    President Donald Trump’s emergency appeal aimed at limiting the use of mail ballots is poised to test a controversial, 20-year-old Supreme Court principle that was intended to avoid chaos before elections.

    The “Purcell principle,” rooted in a 2006 Supreme Court decision, warns federal courts against making last-minute changes to voting rules. But the principle has never before been weighed in a Supreme Court case involving a federal election policy like Trump’s effort to give the US Postal Service and the Department of Homeland Security a hand in screening state voter rolls for potential non-citizen voters.

    How the 6-3 conservative majority deals with its self-created and oft-criticized rule in the Trump case could have practical implications for how the court handles the flood of litigation that will inevitably crash onto its docket this fall, and ahead of the 2028 presidential election.

    “Here we have potential federal agency action that could impact the way the 2026 election is run,” said Chad Ennis, the vice president of the Honest Elections Project, a conservative group focused on voting policies. “I think this is a novel set of facts and how SCOTUS would apply Purcell, if at all, is an open question.”

    Signed in March, the president’s executive order would require states to submit lists of eligible voters to the US Postal Service, which would be barred from sending ballots to anyone not on those lists. It would also require states to use tracking barcodes on ballot envelopes. And it would “prioritize” federal prosecution of state election officials who send or receive ballots to non-citizens or others ineligible to vote.

    The order also requires DHS to create lists of what it views as eligible, US citizen voters in each state.

    Federal courts in Boston blocked the order’s implementation. Trump filed an emergency appeal at the Supreme Court last week. That appeal doesn’t deal with the merits of the president’s order, nor does it say anything about Purcell. But if the court sides with Trump on any portion of the case, it will likely set up a showdown over the doctrine later this year.

    A group of Democratic states challenging Trump will respond to the president’s emergency appeal on Monday. The Supreme Court could then rule later this month.

    Because of the Purcell doctrine, timing almost always lurks as a central issue in federal challenges to voting rules.

    In December, the Supreme Court allowed Texas to use a congressional map that boosted the GOP’s chances of keeping control of the House, partly because the primary election was set for March.

    In 2024, the court cited Purcell when it allowed Louisiana to use a congressional map that benefited Democrats because the state argued that candidate filing deadlines were fast approaching.

    Two years earlier, roughly a month out from Alabama’s primary election, the court appeared to rely on Purcell to keep a congressional map drawn by the state’s Republicans in place, despite a lower court decision that the map diluted the political power of Black voters. The court’s brief order didn’t cite Purcell, but Justice Brett Kavanaugh wrote a lengthy concurrence defending its application in that case.

    “This court has repeatedly stated that federal courts ordinarily should not enjoin a state’s election laws in the period close to an election,” Kavanaugh wrote. “That principle — known as the Purcell principle — reflects a bedrock tenet of election law: When an election is close at hand, the rules of the road must be clear and settled.”

    Critics, however, note that a majority of the court was fine allowing Louisiana to revert immediately to a Republican-friendly congressional map in May even though absentee voting had already started for the primary under a different map that included a second Black-majority district. Justice Ketanji Brown Jackson, a liberal, questioned at the time how her colleagues could square the hurry-up approach in that case with its reticence to engage at the last minute in others.

    Jackson noted that the emergency Louisiana appeal came “in the midst of an ongoing statewide election.”

    “The court unshackles itself from both constraints today and dives into the fray,” she wrote. “And just like that, those principles give way to power.”

    Her dissent drew a sharp rebuke from Justice Samuel Alito, a conservative, who noted that the map Jackson would have left in place for this year’s election had been ruled unconstitutional by the Supreme Court days earlier. The state had also suspended voting in the House contests after the Supreme Court’s ruling in Louisiana v. Callais.

    Purcell is not currently at issue in the Trump appeal over the mail ballots, but the states are likely to ask the court to keep the doctrine in mind to head off a catch-22 scenario. That’s because Trump’s central argument is that the states and groups who are challenging his order sued too soon. If the Supreme Court agrees with Trump, then the states will have to wait to revive their litigation. And that will necessarily push the cases closer to the November election, allowing the administration to raise Purcell to bar courts from weighing in.

