballooning national debt in his two terms.

    While progressives are outraged at Israel because of the humanitarian crisis in Gaza, anti-Israel sentiment has also been rising to Trump’s right in the Republican Party, fanned by influencers and podcasters with huge audiences. CNN’s Donie O’Sullivan, who has spent months speaking with Trump supporters, found many believe the US is fighting Israel and are skeptical about the US relationship with its government.

    In a Quinnipiac poll published in June, 48% of respondents said the US is too supportive of Israel; 38% said US support was about right; and only 7% said the US was not supportive enough. This was the highest percentage of voters thinking that Washington was too supportive of Israel since Quinnipiac first started asking the question in January 2017.

    In a sign of how sentiment on Israel has shifted among Democrats, former Obama White House chief of staff Rahm Emanuel, who may run for president in 2028, has argued against unconditional US military aid to Israel and called for a new US relationship with the country in a speech in Tel Aviv earlier this year.

    In one sense, it might make sense politically for Israel to try to separate its military decisions and purchases from polarizing US domestic politics. It would be free to make its own choices about what to buy, although in practice it’s unlikely to turn to Europe’s manufacturers because of huge public anger there over Gaza. The idea that it would purchase Russian or Chinese equipment seems a long shot given certain US opposition.

    But such scenarios point to another headache for Israel if it remains a flashpoint in US politics. Presidents can authorize arms sales to foreign states; lawmakers can seek to block them, but in this case, the chances of veto-proof majorities seem slim.

    But there’s another worrying possibility for Israel’s supporters: that political hostility produces a president from either party who is less committed to its national security needs than Trump, former President Joe Biden or their predecessors.

    As Emanuel put it in an interview with CNN’s Fareed Zakaria in July, Israel could pay a price because of its own actions. “That’s not a Democratic Party problem. That’s an America problem,” he said.

    Ex-Rep Justin Amash says Mike Rogers ‘would be more dangerous in the US Senate’ than Abdul El-Sayed

    The former House lawmaker noted he did not vote for El-Sayed or Rogers in the Michigan US Senate election

    Observers wonder whether Democrat Rep. Haley Stevens’ surprise endorsement of Republican Mike Rogers will cost Abdul-El-Sayed the Senate seat in the hotly-contested Michigan race.

    Former Rep. Justin Amash — who announced on Monday that he did not vote for Abdul El-Sayed or former Rep. Mike Rogers in Michigan’s U.S. Senate race — said he thinks El-Sayed would “be far less dangerous in practice than Rogers.”

    Rogers, a Republican candidate endorsed by President Donald Trump, is facing Democratic candidate El-Sayed in the widely-watched Senate contest.

    “It goes without saying that I have major disagreements with both Mike Rogers and Abdul El-Sayed, and neither one particularly likes me,” Amash wrote in a thread on X. “I also don’t vote for ‘the lesser of two evils.’ I believe you should support a candidate only if you truly want the person to hold that office. I’ve already voted, and consistent with the above principle, I didn’t vote for Rogers or El-Sayed. But I do know which one would be more dangerous in the U.S. Senate — and it’s not even close.”

    Amash pointed to Sen. Bernie Sanders, I-Vt., as a political figure who resembles El-Sayed. Sanders has supported El-Sayed in the Senate race.

    “To assess who is the greater threat to American freedom, let’s take a look at my time in Congress with Rogers and Bernie Sanders, who shares many of El-Sayed’s views and can serve as his stand-in,” Amash wrote. “Several of Sanders’s key proposals, in my opinion, would be exceptionally bad for our country. But given the structure of our government, he’s in no position to get those ideas enacted and enforced.

    “In contrast, Rogers is extraordinarily bad on all the issues on which an individual member of Congress may be the deciding vote. Again, these are issues like war powers, surveillance, privacy, the freedom of speech, criminal justice, and government oversight and accountability,” he asserted. “In this world — the real world, not the imaginary one that partisan pundits on the right and left live in — Rogers poses a far greater threat to individual liberty and the Constitution than Sanders. Moreover, it’s not just that Rogers is awful here; it’s that Sanders is actually much better on these issues than the median member of Congress.”

    Amash asserted that between Rogers and El-Sayed, the Democratic candidate would be “less dangerous.”

    “I think it’s fair to view El-Sayed as someone who mostly will follow in Sanders’s footsteps on policy and therefore will be far less dangerous in practice than Rogers,” Amash wrote, adding in parentheses, “(Again, El-Sayed as a senator will do many things that are bad. The question addressed at length is not whether he’s good but simply whether he’s better on the whole than Rogers.)”

