‘It’s definitely the time’: Black governor hopefuls from both parties aim to make history in midterms

    Published: 2026-10-28T09:00:16.303Z | Source: https://www.cnn.com/2026/10/28/politics/black-governor-candidates-bottoms-donalds

    Atlanta—

Americans have elected three Black governors in the nation’s 250-year history. By next week, that figure could multiply.

From Keisha Lance Bottoms in Georgia to Byron Donalds in Florida to David Crowley in Wisconsin, Black candidates are vying to lead eight states from the South to the Midwest to the West. In all, five Democrats are running in gubernatorial races, and three Republicans are vying to be the country’s first elected Black Republican governor.

“We’re a complicated, beautiful country,” said Bottoms, a Democrat who would become the first Black woman governor in the nation’s history if she wins. “Just because it hasn’t happened, that doesn’t mean it’s not going to happen real soon.”

Donalds, a Republican, said in a recent Fox News interview that “Black voters need to take a look at these elections and the policies that are gonna improve their lives, and more and more, you’ll find that that’s in the Republican Party.”

The eight Black nominees in governor’s races this year are seeking to force change that has been slow in coming, long after the ends of slavery and the Jim Crow era. While some carry favorable odds and others are long shots, taken together, they represent a record number of candidates in one cycle.

In 1989, Douglas Wilder became the nation’s first elected Black governor in Virginia. Deval Patrick in Massachusetts followed him in 2006. Maryland’s Wes Moore became the third elected Black governor in 2022 and is seeking reelection to a second term. (David Paterson served as governor of New York from 2008 to 2010 after being appointed to fill the term of Eliot Spitzer.)

Bottoms, 56, is the daughter of R&B singer Major Lance and Sylvia Robinson. She talks about her roots going back more than five generations in Georgia.

“For me, it’s so much more personal,” Bottoms said in an interview. “My people were once enslaved in this state.”

Still, the nominees largely have not spent much time emphasizing their potential to break through barriers in their own states — or the significance of the history-making moment if several of them win on November 3.

Nor have two history-making Democrats who have campaigned with several of them: former President Barack Obama, the first Black president, and Kamala Harris, who in addition to breaking racial barriers, was the first female vice president and in 2024 fell short of becoming the first woman elected president.

At an event Monday with Crowley, the Democratic nominee for Wisconsin governor, Harris recalled being asked by reporters to address “women’s issues.”

“I’d look at them and say, ‘I’m so glad you wanna talk about the economy,’” she said.

Still, last week in Nevada, where she campaigned alongside Democratic Attorney General Aaron Ford, who is taking on Republican Gov. Joe Lombardo, Harris touted Ford’s chance to become the first Black governor west of the Mississippi River. She told culinary workers they were “going to make history” by electing him.

In Georgia, Stacey Abrams twice ran for governor and fell short both times.

The disappointment Democrats had from those campaigns in 2018 and 2022 still hangs over Bottoms’ race. Yet she spends her time focused on the present, talking about how Georgia has fared in Trump’s second term.

“Everything is different with Trump 2.0,” Bottoms said. “We are now in the midst of a war that didn’t have to happen. Gas prices have gone up. Grocery prices are continuing to rise.”

Bottoms, a former Atlanta mayor, is set to appear Wednesday night at a metro Atlanta rally with Obama. The next day, Harris will also visit Georgia, underscoring the potential opportunity in a state where Democrats last elected a governor in 1998.

“I wake up as a Black woman every day, so it’s no surprise to me that I’m capable and I’m qualified and I’m able,” Bottoms said. “But if it’s representation for other people who may not have thought that it was possible, then it’s all worth it.”

She has been dramatically outspent by her GOP rival, businessman Rick Jackson, but is hoping her candidacy is lifted by the strength of Democratic Sen. Jon Ossoff, who even Republicans acknowledge is likely to cruise to reelection.

“I’ve never felt the level of anxiety and sadness that I feel when I’m talking to people across the state,” Bottoms said. “But along with that, there’s hope and there’s optimism that we can turn the corner.”

Jackson has assailed Bottoms’ record of running Atlanta, saying: “Bad mayors don’t make good governors.” Yet at a campaign stop this week in Cedartown, he acknowledged concerns of his own as he addressed supporters.

