    Washington — Pentagon officials have discussed firing the longtime publisher of Stars and Stripes before his scheduled retirement, U.S. officials told CBS News, as the Trump administration strategizes an overhaul of the military news outlet partly funded by American taxpayers.

    Max Lederer, who has served as the publisher of Stars and Stripes for 19 years, this week announced to colleagues his decision to retire on Sept. 30, citing fundamental differences with the Trump administration. Editor-in-Chief Erik Slavin has spoken publicly, including to CBS News, about disagreements with Pentagon leaders.

    It was unclear when a decision on the news outlet’s leadership would be made. Spokespeople for the Defense Department didn’t immediately comment.

    The outlet, which receives about 65% of its funding through the Defense Department, has long prided itself on its editorial independence from the public affairs apparatus at the Pentagon.

    Chief Pentagon spokesman Sean Parnell has posted on social media about “bringing Stars and Stripes into the 21st century,” writing in January: “We will modernize its operations, refocus its content away from woke distractions that syphon morale, and adapt it to serve a new generation of service members.”

    CBS News has reported that an average of 1.4 million people see Stars and Stripes each day — mostly online, although it puts out a print version overseas for service members in remote places where access to the internet can be unreliable.

    The publication was projected to spend about $400,000 this year on subscription services for content that appears on its pages, records show. The outlet no longer uses wire services such as Reuters or The Associated Press. Parnell said in January that the outlet would “focus on warfighting, weapons systems, fitness, lethality, survivability, and ALL THINGS MILITARY. No more repurposed DC gossip columns; no more Associated Press reprints.”

    Newspapers typically use wire service copy to inform readers of news they are not covering with their own staff.

    Asked for comment, Lederer in an email to CBS News on Wednesday said he wasn’t comfortable participating in an interview before he leaves his job.

    In his note to staff on Tuesday, which was obtained by CBS News, Lederer wrote: “It has become clear that my philosophy of leadership, and my understanding of the value and mission of Stars and Stripes, differ in fundamental ways from the direction the leadership of the Department of Defense has for the organization.”

    The new guidance says schools cannot modify discipline policies simply to reduce such racial disparities.

    A school’s decision “to change its discipline policies with the purpose of avoiding or reducing racial disparities in discipline constitutes race discrimination,” the Education Department’s office for civil rights
    said in a letter, opens new tab.

    It said schools must ensure students are not treated differently because of race and that “racial balancing” constitutes discrimination.

    The guidance follows the department’s decision last month to remove several “disparate impact” regulations that for decades have prohibited policies and practices ‌with ⁠discriminatory effects that are often unintended.

    President Donald Trump has acted against diversity initiatives, which he calls discriminatory against white people and males. Civil rights advocates say Trump’s actions are rolling back social progress by removing practices aimed at helping marginalized groups.

    Eric Duncan, education equity advocacy group EdTrust’s director of P-12 policy, criticized the latest guidance.

    “You cannot address racial disparities in school discipline by telling schools to ignore race,” he said. “Black students have long faced some of the harshest discipline ⁠in our nation’s schools.”

    Data from the 2023 report also showed that Black boys were nearly twice as likely as white boys to receive an out-of-school suspension or ⁠expulsion in K-12 public schools while Black girls were nearly twice as likely to receive one or more in-school suspensions, one or more out-of-school suspensions, and expulsions than white girls.

    2 members of Tennessee college cycling team killed in highway collision, officials say

    Two members of the Milligan University cycling team were killed, and several more were injured, in a collision with a vehicle on a rural highway in eastern Tennessee on Wednesday morning, state officials and the school confirmed. A driver has been arrested.

    In a news conference Wednesday night, Milligan University President Dr. Stephen Waers said 11 cyclists were on a training ride when the crash occurred at about 8 a.m. local time. Waers said two cyclists were killed and seven others were hospitalized.

    Waers identified the two deceased victims as sophomores Haylan Engdahl and Brayden Rogers.

    “This is an elite cycling team, it’s not a bunch of club guys getting together to ride, they know what they’re doing,” Tennessee First Judicial District Attorney General Steven Finney told reporters.

    Officials said some of the injured cyclists were airlifted by helicopter to Johnson City Medical Center, an area hospital. Dr. Bracken Burns, the trauma medical director for the hospital, said during the news conference that of the seven patients the hospital received, four were in critical condition, two were in stable condition and the seventh was evaluated and released.

