    IRS proposal would force nonprofits to disclose fraud or terrorism convictions of leaders

    Washington— The Trump administration is weighing a proposal to require nonprofits to disclose in their annual tax filings whether their top officials have been convicted of certain financial or terrorism-related crimes, sources with direct knowledge of the matter told CBS News.

    The IRS disclosure requirement would be added to the Form 990, the annual return that nonprofit groups file with the agency, said the sources, who spoke on the condition of anonymity because they were not authorized to talk publicly. Federal officials have viewed it as an effort to pressure tax-exempt groups to cut ties with people who have such criminal records and ensure that donors can make informed decisions about how to best direct their money, the sources said.

    Convictions that would have to be reported include providing material support to terrorists, fraud, money laundering, securities fraud, tax evasion, theft and civil judgments from Securities and Exchange Commission or state securities regulators’ enforcement actions.

    The IRS proposal would not force groups to identify which officer, director or trustee was convicted, according to the sources. It is not a violation of federal law for people with felony convictions to serve on a nonprofit board.

    The proposal is expected to relate to convictions that occurred within the last 10 years. Nothing has been finalized, and it is one of at least two proposed revisions to the Form 990 moving through the Treasury Department and the IRS. Another proposal announced in April would impose new disclosure requirements for nonprofits that receive government funding.

    “No one has a right to privacy of their criminal record,” said Tom Jones, an ally of President Trump who leads the conservative American Accountability Foundation nonprofit. “If your board members are convicted criminals, I am hard pressed to understand why you have a problem with that being publicized. You should have to explain why those people are on your board.”

    A spokesperson for the Treasury Department said that it is considering “a range of measures to strengthen accountability for nonprofit organizations” and that the agency “will continue to follow the money to ensure tax-exempt status is not exploited to facilitate illicit activity.”

    Inside the IRS, some officials have privately raised concerns about the conviction-related proposal and what the agency could lawfully do with the information — as well as questioned how it relates to enforcement of tax laws, multiple sources familiar with the conversations told CBS News.

    These IRS officials have said they view the effort as a form of potential political targeting that could draw legal challenges, including on free speech grounds, sources said.

    “This disclosure rule goes directly to guilt by association,” said Roger Colinvaux, a law professor at the Catholic University of America and former counsel to the nonpartisan Joint Committee on Taxation in Congress. “There’s no federal law that says a nonprofit cannot have a convicted felon on their board. It could just create a stigma and chill association. This would reach deeply into American civil society.”

    One of the sources with direct knowledge of the proposal, who spoke on the condition of anonymity because they were not authorized to talk publicly, suggested that such a move is not much different from material disclosures that publicly traded companies are required to make to help the investing public make informed decisions.

    The source also suggested that the proposal could help the IRS move faster to suspend or revoke the tax-exempt status of nonprofits if they fail to disclose convictions of any of their leaders.

    That’s because the nonprofit officials who submit the Form 990 must attest to its accuracy under the penalty of perjury, and fact-checking whether board members have undisclosed criminal convictions would be a relatively simple task for the IRS to do, the source added.

    The disclosure efforts come amid a broader effort by the Trump administration to target left-leaning nonprofits. Mr. Trump signed a national security memorandum last year that directed the IRS to refer groups believed to be financing “domestic terrorism” to the Justice Department. In March, CBS News was first to report that the FBI and IRS Criminal Investigation teamed up to launch a “command post” tasked with investigating possible links between nonprofits and terrorism.

    That followed a directive from then-Attorney General Pam Bondi late last year for law enforcement agencies and federal prosecutors to probe the anti-fascist antifa movement and other “extremist groups.” The memo asked law enforcement agents to consider investigating extremist groups for potential fraud and tax crimes. Antifa, a decentralized coalition of far-left activists, is not a formal organization and has no board members or officers.

    A number of federal criminal investigations and prosecutions targeting nonprofits are now underway. The highest-profile prosecution focuses on the Southern Poverty Law Center, which is accused of misleading donors and banks by funneling money to informants for white supremacist groups. The SPLC has pleaded not guilty.

    In another matter, Neville Roy Singham, the wealthy husband of the founder of the progressive nonprofit Code Pink and benefactor of far-left political causes, is under criminal investigation in Manhattan, CBS News previously reported. That investigation began by looking into possible violations of the Foreign Agents Registration Act and has since expanded into a criminal tax probe over whether money was unlawfully funneled through nonprofits he controls and whether he lied on tax forms for those nonprofits.

