    A jury has found Duane “Keffe D” Davis guilty of orchestrating the 1996 killing of rapper Tupac Shakur in Las Vegas, marking the first conviction in a case that has gripped hip-hop fans for decades.

    Davis, 63, was convicted Monday on a charge of murder with a deadly weapon with the intent to promote, further or assist a criminal gang in Shakur’s killing, and could be sentenced to life in prison. He had pleaded not guilty. The prosecution said Monday night that the state would dismiss the gang enhancement part of the charge due to witness logistics.

    The jury reached its verdict in less than three hours after a weekslong trial.

    After the verdict was read, Shakur’s sister, Sekyiwa “Set” Shakur, cried and reached back to a person behind her. Also in the courtroom was Davis’ son, who covered his face with one hand.

    Chief Deputy District Attorney Binu Palal told jurors in closing arguments that Davis acquired a gun and “went hunting” for Shakur and Death Row Records co-founder Marion “Suge” Knight after they beat up Davis’ nephew earlier that night.

    Palal acknowledged that Davis’ accounts of the killing evolved over the years but argued those differences reflected Davis’ changing motivations and efforts to protect himself. One critical detail, he said, remained consistent: Davis repeatedly placed himself inside a white Cadillac from which the shots were fired.

    “The core facts remain. The material facts remain,” Palal said.

    Davis’ defense attorney, Michael Sanft, challenged jurors to identify evidence outside Davis’ own statements that placed him in Las Vegas or inside the Cadillac on the night Shakur was shot. He pointed to the absence of surveillance footage, phone records and other evidence putting Davis there.

    “They have nothing in this case that says that man was here in Las Vegas on Sept. 7, 1996,” Sanft said, pointing toward Davis.

    The panel of 16 jurors, four of whom were alternates, heard testimony from 24 prosecution witnesses and three defense witnesses over nine days.

    The trial brought to a head a decades-old case that for years has drawn the eyes of hip-hop fans and true crime experts alike.

    Shakur, who was considered one of the most influential rappers of all time, was in Las Vegas on Sept. 7, 1996, and stopped at a red light when a white Cadillac pulled up beside him, and shots were fired. He died six days later from his wounds. Knight was also wounded but survived.

    For years, nobody had been charged in the rapper’s death until Davis began making public statements, saying he was in the Cadillac and gave the gun to others in the back seat. Davis described the shooting as an act of retaliation after Knight and Shakur’s entourage beat up Davis’ nephew hours before the shooting.

    Under Nevada law, someone who helps another person commit murder can be convicted of the crime. Davis is the only person still alive among the four men prosecutors say were in the Cadillac. The man who prosecutors say originally gave the gun to Davis is also dead.

    Palal told jurors that if they believe Davis’ statements, they do not have to be independently corroborated with additional evidence.

    Still, he pointed to the rivalry between the South Side Compton Crips and Mob Piru, the fight with Orlando “Baby Lane” Anderson and testimony that members of Shakur’s circle identified Anderson and Davis as suspects the night of the shooting. Witnesses had testified to the heated gang rivalry between the South Side Compton Crips and Mob Piru, which were associated with dueling record companies Bad Boy Records and Death Row Records.

    “Who fired is not the question,” Palal said. Prosecutors haven’t argued that Davis pulled the trigger, but instead that he was criminally responsible because he provided the gun and ordered the attack.

    Palal also argued the shooting was premeditated, pointing to testimony and Davis’ accounts that the group searched for Shakur before spotting him on the road and making a U-turn. “It’s a plan, not an impulse,” Palal said.

    Palal held up Davis’ 2019 memoir, “Compton Street Legend,” and played an interview in which Davis encouraged people to buy it to get the “real truth.” Although the book contains a disclaimer saying some facts were changed, Palal argued that names, hotels and other details changed while the central account did not.

    Palal also rejected the defense’s contention that Davis fabricated his accounts to make money. “It is an entirely different proposition to be profiting from a murder,” Palal said. “And that is what Mr. Davis is doing.”

    Sanft also turned to his client’s memoir during his closing argument. While reading an excerpt, he said the N-word aloud, prompting people watching in an overflow courtroom to recoil and shake their heads.

    In multiple interviews, Davis said he handed the gun to the back seat, but in others as well as in his book, Davis wouldn’t say who pulled the trigger.

