First challenge to prediction markets reaches Supreme Court

New Jersey on Wednesday asked the Supreme Court to shut down prediction markets in the state, teeing up a potential landmark case where the justices could decide if the highly popular but controversial industry can survive in its current form.

This is the first time the nationwide legal battle over the legality of prediction sites has reached the Supreme Court, and it comes after a string of recent rulings against the companies, including from a federal appeals court.

The high court will likely consider later this fall whether to hear the case. If it does so, then the court would likely hand down a decision by the start of next summer.

Prediction sites like Kalshi and Polymarket let people bet on real-world events like sports, elections, entertainment, the weather and more. They’re structured as financial derivatives markets – not gambling – and are regulated federally by the Commodity Futures Trading Commission.

However, a bipartisan coalition of 44 states have argued that these platforms are, in fact, gambling. They believe prediction companies are running unlicensed sportsbooks, unlawfully skirting state gaming regulations that impose consumer protections and bring in billions in state tax revenue.

That’s why New Jersey’s attorney general tried to shut down Kalshi’s sports bets in the state last year. Kalshi sued, and a federal district judge blocked New Jersey from taking regulatory action against Kalshi. The Philadelphia-based 3rd US Circuit Court of Appeals upheld that ruling in a 2-1 decision in April.

“We’re calling on the Supreme Court to resolve this issue and recognize that Congress did not silently make the sports-betting industry immune from state law,” New Jersey Attorney General Jennifer Davenport, a Democrat, said in a statement on Wednesday.

After New Jersey’s filing, Kalshi expressed confidence that it would ultimately prevail.

“Kalshi is an open, nationwide financial exchange,” Kalshi spokeswoman Dani Lever said in a statement. “It cannot be regulated by 50 different regulators. Both the Third Circuit and the District of New Jersey sided with Kalshi because the CFTC’s exclusive jurisdiction preempts state law.”

The New Jersey appeal comes less than one week after another state, Nevada, secured a significant victory in a related case on the other side of the country. The 9th US Circuit Court of Appeals ruled 3-0 on Friday that states can regulate prediction markets as sports-betting, creating a circuit split.

The Third Circuit previously found that prediction sites are legally distinct from traditional sportsbooks because they offer “event contracts” for trading, and, thus, must be regulated federally. The Ninth Circuit rejected that view, saying, “Kalshi’s sports event contracts have the hallmarks of sports betting.”

Kalshi is the most popular prediction site in the country. But so far, regulators in three states have secured court orders shutting down Kalshi and, at least, its sports bets: Nevada, Michigan and Washington state.

(CNN has a partnership with Kalshi and uses its data to cover major events, but CNN editorial employees are prohibited from trading on prediction markets.)

Kalshi and Polymarket now see billions of dollars in weekly volume, and the Trump administration has made clear that it wants these sites to flourish.

CFTC chairman Mike Selig, a Trump appointee, has championed prediction markets and has said his agency has exclusive jurisdiction to regulate them.

The agency didn’t intervene in the New Jersey case, but it did in the Nevada case, arguing that prediction sites can’t be touched by state laws. Under Selig, the CFTC has also sued several other states that tried to ban prediction sites.

The CFTC proposed new federal rules in June that would leave most of the industry intact, including most sports markets. Selig’s proposal rebuffed calls for more aggressive regulation from state officials, dozens of lawmakers, addiction experts, and major sports leagues like the NCAA and NBA.

Looming over the potential future Supreme Court action in this case is President Donald Trump’s financial and familial ties to the industry.

The president’s social media company, Trump Media & Technology Group, announced last year that it was launching its own prediction market called Truth Predict, though it has scaled back those plans in recent months.

And the president’s eldest son, Donald Trump Jr., is an investor and adviser to Polymarket, and is an adviser to Kalshi. A spokesman for Trump Jr. previously said he doesn’t lobby federal officials on behalf of the companies.

Trump has only personally spoken out a few times about prediction markets.

In April, he lamented that “the whole world, unfortunately, has become somewhat of a casino.” But in May, he said it was “critically important” to stop states from regulating prediction sites, so they could “flourish” under new rules proposed by the CFTC and Selig, who he said was “doing a great job.”

The trial of Lindsay Clancy over the killings of her three young children is driving conversations outside the courtroom about postpartum healthcare — and gaps in the system.