    Earlier this year, eight people affiliated with a North Texas antifa group were sent to prison for sentences ranging from 30 to 100 years, after they were convicted for providing material support to terrorists and other offenses, including the attempted murder of an Alvarado police officer at the Prairieland Detention Center.

    The proposal comes as the Trump administration has also focused its attention on fraud in recent months and spotlighted the pandemic-era Feeding Our Future scandal in Minnesota as an example of abuses in the nonprofit sector. So far, the estimated $250 million scheme has resulted in 68 convictions or guilty pleas.

    Some states already ask tax-exempt groups a version of the question the IRS is now weighing. California requires charities soliciting donations in the state to disclose whether their officers or directors have been convicted of certain offenses, as part of an effort to prevent charitable fraud. Under state law, a court can remove a director for fraud, dishonest acts or breach of duty in a case the attorney general can bring.

    But federal law has no equivalent remedy, said Ellen Aprill, a senior scholar in residence at UCLA Law School’s center for philanthropy and nonprofits — meaning the IRS would be collecting information it has no stated authority to act on.

    “I think there is the potential for a fishing expedition,” Aprill said.

    Alexander Reid, a partner at the law firm BakerHostetler who specializes in tax-exempt organizations, said the proposal about board members would collide with the Supreme Court’s 2021 decision in the case Americans for Prosperity Foundation v. Bonta. The ruling struck down a California requirement that charities turn over lists of their major donors.

    “The bulk collection and disclosure of sensitive information from tens of thousands of charities, much of which would never be relevant to tax administration or charitable-law enforcement, would fail exacting scrutiny by chilling freedom of association without furthering a narrowly defined governmental interest,” Reid said.

    The IRS has come under the spotlight more recently over questions about political interference. Ken Kies, who was the top tax official at the Treasury Department, was ousted in July after warning that the White House was at risk of illegally involving itself in IRS audits, The Wall Street Journal reported.

    Steven Toscher, a tax attorney in California, said that from a good governance perspective, he does not see a problem with requiring nonprofits to disclose terrorism-related convictions of their board members. At the same time, he said, it’s fair to raise questions about why the Trump administration wants this information, what it might use it for and how it defines terrorism.

    “It’s hard to view this in isolation of just good corporate nonprofit governance because of the executive who is proposing it,” he said. “They have an agenda, so it’s hard to filter this.”

    Diane Yentel, president and CEO of the National Council of Nonprofits, which represents roughly 37,000 organizations, sees the administration’s proposal for officers as part of a pattern of Republicans seeking to target groups in the sector that are not aligned with Mr. Trump.

    “Nonprofits welcome reasonable regulation as a way to maintain public trust,” said Yentel, but the proposal is “a step too far when viewed in the context of all of the administration’s actions and rhetoric of the last 18 months, including equating some nonprofits to ‘domestic terrorists’ or ‘enemies’ of the American people.”

    She said complying with the disclosure “would take precious time and resources away from nonprofits’ core work of serving communities.”

    Judge rules FBI can’t abandon Biden-era plan to relocate headquarters to Maryland

    A federal judge has blocked the Trump administration from abandoning a Biden-era plan to relocate the FBI headquarters to suburban Maryland.

    The FBI and the General Services Administration had announced plans in July 2025 to move the agency’s headquarters from the J. Edgar Hoover building in downtown Washington, DC, to the Ronald Reagan Building blocks away — scrapping GSA’s 2023 selection of a site in Greenbelt, Maryland.

    But Judge Theodore Chuang said in his ruling Monday that the Trump administration’s move exceeded the authority of the FBI and GSA.

    Chuang, who was appointed by former President Barack Obama, also agreed with Prince George’s County and the state of Maryland — which sued in November — that the FBI’s reprogramming of $555 million toward the Reagan building move, which included $323 million that was appropriated by Congress for the Greenbelt project, was “arbitrary and capricious” and not in accordance with law.

    While the Hoover building has long been in need of drastic repairs, the question of where to move the FBI has been a drawn-out political fight. The 2023 selection of Greenbelt was nearly 15 years in the making, Chuang said in his ruling.