    Trump’s Justice Department has argued that the lawsuit against the administration isn’t “ripe” because the government hasn’t taken any steps yet to enforce its order.

    “The executive order is an intra-branch directive from the president to his subordinates — which, of its own force, does not change anything at all about elections in any state,” US Solicitor General D. John Sauer told the justices in the administration’s appeal last week.

    At the same time, the administration hasn’t ruled out trying to invoke Purcell at a later stage in the case. At a May hearing in a separate case dealing with the same executive order, US District Judge Carl Nichols, a Trump nominee, asked if the administration would try to raise that argument. The administration’s attorney, Stephen Pezzi, said he didn’t think it was likely.

    But he also didn’t rule it out.

    “I, of course, can’t and won’t take an argument off the table about what the world will look like in August from the lectern today,” Pezzi said. “But it’s far from clear to me that that sort of consideration would apply here.”

    Because the federal government has historically had an infinitesimal role in running elections, the last-minute voting cases that race up to the Supreme Court have dealt with state policies.

    Sophia Lin Lakin, director of the Voting Rights Project at the American Civil Liberties Union, described the Trump administration’s executive order on mail ballots as unprecedented. And that means the case may shed light on the court’s approach to Purcell.

    “Many of these decisions on Purcell have been handled on the shadow docket in a way that hasn’t necessarily garnered clear support of five justices, so we’ve been at times piecing together different ideas along the way to determine how it might play out,” said Lakin, whose group is challenging Trump’s executive order in a separate case pending in a federal court in Massachusetts.

    While Trump’s emergency appeal raises questions the court hasn’t directly addressed, Lakin said she believes there are clues that a majority of justices might vote to intervene to halt the administration’s order, even with Purcell on their minds. Increasingly, the court’s conservatives have framed the principle as a check on the power of federal courts to interfere in elections that are run by states.

    In that sense, the doctrine is partly about ceding control to run elections to the states — not the federal courts, nor federal agencies.

    “This mail voting executive order sits on the wrong side of the line,” Lakin said. “It’s a federal actor imposing late-breaking changes on state election systems over the objections of the states that run them.”

    Derek Muller, a law professor at Notre Dame who is an expert on election law, agreed.

    “Purcell has more weight when you are enjoining a state rule because of federalism concerns,” Muller said. “That on its own is a powerful distinction” from a federal election policy.

    The court also considers more than just Purcell when it’s weighing an elections case, Muller said. Those other factors, he said, might disfavor the federal government if courts felt it was attempting to game the system with last-minute changes.

    “I also think Purcell doesn’t really work when the rule is being enacted very close in time to the election,” Muller said. “In that circumstance, regular equitable considerations would allow courts to intervene.”

    A federal appeals court in Washington, DC, okayed Trump’s executive order in a separate case last week. In the final paragraph of that order, the court dismissed the idea that the Trump administration would be able to invoke Purcell to shut down a future challenge to its order later this year.

    “Plaintiffs’ fear has the Purcell principle backwards,” the panel of three appeals court judges said.

    If the administration were to attempt to impose “massive changes on the states’ voting systems on the threshold of the upcoming election,” then federal courts could block that — despite Purcell — because such a move would “preserve the states’ existing electoral status quo.”

    The appeals court, tellingly, didn’t cite a single Supreme Court decision to back up that conclusion.

    Candidates eyeing the late Sen. Lindsey Graham’s seat of power in the Senate will get a chance to define themselves on the debate stage Monday.

    Untested fresh blood, lawmakers eager to ascend and candidates who have failed to launch are set to share the same stage and will get an equal opportunity to convince South Carolinians that they have what it takes to take over for Graham.

    While nearly 10 candidates have jumped into the race for the suddenly vacant seat, politicos in South Carolina contend that only a few are true contenders and have the most to prove during the televised sales pitch to voters as campaign materials darken voters’ doorsteps.

    “This debate is the opportunity for South Carolinians to have a moment to hear from these candidates directly,” Dave Wilson, a South Carolina-based political consultant, told Fox News Digital.

    “The mail is already coming in,” he continued. “The emails are already going out, but this is a time to see whether the candidates can handle the job in what is in essence the only job interview that we will see ahead of the primary.”