Clancy’s defense says she killed her three children after suffering from postpartum psychosis, a severe condition affecting someone’s sense of reality, while the prosecution argued she planned the killings and knew what she was doing was wrong.

Clancy’s legal team says she tried to get help but was overmedicated and didn’t get the care she needed.

Postpartum psychosis is estimated to affect about one in 1,000 people after childbirth, and the case is resonating with moms across the country — bringing into focus the spectrum of perinatal mood and anxiety disorders and the lack of resources for many women.

Perinatal mood and anxiety disorders are mental health conditions, including depression, anxiety, bipolar disorder and postpartum psychosis, happening during pregnancy and up to a year after giving birth. Overall, they are estimated to affect one in every five to seven women.

Moms have traditionally had a postpartum appointment with an OB-GYN around six weeks after giving birth, where they receive a physical checkup and are screened for mental health issues. But following that visit, there isn’t a standard appointment schedule.

“We can’t just clear a mom at six weeks postpartum and expect her to figure out the rest of what’s going on for the next 12 months,” said Nicole Kumi, a maternal wellness advocate and founder of The Whole Mom, an organization focusing on perinatal transitional coaching.

The American College of Obstetricians and Gynecologists recommends women have contact with a maternal care provider within the first three weeks postpartum and a comprehensive postpartum visit no later than 12 weeks after birth. The organization says care should be individualized and ongoing as needed.

“This is not a ‘one and done’ for our moms,” Kumi said. “She’s going to have physical challenges, she’s going to have mental health challenges, and I think the duty is on the system to revamp, and I feel like this case is going to put the system in a place where they have to act. Changes have to occur.”

The first step for Kumi, a mom herself, is educating women about what postpartum mental health can look like before they are in the thick of it.

“We routinely are expecting our moms to recognize the signs and symptoms that they were never taught to recognize in the first place,” she said. “Then once we identify that something is wrong, we’re expected to navigate this fragmented, if not broken, system while we’re hormonal, while we’re caring for a newborn, potentially other babies, sleep deprived and going back to work.”

Driven by her own experience hiding her mental health challenges during postpartum and hearing from other moms who did the same, Kumi started The 4th Trimester Program to provide education and support to moms. It also aims to create a virtual community of moms to help each other.

A key to filling the healthcare gap is making mental health part of a mom’s treatment plan and ensuring people around her also know the signs of mood and anxiety disorders, Kumi and others say.

“Mental health should be woven into your care before you have a baby, during your prenatal care and especially afterwards,” Dr. Kameelah Phillips, an OB-GYN and founder of a women’s health clinic, said on “CBS Mornings.”

Phillips warned about inadequate funding and a decline in doctors specializing in maternal care that worsened after the Supreme Court overturned Roe v. Wade. One in three U.S. counties is considered a maternity care desert, meaning there are no obstetric clinicians or birthing facilities, according to March of Dimes, a nonprofit that advocates for maternal healthcare.

“I don’t think that America is paying attention to what’s happening in women’s health,” Phillips said. “These women’s health deserts are going to set us up for failure in the near future if we don’t start acting and talking about this really pivotal issue.”

Speaking up about these issues isn’t easy, said Dr. Catherine Birndorf, a reproductive psychiatrist and co-founder of The Motherhood Center, a maternal mental health treatment center in New York.

“There’s a lot of fear around even speaking ill of being a mother, right?” she said. “Society wants us to feel great about it, to be the best thing that ever happened, but in fact, it’s an enormous challenge. It is both/and. It is both wonderful and complicated and challenging, and that nuance is hard to hold and it’s hard to speak about.”

Kumi hopes the more moms who do speak up, the less stigma there will be.

“I think that there’s more of us that are welcoming and understanding of it now than ever before, so I really hope that we can lean into this momentum of driving home change,” she said.

Sept 2 (Reuters) – New Jersey authorities on Wednesday asked the U.S. Supreme Court to resolve whether states ‌have the power to police sports betting that occurs on prediction markets operated by Kalshi and competing platforms.

The state asked the Supreme Court to overturn an appellate court’s decision in April holding that the U.S. Commodity Futures Trading Commission has exclusive jurisdiction over the sports-related ​event contracts that Kalshi allows people to trade on its platform.

“These companies have no right to ​offer their sports bets without following state law, which is why dozens of states ⁠across the ideological spectrum have opposed them,” New Jersey Attorney General Jennifer Davenport, a Democrat, said in a ​statement.