    The Reagan building was home to the now-defunct US Agency for International Development. It also houses other agencies, including US Customs and Border Protection.

    In his ruling, the judge also considered the economic impact to Prince George’s County and the status of the FBI’s move to the Reagan building.

    “[I]f the Reagan Building project moves forward, Plaintiffs will lose the opportunity to have the substantial economic benefits that would have a positive impact not just on individual private parties, but on the community in Prince George’s County,” Chuang wrote. “As for Defendants, they are still at the beginning stages of moving the FBI to the Reagan Building … so the immediate impact of an injunction of Defendants would be limited.”

    A GSA spokesperson said in a statement to CNN that the judge was making a “political decision designed to undermine” the president.

    “GSA will not pursue an inferior approach in cost, speed, and value,” the spokesperson added, saying it will “ensure its agency partners, including the FBI, have workspaces to best accomplish their missions on behalf of the American people.”

    A spokesperson for the FBI said, “The court has chosen to impermissibly intervene for political reasons.”

    CNN has also reached out to the Justice Department for comment.

    Maryland Democratic Gov. Wes Moore celebrated the ruling, saying in a statement on Monday, “President Trump tried to take from Maryland what Maryland had already won. He failed.”

    “Now it is time to stop the games and get to work building the world-class FBI headquarters that our public servants deserve, where it belongs: in Prince George’s County, Maryland,” he added.

    Shortly after taking office, President Donald Trump vowed to stop the FBI headquarters from moving to “a liberal state.”

    “We’re going to stop it. Not going to let that happen,” said Trump during a March 2025 speech at the Department of Justice.

    The selected site for a FBI headquarters in Greenbelt, a parking lot next to the Greenbelt Metro Station in Prince George’s County, Maryland.

    An immigrant in Minnesota who once received an “outstanding refugee” award from the state government has been charged with Medicaid fraud, prompting strong backlash on social media.

    Salman Ahmed Elmi is facing three counts of aiding and abetting by swindle and five counts of aiding and abetting by false representation as part of an alleged scam to bill Medicaid for over $1 million in fraudulent services, Fox 9 Minneapolis reported.The charges also allege that two members involved in the fraud scheme were tied to a sex-trafficking ring involving brothels.

    In 2021, the Minnesota Department of Human Services, an agency deeply involved in the massive fraud scheme that has unfolded across the state in recent years, honored Elmi with the title “outstanding refugee” along with an Entrepreneurship Award.

    News of the charges quickly spread on social media via conservative influencer accounts like LibsofTikTok and End Wokeness.

    “You literally cannot make this up,” conservative pundit Eric Daugherty posted on X. “Get these people out of my country.”

    “The same agency that awarded Elmi is the SAME agency that gives out Medicaid payments,” conservative commentator Benny Johnson posted on X. “You can’t make this up.”

    Fox 9 Minneapolis also reported that Elmi was part of a startup that received financial backing from Shark Tank star Kevin O’Leary.

    “I started a business to help inspire other people,” Elmi said in an archived post on the Minnesota DHS website. “No one owns businesses in my family; my entire family came here with the idea that the American dream was just getting a job and making it work, so shifting that mindset was difficult but important. Navigating those treacherous waters allowed me to provide for my family and work on my terms.”

    The Minnesota state government, led by Gov. Tim Walz since 2019, has been under the microscope over the past year as systemic fraud, largely involving the local Somali community, that prosecutors say could total more than $9 billion has been exposed throughout various departments and programs in the state.

    Critics have argued that the fraud, which was an open secret for years, was aided by the fear of publicly calling it out over fears of being labeled as “racist,” Fox News Digital reported last year.

    Walz was ultimately forced to drop his bid for re-election amid the fallout.

    Fox News Digital reached out to Walz’s office for comment.

    In a statement to Fox News Digital, a Minnesota DHS spokesperson said the Outstanding Refugee Awards ended in 2024.

    “Salman Elmi’s alleged actions are disturbing and do not reflect the goal of the Outstanding Refugee Awards,” the spokesperson said. “They also do not represent Minnesota’s refugee community. We are surrounded by neighbors, coworkers, employees and friends with powerful stories of resilience in the face of difficult circumstances, who are showing leadership in small as well as large ways to improve their communities. The Outstanding Refugee Awards were a way to recognize some of the individuals who make Minnesota better for all of us.”