    Milligan University, a small Christian college located in Elizabethton, Tennessee, said the crash occurred in the community of Hampton, about 10 miles east of the campus.

    The Tennessee Highway Patrol said it took place on a rural highway. Officials did not provide any details on the circumstances of the crash during the news conference. A highway patrol source told CBS News that it occurred in a mountainous area.

    The Food and Drug Administration upgraded a recall of frozen blueberries and mixed berries sold at Publix grocery stores across the U.S. to the highest health risk level on Tuesday, according to an enforcement report.

    Publix on July 29 announced a recall of four varieties of frozen GreenWise organic blueberries and mixed berries sold at stores across eight states over potential E. coli contamination. The FDA is now categorizing it as a “Class 1” recall, which the agency assigns to product recalls “in which there is a reasonable probability that the use of or exposure to a violative product will cause serious adverse health consequences or death.”

    Twelve people infected with the outbreak strain of E. coli have been reported in two states, according to the Centers for Disease Control and Prevention. No deaths linked to the outbreak have been reported.

    The following products, shipped to Publix stores in Alabama, Florida, Georgia, Kentucky, North Carolina, South Carolina, Tennessee and Virginia, are under recall. They should be discarded or returned to Publix for a full refund. Their expiration dates are before Feb. 9, 2028.

    E. coli, a large group of bacteria, can cause illness characterized by severe stomach cramps, diarrhea and vomiting, according to the FDA. In severe cases, the bacteria can cause hemolytic uremic syndrome, which can lead to kidney failure and be life-threatening.

    Last week, the FDA also upgraded an egg recall to the highest health risk level over potential salmonella contamination.

    Aug 19 (Reuters) – A federal ​appeals court on Wednesday upheld a more than $1 billion settlement to resolve antitrust ‌claims that real estate brokerages conspired to inflate agents’ commissions, rejecting objections by home buyers and sellers who said their claims should not have been released.

    The 8th U.S. Circuit Court of Appeals in St. Louis said a ​federal district judge did not abuse his discretion in finding that any conflicts of ​interest between buyers and sellers were not severe enough to undermine the settlement’s ⁠fairness.

    Circuit Judge Lavenski Smith wrote for a three-judge panel that changes to how brokerages negotiate, ​allocate and disclose commissions “will benefit the entire class.”

    Wednesday’s decision upheld the November 2024 settlement approval by ​U.S. District Judge Stephen Bough in Kansas City, Missouri.

    The settlement covering tens of millions of class members includes $418 million from the National Association of Realtors, $250 million from Berkshire Hathaway’s (BRKa.N) HomeServices of America, and $333 million in legal fees.

    As part ​of the settlement, the NAR agreed to revamp decades-old rules governing the splitting of agent commissions, ​which hovered around 5% to 6%. Many buyers and sellers found those commissions too high.

    Patrick Knie, a lawyer ‌for ⁠some of the objectors, said his clients may appeal to the Supreme Court. He said they weren’t allowed to properly raise their objections, and the payout was too low.

    “Everyone got next to nothing for the sake of settling,” he said. “There’s something just not right about that.”

    The NAR said it ​was pleased, and would ​continue efforts to “foster fair, ⁠transparent, and pro-consumer real estate markets.”

    HomeServices Chief Executive Chris Kelly said he was also pleased, and the decision provided “additional certainty” to the company, customers ​and agents.

    The settlement saved the industry some money, after a Missouri ​jury in October ⁠2023 ordered the NAR, HomeServices and the realty Keller Williams to pay $1.78 billion to home sellers who claimed they were overcharged.

    Other sizable brokerages, including Brown Harris Stevens, were allowed to join the settlement and ⁠provide additional ​cash if they changed their business practices.

    Berkshire Hathaway Energy, ​the immediate parent of HomeServices, is still defending against a separate proposed class action before Judge Bough claiming it also conspired to ​inflate commissions, despite the $250 million settlement.

    President Donald Trump’s approval rating has plummeted to a record low during his second term in office and is now tied for his lowest approval rating ever as commander in chief, according to a new poll.

    Only 33% of those surveyed in a new Reuters/Ipsos poll approve of the 45th and 47th president’s job in the White House. The rating is down from 35% last week. A survey of 1,166 respondents showed that 64% disapproved of Trump’s job performance.