New York-based Kalshi did not immediately respond to a request for comment.

Kalshi, which in a recent funding round ​was valued at $22 billion, has been at the center of an escalating legal battle over the ability of state gaming regulators to police companies in the fast-growing prediction markets industry.

States argue that firms like Kalshi are operating without required state licenses, in violation of ​gaming laws, including bans on wagers by those under 21.

Under Republican President Donald Trump’s administration, the CFTC has shared ​the companies’ position that trading on prediction markets falls exclusively under the agency’s jurisdiction.

Davenport is asking the Supreme Court to ‌overturn a ⁠2-1 decision by the Philadelphia-based 3rd U.S. Circuit Court of Appeals in Kalshi’s favor that concluded that the federal Commodity Exchange Act likely preempted New Jersey’s laws.

New Jersey took its case to the nation’s highest court just days after a different federal appeals court sided against Kalshi, ruling that Nevada gaming regulators could not be blocked from ​requiring the company to hold ​a gaming license to ⁠allow users to bet on sports outcomes.

Those conflicting appellate court rulings increased the possibility that the Supreme Court could be forced to step in and resolve the ​issue, which is at the center of numerous other court cases nationwide. At ​least four states — ⁠Nevada, Massachusetts, Michigan and Washington — have won court orders restricting Kalshi’s activities.

New Jersey argues the 3rd Circuit’s holding rests on the incorrect premise that Congress, in adopting the Dodd-Frank Act following the 2008 financial crisis, silently shifted authority over sports wagering away ⁠from ​states to the CFTC when it was directed to regulate “swaps,” a ​type of derivative contract.

“At the very least, Dodd-Frank is not nearly clear enough to transfer authority over a multi-billion-dollar sportsgaming industry to a ​federal regulatory agency with no gambling expertise,” the state’s lawyers wrote.

Meta says AI glasses fix stops users from secretly recording others

Meta announced privacy updates to its artificial intelligence-powered glasses after reports that users of the device were filming people without their consent.

The glasses include an LED light that signals when filming has started. Meta said it recently disabled the glasses’ cameras if the light is physically tampered with. The light previously had to be blocked before filming started to lock the recording function. Now, recording is disabled if a user starts filming and then covers the light, according to Meta.

“These investments are already having a deterrent effect — companies that were offering LED tampering services have shut down because the camera now deactivates when tampering is detected,” the company noted in an email to CBS News.

CBS News reported in August that a woman who was unknowingly filmed by a man wearing the glasses discovered a video of herself on social media. The woman said she was unaware she was being filmed and had never been asked for permission to be recorded.

“I had no say,” she told CBS News.

CBS News senior crime and public safety coordinating producer Anna Schecter tested the glasses last month and found that an earlier iteration of the disabling mechanism did not work when she covered the light after recording had begun.

Meta said the enhanced security feature now deactivates the recording function whenever tampering is detected.

“We’re going to keep rolling out updates like this to make sure the capture LED can reliably alert bystanders when photos or videos are being captured for someone’s gallery,” Alex Himel, vice president of wearables at Meta, said in a social media post last week. “Only a tiny minority of people try to get around these protections, and the fact they have to go to these lengths shows our efforts are working.”

In a new education and awareness campaignhttps://www.youtube.com/watch?v=x_mVx1XR43c, Meta said it designed the light to signal to others when the glasses are capturing photos or recording videos.

The company said it has also taken other steps to address privacy concerns regarding its AI glasses. Those include removing online posts providing tampering instructions or services; removing thousands of harassing posts related to pickup artist and prank content; and blocking search terms and hashtags associated with violating content, such as “pickup artist” and “rizz” posts.

The Justice Department moved Wednesday to require states to provide information on undocumented immigrants or lose federal funding for two key public assistance programs, issuing a sweeping revision of a long-standing legal opinion.

It’s the latest move by the Trump administration to force states to cooperate in the president’s aggressive immigration crackdown — this time, threatening to pull federal funding if they don’t turn over information on undocumented immigrants who they believe are residing in the country.

It stems from a new legal opinion from the Office of Legal Counsel stating that when a state chooses to participate in the Temporary Assistance for Needy Families (TANF) and the Supplemental Security Income (SSI) programs — as all states do — they are required to report individuals who are illegally present in the United States to the Department of Homeland Security.