    The spokesperson added that recipients received a certificate and a plaque but no monetary award.

    “The value came from the opportunity to recognize the courage, resilience and entrepreneurship of refugees and their children, and to recognize their contributions to the state,” the spokesperson said. “Refugees and immigrants offer skills to a needed workforce, provide entrepreneurial innovation and expand worldwide networks – all of which benefit Minnesota.”

    USS Benfold, Navy destroyer, went days without power in the South China Sea

    The guided-missile destroyer USS Benfold spent four days without power last month after a problem with its engineering, according to a spokesperson for the Navy’s 7th Fleet.

    Commander Matthew Comer, the spokesperson, said there were no injuries to the crew.

    The loss of power impacted plumbing, meals, toilets and air conditioning aboard the ship. The issue has been fixed and is under investigation. The incident was not publicly disclosed for nearly a month.

    In addition to the poor conditions, the vessel was located in the South China Sea, which is not friendly waters. Officials told CBS News that the vessel is being protected by other air and surface assets nearby and that they wouldn’t leave an asset vulnerable to an attack “like a sitting duck.”

    Benfold received direct support from the George Washington Carrier Strike Group, and meals from Ticonderoga-class guided-missile cruiser USS Robert Smalls.

    The vessel was towed by contracted tugboats into Subic Bay, Philippines, for repairs and was met on arrival by experts from the Ship Repair Facility – Japan Regional Maintenance Center on July 28. The crew was provided food and contracted lodging off the ship beginning a day later. The ship’s power was then restored on July 30.

    All the required repairs were completed by Aug. 7. The ship departed Subic Bay a day later with all engineering, combat systems and crew support systems functioning normally to resume routine operations in the U.S. 7th Fleet.

    The news about the Benfold comes amid ongoing concerns about conditions aboard the USS Abraham Lincoln, which has been deployed in the Middle East for nine months. Some family members have said they worry about conditions aboard the ship and fear the long deployment and grueling pace are worsening mental health issues. A U.S. official last week told CBS News that the USS George Washington is headed to the Middle East to relieve the Lincoln.

    Republican Rep. Don Bacon said Sunday on “Face the Nation with Margaret Brennan” that Congress should conduct oversight, calling for testimony from top Navy officials.

    DOJ to stop using outside experts to help vet competitive grant applicants

    Washington— The Justice Department is scrapping its longtime practice of hiring outside experts to help review and rank competitive grant applications submitted by law enforcement offices, victim services groups and research institutions, a move that some fear could harm the integrity of the selection process and hinder efforts to ensure the money is well-spent, multiple sources told CBS News.

    The Justice Department’s Office of Justice Programs, or OJP, has for decades relied on a peer review program to help it select winners each year for its competitive pool of grant funds that get awarded to state and local governments, nonprofit victims services groups and criminal justice researchers.

    The DOJ’s Office on Violence Against Women, or OVW, a smaller separate grant office, has also used peer reviewers for its competitive awards.

    The Justice Department awards billions of dollars in federal grants each year. While some of those are doled out based on formulas such as population and crime rates, another bucket of them are competitively awarded.

    Some of DOJ’s most popular competitive awards are used to fund projects by law enforcement agencies or to support organizations that assist victims of sexual assault, human trafficking and domestic violence.

    Competitive grants are also awarded to universities that undertake studies that help inform best practices for the fields of law enforcement and victim services providers.

    The peer review program, which is modeled after a grant review process created by the National Institutes of Health that is considered the gold standard, entails hiring independent subject matter experts who are tasked with reviewing, scoring and ranking grant applications.

    They work to ensure that the proposals are feasible, meet the government’s criteria and that their budgets can adequately cover the work being performed.

    Although peer reviewers’ recommendations are nonbinding, the process has been utilized for decades to ensure that competitive grants are awarded fairly and impartially.

    Peer review “is one of the tools that the government could use to make good, sound, cost-effective decisions,” said Kristina Rose, who previously served as director of the Office for Victims of Crime, an OJP office that awards grants to help support organizations that offer services for the victims of crime.

    She added that eliminating peer review is a blow in particular to the National Institute of Justice, which funds criminal justice research projects that are highly specialized and contain complex methodologies.