    Trump hit 33% approval in December 2017, his lowest during his first term in office, according to Reuters/Ipsos.

    Meanwhile, 80% of survey respondents said they expect the war in Iran “will go on for an extended period of time.”

    The war began in February and was explained to Americans as a mission to wipe out the Middle Eastern country’s nuclear weapons program. Iranian attempts to assert dominance over the Strait of Hormuz have complicated matters.

    One fifth of the world’s oil traverses the Strait, and the effects have been felt at the pump.

    LAWMAKERS CLASH OVER TRUMP GAS TAX HOLIDAY AS IRAN WAR DRIVES PRICES HIGHER

    Since the war began, national average gas prices have jumped from just under $3 per gallon to just over $4 per gallon, according to American Automobile Association (AAA) data. On Friday, at a rally with law enforcement in New York touting record low crime rates, Trump defended the jump in prices at the pump.

    “Remember that when you have to pay a little bit more, $4, it’s OK,” he said, adding that he did “the right thing,” and saying, “I’ll never apologize.”

    Inflation has also spiked since the beginning of the war. According to the Bureau of Labor Statistics (BLS), year-over-year inflation in February was 2.4%. That number now sits at 3.4%.

    “President Trump is cleaning up Joe Biden’s mess, and there is more work to do, but the United States of America has never been stronger,” she continued.

    The White House did not comment on whether there is a target date for ending the war.

    Democrats have seized on the war, which only 35% of Americans support, according to Reuters/Ipsos, along with affordability in their attempts to retake the House and Senate in November.

    The mission to save NASA’s sinking Swift Observatory was called off Wednesday, dooming the telescope to a fiery reentry later this year.

    NASA and Katalyst Space Technologies announced the news more than a month after the startup’s Link spacecraft rocketed away to the telescope’s rescue.

    Katalyst said Link will not attempt to capture Swift and boost it to a higher orbit because of problems with controlling the spacecraft. NASA said this means the telescope will plunge through the atmosphere after more than 20 years of tracking some of the biggest explosions in the universe, like gamma-ray bursts and exploding stars.

    NASA paid $30 million to Katalyst in an attempt to raise the telescope to a safer, longer-lasting orbit. Intense solar activity caused it to lose altitude faster than expected. The rescue spacecraft went into an uncontrollable spin a few weeks after its liftoff in early July. While flight controllers managed to slow Link’s tumble, issues continued to plague its pointing and positioning in orbit.

    “This is not the outcome we were working toward, but it does not change why this mission was worth attempting,” NASA Administrator Jared Isaacman said in a statement.

    As a consolation prize, Katalyst will continue to operate Link in proximity with the telescope to demonstrate capabilities for future rescue operations.

    Katalyst CEO Ghonhee Lee said it was an ambitious mission on an aggressive timeline that was thrown together in under a year.

    “We took on this high-risk, high-reward challenge and are proud of the milestones we reached along the way,” Lee said in a statement. “We have already learned a tremendous amount.”

    Launched in 2004, Swift’s science instruments were turned off earlier this year to slow its descent. It was orbiting 216 miles high as of last week. The satellite is predicted to reach an altitude of 186 miles in October.

    Designed for a two-year mission, Swift has been slowly falling to lower and lower altitudes over the past two decades because of interactions with traces of the extreme upper atmosphere that extend out into the realm of low-Earth orbit.

    Solar storms can heat up the atmosphere, periodically causing it to swell, increasing the “drag” on the spacecraft, and Swift is not equipped with thrusters to counteract that downward pull.

    The observatory is currently falling about 5 miles per month, a descent that will slowly but surely pick up speed as it drops lower and lower into thicker regions of the upper atmosphere.

    Shawn Domagal-Goldman, Astrophysics Division director at NASA, told “CBS Mornings” in June that nothing pinpoints gamma-ray bursts like the orbiting Swift Observatory.

    “A nuclear weapon going off doesn’t even compare to the magnitude of energy that comes out of these things and it’s literally the biggest explosions in the universe,” Domagal-Goldman said.

    NASA’s Hubble Space Telescope could benefit from an orbital boost and had been next in line for a rescue attempt had this mission gone well. The 36-year-old Hubble is also dropping in orbit because of all the sun’s recent outbursts and is expected to reenter the atmosphere in the 2030s if nothing is done. It wasn’t immediately known whether Hubble is now out of luck.