“This race is tied at best,” Jackson said. “The only reason we’ll lose is if rural Georgia doesn’t show up to vote.”

Jackson has vastly outspent Bottoms in the race, thanks in part to hundreds of millions of dollars of his personal fortune. Since the beginning of the 2026 election cycle, pro-Jackson advertising has dwarfed pro-Bottoms advertising, $271.5 million to $32.8 million, according to AdImpact data. That includes nearly $199 million from Jackson’s campaign, which has relentlessly attacked Bottoms on crime in Atlanta.

That margin has narrowed slightly since the end of the parties’ primaries but Jackson is still well ahead, with the Republican and his supporters spending $107.2 million since June 17 to $28.1 million from pro-Bottoms forces.

At a campaign field office on the west side of Atlanta on Tuesday, Bottoms acknowledged the wide spending disparity in the race but said former New York City Mayor Mike Bloomberg had just made a $2.5 million donation to help finance get-out-the-vote efforts in the final week. The Democratic Governors Association also made a late $5 million contribution, bringing its total to about $16 million.

“Tell people it ain’t over until it’s over,” Bottoms said. “What we don’t want to have happen is have this record, extraordinary turnout and then we get overtaken at the end on Election Day.”

Sue Ross, a retired city worker, was making calls alongside other campaign volunteers and thinking of the possibility of making history next week if Bottoms is victorious.

“It’s definitely the time,” Ross said. “We can take this state with our troubled history and move it into the future. This election is not just about Georgia, it’s also about America.”

Republicans have nominated three Black candidates in races for governor this year: Lisa Demuth, the former state House speaker, in Minnesota; Rep. John James in Michigan; and Donalds, the Trump-aligned congressman, in Florida.

Of the three, Donalds is believed to have the best chance of winning, thanks to Florida’s more favorable recent history for Republicans.

Donalds’ campaign has operated under the assumption that his historic candidacy could help him over-perform in Black communities. Shortly after winning the nomination, Donalds announced support from a coalition of African American leaders in the state, including Gainesville City Commissioner Cynthia Chestnut, a Democrat critical of her own party’s all-White ticket.

But the racial dynamics of his candidacy have also presented challenges. It didn’t go unnoticed within Donalds’ campaign that 15 of the 16 counties Donalds lost in the August primary were in the state’s deeply conservative Panhandle, where the politics more closely resemble those of neighboring Southern states. In some places, Donalds finished third, despite carrying Trump’s endorsement.

David Jolly, the Democratic nominee for Florida governor, told CNN earlier this fall that he hopes skin color doesn’t “inform people’s vote” one way or the other, though he acknowledged some Black voters may choose to be part of history. Jolly, meanwhile, has sought to portray Donalds as out of step with Black communities on issues ranging from education to criminal justice.

Donalds’ own remarks on Black history have at times drawn backlash from both parties. In 2023, he broke with Republican Gov. Ron DeSantis over new teaching standards that called for middle schoolers to learn how some African Americans benefited from slavery, sparking a heated response from DeSantis and his allies. A year later, Donalds drew ire from Democrats after claiming at a Black outreach event in Philadelphia that “during Jim Crow, the Black family was together” and “more Black people voted conservatively.”

The tensions surrounding his candidacy were on full display during a September event at Florida A&M University, a historically Black institution in Tallahassee. Facing an auditorium of skeptical students, Donalds defended his record on immigration and the Second Amendment, as well as his support for Supreme Court rulings that weakened the Voting Rights Act and taxpayer-funded vouchers for private schools — issues that have stirred particular concern in Black communities. His remarks were met at times with groans, boos and some heated objections.

Donalds nevertheless fielded questions for several hours, remaining even after a fire alarm disrupted the event. He told CNN the next day that engaging in difficult conversations could help “bring down the temperature” and “break those walls down.”

“Every room you go into isn’t going to be a lovefest,” Donalds told CNN the next day.

The outreach, though, didn’t appear to win over many students. Myia Tucker, a student at Florida A&M, said after that while Donalds’ victory would be historic, she cares more about the policies he supports.

“Two things could be true at once,” Tucker said. “While it would be progress to elect an African American governor, I think it will also show that there are still work and policies that need to be implemented that affect us all.”

