A federal judge on Monday found the Justice Department’s firing of Maurene Comey, a former federal prosecutor who presided over several high-profile cases including those of Jeffrey Epstein and Sean “Diddy” Combs, was unconstitutional.

Comey, an assistant US attorney for the Southern District of New York for nearly a decade, was fired in July 2025. She filed a lawsuit claiming the firing was in retaliation because her father is former FBI Director James Comey, a vocal opponent of President Donald Trump.

Until she was fired, Comey received accolades from her supervisors and was frequently tapped for some of the office’s biggest cases. DOJ, in its arguments, acknowledged Comey was not fired for cause or due to her performance.

Judge Jesse Furman said the Justice Department’s firing violated the separation of powers clause of the US Constitution, which places limits on how certain federal employees can be fired. He also found it violated the Civil Service Reform Act, which guards the process by which federal employees can be removed.

“Yes, the Attorney General is authorized by law to remove an AUSA. But the Attorney General (and anyone to whom the Attorney General delegates that authority) is also limited by law, namely the CSRA, to do so only in a particular manner and only for certain reasons. And Comey’s removal indisputably violated the CSRA,” Furman wrote.

The Justice Department had argued the attorney general exercises the president’s powers and could not be limited by Congress.

Furman said DOJ’s argument that Congress cannot dictate how federal employees are removed would upend two centuries of Supreme Court decisions. To agree with DOJ would “risk a return to the spoils system that Congress has sought to end since the nineteenth century,” he wrote.

Comey is currently working as a defense lawyer. The judge ordered her to receive backpay until the time she took on that position.

“This hard-earned victory belongs to Ms. Comey, to all civil servants, and to all fighting for the rule of law,” Maurene Comey’s legal team said in a statement. “As the Court correctly held, to accept the government’s argument about unlimited executive power ‘would be to unsettle the very equilibrium established by this Nation’s constitutional system.’”

A DOJ spokesperson said, “The department disagrees with this decision and will appeal in due course.”

After she was fired, Comey told her former colleagues in an email that her sudden dismissal should “fuel the fire” of their work fighting abuses of power.

“If a career prosecutor can be fired without reason, fear may seep into the decisions of those who remain,” she wrote in a message to her former colleagues, which was obtained by CNN. “Do not let that happen.”

She continued: “Fear is the tool of a tyrant, wielded to suppress independent thought. Instead of fear, let this moment fuel the fire that already burns at the heart of this place. A fire of righteous indignation at abuses of power. Of commitment to seek justice for victims. Of dedication to truth above all else.”

Furman, an appointee of former President Barack Obama, did not rule on Comey’s claim that her termination violated the First Amendment. He asked both sides for further briefings on that topic.

Catholic bishops regret Trump meeting, saying they were used for ‘political purposes’

Two Catholic bishops have expressed regret over attending a meeting with 10 other prelates and President Donald Trump in the Oval Office, saying they were “exploited” and “manipulated.”

Photos and video of 12 clergy members praying over the president were released on Thursday, less than two weeks before the midterm elections. The images show the clergy members praying around Trump, who has his head bowed as he is seated at the Oval Office desk.

Now, one bishop in the meeting said he felt they were manipulated and apologized for “inadvertently” participating in a political event so close to an election. Another said the meeting was “exploited” for “partisan political purposes” and expressed regret for attending.

The image released by the White House starkly contrasted with how careful Pope Leo XIV has been to avoid taking sides in politics — the first American pope has insisted that bishops avoid any political partisanship. However, he has addressed policy issues more broadly, speaking out against the Trump administration’s immigration crackdown and the war in Iran, in addition to calling for tighter regulation of artificial intelligence.

The pope’s decision not to visit the United States in 2026 was also in large part due to the midterms, as papal visits traditionally do not take place during election cycles.

One of the attendees, Archbishop of Milwaukee Jeffrey Grob, said afterward that the meeting had been manipulated, that he was unaware their meeting was being recorded and that the bishops did not give permissions for the public distribution of the footage and images.

“To begin, the meeting was in no way an endorsement of the president, his policies, or his party,” Grob said in a statement.

But he explained that after images were released he “soon began receiving messages of serious concern over the possibility that I had inadvertently participated in a political event less than two weeks before a national election.”

The archbishop went on: “I did not go [to the meeting] without reservations. I wish I had heeded them. Please know that I have heard these concerns, understand how I caused them, and I apologize for any damage my actions have done.”