    The key candidates to watch are Sen. Darline Graham, R-S.C., who was appointed to take her brother’s seat and has since received President Donald Trump’s endorsement. Behind her are Reps. Ralph Norman, R-S.C., and Russell Fry, R-S.C., and former Gov. Mark Sanford.

    Wilson contended that both Norman and Sanford have statewide name recognition — Norman unsuccessfully ran for the GOP nomination for governor this year and Sanford has been a known entity in South Carolina politics for nearly two decades.

    Graham could ride on the wave of her brother’s last name, but she doesn’t have the record to push like the others in the race. While she’ll be making a pitch about who she is, Fry could stand to gain the most among the other competitors.

    Amid the corporate carpeting and industrial artwork of McCormick Place, the Democratic Socialists of America spent a rainy weekend preparing their next steps for taking over the Democratic Party and taking down capitalism.

    The “DSA Merch” table had $30 T-shirts and $45 sweatshirts with roses and Green New Deal slogans. A table from a local socialist bookstore stocked Palestinian poetry collections, Black Panthers histories, “The Communist Manifesto” and a children’s book called “Prisons Must Fall.”

    The attendees at the lakefront convention center called one another comrades. A pamphlet with a sketched red fist laid out the group’s program, including “a future without capitalism,” where “food, education, energy, medicine and transportation aren’t for-profit businesses; they are common goods and utilities.” It encouraged supporters to dream of a world where they don’t have to worry about paying rent or loans and can embrace “a socialist day off.” It pitched a 32-hour workweek, universal healthcare, reparations for slavery, and “steps towards fully abolishing the police and prison system.”

    It said the DSA wants to “replace the president and Supreme Court with an executive judiciary chosen by and subordinate to Congress,” and it wants that Congress to be an expanded House of Representatives with an abolished Senate — a position DSA co-chair Megan Romer stuck by in a recent Fox News interview that went viral.

    The DSA has taken a strategic approach to growing its power within the Democratic Party, picking off two House incumbents already this year and potentially more this month. As the group’s summit in Chicago made clear, its members see this as only the beginning of a fight against both Republicans and Democrats alike.

    A recent CNN poll found that one-third of Democrats or Democratic-leaning independents identify as democratic socialists. Zohran Mamdani, a proud DSA member, is mayor of the nation’s largest city; Francesca Hong is running strong in this month’s primary for governor in Wisconsin; and Rep. Alexandria Ocasio-Cortez is widely discussed as a potential candidate for president in 2028.

    That’s left many non-DSA Democrats uncomfortable, both for how they’re being chased from power and for being told they need to accept a hard-left swing. Republicans are eager to tie Democrats in close races to the most maximalist parts of the DSA agenda.

    “We’re not knocking doors and saying, ‘Hey, would you like to abolish the Senate this year?’” said Ashik Siddique, another DSA co-chair who noted to CNN that at 38, he’s the oldest member of the group’s leadership. “I don’t think we say anywhere here, ‘These are the promises we’re making that we’re going to do.’ It really is about helping people envision what a different and better society would be, and then what it would take to get there.”

    The DSA’s leadership committees barred reporters from speaking to most attendees inside the convention hall beyond a selected group of speakers — out of concern, according to spokesperson Priscilla Yeverino, that many attendees are not fully briefed on the group’s history and electoral goals. Content creators who were members of the DSA in good standing were given free rein. Name badges were printed with just first names and initials of last names. Volunteers stood outside rooms where organizers were being trained.

    Siddique announced that the group is now the largest socialist organization in American history, at 120,000 members nationwide, past the Eugene Debs-era high of 118,000 Socialist Party members. Siddique added he was conflicted about the symbolism of happening to pass that mark on July Fourth, worried about seeming too nationalistic by mixing their success with Independence Day pride.

    CNN’s poll found that Democrats identifying as democratic socialists are more likely to hold favorable views of the Democratic Party and its congressional leaders, while also wanting the party to move left on policy issues. But at the core of DSA thinking is the conviction not only that its members are right, but that hundreds of millions of people around the world already agree with them — and that the movement has failed to prevail only because corruption, money and powerful interests, abetted by those who acquiesce, have kept it down.