    The Rogers and the El-Sayed campaigns did not immediately respond to Fox News Digital’s requests for comment on Tuesday.

    Amash, who served in the U.S. House of Representatives from early 2011 until early 2021, voted to impeach President Donald Trump in late 2019. While he served most of his congressional tenure as a Republican, Amash switched to Independent in 2019 and then to Libertarian in 2020.

    He lost the 2024 GOP Michigan U.S. Senate primary to Rogers.

    Rogers went on to lose the general election that year to Democrat Elissa Slotkin, who was a House lawmaker at the time.

    Rep. Haley Stevens, D-Mich., who lost the Democratic Senate primary to El-Sayed this year, shook up the 2026 general election when she endorsed Rogers on Sunday.

    The afternoon before Election Day, three voters on the streets of Rochester told Fox News Digital why they are backing former Michigan Rep. Mike Rogers or his Democratic Senate opponent, Abdul El-Sayed.

    Michigan voters showed the swinginess of their state in conversations with Fox News the day before the midterm elections, with one former Democrat firmly backing GOP Senate candidate Mike Rogers and a lifelong Republican holding his nose to vote for Dr. Abdul El-Sayed, a Democrat.

    After casting a ballot for Rogers, voter Marjorie Mehney said she was a Democrat “years ago” and would be “embarrassed to be one today” with candidates like El-Sayed representing the party.

    However, she pointed out that El-Sayed has won over many voters in her hometown of Petoskey, located in Emmet County, where President Donald Trump took more than 55% of the vote in 2024.

    “The majority are Republican. However, there’s a great deal of signage for Abdul. So it’s very mixed. We’ve never seen anything like the support that’s going on with signs in front yards,” Mehney told Fox News in downtown Rochester.

    ROGERS WARNS MICHIGAN VOTERS AGAINST EL-SAYED’S ‘EXTREME’ AGENDA AHEAD OF ELECTION

    When asked if she knew why there had been a shift toward El-Sayed, she said she had “no idea” and called the momentum he is experiencing in her community “a bit shocking.”

    “They are people I’ve known and never knew that they felt this way that Abdul does,” she said. “It’s a little concerning.”

    Mehney predicted that El-Sayed will prevail over Rogers on Tuesday, but warned that Michigan voters will come to regret sending him to the Senate.

    Another voter, Tom Wright, told Fox News that he voted for El-Sayed despite disagreeing with him on “60% to 70% of his policy positions.”

    “I cannot bring myself to vote for a Trump minion under any circumstances,” Wright said, referring to Rogers.

    Rogers left Congress before Trump launched his first presidential campaign, representing Michigan’s 8th District from 2001 to 2015, meaning he has no congressional voting record on Trump’s legislative agenda across either of his two terms.

    Rogers has made his position clear on a series of Trump policies. For instance, he backed the Iran war in its early stages and has supported giving presidents broad authority to impose reciprocal tariffs, as Trump did.

    TRUMP DOMINATES EL-SAYED’S ATTACKS AGAINST ROGERS, BUT GOP RIVAL OFFERS UNEXPECTED POLICY SPLIT

    However, as the Senate campaign entered its final stretch, Rogers has distanced himself with Trump on both issues. In late September, he released an ad calling for a quick end to the Iran war, and in early October, another ad of his demanded an end to the “tariff war” with Canada.

    Wright, who described himself as “a lifelong Republican,” said Rogers’ shifts on those issues were not enough to win his support.

    Wright argued that the GOP is “too far toward Trump” and that “Mike Rogers won’t stop it.”

    “The litmus test is, are people willing to hold their nose and vote for Abdul because they are so appalled by Trump? Not that they like Abdul or are a progressive,” Wright said.

    When asked about his reservations about El-Sayed, Wright said he doesn’t like his stance on Israel and Palestinians.

    “I don’t think he has sufficiently disavowed elements that I consider divisive. A man is judged by the company he keeps and he keeps some pretty bad company,” Wright said. “Nonetheless, he is one senator out of 100. I don’t care what he says he’s going to do. He can’t do a damn thing. And if some sanity returns to the Republican Party in six years, I can vote for the opposition.”

    A third Michigan voter, Gerald, said he was planning to split his ticket, telling Fox News he would vote for Rogers for Senate and Democrat Jocelyn Benson for governor.

    Gerald wasn’t comfortable voting for El-Sayed because he heard he is a “communist.”