Her classmate, Desmond Whitfield, put it more bluntly.

“All skin folk ain’t kinfolk,” he said. “He may look like us, but his ideologies and his culture and what we value, he doesn’t value.”

CNN’s David Wright contributed to this report.

    https://www.cnn.com/

In the closing days of the midterms, the Trump administration has sent multiple states lists of what it alleges are noncitizens on the voter rolls, intensifying its controversial efforts to stop those people from voting in the election.

In California, the administration claimed there were 20,000 people who could be noncitizens on the rolls, while in Washington state, the administration alleged this week that 400 possible noncitizen voters had voted 1,500 times in past elections. The Justice Department sent letters to both states demanding they set aside the ballots of those the department claimed could be noncitizens — and sued California when the state said that the request ran afoul of its laws.

The demands this month of California and Washington marked a significant escalation of the administration’s efforts to hunt voter fraud by creating lists of potential noncitizen voters, one of numerous ways the federal government has tried to prove President Donald Trump’s baseless claims of mass voter fraud.

The allegations have sparked questions about how the administration created its lists of voters who could be noncitizens — and criticism that its claims of tens of thousands of noncitizens voters have whittled down under scrutiny.

State election officials and election experts have questioned the validity of the data the Trump administration is relying on to make its sweeping allegations — in addition to the decision to bring these demands to the states as early voting in the midterm election is already underway.

At a district court hearing Tuesday in the California case, attorneys for the secretary of state, Los Angeles County and outside groups argued that the federal government’s data was outdated, flawed and was a “recipe for disenfranchisement” of US citizens.

“This is a deeply troubling process, that is trying to use social security numbers that they’ve glued to the voter file, to go fishing for anyone who has an alien number,” said Anna Baldwin, an attorney arguing on behalf of the League of United Latin American Citizens and NAACP.

Bill Essayli, first assistant US attorney for the Central District of California, argued that the federal government had “developed credible evidence” of noncitizens on the rolls that California refused to address.

Essayli argued that the federal government was trying to “protect votes of lawful citizens.”

While much of the case focused on whether the federal government could preempt state election law when the Constitution primarily gives the power to administer elections to the states, the circumstances surrounding how the government came up with the lists of voters were also a frequent point of contention.

Essayli offered to have the DHS officials who submitted sworn statements testify at Tuesday’s hearing to help explain the process that was used to determine the voters on the list were not citizens.

Instead, US District Judge David Carter, a Clinton appointee, said he’s appointing a special master to dig into the data provided by both the federal government and Los Angeles County, ahead of the state’s December 3 deadline to cure ballots.

Ahead of Tuesday’s hearing, a three-judge panel of the 9th Circuit US Court of Appeals rejected the Justice Department’s California lawsuit on Monday in a 2-1 decision on procedural grounds. But the two judges who sided with the state, Trump appointee Mark Bennett and Biden appointee Gabriel Sanchez, both wrote in concurring opinions they also would have ruled against DOJ.

In his opinion, Sanchez wrote that California and LA County “have expressed serious doubts about the accuracy and reliability of the United States’ data and methodology used to generate this list and contend that this extraordinary request threatens to disenfranchise thousands of California voters.”

He asked several pointed questions during Sunday’s emergency hearing about the data and list the Justice Department was using to make its claims and how the Trump administration arrived at its conclusions.

“Your claims very much depend on the reliability of that list,” Sanchez said to DOJ attorney Matthew Donnelly.

The Trump administration has claimed even larger numbers of noncitizens on state voter rolls. After Trump’s July primetime speech on election fraud, Department of Homeland Security Secretary Markwayne Mullin claimed there were more than 190,000 voters registered in California who “may be” noncitizens.

California was one of several Democratic-run states that Mullin singled out after Trump’s speech.

“We’ve identified 250,000 noncitizens registered to vote in just four states,” Mullin told reporters, citing findings in California, New Jersey, Pennsylvania and Nevada.

While Mullin stated the figures as facts, those numbers have shrunk considerably under scrutiny in the months since.

In Nevada, for instance, DHS alleged it had identified 15,903 noncitizens on the state’s voter rolls. But in a follow-up meeting, DHS officials told the state they had “confirmed” just 185 Nevada registrants as noncitizens through manual review.

