    Fired Stars and Stripes journalists sue Hegseth and Pentagon spokesperson

    Washington — Three fired Stars and Stripes journalists sued Defense Secretary Pete Hegseth and two other top Pentagon officials in federal court Thursday, claiming the Trump administration is attempting to fire them illegally as part of its “extraordinary censorship efforts” against the military news outlet.

    The plaintiffs — publisher Max Lederer, editor-in-chief Erik Slavin and reporter Lara Korte — were given separation notices last week. The cause cited was insubordination.

    They alleged that they were fired both for “speaking up as private citizens in support of the press’s freedom to cover military operations,” and because of their reporting on rough conditions aboard the USS Abraham Lincoln aircraft carrier. The lawsuit names Hegseth, Pentagon spokesman Sean Parnell and aide Andrew Brey as defendants.

    Slavin and Korte said the alleged insubordination cited in their termination notices was related to interviews they gave to CBS News for a piece on “CBS Sunday Morning” that aired in July. In the story, Korte said that she worked for Stars and Stripes, “not for the Pentagon, not for any administration, not for any policymaker.”

    More than a month later, the newspaper published a piece detailing flagging mental health and food and water shortages aboard the Lincoln, which has been deployed for nine months. A day after that story ran, the lawsuit says, the defendants “ordered plaintiff Max Lederer, Stripes’ publisher, to present notices of separation to Mr. Slavin and Ms. Korte.”

    “The notices charged them with insubordination for the statements they made five and one-half weeks earlier on ‘CBS Sunday Morning,’” the lawsuit reads.

    He did not deliver the notices. Lederer announced his intent to retire at the end of September over “fundamental” differences with the Defense Department, but the Pentagon fired him before he could.

    The three fired staffers’ complaint says they are “facing imminent retaliation and termination in violation of their First Amendment and statutory rights.”

    “This action seeks to prevent the blatant violation of the First Amendment rights of these journalists and challenges the U.S. Department of Defense’s (“DoD”) extraordinary censorship efforts in violation of both the First Amendment and DoD regulations and policies,” the lawsuit reads.

    CBS News has reached out to the Pentagon for comment.

    Stars and Stripes was first published during the Civil War, and in recent decades, the paper has prided itself on its editorial independence — meaning the federal government does not dictate what it can and can’t publish.

    Roughly half of the paper’s $29 million annual budget comes from taxpayers, a person familiar with the newspaper’s operations told CBS News last week. Readership has declined since its peaks during the Vietnam War, the Cold War and World War II, according to two U.S. officials, but an average of 1.4 million people see Stars and Stripes each day. Print editions overseas also reach service members in remote locations where internet access is spotty and unreliable.

    Earlier this year, Parnell said the Defense Department would make sweeping changes to the paper. He vowed to “modernize its operations, refocus its content away from woke distractions that syphon morale, and adapt it to serve a new generation of service members.” The Pentagon later sought to stop the paper from running syndicated articles by wire services, Slavin has said.

    Shortly after the firings, Stars and Stripes published an open letter from Navy Capt. William Urban, who said he was tapped to serve as military deputy to the publisher. Urban wrote that his priorities were to produce “the highest quality of editorially independent reporting,” while modernizing the paper and boosting its advertising revenue.

    Washington — A federal judge on Thursday pressed lawyers for Ohio Democratic Rep. Joyce Beatty and the Justice Department on new efforts by the John F. Kennedy Center for the Performing Arts’ Board of Trustees to add President Trump’s name back onto the building’s facade.

    Lawyers for Beatty, who sued last year over Mr. Trump’s changes to the Kennedy Center, argue that the board’s recent efforts to recognize the president violate federal law, and they asked U.S. District Judge Christopher Cooper to issue emergency relief blocking the changes.

    Cooper quickly convened a hearing to consider Beatty’s request but did not issue a decision. The Kennedy Center’s board has agreed not to take any action until Sept. 8, though the judge swiftly questioned Brantley Mayers, a Justice Department lawyer, as to why it had to move so soon.