    As in past midterm elections, Michigan could play a pivotal role in determining control of Congress. Polls are open across the state Tuesday from 7 a.m. to 8 p.m., with voters still able to cast a ballot as long as they are in line by the time polls close.

    Voting machines in Westchester County, New York, the state’s seventh most populous county, are not accepting paper ballots at polling locations throughout the county, the Westchester County Board of Elections said in a statement Tuesday morning.

    “The Westchester County Board of Elections (BOE) is aware of an issue involving the paper ballots that is preventing some voting machines from accepting ballots at polling locations throughout the County,” the statement read.

    The board, in a separate statement issued later in the day, said the issue stemmed from an update to the county’s election programming that occurred after initial testing of equipment.

    “A change affecting a contest in one municipality required updated election programming, which was subsequently tested and deployed for early voting and for Election Day machines in that municipality,” the statement read.

    “However, Election Day machines elsewhere in the county continued to use the original programming and therefore could not recognize and accept the ballots being used for Election Day,” the statement continued.

    Rep. Mike Lawler, R,-N.Y., whose district contains a large swath of Westchester County, said the specific issue was that the paper ballots are too thick for the machines to read.

    “There was an issue with the thickness of the ballot and the formatting of the machines. And so none of the machines were accepting the ballot across the entire county,” Lawler told CNN.

    Lawler first alerted voters to the apparent ballot scanner problem in the county in a Tuesday morning post on X.

    “There is a problem with every ballot scanner in Westchester County. We do not yet know the exact cause of the issue, whether it is the ballot or the machine. The Board of Elections is working with their vendors to resolve it,” Lawler wrote.

    “However, every ballot will be counted. Stay on line and vote. Do not leave the polling place without voting,” Lawler’s post concluded.

    Multiple voters in Westchester County told Fox News Digital that their paper ballots were taken and placed into red or orange bags. Lawler confirmed the procedure of using the bags to store ballots.

    “As is often the case, when there’s an emergency, they take the ballot, and they put it in an emergency voting bag. Every ballot will be counted. And everybody should be rest assured that their vote will count. They should wait on line. I know the lines may be impacted a little bit. With some delays, but do not leave the line. Make sure you vote. Your vote will be counted. The machines are being fixed,” he said.

    The county’s board of elections reiterated Lawler’s insistence that all ballots will be counted.

    “Voters should continue to complete their paper ballots as instructed by poll workers. Ballots that cannot be processed by voting machines will be placed in designated orange emergency ballot bags, which will remain secure and monitored. These ballots will subsequently be counted,” the BOE said.

    In a statement, Westchester County Executive Ken Jenkins said, “My office is fully aware of the ongoing problems with ballots and voting scanners across Westchester County, and I want to be absolutely clear: this situation is unacceptable.

    “Voters should remain in line and exercise their right to vote. Every eligible voter will have the opportunity to cast their ballot, and every vote must be counted. I have directed County officials, including representatives from our Law Department, to monitor the voting process and ensure that voters can cast their ballots without interference and that every vote is properly and accurately counted.

    “Once these issues are resolved, I will convene a bipartisan team to conduct a thorough review of the decisions and failures that led to this debacle, determine where accountability lies and ensure that this never happens again.

    “Westchester County voters deserve a fair, secure and seamless election process. Today, we have fallen short of that standard. The voters deserve better, and I intend to make sure they get it,” Jenkins said.

    The board also apologized to voters and to poll workers for the inconvenience.

    “Let us be absolutely clear: Every eligible vote will be counted. No voter should be discouraged from participating in this election because of this issue. Your voice matters. Your vote matters. Please stay in line and vote,” the board’s statement said.

    Voter Patrick Reagan, who has been voting in Westchester County for the last 40 years, spoke to Fox News outside a polling place in Yonkers.

    “I hope all the votes are going to be corrected properly and accounted for. And, you know, it’s a big year for everybody just voting. You know, we need to keep the country safe and good. And I hope, it’s going to turn out the way I wanted to,” Reagan said.

    Voter Linda Giaimo, a woman who took her friend to vote, said she would be calling the Board of Elections about what was happening on Election Day.

    “It’s all through Westchester County, that all these machines are down. So now we’ve got to put our vote in a bag and believe that that bag is going to be delivered. I got a problem with this,” Giaimo said.

    New York’s Democratic Attorney General Letitia James also weighed in.