Nevada election officials pushed back. “As for the 185 individuals, our records indicate that they were citizens. You have provided nothing of substance to suggest otherwise,” a Nevada official wrote to DHS last month.

Donnelly, the DOJ attorney, disputed this at Sunday’s hearing, however, saying that Nevada’s leaders were basing this solely on voters attesting they were citizens when they registered.

“That, candidly, we do not think constitutes proof that our list was invalid,” he said.

Asked about the downward shift in California from 190,000 voters to the 20,000 now being alleged, Donnelly said during Sunday’s hearing that the lower number was the result of further checks by DHS.

After a review of more than 100 million voter records across both Democratic- and Republican led states, DHS is still claiming it has found 300,000 “potential” noncitizens. As of mid-September, the agency had opened 1,620 investigations based on the review, and so far, the effort has led to around 160 arrests.

During Tuesday’s court hearing, Carter told Essayli that the government already had a way to handle noncitizens who voted. “You’ve got a remedy for goodness sakes, go out and indict,” the judge said incredulously.

A DHS spokesperson said in a statement that “190,000 remains the number of potential noncitizens registered to vote in California that DHS asked Secretary (of State Shirley) Weber to review.”

“The 20,000 referenced by DOJ is a subset of registrants that have gone through the manual verification process so far,” the spokesperson said, adding that the DHS process was a “commonsense step to secure our elections.”

DHS has been vague in correspondence to states about how it came up with its lists of voters it believes are noncitizens, but more details have emerged in the California lawsuit.

USCIS and Homeland Security investigations officials have said in court filings they obtained California’s public voter list in August 2025. While the voter list was obtained from the secretary of state’s office, DOJ redacted who specifically obtained it from the state.

The Trump administration “was supplied a list that was purchased” from California, Donelly said during Sunday’s hearing.

Earlier this year, DHS began analyzing the file, and it used a third-party system to further analyze the data and compare it to DHS immigration databases to identify potential noncitizens. Then, DHS officials say they checked the findings against federal databases and conducted manual checks of voter files.

“These processes resulted here in a culled list of people who are likely to be noncitizens and who registered to vote in the upcoming 2026 federal election,” wrote Nicolas Bartell, associated director of Fraud Detection and National Security Directorate at USCIS.

Wren Orey, managing director of the Bipartisan Policy Center’s Elections Project, said the third-party information appeared to be used to “backfill personally identifiable information based on the information on the publicly available voter list.”

“That seems to me like a big risk that they were getting high rates of false positive matches,” Orey said.

While Donnlly said he did not know the third parties used during Sunday’s 9th Circuit hearing, Bartell wrote in his declaration this week that USCIS “enhances” the voter roll data through Lexis Nexis’ Accurint, a commercial data company.

In a whistleblower report filed with Democratic Sen. Alex Padilla of California, the whistleblower alleged that certain information not included in the source data was brought in through a process referred to as “supplemental magic.”

DOJ is relying on a voter list in California that’s publicly available, because the state rejected the Justice Department’s attempt to obtain its unredacted voter file, which would contain sensitive information like Social Security numbers. DOJ has sought unredacted voter lists from nearly every state and has sued roughly 30 states that refused to turn them over but has lost every court decision on the matter so far.

Christina McCall, an attorney for the state, argued that the government’s explanation doesn’t sufficiently spell out the way that the administration compiled its data — or how it even obtained the state’s voter rolls.

“They’re not reliable, they’re vague, and they lack personal knowledge,” she said of the state’s lists of alleged noncitizen voters.

Bartell stated in his declaration that USCIS compares the data it compiles against databases from the State Department and Social Security Administration to weed out US citizens on its lists who have a passport, confirming they’re citizens, or have died.

The immigration agency then assigns a “confidence level” for each possible noncitizen match, followed by a manual review. Those cases are then referred to HSI for further investigation.

In separate litigation, which led to a federal court last week ordering DHS to stop certain investigative actions in its hunt for noncitizen voters, DOJ attorney Kelsey Helland argued that the groups suing did not have evidence that US citizens were impacted by the steps DHS took going from large list of suspected noncitizen voters to a smaller list of individuals who are investigated.