    In a rebuttal argument, prosecutor Marc DiGiacomo pointed to a scrapbook Davis kept containing articles about Shakur.

    “This guy’s scrapbooking his murder, for God’s sake,” DiGiacomo told jurors.

    The prosecution’s witnesses included a gang expert who described Davis as the shot caller that younger gang members had to obey. Sanft, meanwhile, asked jurors if there was any evidence that Davis had ever called the shots before or after the shooting.

    During the trial, investigators said a Las Vegas hotel bill was found at Davis’ residence during a police search, but it wasn’t clear when it was dated — or where that evidence is currently located.

    The case is nearly 30 years old, which has affected the kind of evidence presented in court. Prosecutors warned jurors that material collected in the ’90s is different from what law enforcement collects today, including hotel surveillance video from the night of the shooting.

    BOSTON, Aug 31 (Reuters) – President Donald Trump’s ​administration on Monday asked a U.S. appeals court to lift a judge’s order blocking a new ‌rule that would tighten mail-in voting requirements ahead of the November congressional elections.

    A ​lower-court judge issued the order on Thursday at the behest of Democratic-led states and voting rights groups.

    The administration ​asked the appeals court to intervene after Boston-based U.S. District Judge Indira Talwani earlier ⁠on Monday declined to pause her restraining order. It will remain in place for 14 days while she considers ​whether to issue a longer-term injunction at a hearing set for Thursday.

    Talwani, an appointee of Democratic President Barack Obama, ​in issuing the restraining order had concluded that USPS’ rule risked disenfranchising voters and was likely unlawful and adopted in violation of the U.S. Constitution, which gives states the authority to administer elections.

    Justice Department lawyers told the 1st Circuit that Talwani’s ruling was “gravely mistaken,” and ​the lawsuit appeared based on an unfounded premise that USPS intends to seize control of the administration of ​federal elections.

    “The rule’s improvements and modernizations of USPS’s infrastructure for supporting this particularly sensitive category of mail are fully consistent with USPS’s ‌statutory ⁠and constitutional authority,” the Justice Department argued.

    Should the 1st Circuit decline to halt Talwani’s order, the administration could try to seek the intervention of the 6-3 conservative-majority Supreme Court, which last week lifted an earlier injunction the judge had issued that had blocked USPS from moving forward with the rule.

    USPS issued the rule to implement an executive order the ​Republican president signed in March ​after years of Trump ⁠calling for tighter rules on voting by mail and pushing the false claim that his 2020 presidential election defeat to Democrat Joe Biden was the result of widespread voter ​fraud.

    Under the rule, states must supply the USPS with lists of mail ballot recipients, ​and all outbound ⁠and return ballot envelopes must bear unique barcodes.

    The USPS, under the rule, may refuse to deliver ballots that do not comply with the new standards or are associated with voters who do not appear on the lists.

    All 50 states allow ⁠for some ​form of mail-in voting, with 29 allowing voters to ask to ​cast ballots that way without providing a reason and eight conducting their elections entirely by mail. North Carolina is set on Friday to become ​the first state to mail out ballots for the November election.

    Congress has little left on its agenda after the Senate approved a bill to avert a government shutdown through December

    Fox News chief congressional correspondent Chad Pergram reports on the House returning to session as lawmakers face a looming government shutdown deadline and a vote on a resolution targeting socialist policies on ‘Special Report.’

    The House of Representatives is back in town after not voting since July 23.

    But the House is only back for less than a week. And the Senate doesn’t even return until Monday, September 14.

    The first day of school, this is not.

    House members descending on the Capitol this week – then abandoning Washington for Labor Day is kind of like the third and final preseason game in the NFL.

    Lots of fans show up for the first game of the NFL preseason. It’s usually a nice – if sweltering – August night. Not some bone-shivering chill in Cleveland with a foot of snow on the ground in mid-December. There’s anticipation. The first look at the new team. The first tailgate. First-string players and highly touted draft picks even play a series or two.

    But by the third preseason game, few want to be there.

    The die is cast for the roster spots. Players are cut. Even the most robust fans only show up for a quarter or two.

    In the NFL, everyone is waiting for the regular season to begin in a few weeks.

    That’s kind of where things are now in the House. Congress has tackled most of its business for the year. The highly-touted GOP “Reconciliation 3.0” likely falls by the wayside. Lawmakers even tucked into bed the usual autumn drama surrounding a possible government shutdown. The chances of a repeat following last year’s 43-day shutdown saga dissipated in early August when the Senate approved an interim, bipartisan bill which will fund the government through December 11. The House votes on that bill Tuesday.