    “The Republicans are in on it, the Democratic Party is asleep at the wheel, and both are funded by the same criminal class of billionaires and war profiteers,” the program declared.

    For all these big dreams and high-profile primary wins, only about 600 people came to the summit, with another 300 for the attached Young DSA gathering for youth and students.

    “And yet everybody’s talking about us,” Chris Rabb, a Pennsylvania state legislator who won a primary for a US House seat in May, told CNN with a smile as he arrived. With a safe general election in November, Rabb is campaigning for other democratic socialists around the country.

    “We’re beating establishment candidates,” he said. “We are connecting with folks who don’t necessarily identify as democratic socialists in ways that are very impressive and strategic and intentional and inclusive that a lot of people are paying attention to. Because if the Democratic Party knew how to do this, things would be a lot different.”

    Rare was the attendee over 30. Even rarer was the attendee over 40. Rarer still was the attendee spotted who was Black.

    Rabb, who is Black, said he is concerned about the lack of diversity in the DSA but believes that will change with more outreach, since “the very power and legacy of this movement in this country is born out of Black progressive movements, Black radical traditions of any organization will have an understanding for its importance.”

    Siddique told CNN that he shares concerns about the racial makeup of the group, which he attributed in part to structural racism in America and in part to an organization that was founded in 1982 but has only recently started to grow as a mainstream force.

    Most of the time, DSA members speak in generalities about building community and the working class. This is not just deliberate but stressed: Leading a session on speaking to the media, Yeverino, the spokesperson, encouraged activists to learn to pivot from uncomfortable questions and give the answers they wanted.

    “This is probably why you’re frustrated with a lot of politicians. But it works!” she told them. (She also urged members to be concise and exact in their press releases for added appeal: “We are disciplined and militant — also when it comes to grammar and getting facts right.”)

    The group has neither interest nor patience for Democrats across the country who worry the DSA is pulling the party so far left that it makes winning elections harder.

    “A lot of the pundits, a lot of the media, likes to say about these independent voters, swing voters, as if they’re in the middle,” said Gabriel Sanchez, a Georgia state representative who was one of the group’s approved speakers. “‘Independent voters,’ all that means is that they don’t identify with other Democrats or Republicans.”

    Even with the many printed copies of the DSA program, members were divided over how much to stand by it.

    “I’m going to fight like hell to make it happen,” said Mitch Green, a Portland, Oregon, city councilman. “I mean, I think none of this is easy. And these are big swings. And I think it’s important for an organization like ours to aspire to do big things.”

    Diana Moreno, who earlier this year won the special election for the New York State Assembly seat Mamdani vacated to move to Gracie Mansion, said non-DSA Democrats should pay attention to how the group is whipping up support. Democrats, she argued, are “out of touch and losing primaries, and with a base that’s deeply angry at their inability or unwillingness to fight against the far right.”

    To Moreno, democratic socialism “means healthcare, that means housing, that means childcare. That is the responsibility of government to actually guarantee for its citizens because it’s something that we need to live.”

    Beyond a general push to end wars, the foreign policy issue discussed in most detail was opposition to Israel.

    “The weight of our organization now has affirmed an anti-Zionist position, that affirms that ‘from the river to the sea’ in present-day Israel and Palestine, people should have equal rights,” Siddique said. “We haven’t affirmed a position on one state vs. two states.”

    Cutting off all arms was a baseline demand. “Zionists” was used interchangeably with “billionaire class.” There were keffiyehs in many colors and sizes — a variety of scarf knots, one turned into a halter, one turned into a sarong, another repurposed into a tote bag, some used as shawls to protect against McCormick Place’s central air-conditioning, some paired with cut-off shorts.

    “Cuban Americans are harder to appeal to with socialism because they have their own version of Zionism,” one attendee was overheard telling another.

    At one of the panels, Morales touted working on a bill she picked up from Mamdani in the New York State Assembly that would strip tax-exempt status from groups that do work deemed detrimental to Palestinians.