    “What does that have to do with what Congress intended?” Cooper asked of the fast-approaching deadline.

    The board, which is chaired by Mr. Trump and composed of his Cabinet members and allies, approved a resolution earlier this month that calls for the inscription “Renovated and Restored by President Donald J. Trump” to be placed under the center’s name on the building and for the inscription “Endowed by the Trump Kennedy Center Fund” to be added if a $100 million fundraising threshold is met. The resolution also calls for the Kennedy Center’s grounds to be named the “President Donald J. Trump Plaza.”

    Nathaniel Zelinsky, a lawyer representing Beatty, called the board’s vote to again put Mr. Trump’s name on the center “deja vu” and an act of “outright defiance” of an order from Cooper earlier this year that barred the center’s closure and ordered Mr. Trump’s name to be removed from the building.

    “They are doing the same thing they were told they couldn’t do before,” Zelinsky said, calling the board’s move this month an “attempt to end-run your order.”

    The board voted late last year to rename the Kennedy Center to “The Donald J. Trump and John F. Kennedy Memorial Center for the Performing Arts,” and the president’s name was added to the building soon after. But construction crews removed the president’s name from the facade in June after Cooper’s ruling. Since then, the front portico of the building has been covered by a construction tarp, concealing most of its name.

    Zelinsky has said that the marble on the building was damaged as a result of the new inscription.

    But Mayers, counsel to the associate attorney general, told Cooper that the Kennedy Center is in “structural and financial disarray,” echoing assertions made in a filing Tuesday. In court papers, the Justice Department warned the performing arts institution may have to be demolished if it cannot be closed for two years for renovations.

    “There is no renaming here,” Mayers repeatedly argued in court. He said the Kennedy Center board moved to inscribe Mr. Trump’s name in the facade and plaza because of ongoing and future fundraising efforts by the president to supplement congressional funds for the center.

    “President Trump is a successful fundraiser,” Mayers said.

    The Justice Department had argued in filings that the center’s “dangerously dilapidated, outdated, and decrepit” conditions and millions of dollars in financial losses put the living memorial to President John F. Kennedy in a “financial and structural death spiral” that will require it to close for renovations.

    “Without those efforts, the Center will deteriorate further into an unsafe, decrepit structure that will be required to be taken down, with a determination to follow on what to build on the site, such as a large outdoor amphitheater overlooking the Potomac River that has been proposed, by some, for many years,” lawyers for the federal government wrote.

    But Cooper told Mayers that the claims about the physical state of the Kennedy Center were a “nonsequitur,” since he is tasked with deciding whether the board’s attempt to put Mr. Trump’s name back on the building complies with federal law.

    Still, he also questioned lawyers for both sides on whether he still has jurisdiction over the case, since the Trump administration appealed his earlier decision in favor of Beatty.

    Cooper had previously ruled that “Congress gave the Kennedy Center its name, and only Congress can change it.” He wrote then that no other individual other than Kennedy can be memorialized on the center’s front portico.

    There are no official existing plans to tear down the almost 55-year-old performing arts center. But the warning could raise the stakes in a monthslong legal dispute over the center, which Mr. Trump and his handpicked board of trustees have sought to overhaul.

    Beatty was seated next to her legal team in the courtroom. When he took the bench, Cooper joked to the congresswoman that the ongoing legal battle “may have been more than you bargained for when you joined this suit,” prompting laughter from the courtroom.

    Ahead of the hearing, Commerce Secretary Howard Lutnick said he had “no idea” whether the Trump administration has the legal authority to tear down the center, and called adding Mr. Trump’s name to parts of the center’s campus “the right thing to do.”

    “What I can’t figure out is why we’re in this courtroom,” Lutnick said.

    The secretary remained in the courtroom for the entire hearing and spoke with Justice Department attorneys during a brief break in the proceedings.

    Lutnick is not a member of the Kennedy Center’s board of trustees, but his wife, Allison, is.

    The Trump administration spent months insisting Iran did not control passage through the Strait of Hormuz.