TANF provides cash assistance and other support to low-income households. SSI provides monthly payments to low-income senior citizens or people with disabilities.

The opinion, which the DOJ cast as a clarification of a previous opinion, applies to all agencies within a state, not just those that administer the programs. Previously, under a Clinton-era opinion from 1998, the reporting requirement was specific to state agencies administering TANF or SSI.

“Congress wrote this requirement plainly,” Assistant Attorney General T. Elliot Gaiser of the OLC said in a statement.

“When a state chooses to participate in TANF, it accepts the obligation to report illegal aliens in the United States. Tax dollars intended to help vulnerable Americans should not perversely encourage illegal entry into the United States, but rather should reinforce our laws and our borders,” he said.

There are also some federal housing programs that are subject to the same reporting requirements, the opinion states.

The opinion, dated Tuesday, only applies to future funding.

It’s unclear how the new opinion will be put into action, and it is likely to face swift legal challenges from critics who argue the federal government is improperly attempting to leverage welfare benefits for access to state data.

The US Department of Agriculture has also tried to gain more information from states about undocumented immigrants possibly receiving food stamps — a key safety net program that is funded by the federal government but administered by states.

Undocumented immigrants are not eligible for food stamps — formally known as the Supplemental Nutrition Assistance Program, or SNAP — and other federal benefits.

Last year, USDA requested for the first time that states provide it with their food stamp enrollee records, and Agriculture Secretary Brooke Rollins threatened to withhold funding from blue states that didn’t comply. But a coalition of Democratic states sued and won a preliminary injunction.

Earlier this year, a federal judge issued a preliminary injunction blocking the department from imposing new conditions on USDA funding for food stamps and other nutrition programs. The conditions included barring states from using funding for programs that allow undocumented immigrants to receive taxpayer-funded benefits.

Former state Sen. Troy Jackson, who has replaced Graham Platner as the Democratic Senate nominee in Maine, backed bills seeking to send millions of dollars in public funds to a college while his son lobbied on its behalf, documents show.

Jackson’s son, Chace, was registered as a lobbyist for the Maine Maritime Academy at the same time his father was serving as president of the Maine Senate, according to state lobbying records.

In 2024, the elder Jackson co-sponsored legislation that would have sent $13.4 million to the maritime academy after pushing a bill providing the institution with an additional $2 million per year in 2023. Both pieces of legislation were drafted while Jackson’s son was lobbying for the college.

“Troy Jackson authored Augusta’s failed status quo and has turned public office into a family affair of self-enrichment,” National Republican Senatorial Committee press secretary Bernadette Breslin told Fox News Digital. “He’ll always prioritize personal kickbacks over the needs of working Mainers.”

Before his son was lobbying on its behalf, Jackson also supported legislation in early 2022 that provided the academy with a one-time $6.8 million payment to fund repairs to one of its buildings.

Jackson’s son first registered as a lobbyist for the Maine Maritime Academy in December 2022, according to public records. He renewed his lobbying registration in January 2024, just as his father was co-sponsoring legislation that would have sent over $10 million to the academy.

While the Maine Maritime Academy funding boost Jackson backed in 2023 went into effect, his 2024 bill passed the Maine Senate but was never signed into law.

“Troy Jackson has fought for working Mainers and [is] guided by one goal: fixing our broken system, so Maine’s working families stop getting squeezed while the rich get richer,” a spokesperson for the Jackson campaign told The Washington Free Beacon, which first reported on the lobbying records.

In April, Jackson justified his failed run for governor by claiming that the “status quo isn’t working” in Maine because of “special interests, high-priced lobbyists and corporate greed.” In addition to representing the Maine Maritime Academy, Chace Jackson works as one of the expensive lobbyists his father has criticized, at one point representing the multinational alcohol company behind premium beverages such as Johnnie Walker whiskey and Don Julio tequila.

In 2024, while his father was the Maine Senate president, the younger Jackson represented nine clients. That sum dropped to five clients after his father left the chamber in 2025.

for details about an internal anti-money laundering review that the bank said last month led it to close accounts linked ​to President Donald Trump and his businesses.

In a letter sent to Capital One CEO ‌Richard Fairbank on Tuesday evening and first reported by Reuters, Senator Maggie Hassan, a New Hampshire Democrat, asked for documents describing the transactions, alerts and other factors that prompted the review, as well as any communications with law enforcement ​or regulators related to the matter.