“That’s the initial step, and it goes through various sources of cross-checking databases, and there’s safeguards where USCIS officers are instructed not to keep going if it appears that a person is a citizen,” Helland said during a District Court hearing last week.

In that litigation, a redacted HSI official touched on the potential inaccuracies in the agency’s data. “When potential inaccuracies were identified in the USCIS lists, DHS sought further resources to prevent inaccuracies and developed a new model for generating leads for HSI’s unlawful voting investigations,” the official wrote.

Over the past year, DHS has also sought to identify noncitizens on voter rolls through its Systematic Alien Verification for Entitlements database — known as “SAVE” — particularly in states that voluntarily turned over their unredacted voter files. The Supreme Court allowed the federal government to continue using SAVE for its investigations last month, but DHS said that the database was not used to compile the list it sent California.

Election experts say that it’s still not clear how reliable the DHS matches may be, especially given that the Trump administration is using a publicly available voter file, not the state’s list that contains personally identifying information like Social Security numbers.

“We still don’t have all the information about what kinds of databases are used. And then more to the point, what level of matching is sufficient,” said Derek Muller, an election law professor at Notre Dame Law School.

California has argued in court filings that the DHS voter file used to compile the list of 20,000 voters it believes could be noncitizens is based on data more than a year old and could be subject to false positives.

“The Executive’s own declarations describe a bulk data match that began with a voter roster more than a year old, obtained from an unidentified source, supplemented through an unnamed commercial platform, and compared against federal databases,” Los Angeles County Registrar Dean Logan wrote in a factual declaration for the case.

“Other states’ experience confirms why such matches require investigation and individualized proof,” Logan added.

    https://www.cnn.com/

Logan’s office took a sample of 200 voters from the 7,035 names with LA County addresses. His office found that of the 200 individuals, 42.9% had canceled voter registration records and 4.6% were considered inactive, meaning they were not mailed ballots this year, Aman Bhullar, an assistant registrar/recorder who works on IT and technology, wrote in a declaration.

Bhullar said that more than 71% of the sample had never voted, and 38.9% of those who had a birthplace reported indicated they were born in the US.

In Washington state, which received the letter from the Justice Department Tuesday, the secretary of state’s office noted that one of the 400 records was from 1994. “The system the DOJ uses frequently flags legitimate U.S. citizens as noncitizens, jeopardizing their legal right to vote,” the secretary of state’s office said in a statement.

In a new court filing this week, DHS officials pushed back on California’s sample of 200 voters. Bartell wrote in a declaration that UCSIS reviewed 51 voters on the DHS list “where California’s voter roll indicates the person claimed to be born in the United States.”

“After a thorough review of the immigration records of all the individuals on the County’s Sample List, it was determined that none of the individuals USCIS matched to the County’s Sample List were born in the United States according to USCIS records,” Bartell wrote, though he acknowledged four of the voters “might have a claim to U.S. citizenship,” even though they weren’t born in the United States.

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/epstein-efta001.jpg

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/epstein-efta-sdny-cases.jpg

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/efta-pages.jpg

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/epstein-checks.jpg

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/epstein-r1-small.jpg

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/epstein-emails.jpg

Classified material missing from Epstein files, documents suggest

    2026-10-28T06:00:04-0400 / CBS News

Attorney General Todd Blanche has long maintained that the so-called Epstein files, even those kept from the public, contain no secret information related to national security.

When the document releases began last winter, Blanche noted that the Epstein Files Transparency Act authorized withholding information in the interest of national security or foreign policy, but said, “no files are being withheld or redacted on that basis.”

“There’s not some tranche of super-secret documents about Jeffrey Epstein that we’re withholding, we’re actually not withholding anything based upon [national defense information],” said Blanche, who was deputy attorney general at the time.

But the contents of at least three documents in the massive tranche of files indicate classified information was included in files collected by the DOJ.

One of the documents shows Blanche’s Office of the Deputy Attorney General itself received classified material related to Epstein in March 2025. By law, material can only be classified for national security purposes.

What exactly was classified and why remains a mystery.

The Department of Justice says it collected 6 million pages of material and ultimately released over 3 million of those pages after reviewing for duplication, attorney-client privilege and relevance to Jeffrey Epstein.