Another bishop, William Joensen of Des Moines, said he felt the meeting had been “exploited” for “partisan political purposes” and that he wished he’d done things differently. “I wish I had been more shrewd and less simple,” he said. “I pray I am more prudent and wise going forward, even as I remain resolute in my openness to engaging and praying for political leaders at all levels.”

The meeting was attended by Trump’s longtime faith adviser, Paula White-Cain. Trump said after: “It was a great meeting. Well, they prayed. They mostly prayed. It was actually a very nice meeting. They’re great.”

Trump has attracted support from Catholics during his past campaigns, although recent polls show that has dropped since his return to office.

White House spokeswoman Taylor Rogers did not respond to a question about whether the clergy members had cleared the use of their images, instead sending a statement that said: “There has never been a greater president for Catholic Americans than President Trump.” She cited “expanded religious rights,” his pardoning of anti-abortion activists, his work against providing gender-identity care for children and his protection of parents’ rights.

While the president had a public clash with the pope earlier this year, Trump has been less critical of him lately — frequently talking about how the pontiff’s eldest brother, Louis, is a MAGA supporter. When the pope was recently diagnosed with lung cancer, Trump said he wanted to see him “get well.”

“It’s big stuff anytime you have cancer, but the prognosis seems to be good,” the president said, going on to call Leo’s brother “a friend of mine.”

Following release of the footage of the bishops and the president praying, one church source joked to CNN that it was the White House doing “trick or treat early!”

EXCLUSIVE:U.S. and Latin American officials are accusing the U.S. Agency for International Development (USAID) of using American taxpayer dollars for causes championed by left-wing candidates across Latin America.

The allegations come after several countries in the region elected conservative leaders following the Trump administration’s decision to dismantle USAID and shift remaining foreign assistance functions to the State Department.

“You have plenty of examples out there of how USAID was attempting to run its own foreign policy,” U.S. Ambassador to Panama Kevin Marino Cabrera told Fox News Digital.

“When you look at a post-USAID world where we have forces from the State Department and U.S. Southern Command working together in Jamaica, Venezuela, Colombia and now Panama, they’ve had great success in responding to natural disasters,” Cabrera said.

Cabrera also criticized what he described as a lack of leadership during the Biden administration, saying it allowed USAID to pursue programs that promoted left-wing causes in the region.

“This is foreign election interference,” Bolsonaro told the outlet. “American taxpayer dollars were financing foreign censorship in the name of the left, which is completely contrary to why USAID was even created in the first place.”

Bolsonaro said President John F. Kennedy created USAID with good intentions but argued that the agency had since strayed from its original mission.

Washington — A federal judge on Monday found that the Justice Department unlawfully fired Maurene Comey, the daughter of former FBI Director James Comey, from her post as a federal prosecutor in the Southern District of New York.

U.S. District Judge Jesse Furman said in a 55-page decision that Comey’s removal violated the constitutional separation of powers and federal law. The judge retroactively reinstated Comey to her role as a federal prosecutor and ordered the Trump administration to provide her back pay from the date of her firing in July 2025 through Dec. 20, when she accepted a different job.

Comey’s lawsuit was one of several filed by former government employees who were fired without cause that tested the limits of the president’s power to fire federal officials.

The Trump administration had argued that Article II of the Constitution gives the president unrestricted removal power, and said Congress could not limit the removal of federal prosecutors.

But in his decision, Furman ruled that Comey’s firing violated the Civil Service Reform Act, a landmark law enacted in 1978 that provides protections for federal workers. The Trump administration, he wrote, is attempting to “upend” long-settled case law allowing Congress to regulate the removal of so-called inferior officers.

“Indeed, to accept Defendants’ argument would be to unsettle the very equilibrium established by this Nation’s constitutional system,” Furman wrote.

Comey’s legal team cheered the decision as a “hard-earned victory” for her and all civil servants.

“As the Court correctly held, to accept the government’s argument about unlimited executive power ‘would be to unsettle the very equilibrium established by this Nation’s constitutional system.’ This decision reaffirms our bedrock system of checks and balances: the President is not above the law,” lawyers Ellen Blain, Nicole Gueron, Deepa Vanamali and Margaret Donovan said in a statement.

A Justice Department spokesperson said it “disagrees with this decision and will appeal in due course.”

Comey had served as a federal prosecutor in Manhattan since 2015, handling high-profile criminal cases against figures including Sean “Diddy” Combs, Jeffrey Epstein, Ghislaine Maxwell and former Democratic Sen. Robert Menendez.