“The American people deserve to know,” wrote Hassan, the top ​Democrat on the Joint Economic Committee.

Capital One declined to comment.

Spokespeople for the White House ⁠and Trump Organization did not immediately respond to requests for comment.

The Trump Organization and Eric Trump, ​the president’s son, sued Capital One in March 2025 alleging the bank’s closure in 2021 of hundreds ​of affiliated accounts was politically motivated.

The U.S. bank has denied acting on political grounds. In a July court filing, it said the closures were the result of a careful review by Capital One’s AML team “in accordance with bank policies and ​regulatory guidance.” It has never accused the Trump Organization of money laundering. In a subsequent court ​filing, the plaintiffs said the AML review was pretextual.

If Capital One complies, Hassan’s request could shed further light on the ‌financial ⁠dealings of the president’s companies, as well as whether Trump’s “debanking” allegations have merit.

Debanking — denying services on religious or political grounds — has gained prominence during Trump’s second term. The president and administration officials have amplified conservative claims that “woke” — or left-leaning — large financial institutions have targeted conservative-leaning individuals, groups and businesses by restricting access to ​banking services. The industry ​has said lenders merely ⁠followed federal regulations when closing accounts.

in January on ​similar grounds. The bank denies the claims. A top banking regulator, the Office ​of the ⁠Comptroller of the Currency, is also probing the issue of debanking across several institutions.

In the letter to Fairbank, Hassan wrote that additional information is needed for congressional oversight.

The letter asked Capital One to identify the activity that ⁠triggered its ​review, explain the policies it applied, describe the findings that ​led to the account closures and, to the extent permitted by law, disclose any referrals or communications with federal or state ​authorities tied to the matter.

Washington— A Coast Guard jet carrying Homeland Security Secretary Markwayne Mullin and other top DHS officials made an emergency landing Wednesday afternoon outside Washington, D.C., after one of its engines failed.

The pilot of the plane, a C-37A, reported the loss of an engine to air traffic controllers at Ronald Reagan Washington National Airport.

“We just lost our right engine and would like to declare an emergency and immediate landing at DCA,” the pilot told the airport’s control tower, according to an audio recording of the communication. The pilot told controllers the plane had 14 people on board and 2.5 hours’ worth of fuel.

The C-37A is the military version of a Gulfstream V jet and is routinely used to carry senior Coast Guard and DHS officials, including the secretary. DHS oversees the Coast Guard.

Mullin confirmed the emergency landing in a post on X, writing that “The United States Coast Guard pilots made the single engine landing feel routine. No panic, just straight professionalism.”

“After we landed, the pilots told me that was a first for them! We could not have been in better hands,” he added.

The airport said in a statement that the plane “landed safely, was thoroughly checked by Airports Authority Fire and Rescue personnel then proceeded off the runway.”

CBS News has reached out to the DHS for comment about the emergency landing. The Coast Guard referred CBS News to DHS.

The department has raised concerns about the aging aircraft in the past. Last year, DHS said in a statement that the Coast Guard plane was “22 years old and faces significant avionics and communications obsolescence issues.”

The department’s fiscal year 2025 spending plan sought roughly $50 million to replace its aging Coast Guard executive jet used to transport senior officials. The request drew scrutiny from lawmakers on Capitol Hill, including Democratic Rep. Lauren Underwood of Illinois, who questioned Coast Guard leadership about the proposed purchase during an appropriations hearing.

During a May 20 Senate hearing, then-Secretary Kristi Noem defended her request, saying the existing jet had been in service “beyond its usable hours.”

Days later, Democratic Reps. Bennie Thompson of Mississippi and LaMonica McIver of New Jersey questioned DHS about why replacing its executive aircraft should take priority over updating older Coast Guard planes used in search-and-rescue missions.

By October 2025, the Coast Guard shifted its request from a proposed $50 million to two new Gulfstream G700s for roughly $200 million, prompting more scrutiny from members of Congress.

Kennedy Center has dismantled ‘Blue’ sculpture

The Kennedy Center began dismantling a large stick figure sculpture on its grounds today. The sculpture called “Blue” was created by artist Joel Shapiro and installed outside the center in 2019. A Kennedy Center spokesperson said in a statement to CNN that the venue requested the “deinstallation,” which the person described as “common practice.” It comes as President Donald Trump has worked to reshape the performing arts institution.