Congressional challenges and a lawsuit are casting doubts on the DOJ’s claims and demanding the release of more documents that were held back.

    Clues about classified material

Included among the Epstein files is an eight-page timeline of the FBI’s New York office’s initial efforts last year to track down and deliver its voluminous files to the Justice Department’s Washington headquarters.

On March 25, 2025, one document shows delivery of “16 Epstein items to ODAG,” referring to the Office of the Deputy Attorney General. Among them, items No. 2 and No. 6 are described as “Epstein Transparency Project – Classified Material” and “CDs with classified materials (x2).”

The Epstein Transparency Project refers to the Justice Department’s effort to review the files and redact, withhold or clear them for release. It is not clear what exactly was identified as classified. Each CD was likely capable of holding hundreds of megabytes of material.

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/epstein-list.jpg

Excerpt from a document listing “16 Epstein items” delivered to the Office of the Deputy Attorney General, including two that reference classified material. DOJ/Epstein files

Also in the files is an email sent that same day from the unit chief of the National Security Classification Operations Unit — an office whose role is to review FBI documents for classification or declassification. The email includes an attachment labeled “Epstein – Classified Document Memo.docx.”

The body of the email says there were three documents “identified that remain classified.” One was described as an “FBI document which is classified when see-through.” A redaction obscures the unit chief’s description of the other two documents.

The identity of the email’s recipient is also redacted.

It’s also not clear whether the two documents — the email and the list — are referring to the same classified material.

    Coding system reveals missing pages

A CBS News analysis of a numerical coding system used by the DOJ to organize the Epstein files offers clues about some of the documents the department has withheld.

The codes don’t reveal what’s missing, but they do show where gaps exist, raising questions about the DOJ’s explanation for why documents were withheld.

Among the missing documents are pages from Epstein’s own financial records collected as evidence in a federal prosecution.

Here’s how it works: Documents from the Epstein files are labeled with a string of numbers beginning with the letters EFTA stamped on the bottom right-hand corner; EFTA stands for Epstein Files Transparency Act.

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/epstein-efta001.jpg

An evidence photo from the Epstein files, with its number circled in red in the lower right corner. DOJ/Epstein files

Those are called Bates numbers — a common way of organizing massive document batches in legal cases. Every page receives its own number. In the Epstein files, the sequence goes from 1 to 2,858,498, which is the tally of approximately how many pages of documents were released.

According to the DOJ, other documents — including court records and investigative files they’ve previously released — bring the total to over 3 million.

Alongside the Epstein files’ Bates numbers are other, older coding numbers that appear on many documents. This indicates that those documents had previously been used in federal legal cases, potentially collected as part of an earlier subpoena.

For instance, Bates coding on some of the documents is from the Ghislaine Maxwell criminal case and was used to organize files given to Maxwell’s legal team ahead of her 2021 trial as part of the discovery process.

Other Bates numbers indicate documents were collected from Epstein’s banks, including JPMorgan and Deutsche Bank, during the FBI’s investigation into his trafficking activities.

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/epstein-efta-sdny-cases.jpg

Two examples of Bates numbers starting with “EFTA” on documents from the Epstein files. Previous “SDNY” numbers indicate they’d been used in court cases. DOJ/Epstein files

Similar gap analyses have been done in the past by independent researchers.

    Missing financial documents

Finding gaps in these documents is a simple process of counting.

In tens of thousands of instances, the main EFTA number will advance by one but the other Bates numbers advance by two or more. Those gaps indicate pages that had been there before were likely removed at some point after the DOJ obtained them.

Take the images below: The EFTA number advances by one but the JPM-SDNY and SDNY_GM numbers advance by 2, as do the page numbers from the original document.

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/efta-pages.jpg

Page numbers and previous coding suggest a gap in this document in the Epstein files. DOJ/Epstein files

In another example, a series of around 4,500 images of checks from Epstein’s accounts has gaps where 66 of those check images should be. Oftentimes the missing image is only the front or the back of the check, although in several cases both are missing.

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/epstein-checks.jpg

Images of checks from Epstein’s accounts, with X’s marking gaps in the files. DOJ/Epstein files

Comparing all of these numbers against the final EFTA page numbers, it is possible to calculate that there are tens of thousands of pages of documents that are missing from these sections, with no clear reason why.

