Kristi Noem’s ‘official statement’ on X wasn’t approved by officials, sources say

A little over a week ago, an “official statement,” appearing to be printed on State Department letterhead with its seal, was posted on Kristi Noem’s official special envoy X account and her own personal X account about the end of her tenure as an envoy to the Shield of Americas.

Two sources familiar with the matter told CNN that the letterhead was not real, and it was not an official statement on behalf of the Department. They said nobody on the seventh floor – where the State Department leadership sits – or in the press office saw the memo before it was posted on X.

It is unclear if the Department will take any action against Noem, who is now serving as a senior adviser to Deputy Secretary of State Chris Landau. However, one source told CNN that people “are not pleased she tried to pass off a fake statement.” Though both said the substance of the statement beneath the letterhead was accurate, they were objecting to the format and the fact it appeared to be an official department communication when it had not been authorized by leadership or the press office.

One of the sources noted that only the State Department press office puts out official statements.

The content of the statement beneath the letterhead was consistent with what State Department officials said at the time about her change of job.

“The Special Envoy to the Shield of the Americas role was always a six-month appointment,” it read. “Secretary Noem remains at the State Department as a Senior Advisor.”

CNN has asked a representative for Noem who drafted the statement and whether it was authorized. CNN also asked the State Department for comment on the allegations.

On Saturday, seemingly in response to the reports of the unauthorized statement, Noem posted on her personal X account, “You may have read some ‘Fake News’ lately, but I am honored and grateful to continue advancing President Trump’s America First agenda and working to strengthen security and cooperation across the Western Hemisphere.”

“There is important work to be done, and I remain committed to getting it done!” she wrote.

Noem, who previously served as Homeland Security Secretary, quietly moved into the senior adviser role after her special envoy status expired last month. A State Department official told CNN at the time that she “continues to work on the Shield of the Americas portfolio.” The Shield of the Americas is a coalition started by the Trump administration meant to jointly combat security issues and drug cartels in Central and South America.

At a meeting of the Shield of the Americas leaders at the UN General Assembly last month, Noem was present and mingling with the leaders in the room. President Donald Trump praised the work she was doing with the coalition.

Trump removed Noem from his Cabinet earlier this year after multiple controversies under her leadership at the Department of Homeland Security.

According to multiple people familiar, Justice Department prosecutors are now investigating allegations of contract misconduct at the Department of Homeland Security, including the role of Corey Lewandowski – Noem’s de facto chief of staff.

CNN has reported that Noem’s handling of contracts within DHS was one of the main issues behind her ouster, notably when she claimed that Trump knew of a $220 million ad campaign prominently featuring the secretary.

Appeals court rejects Trump DOJ demand to set aside 20,000 California mail ballots

A federal appeals court on Monday rejected the Trump administration’s unprecedented attempt to force California to set aside votes from 20,000 people it claims are noncitizens.

The Justice Department’s lawsuit in California, filed earlier this month, is part of its escalating effort to insert the federal government into how states run their elections.

A three-judge panel on the 9th US Circuit Court of Appeals denied the Justice Department’s emergency appeal following arguments in an unusual emergency Sunday hearing held via Zoom.

Judge Mark Bennett, a Trump appointee, and Judge Gabrial Sanchez, a Biden appointee, ruled that the appeals court did not have the authority to rule on the DOJ lawsuit before the district court had addressed the matter.

“The United States’s claimed emergency, at least in part, is a self-constructed one,” the majority wrote. “At least part of the delay here is attributable to the United States’s own delay in filing suit, in realizing that existing California state law governs the issuance and processing of ballots, in recognizing that California has millions of registered voters and processes ballots on a schedule aligned with that scale, and in communicating to the court its desired relief.”

A third judge on the panel, Trump appointee Judge Patrick Bumatay, dissented.

The decision sends the case back to the US District Court in California, where a Tuesday hearing is scheduled at 4 p.m. ET.

The Justice Department filed a lawsuit earlier this month seeking to prevent officials in California from counting more than 20,000 mail-in ballots associated with people the federal government says it believes are likely noncitizens. DOJ appealed to the 9th Circuit after the district court judge did not issue a ruling last week ahead of Tuesday’s hearing.

This is a developing story and will be updated.

James Comey faces new DOJ case over alleged national defense disclosure

The new criminal information marks the third criminal matter the Trump Justice Department has brought against Comey

The Justice Department filed a criminal information against former FBI Director James Comey over allegations that he willfully communicated national defense information to an unauthorized person in connection with an alleged 2016 disclosure.

Federal prosecutors filed the two-count criminal information in U.S. District Court for the District of Columbia, alleging Comey communicated national defense information and conspired with others to unlawfully disclose it.