    But after Iran and Oman unveiled a proposed framework that Tehran says would exclude military vessels if finalized, the White House would not say whether President Donald Trump would accept any restriction on U.S. warships under the arrangement.

    U.S. Central Command, meanwhile, rejected Iran’s underlying claim of authority.

    “Iran does not control the Strait of Hormuz,” CENTCOM spokesperson Capt. Tim Hawkins told Fox News Digital. “The strait is an international waterway that commercial vessels continue to transit with U.S. military assistance.”

    Fox News Digital asked whether Trump would accept a restriction on U.S. military vessels if the proposal becomes binding, whether American forces would be expected to comply and whether U.S. warships retain the right to operate in the strait regardless of any future arrangement. The White House did not respond.

    Hawkins said U.S. forces have helped nearly 1,500 vessels transit the strait since early May.

    The silence marks a shift after months in which the administration publicly challenged Iranian efforts to dictate passage through Hormuz. Secretary of State Marco Rubio repeatedly called a proposed toll system illegal and unacceptable, while Trump threatened Oman this month if it “gets in the way” of a U.S. deal with Iran.

    The administration has also spent months applying military and economic pressure aimed at reopening the strait on U.S. terms. American forces have struck Iranian military targets, protected commercial shipping and maintained a blockade of Iranian ports, while the administration expanded sanctions through its new Operation Economic Outcast campaign.

    Those measures have helped push some ships back through Hormuz, but traffic remains far below pre-war levels.

    Oil flows through the strait stood Monday at about 5 million barrels per day, down from more than 20 million barrels per day before the war, according to Reuters, which cited provisional Vortexa tracking data.

    Iran is now pursuing a reopening arrangement that, by its account, would preserve a measure of control over the waterway while excluding foreign military vessels.

    Oman and Iran announced a proposed framework Monday to reopen the strait through a joint temporary navigational corridor and a joint mine-clearing project.

    Their joint statement said technical talks would continue on a permanent corridor, future administration of the strait, traffic management and security services, leaving key terms unresolved.

    Iranian officials filled in some of those blanks Tuesday.

    Toronto Mayor Olivia Chow told CBS News that the escalating tariff fight between the U.S. and Canada is “a lose-lose situation” and “really unnecessary,” arguing the trade dispute threatens jobs in Canada and could increase prices for Americans.

    Canada’s tit-for-tat tariffs of up to 50% on $20 billion worth of American goods announced Tuesday are a dollar-for-dollar retaliation against the Trump administration’s 50% tariffs on Canadian products – the latest volley in a widening trade war.

    Chow said around 5,000 jobs in Toronto’s textile, clothing and leather manufacturing industries could be affected.

    “When that happens, it means the price of Americans buying things, the cost will go up,” Chow said.

    President Trump also announced 50% tariffs on Canadian automotive and steel imports that, absent a deal, would take effect on Jan. 1, 2027.

    “Canada has been ripping off the United States of America for years,” Mr. Trump wrote on Truth Social Monday, adding “Canada will be treated like a State no longer!”

    “We feel like we’re being bullied,” Chow said in response to Mr. Trump’s comments about making Canada the 51st U.S. state. “Being called the 51st state, it’s threatening our sovereignty as a country, and we don’t take it lightly.”

    Chow has vowed to “hit back,” in part, by encouraging her constituents to buy Canadian goods rather than American products.

    “Unless there’s a choice, we’re going to buy what is around us,” Chow said, stressing her frustrations are with the U.S. government, not the American people.

    “It’s not Americans that are hostile. It’s that president of yours that is just attacking us,” she said.

    Transportation Secretary Sean Duffy said Tuesday FAA officials are working with the Marine One team to resolve telecom issues after a loss of separation last week between President Donald Trump’s helicopter and a commercial aircraft near Reagan National Airport.

    Marine One’s crew made repeated but unsuccessful attempts to notify Reagan National Airport that President Donald Trump’s helicopter was preparing to depart Aug. 4 before it flew near a commercial passenger jet, according to a preliminary federal report released Thursday.

    The National Transportation Safety Board’s preliminary report said the crew’s first call to Reagan National’s helicopter-control frequency before departing from the Ellipse was not received. A second transmission was “broken and completely unreadable.”