    At another point, when an Ithaca, New York, council member was recalling being warned about participating in Palestinian solidarity rallies the day after Hamas’ October 7, 2023, attack on Israel, an audience member loudly giggled multiple times.

    Regarding a candidate who doesn’t describe the war in Gaza as genocide, Morales told CNN, “I don’t know if I would trust their judgment in other issues, because I think to me it’s blatant and clear that what’s happening in Palestine and has been happening for now years is considered a genocide.”

    Israel denies that its war in Gaza following the October 7 attack constitutes a genocide.

    What’s next for the DSA is obvious in the minds of many. That’s why the group placed invitations for an event at a funky bar on the chairs of the rooms being used for panels: “DSA for AOC.”

    Ocasio-Cortez was DSA’s first big victory when she won her primary in 2018 — Bernie Sanders, her political godfather, is a democratic socialist but not a DSA member. In 2024, DSA’s national political committee threatened to pull its endorsement of Ocasio-Cortez because it accused her of not doing enough to oppose Israel.

    Now, DSA members are looking for her to be their next big hope.

    “The only position, the only position in the fking world that can actually fight fascism, that can actually fight the climate catastrophe, is the presidency of the United States, and so raise your hand if you are ready to take on that fight these next two years, to go to the fking top,” said Jeremy Cohan, a member of the New York City DSA chapter’s steering committee, exhorting the crowd at the bar.

    Cohan told those listening they need a candidate who was all in for “Medicare for All,” a $25 minimum wage, free college, a Green New Deal, ending arms sales to Israel and calling Israel’s war in Gaza a genocide.

    As CNN has previously reported, Ocasio-Cortez is looking at running, but is adamant she will do so only if she thinks she can win rather than to stage a protest candidacy. Multiple members that night and over the weekend said they’re not sure anyone could be a second choice, but whoever it is would have to sign on to at least most of their program, which they expect to expand by the time they meet for a full convention next year.

    A spokeswoman for Ocasio-Cortez did not respond over the weekend when asked by CNN whether she would have anything to say to DSA members who want her to run.

    “Beyond just the question of yes or no, do we endorse AOC, how do we do it, how do we use it to keep building our own organization?” Siddique said.

    Another DSA organizer stood up when he finished. “Nobody’s getting out of here without some good ol’ fashioned calls to action,” she said, clapping her hands between words.

    “Anybody here know how to win a presidential campaign?” she said.

    No one raised a hand. Prepared organizers in the crowd started holding up QR codes on their phones for others to scan. This, they said, was how it’s going to start.

    Rain started falling. They cheered for the end and rushed inside.

    Over the past 16 months, the administration has examined museum exhibits, educational programming, internal records and leadership statements, issued multiple document requests, interviewed curators and conducted on-site museum walkthroughs.

    The effort culminated in a 162-page White House report recommending sweeping reforms and announcing new executive actions aimed at implementing those recommendations.

    Here’s a timeline of the major developments.

    March 27, 2025: Trump launches effort to root out ‘woke’ ideology at the Smithsonian

    Trump signed an executive order titled “Restoring Truth and Sanity to American History” two months into his second term. The order argues that federal cultural institutions, including the Smithsonian, have promoted “divisive” ideological narratives.

    The executive action directs the Trump administration to restore what it describes as a more patriotic presentation of American history. And it tasks the White House Domestic Policy Council and Vice President JD Vance, in his role as a Smithsonian Regent, with reviewing Smithsonian exhibits and programs.

    Spring–Summer 2025: White House launches Smithsonian investigation

    Following Trump’s executive order, the White House Domestic Policy Council kicked-off an investigation of the Smithsonian, focusing primarily on the National Museum of American History.

    Officials reviewed exhibits, educational materials, strategic plans, leadership speeches, museum programming and public statements. During that review, the council documented examples they argue prioritize divisive ideological narratives over a so-called patriotic telling of American history.

    Aug. 12, 2025: White House formally puts Smithsonian on notice

    White House officials sent Smithsonian Secretary Lonnie Bunch a letter formally launching the review ordered by Trump.

    The letter directs the institution to turn over exhibition plans, educational materials, internal policies and other records while outlining a review of eight Smithsonian museums to ensure exhibits “celebrate American exceptionalism” and remove what the administration calls divisive narratives.