The Justice Department said that the filing was made to preserve the allegations before the statute of limitations expired as an investigation remains ongoing.

“The Department filed a waiverless criminal information to toll the statute of limitations as it relates to allegations concerning former FBI Director Comey,” a spokesperson for the DOJ said.

“Filing a criminal information to toll the statute of limitations is a widely recognized practice in federal court and has been approved by multiple Circuit Courts of Appeals. This is an ongoing criminal investigation, and we will not comment further.”

Comey’s attorneys have challenged the filing. They’ve argued that prosecutors cannot move forward with the case without first obtaining an indictment from a federal grand jury.

U.S. District Judge Trevor McFadden held an emergency, closed-door hearing on Oct. 9 after Comey’s attorneys moved to dismiss the case and unseal the proceedings.

McFadden, who was appointed to the federal bench by President Donald Trump in 2017, granted the request to unseal the case but has not ruled on Comey’s motion to dismiss.

It remains unclear when or if prosecutors will seek an indictment from a grand jury.

Prosecutors allege that on or about Oct. 5, 2016, Comey knowingly and willfully communicated information related to the national defense to a person who was not entitled to receive it.

Comey denied wrongdoing in an Instagram post Monday, calling the latest action an “appalling abuse of the Department of Justice.”

“Nothing’s changed with me. I’m still innocent. I’m not afraid of these people. And I still believe in the independent federal judiciary,” Comey said.

He added that his family and legal team would “stand up in court and fight the latest and whatever comes after this.”

Justice Department charges former FBI Director James Comey for third time

The Justice Department criminally charged James Comey over a decade-old allegation that he ordered his staff to leak classified information to a reporter, the third time that prosecutors have levied criminal allegations against the former FBI director.

Comey is charged over allegedly leaking a sensitive national security document when he was FBI director in October 2016, according to court records made public Monday, allegations that his attorneys said were investigated previously without resulting in charges.

“It would almost be funny if it weren’t such an appalling abuse of the Department of Justice, one that we cannot become numb to,” Comey said in a video he posted on social media.

    0:35 • Source: CNN

The Justice Department, however, says the document that the two charges are outlined in — called an information — is not enforceable and that they have yet to file their official charges against Comey. The move is instead an attempt to push back the 10-year deadline on bringing charges under the Espionage Act against the former FBI director, which expired earlier this month, a department official said in a statement.

“Filing a criminal information to toll the statute of limitations is a widely recognized practice in federal court and has been approved by multiple Circuit Courts of Appeals,” the DOJ official said. “This is an ongoing criminal investigation, and we will not comment further.”

Ultimately, a judge will decide whether the Justice Department’s move to prosecute Comey after the statute of limitations expired is valid. Comey moved earlier this month to dismiss the case, saying that there needs to be an indictment within 10 years and that the DOJ filing does not suffice.

The case was unsealed on Monday, but documents include scant details about what prosecutors are specifically alleging.

The controversy over the alleged leaks to The New York Times began in the early days of Trump’s first administration. After he was fired as FBI director by President Donald Trump, Comey shared with his team at least one memo describing his conversations with the president. The information was then shared with a New York Times reporter.

The allegations into Comey’s conduct have been at the center of multiple investigations, including by the Justice Department’s inspector general and by Special Counsel John Durham, who was brought in to examine the origins of the federal investigation into Russia’s interference in the 2016 election.

Durham brought charges against three people associated with the probe and while he criticized some of the decisions made by Comey and other top government officials, Durham didn’t find evidence to support criminal prosecutions against them.

Comey faces a separate criminal charge still in North Carolina where he is accused of threatening Trump by posting last spring on social media a photo of seashells in the sand arranged to say “8647.” A previous case against Comey over his Congressional testimony about leaks to the media was dismissed by a judge last year.

“This is a bizarre, and likely improper, use of a criminal ‘information’ ’to end-run the statute of limitations,” Elie Honig, a former federal prosecutor and CNN’s senior legal analyst said Monday. “Typically an information must be agreed to by a defendant — and Comey did not consent here. It therefore likely cannot extend the statute of limitations, which would have expired on October 5, 2026.”

DOJ takes steps to charge James Comey again

    Updated on: October 26, 2026 / 6:45 PM EDT / CBS News

The Justice Department took steps to charge James Comey with leaking information earlier this month, court records show, in its third attempt to bring criminal charges against the former FBI director and Trump foe.

Prosecutors are seeking to charge Comey with two counts of violating the Espionage Act by transmitting national defense information to a person not entitled to receive it. He has not been indicted by a grand jury or charged by criminal complaint, and was instead targeted through a criminal information filing.