In a letter to her former colleagues at the time of her dismissal, Comey said she was “summarily fired via memo” by the Justice Department’s headquarters in Washington, and was not given a reason for her termination.

The letter she received stated, “Pursuant to Article II of the United States Constitution and the laws of the United States, your employment with the Department of Justice is hereby terminated, and you are removed from federal service effective immediately.”

It was initially unclear who made the decision to oust Comey, but in May, the Trump administration said then-Attorney General Pam Bondi “directed” her removal, and her successor, Todd Blanche, “ratified” her termination.

Comey sued the Justice Department over her firing last year, alleging she had probably been fired because President Trump dislikes her father, who has been indicted twice during the second Trump administration. One of the criminal cases was tossed out, and James Comey has denied wrongdoing in the second.

“Ms. Comey’s termination — without cause, without advance notice, and without any opportunity to contest it — was unlawful and unconstitutional,” Comey’s attorneys wrote in their complaint.

The Trump administration attempted to dismiss the lawsuit on the grounds that Comey was required to bring her claims before the Merit Systems Protection Board, the agency tasked with adjudicating appeals from federal employees regarding adverse actions taken against them, but Furman denied the government’s motion and allowed the case to continue.

Furman found that because Comey’s firing rested on Article II of the Constitution — not a federal law governing the civil service — the federal court had jurisdiction to hear the case.

In court filings, the Justice Department admitted that Comey had received a rating of “outstanding” on her performance reviews from 2019 through 2024, but said that her firing had been carried out under legal authority Congress granted to the attorney general to fire assistant U.S. attorneys.

In defending Comey’s firing, the Trump administration relied, in part, on the Supreme Court’s June decision allowing the president to fire members of certain independent agencies without cause. In that case, the high court overturned a more than 90-year-old decision that allowed Congress to restrict the president’s ability to fire officials from multimember agencies at will.

But Furman said the Justice Department’s argument amounted to a “sweeping and unprecedented theory of executive authority.”

WICHITA, Kan. — National Democrats are pouring millions of dollars into Kansas to bolster Adam Hamilton, who has spent much of his campaign arguing that he would not be beholden to the top Democratic leaders in Washington, D.C.

Tens of millions are flowing into Kansas to boost Hamilton, with a sizable chunk coming from Senate Majority PAC, a super PAC closely aligned with Senate Minority Leader Chuck Schumer, D-N.Y., whom Hamilton has repeatedly said he would not support as the Democratic leader should he win in November.

But his opponent, Sen. Roger Marshall, R-Kan., questioned how he could benefit from “$30 to $40 million from Chuck Schumer and not be beholden to him in some way?”

“Regardless of what he says, if we lose this seat, then it’s going to give the Senate control to the Democrats,” Marshall told Fox News Digital during an interview on the campaign trail. “Chuck Schumer would be the leader of the Senate.”

“Look, if he’s going to denounce Chuck Schumer, let’s denounce him with his money as well,” he continued, “Look, we’re going to be outspent five to one, and we knew that.”

Candidates, notably, can’t directly accept outside funding from independent groups like the Senate Majority PAC, given the guardrails are established by federal election law, according to the Federal Election Commission.

The Schumer-aligned group teed up $5 million in advertising spending in Kansas earlier this month, a sign that Democrats are bullish about flipping the seat in a contest that has gotten closer than Republicans expected.

Hamilton’s campaign pushed back on Marshall, arguing that the first-term senator has been given a lifeboat by national Republicans. Hamilton has vastly outraised Marshall, scoring nearly $14 million compared to Marshall’s almost $6 million, according to Federal Election Commission filings.

“Adam has said repeatedly he believes it’s time for fresh leadership in Washington,” Tyson Brody, a Hamilton campaign spokesperson, told Fox News Digital. “Adam will always put Kansas first. Meanwhile, Roger Marshall is totally dependent on Washington money to save his campaign because he has abandoned Kansas to support D.C. corruption, endless war and high prices.”

In all, national Democrats and their affiliated groups — combined with spending from Hamilton’s campaign — are slated to dump $38 million into the race, according to AdImpact. National Republicans, along with Marshall’s campaign, are putting $32 million into the contest.

Marshall has sought to tie Hamilton, who is running as a moderate in ruby-red Kansas, directly to Schumer, a point he made several times during their final debate before Election Day this week.

Hamilton pushed back, arguing that Marshall had mentioned Schumer “maybe 20 times so far.”

“I’ve already said I wouldn’t support Chuck Schumer for Senate majority leader if the Democrats took control of the Senate,” Hamilton said.