    After failing to reach the tower, the Marine One crew tried to relay the required three-minute notification through the helicopter facility at Joint Base Anacostia-Bolling, but that effort was unsuccessful as well, according to the report.

    The missed warning meant Reagan National controllers did not receive notice that would have required them to stop departures before the presidential helicopter lifted off.

    Instead, Envoy Air Flight 3742, an Embraer E-170 bound for Pensacola, Florida, was cleared to take off from Runway 1 as Trump departed the White House aboard Marine One for a planned trip to Los Angeles.

    The passenger jet was beginning its initial climb as Marine One departed the Ellipse, about 2 miles north of the airport, the NTSB said.

    The FAA’s preliminary estimate found the aircraft came within about 0.82 nautical miles of one another laterally and roughly 700 feet vertically. No one was injured, neither aircraft was damaged and both flights continued without further incident.

    The Envoy flight crew said the jet’s traffic-collision system announced, “Traffic, Traffic,” as the aircraft climbed and accelerated after takeoff. The pilots did not visually spot Marine One but said the helicopter appeared to the right and below their aircraft on the cockpit display.

    The system did not issue a resolution advisory, a more urgent instruction telling pilots to climb or descend to avoid another aircraft, according to the NTSB report.

    Marine One was eventually able to contact the tower after climbing high enough to establish reliable communications. Controllers then issued a traffic advisory, and the helicopter crew immediately reported having the Envoy jet in sight, the report said.

    The newly released report also shows the communications concern had been raised just days earlier.

    On July 30, Marine Helicopter Squadron One, known as HMX-1, met with Reagan National tower staff to discuss operations in the area. During that meeting, HMX-1 told controllers that communications had been “spotty,” the NTSB said.

    Controllers had also raised concerns that HMX-1 crews had not always provided the required three-minute warning before takeoff. The two sides agreed that helicopter crews would use backup methods to reach the tower, including relaying the notification through another aircraft, if direct radio communication failed.

    That is what Marine One’s crew attempted on Aug. 4, but the message still did not get through.

    FAA technicians later determined there was not adequate line-of-sight coverage between the radio transmitter-receiver site and the Ellipse, where Marine One was temporarily operating during construction at the White House.

    The FAA subsequently moved the radios used for the airport’s helicopter-control frequency from a nearby residential neighborhood to the top of Reagan National’s control tower, according to the report.

    The agency later conducted radio checks with two HMX-1 aircraft operating near the Ellipse and reported no deficiencies after the equipment was moved.

    The FAA and NTSB began reviewing the incident earlier this month and previously characterized the event as a “momentary loss of separation.”

    “Based on our preliminary safety review, there was momentary loss of separation, after which the aircraft continued to move away from one another,” the FAA previously told Fox News Digital.

    “The air traffic controller was in contact with both the commercial pilot and Marine One pilot during the loss of separation.”

    While the aircraft were estimated to be less than 1.5 nautical miles apart horizontally, the NTSB said the preliminary estimate of 700 feet of vertical separation met the applicable FAA standard. In the relevant Class B airspace, the standard requires either 1.5 nautical miles of lateral separation or 500 feet of vertical separation.

    Officials investigating Marine One safety incident in DC

    The NTSB said it is continuing to review surveillance data to calculate and confirm the closest point between the two aircraft.

    The White House previously said Trump was never in danger.

    “Marine One flights are piloted by some of the best aviators in the world, and at no point was the president in harm’s way,” White House spokesman Kush Desai told Fox News Digital.

    The NTSB told Fox News Digital its preliminary report “is intended to present the factual information developed to date” and does not contain “analysis, conclusions, or findings related to probable cause.”

    Marine One’s warning calls before mishap went unheard by Reagan air traffic controllers, NTSB says

    Air traffic controllers in Washington and the pilots of President Trump’s helicopter met to discuss communication issues one week before a jet was allowed to take off just as Marine One left the White House, federal investigators said Thursday.