In this case, the information was filed in order to preserve the statute of limitations before it expires, according to a Justice Department spokesperson. The official added that “this is an ongoing criminal investigation, and we will not comment further.”

Comey’s attorney, Patrick Fitzgerald, said Comey “steadfastly maintains his innocence.”

The latest effort by the Justice Department stems from allegations that Comey gave national defense information to an unnamed individual for disclosure in a newspaper in October 2016.

According to court filings in the case, The New York Times published an article on Oct. 5, 2016, titled, “Yahoo Said to Have Aided U.S. Email Surveillance By Adapting Spam Filter.” The article cited two unnamed government officials who spoke on the condition of anonymity.

The Justice Department alleges that it has uncovered evidence that Comey sought to “correct misinformation which had appeared in the press by way of Reuters the day before” and that Comey “directed staff” to speak with the Times reporter about the accuracy of the Reuters article.

Fitzgerald said the information “purports to charge Mr. Comey with crimes that he did not commit,” adding that investigators looked into the matter twice during the first Trump administration and “determined that no charges should be brought against anyone.”

In a separate video statement, Comey said, “well, they’re back again” — a reference to the two prior attempts to charge Comey, including a dismissed indictment accusing him of lying to Congress and a still-pending indictment accusing him of threatening President Trump via a social media post.

“It would almost be funny if it weren’t such an appalling abuse of the Department of Justice, one that we cannot become numb to,” Comey said. “Nothing’s changed with me. I’m still innocent, I’m still not afraid of these people and I still believe in the independent federal judiciary.”

In a statement posted to social media, the Justice Department said: “Filing a criminal information to toll the statute of limitations is a widely recognized practice in federal court and has been approved by multiple Circuit Courts of Appeals.”

Former prosecutors and defense attorneys told CBS News they had not seen a criminal information filed in a felony case in this manner before, and called the maneuver highly unusual.

Michael Bromwich, a former Justice Department inspector general who is now a defense attorney, told CBS News that he has never encountered a situation where a criminal information was filed to pause the statute of limitations. Normally, such charging documents are filed when a defendant plans to waive their right to have a grand jury weigh charges and opts to plead guilty.

“I have never heard of proceeding by information to toll the statute of limitations. Most prosecutors you have ever dealt with have never heard of that. This seems to be a way to do an end-run around the statute of limitations and keep a case alive that deserved to die 9 years ago,” Bromwich said. “This is just absolutely bizarro world stuff.”

The charging documents were filed under seal in early October, and were unsealed by U.S. District Judge Trevor McFadden on Monday at Comey’s request.

For much of this month, Comey’s attorneys and federal prosecutors waged a behind-the-scenes fight over whether the Justice Department’s effort to charge him should be dismissed.

In an Oct. 9 court filing, Comey’s legal team argued the government “filed a faulty information under seal … in an effort to toll the applicable statute of limitations.” The crime that the government is seeking to charge Comey under has a 10-year statute of limitations, which would run out in October of this year — but the ex-FBI director’s lawyers say the statute of limitations applies to indictments and can’t be extended if the government files a criminal information.

They also said Comey had “reason to believe that the government plans to use that information to seek an arrest warrant as soon as today, which could result in an after-hours arrest that would ensure Mr. Comey sits in jail over a holiday weekend.”

“Mr. Comey has reason to believe multiple federal law enforcement officers have surveilled his whereabouts while traveling to a family members’ residence and around his own neighborhood throughout the week,” Comey’s lawyers wrote on Oct. 9, just before Columbus Day weekend.

In an emergency court hearing, the government agreed to hold off on seeking an indictment for 30 days, attorneys for Comey later wrote.

The Justice Department argued that Comey’s efforts to dismiss the criminal information was premature because no indictment has been returned.

“This is not the proper time for him to file pretrial motions or attempt to chip away at charging documents before he subjects himself to the Court’s jurisdiction,” the government said.

Further, the department said the law allows the government to proceed because it permits prosecutors to meet the deadline if the “indictment is found or the information is instituted.”

In an unusual move, the criminal information filed by the department were signed by two senior officials — acting Deputy Attorney General Trent McCotter and Principal Associate Deputy Attorney General Aakash Singh — as well as several special assistant U.S. attorneys who are not originally from the U.S. Attorney’s office in Washington, D.C.

McFadden, the Trump-nominated judge overseeing the case, ordered the court docket to be unsealed Monday, writing: “Criminal charges against a former FBI director for his conduct while in office are of significant public interest.”

He also said Comey “is aware of the criminal information and has offered to ‘self-surrender,’” so there is no need to keep the case secret in order to help the government apprehend him.

The judge did not rule on the merits of the case.