    “If NIJ doesn’t have peer reviewers, that will diminish them in the eyes of the scientific community,” Rose said.

    A Justice Department spokesperson confirmed to CBS News that it is planning to formally end its peer review program for competitive grants.

    “Peer review has become an increasingly inefficient and outdated process that outsources a core function of our grantmaking process to individuals outside the Department who may not have insight into this Administration’s goals and priorities or a reason to pursue them,” a Justice Department spokesperson told CBS News.

    The Justice Department’s peer review program will formally end in the fall, the sources said.

    The peer review program for OJP and OVW is currently administered through two contracts with a company known as BETAH and its subcontractor, Leidos.

    Going forward, staff at the OVW and OJP who are responsible for managing grant awards will now be tasked with conducting internal peer reviews of the applications for all competitive awards, the sources told CBS News.

    In 2025, the use of outside peer reviewers was temporarily stopped, and OJP staff were ordered to do it themselves, even though many people had no expertise and had never conducted peer review, sources said. Sources described the process at the time as chaotic and stressful, with some people working late hours to complete the task.

    Eventually, the use of external peer reviewers was restored.

    A Leidos spokesperson said the company and its predecessor corporations have a “longstanding history supporting DOJ peer review activities” dating back to the mid-1980s for OJP and decades for OVW. The spokesperson said its contracts with OJP and OVW are currently active, with the OJP one running through Nov. 1 under a bridge order.

    The decision internally was made as an attempt to cut costs for the Justice Department and to bring more expertise in-house, one of the sources said. The DOJ’s Office of Community Oriented Policing Services, which gives out competitive awards to law enforcement agencies, has been phasing out the use of peer reviewers since 2019, the source added.

    The Justice Department spokesperson noted that the COPS office had already eliminated peer review “many years ago” and nevertheless has managed to “process grant applications and awards with speed and efficiency while maintaining alignment with the Make America Safe Again mission.”

    “Bringing this function in-house also saves taxpayer dollars by cutting out unnecessary outside contractors,” the spokesperson added.

    But the increased workload comes at a time when OJP’s staffing level is already down by approximately several hundred employees, one source said, and it is still struggling to finalize some grants for fiscal year 2025, which ended Sept. 30, 2025. They are also in the process of working to finalize fiscal 2026 awards before Sept. 30, while also rolling out some $3 billion in new grants required by last year’s One Big Beautiful Bill Act.

    Moreover, some fear that eliminating outside experts from the review process could further risk politicizing how grants are awarded at a time when the White House has already directly intervened in the grantmaking process across the federal government.

    “Grantmaking for victims services should not be based on political goals, but on best practices and demonstrable impact for victims and services,” said Jean Bruggeman, the co-executive director at Freedom Network USA who has also served as a peer reviewer in the past.

    “Eliminating expertise allows you to focus on the administration’s goals — not the goals of Congress. Not the goal of victims and survivors. Not the goals of the program, but rather, the goals of the current administration,” Bruggeman said.

    The peer review process is considered apolitical. However, over the years, there have been a few controversies and efforts to undermine the selection process by injecting political considerations into how awards are made.

    During President Trump’s first administration, the union representing OJP workers filed a complaint with the Justice Department inspector general, alleging that a Trump appointee was screening the social media profiles of peer reviewers to ensure their views aligned with the Trump administration’s positions on issues including immigration.

    In another controversy around the same time, the Justice Department faced internal complaints after the former head of OJP declined to award grants to two organizations that received high marks from peer reviewers and instead gave them to two groups that received low scores — Hookers for Jesus in Nevada and the Lincoln Tubman Foundation in South Carolina.

    In the case of Hookers for Jesus, it received a $530,190 grant over three years to support its safe house for trafficking victims. It was awarded the grant even though it had previously lost Nevada Victims of Crime Act funds after the state discovered the group was forcing victims to attend one specific church and requiring them to participate in religious activities as a condition of receiving housing.

    In another controversy dating back to President George W. Bush’s tenure, the former director for the Office of Juvenile Justice and Delinquency Prevention granted awards to groups that received low peer review scores, including the World Golf Foundation’s “First Tee” program.

    An inspector general investigation later faulted him for breaching ethics rules by accepting a free round of golf from the group before he recommended them for the grant award.