    “My office is monitoring this issue with scanners in Westchester and is in touch with the state and local Boards of Elections as they work on a solution. Westchester voters can still safely fill out and turn in their ballots at their polling locations. Your votes will count,” she wrote in a Tuesday morning post on X.

    James also reminded state residents that New York has a dedicated Election Protection Hotline — (866) 390-2992 — to assist New Yorkers experiencing issues at the polls.

    The FBI arrested an Oklahoma City man suspected of sending hundreds of suspicious white powder letters to election offices and public officials nationwide.

    FIRST ON FOX: The FBI arrested an Oklahoma City man early Monday suspected of sending hundreds of letters containing suspicious white powder to public officials across the country during the 2024 and 2026 election cycles, a federal law enforcement source told Fox News Digital.

    The suspect’s initial court appearance is expected Tuesday afternoon. The letters were sent to more than 100 locations, including multiple secretary of state and election offices, the source said.

    The FBI’s Oklahoma City field office, FBI Criminal Division, U.S. Postal Inspection Service (USPIS), U.S. Capitol Police and the Oklahoma City Police Department (OKCPD) led the investigation.

    The FBI said it was working with the U.S. Postal Inspection Service to investigate “a series of suspicious mailings sent to various addresses nationwide, including Secretary of State offices and their related election offices,” The Associated Press reported last month.

    Authorities had warned recipients to treat the mailings as “potentially hazardous” as authorities worked to intercept additional letters before they reached their destinations, according to the outlet.

    A letter addressed to Sen. Lisa Blunt Rochester’s Delaware office was intercepted by Capitol Police, while suspicious mail addressed to the offices of Sens. Alex Padilla, D-Calif., and Kirsten Gillibrand, D-N.Y., were intercepted by postal authorities, AP reported.

    Oklahoma man charged with mailing letters with white powder to hundreds of officials

    Washington— An Oklahoma man faces federal charges after allegedly sending hundreds of letters containing white powder to public officials and media outlets ahead of both the 2024 and 2026 elections.

    According to charging documents unsealed on Tuesday, Robin Patrick Martin allegedly sent more than 700 envelopes to public officials of both parties across the country. Authorities said the powder contained in the envelopes was nontoxic and said the envelopes had messages written in UV-reactive ink, not easily seen by the naked eye.

    Martin is charged with one count of conveying false or misleading information and hoaxes and another count of mailing threatening communications. It wasn’t immediately clear whether Martin had been taken into custody.

    According to an FBI affidavit, Martin “described perceived issues with the 2020 election, claimed that President Donald Trump won the 2020 election, and voiced concerns regarding some of the same issues recurring in the then-upcoming 2024 election.”

    Some of the messages were marked with return addresses related to previous headquarters for the Green Party of the United States and Democratic Socialists of America. The DSA has cooperated with the FBI in its investigation, the affidavit said.

    In one envelope addressed to the Oklahoma State Election Board ahead of the 2024 election, Martin allegedly wrote “stay on the right side of history your life might depend on it!” Federal prosecutors allege that the handwriting in that message was matched with the new batch of letters through a handwriting analysis.

    According to the affidavit, the content of the letters sent in 2026 “all pertained to the upcoming 2026 national elections” and Martin allegedly referenced an organization known as the United States Traitor Elimination Army in his writings, threatening the recipients with being arrested for treason “OR WORSE!!”

    Federal investigators also intercepted a message allegedly from Martin to FBI Director Kash Patel.

    Surveillance footage allegedly showed Martin dropping off the envelopes at a USPS facility in both 2024 and 2026, and records analyzed by federal law enforcement allegedly show Martin purchased items used for the mailing in August of this year, as well as the ingredients for the “invisible ink” that was used to write on the envelopes.

    In October, Brendan Donahue, the deputy chief inspector at the U.S. Postal Inspection Service,confirmed that “suspicious mailings” were sent to “various addresses nationwide,” including secretary of state offices and related election offices.

    The Senate sergeant at arms also issued a notice to congressional staff informing them of the investigation. Dozens of members of Congress and election officials across the country reported being targeted by the mailings.

    Supreme Court seems likely to side with Catholic preschools in fight over Colorado program

    Washington — The Supreme Court on Tuesday appeared likely to side with Catholic preschools challenging Colorado’s refusal to exempt them from a nondiscrimination requirement and let them participate in its universal preschool program.

    The nondiscrimination mandate at the center of the dispute, St. Mary Catholic Parish v. Roy, requires participating schools to provide children with an “equal opportunity” to enroll regardless of their race, religion, sexual orientation and gender identity, among other characteristics.