    Everyone on Capitol Hill is now waiting for the regular season to begin. That’s what awaits the body politic following the midterm elections in November.

    And most members don’t even want to linger in Washington right now. As fast as they came to Washington, they wanted to skate out of town to campaign. That’s why attendance might be sparse over the next few days.

    The House had 384 members present for one non-controversial measure Monday night. A second vote recorded 388 members present. Those attendance figures could slide if the House returns to Washington in mid-September – as the schedule dictates. Especially among those who either lost their primaries or are retiring. In fact, Fox is told that some members in both camps have even considered resigning early.

    Imagine what that could do to the narrow Republican majority.

    So, will the House stick it out this week, go home and come back in a few weeks?

    “Are we going to be here the entire period?” yours truly asked House Speaker Mike Johnson, R-La. “We’re going to be here this week and then we’re going to come back in a couple weeks?”

    “Well, it’s on the schedule,” Johnson replied.

    That’s a schedule which the House Republican leadership etched out last December – on the heels of that epic government shutdown.

    Who could have anticipated that government funding could work out so easily this time around.

    So what’s on the agenda?

    Republicans plan a vote on a resolution to get Democrats on the record of either supporting socialism or democracy. In other words, the GOP wants Democrats to put their voting cards where their policies are.

    “They want to abolish things like the U.S. Supreme Court. The United States Senate,” said Rep. Jeff Crank R-Colo.

    Republicans hope to compel Democrats to either accept or reject progressive, left-wing ideologies.

    “We need to see where Democrats stand on this because the American people are rejecting it,” said Rep. Tom Tiffany R-Wis., on Fox.

    “They’re going to try to distance themselves as much as they can,” said Rep. Carlos Gimenez, R-Fla. “But the fact is that’s where the Democratic Party is going. That’s where the energy of the Democratic Party is going.”

    This is what’s described in Congress as a “gotcha” vote. Republicans will dare Democrats to vote no. And if they do, the GOP will deploy that vote against vulnerable Democrats in campaign ads this fall.

    Some Democrats could vote to reject any relationship with socialism. In fact, the vote could give those Democrats a gift to say they’re opposed to socialists in the Democratic Party. But Republicans ensconced a measure in the resolution which could oblige Democrats to vote no.

    The measure includes the SAVE America Act. That’s the hallmark of the GOP’s agenda. It requires proof of citizenship for voting. Most Democrats view the SAVE America Act as a poison pill. So Democrats could vote nay. And some Republicans will still say “gotcha” if they oppose it.

    “The resolution elevates the so-called Save America Act, which is just the ‘suppress the vote act,’ said House Minority Leader Hakeem Jeffries D-N.Y. “I’m not clear how many Democrats are actually going to support a resolution whose focus is on trying to rig the midterm election by elevating this voter suppression legislation that Donald Trump has been trying to jam down the throats of the American people for the last year.”

    The House could also wrestle with a resolution to censure Rep. Chuck Edwards, R-N.C. He admitted to inappropriate conduct around female aides and dropped his reelection bid. There could be an effort to expel Rep. Cory Mills R-Fla. He faces allegations of financial misconduct and alleged assault of a woman at his apartment last year. But Mills lost his primary.

    Then there is Rep. Max Miller, R-Ohio. The Ohio Republican faces allegations of spousal and child abuse. Republicans implored Miller to drop his reelection bid. But Miller doubled down, saying the allegations are false.

    Johnson says he supports Miller’s “reelection.” He contends the House shouldn’t take action until the Ethics Committee completes its inquiry.

    “He has been a great Member of Congress,” said Johnson of Miller. “He has some personal issues he’s still working through.”

    But it’s possible Democrats – and even some Republicans – could engineer a special resolution to expel or otherwise punish Miller. Johnson and the GOP leadership want nothing to do with that. So the solution? Get lawmakers off Capitol Hill and back into their districts. Fast.

    Yes, it’s unclear what the Senate may address when it returns in a few weeks. But House Republicans are more concerned with clinging to their narrow majority in November. So recessing until after the election could prove to be the safest political tactic for Republicans.

    Don’t be surprised if the House leaves Washington until November in the next few days.