    It also sets deadlines for document production, curator interviews and on-site reviews, with museums instructed to begin revising public-facing content within 120 days.

    Late 2025: White House says Smithsonian isn’t adequately celebrating America’s founding

    The White House criticizes the museum for holding no special Independence Day programming in 2025 despite being open on July 4, discontinuing its traditional Flag Day ceremonies, and planning 250th anniversary exhibits and events.

    According to the administration, those 250 installations emphasize flaws of the United States while giving insufficient attention to the Founders, the Declaration of Independence and the American Revolution.

    Dec. 18, 2025: White House says Smithsonian isn’t cooperating with its review

    The White House tells Smithsonian Secretary Bunch in a letter that the institution has failed to provide most of the records requested during its review.

    Among other things, the review requested exhibition plans, curatorial documents and governance materials be turned over.

    At this time, the administration gives the Smithsonian until Jan. 13, 2026, to produce the requested records. It also reminds the institution that federal funding must be used in a manner consistent with Trump’s “Restoring Truth and Sanity to American History” executive order.

    White House investigators complete on-site walkthroughs of Smithsonian museums. During the visits, they reviewed exhibits, educational materials, digital content and internal planning documents as well as interviewed museum staff as part of the administration’s review.

    SMITHSONIAN’S NATIONAL MUSEUM OF AMERICAN HISTORY PROMOTES ‘EXTREME POLITICAL ACTIVISM,’ WH REPORT ALLEGES

    Investigators found during those visits exhibits that they argue emphasized restorative history, decolonization, immigration activism, DEI initiatives and social justice. Meanwhile, it claimed that the institution was downplaying America’s Founders, the nation’s achievements and patriotic themes.

    The report ultimately concludes the Smithsonian project has undergone a significant shift away from its original mission, arguing exhibits increasingly emphasize social justice activism and ideological narratives rather than focus on America’s founding principles and national achievements.

    May 14, 2026: White House says Smithsonian’s flagship America 250 exhibit misses the mark

    The museum debuts its signature exhibition commemorating America’s 250th anniversary, featuring 250 objects from its collection, including Thomas Jefferson’s writing desk, George Washington’s uniform and the Star-Spangled Banner.

    The White House said just two months before the country’s 250th celebration that the exhibition repackages existing displays rather than creating a new founding-era exhibit. It also criticized the installation for failing to meaningfully celebrate America’s Founders, the Declaration of Independence or the American Revolution during the nation’s 250th birthday.

    The Trump administration also said the exhibit’s promotional materials and programming downplayed patriotic themes and national symbols.

    July 2026: White House delivers verdict on Smithsonian review

    The White House Domestic Policy Council releases its 162-page “Saving America’s Story” report, concluding that the National Museum of American History has undergone “ideological capture.”

    The report recommends removing what it describes as political activism from museum exhibits and restoring displays that emphasize America’s founding principles, national achievements and patriotic history. It says the findings stem from the Smithsonian review ordered by Trump’s March 2025 executive order.

    The expansive report included images of exhibits, images of exhibits and placards, as well as curators and leaders of the museum.

    It spent much of the report focusing on how the museum classified and portrayed illegal migration in its exhibits.

    July 24, 2026: Trump orders federal agencies to carry out Smithsonian reforms

    Hours after the report’s release, Trump signs the “Restoring Trust in the Smithsonian Institution” executive order, directing the Interior Department, Office of Management and Budget (OMB), General Services Administrator (GSA) and the White House Domestic Policy Council to use available authorities to encourage the Smithsonian to address the report’s findings.

    Trump’s order also instructs the National Park Service (NPS) to install temporary signs outside the National Museum of American History directing visitors to the report and describing the administration’s concerns with the museum’s presentation of American history.

    The administration says its effort is intended to restore a more patriotic presentation of American history at the Smithsonian. The institution, meanwhile, has long said its mission is to preserve and present the nation’s history through scholarship, research and public education, setting the stage for continued debate over how America’s story should be told.

    The Smithsonian did not immediately respond to Fox News Digital’s request for comment.