    When Colorado was preparing to implement the program, the Archdiocese of Denver, which oversees 34 Catholic preschools, sought an exemption from the nondiscrimination rule, since they only enroll families that align with the Catholic Church’s teachings, including on marriage, family and sexual identity.

    The state, however, denied the request for an accommodation and said the Catholic schools could not “discriminate against children or families in violation of state statute.”

    The Archdiocese, two of its parishes and a family then sued the state, arguing that their exclusion from the universal preschool program violated the Constitution’s Free Exercise Clause. Lower courts sided with the state and said the sexual orientation and gender identity provisions of the nondiscrimination rule are neutral and apply generally to providers participating in the universal preschool program.

    But in arguments that spanned two hours on Tuesday, the court’s conservative majority appeared likely to rule in favor of the Catholic preschools. Such a decision would join a line of recent rulings in which the Supreme Court, which has a 6-3 conservative majority, has sided with religious institutions challenging their exclusion from state benefits programs, opening the door for more public dollars to flow to religious schools.

    Oral arguments

    Several of the conservative justices repeatedly raised concerns that the nondiscrimination rule was effectively a back-door way to keep religious entities out of the universal preschool program.

    “You agree, don’t you, that Colorado could not say that Catholic schools or evangelical schools or Orthodox Jewish schools were excluded from participation in the UPK program?” Justice Amy Coney Barrett asked Helen Norton, Colorado’s deputy solicitor general. “Then explain what the difference is between that and choosing to impose a condition that you know that those schools would be unable to agree to.”

    Barrett suggested the effect of the nondiscrimination requirement is to “push out” those with traditional beliefs.

    “Why not seek the win-win?” Justice Brett Kavanaugh asked Norton about the state’s refusal to exempt Catholic preschools. He noted that there are more than 2,000 preschools that participate in Colorado’s universal preschool program, and only 34 are overseen by the Archdiocese of Denver.

    “There are plenty of opportunities to respect the rights of the religious believers and respect the ability of LGBT parents to find among the 2,000 schools an appropriate fit for their children,” he said.

    Justice Samuel Alito raised Colorado’s recent record of losses at the Supreme Court in religious liberty cases, in which the high court sided with a Christian baker, website designer and counselor.

    “We have the state’s record” in other First Amendment cases, Alito told Norton. “What should we make of this?”

    But Norton, the Colorado deputy solicitor general, said Colorado “welcomes” religious preschools to its program.

    “The only thing Colorado asks is that they comply with the same conditions that every publicly funded preschool must meet, religious and secular alike,” she said, adding that religious preschools can teach their beliefs on sex, gender or marriage and are “free to teach them while receiving public funding.”

    Nicholas Reaves, a lawyer with the Becket Fund for Religious Liberty who argued on behalf of the Archdiocese, said Colorado is denying Catholic preschools the ability to receive public benefits because of their religious exercise.

    The three liberal justices each raised concerns that the Catholic schools were asking for a “special” accommodation from the state that would allow them to discriminate against families based on protected characteristics.

    Justice Elena Kagan said that the principle the Supreme Court upheld in a 2022 case involving a Maine tuition-assistance program was that the state cannot treat religious institutions differently.

    “That’s not the principle that’s at issue here,” she said. “The principle at issue here is, do you have to treat them better?”

    Justice Ketanji Brown Jackson said the Archdiocese and its preschools are asking for a “special rule” that would allow them to turn away students based on their or their parents’ sexual orientation or gender identity.

    Colorado’s universal preschool program launched after voters in the state approved a ballot measure in 2020 to provide state funding for a new program that intended to make preschool “widely available for free” to all 4-year-olds in the state.

    Families are reimbursed for the cost of 15 hours of preschool per week, which amounts to more than $6,000 per year. The state uses a mixed-delivery system, meaning public, private, faith-based and secular preschools can participate. Those that do must sign a contract and meet state quality standards.

    The statute that created the universal preschool program also imposed a nondiscrimination rule.

    Colorado estimates there are roughly 40,000 children who are eligible for universal preschool across nearly 2,000 providers. The Archdiocese’s 34 Catholic preschools do not participate in the program.

    The five-page document makes no mention of a potential 2028 presidential or Senate run. Instead, it urges stakeholders to view her record as that of one of the Democratic Party’s most effective messengers for working-class voters.

    Following President Donald Trump’s 2024 election victory, the memo states, Ocasio-Cortez launched an aggressive nationwide push to rebuild the party around economic populism and establish a broad movement for working families.