“Financial records were not a permissible category for removal,” Barbara McQuade, the former U.S. Attorney for the Eastern District of Michigan, told CBS News.

Like every federal prosecutor, she says she is very familiar with Bates numbers. “It’s the reason you have Bates numbers, so you notice something like that,” she said.

The DOJ hasn’t responded to CBS News’ recent inquiries about the Epstein files, but it has previously said that every document required to be released by the Epstein Files Transparency Act has been released, and the remaining files were unrelated, privileged, or were duplicative.

    Email gaps

Another sequence of Bates numbers that provide a map to where documents were removed appears to be from a preliminary processing of the files.

One large sequence of those have “R1” in between EFTA and the page number.

This R1 numbering is found across approximately 995,000 released pages, between p. 61 and p. 2,214,171 in the files. Each page is also labeled with an EFTA page number.

While the EFTAs are sequential, the R1s have gaps which range from 1 page to hundreds of pages. Each time a gap appears — for example, if the EFTA advances by 1 but the R1 advances by 2 — it’s evidence that pages were removed.

By comparing these sequences it’s possible to identify gaps where documents, mostly emails, were removed between that earlier review and the final release. No partial emails turned up in the thousands of documents we examined, so the removals appear to be entire email exchanges.

Here’s what a section of that looks like:

The emails are not sequential in date and jump by days, months and years, so knowing what was removed from context is simply not possible.

But the results of calculating the differences between the first and last of the numbers in this earlier sequence versus the later sequence is 1.2 million pages, which is the total number of identified gaps from just this one section.

Most of the documents in this section are emails to or from Jeffrey Epstein, including communication with young women who would later accuse him of abuse; email exchanges with his business associates; messages to or from his assistant, Lesley Groff; or emails sent or received by Ghislaine Maxwell.

    “De-duping”

There is one possible explanation for many of the email gaps. Instructions given to DOJ attorneys working on processing the redactions state:

“If the document is an email chain and the most-inclusive email (i.e., containing all the back-and-forth) has already been reviewed and redacted as appropriate for production, the interstitial back-and-forth can be marked as duplicates.”

In other words, all emails exchanged prior to the last email in a chain can be considered a duplicate, because the last one should include all of the messages, and eliminating the duplicates will speed up the redaction process. Once a document is marked as a duplicate, it would likely be excluded from the files.

If that was the case, this was only partially accomplished because duplicate emails still exist throughout the files.

There’s also the possibility that errors in the process could have resulted in crucial emails mistakenly being deleted.

    Lack of transparency

The review and redaction process was conducted by hundreds of DOJ attorneys working under a compressed timeline. Given the scale of the task, it’s possible that pages were withheld as a result of honest mistakes. But without a roadmap to the redactions and removals, it’s impossible to make that determination.

Independent journalist Katie Phang issuing the Justice Department, seeking the release of more files as well as an explanation of redactions and removals. A federal judge has made several rulings in her favor and the DOJ is appealing those rulings.

As part of her lawsuit, Phang is asking the court to appoint a special master to review the files.

“If it wasn’t intentional, then was it gross negligence? Were you just lazy? If it was intentional then I think there’s [expletive] there that they don’t want people to see,” Phang told CBS News. “My speculation runs an entire spectrum of reaction — but at the end of the day it just makes the DOJ look bad.”

The DOJ has acknowledged making several mistakes.

It admitted to removing, and then restoring, a photo of now Commerce Secretary Howard Lutnick on a 2012 visit to Epstein’s island, contradicting claims Lutnick had previously made about his contacts with Epstein.

Last year, DOJ officials claimed a minute was missing from prison security video from the night Epstein died, which turned out to not be true.

“This is a case where the process has inhibited public trust in what is ultimately released, and there’s a long tradition of this, whether it’s the Pentagon Papers or the Epstein files,” said attorney Stanley Brand, a veteran litigator and distinguished fellow in law and government at Penn State Dickinson Law.

“This is just another piece where the government process, where making this stuff available just fuels suspicion that there’s something we’re not seeing, and I don’t know that ever gets resolved.”