    Controllers reported not receiving the standard three-minute warning call ahead of Marine One flights and both sides agreed to an alternative in those instances — but that plan to relay the radio call through someone else was also unsuccessful on the day of the Aug. 4 incident near Ronald Reagan Washington National Airport, the National Transportation Safety Board’s preliminary report shows.

    Having both the jet and helicopter in the air at the same time seemed to violate safety procedures put in place after last year’s midair collision near the busy airport that killed 67 people, but officials stressed that the president was never in danger. The Pentagon also has a longstanding agreement with the Federal Aviation Administration to provide controllers with a three-minute warning before the president’s helicopter takes off that predates last year’s crash.

    The NTSB said recordings from the tower showed that the controllers never heard the calls from Marine One’s pilot that day warning that the helicopter was getting ready to take off, but separate recordings posted by ATC.com show the helicopter did make those calls.

    The helicopter pilots tried to relay their three-minute call through the helicopter facility at Joint Base Anacostia-Bolling, but that was also unsuccessful, the NTSB report found.

    CBS News previously reported that the Marine One pilot tried to contact the tower at Reagan three times to alert air traffic controllers that the presidential helicopter was minutes away from liftoff. The tower at one point acknowledged the communication but asked for the pilot to repeat the message because it “was broken and unreadable.”

    “Marine One flights are piloted by the finest aviators in the world, and the White House maintains the utmost confidence in these patriots and other security officials who are responsible for ensuring the President’s safety,” White House spokesman Kush Desai told CBS News in a statement in response to the NTSB’s preliminary report. “Although the President was at no point in harm’s way during the August 4th momentary loss of separation, the White House continues to work with relevant military, FAA, and other security personnel to ensure the President’s continued safety.”

    The FAA decided after an airliner collided with an Army Black Hawk helicopter on Jan. 29, 2025, that all takeoffs and landings at the airport would be halted anytime a helicopter passes by on a conflicting route. The airspace near the White House and Reagan is heavily congested with military and commercial aircraft.

    The FAA has acknowledged that the helicopter and airliner briefly got too close before the two aircraft started to move away from each other. The airplane quickly climbed above the helicopter after Marine One’s pilots saw the plane and paused until it safely left the area.

    In a statement, the FAA said Thursday it “took immediate action following the Aug. 4 incident involving Marine One, including relocating an antenna to improve communications between DCA air traffic controllers and Marine One pilots and reviewing the procedures involved. The three-minute notification was communicated by alternate means, acknowledged by a controller and positive contact was established with Marine One before takeoff.”

    The NTSB said preliminary estimates show the helicopter and plane were just over 0.8 miles apart laterally and about 700 feet apart vertically at their closest. The crew of the Envoy Air flight told investigators they received a traffic warning from their collision avoidance system right after they took off, but they never saw the helicopter.

    The official FAA recordings from the tower at Reagan did not include the warnings that Marine One was getting ready to head to Andrews Air Force Base with the president aboard that day.

    A recording posted by ATC.com showed the Marine One pilot telling the tower that the helicopter was “three minutes to life” just like the 2013 agreement between the FAA and the military calls for. But the controller seemed surprised a few minutes later when the helicopter took off.

    “Uh, Marine One, you said, uh, you’re proceeding as briefed?” the controller asked before giving the helicopter directions and commenting, “OK, no three minutes, roger, proceed as briefed.”

    After the controller warned the helicopter about the plane taking off, the Marine One pilot said he saw the traffic and declared, “We’ll be doing a momentary delay.”

    After last year’s midair collision, it became clear that poor communication between air traffic controllers and the military had been a longstanding issue. During a congressional hearing, it came out that a hotline connecting the Pentagon to the tower at Reagan hadn’t been working for more than three years, and the FAA hadn’t even realized it.

    The NTSB said that after this incident involving Marine One, FAA technicians determined that there wasn’t adequate line of sight between the radio receiver at the airport and the location where the helicopter takes off at the White House. So those radios were moved from the neighborhood where they had been located to the top of the tower at Reagan. Subsequent tests showed the radios working well after that change.
