    Washington — The Supreme Court on Monday ruled that states can count mail ballots that are cast by Election Day but arrive later, rejecting a GOP challenge to Mississippi law’s for late-arriving ballots.

    In the closely watched election dispute known as Watson v. Republican National Committee, the high court split 5 to 4 in finding that Mississippi’s measure does not conflict with federal statutes that set Election Day as the Tuesday after the first Monday in November in certain years.

    Justice Amy Coney Barrett authored the majority opinion, joined by Chief Justice John Roberts and the three liberal justices to uphold Mississippi’s law.

    “The Framers recognized the difficulty of crafting election laws ‘applicable to every probable change in the situation of the country.’ So instead of constitutionalizing election law, they decided that ‘a discretionary power over elections’ needed to be lodged ‘somewhere,’” Barrett wrote. “Suffice it to say, that power was not lodged in this Court. The election-day statutes say nothing about ballot receipt, and we cannot add to the words Congress chose.”

    With the November midterm elections just months away, the case threatened to upend similar laws in more than a dozen states that allow ballots that are postmarked by, but arrive after, Election Day to be tallied.

    Barrett wrote for the majority that federal election laws require voters to make their choice on Election Day, which happens as long as that is the deadline for voting, like it is in Mississippi.

    “But the election-day statutes do not set a deadline for ballot receipt, so they do not prevent Mississippi from counting ballots postmarked before election day yet received afterward,” she said.

    President Trump frequently criticizes mail voting, claiming without evidence that it leads to election fraud, and he has attempted to unilaterally curtail the practice. His administration backed the challenge to Mississippi’s law brought by the RNC, arguing that Election Day is the day the ballot box closes, and when election officials must have all ballots.

    In response to the Supreme Court’s decision, Mr. Trump urged Congress to pass legislation called the SAVE America Act. The bill would impose stringent voting rules, including eliminating mail ballots, with some exceptions, and set voter ID and proof-of-citizenship requirements.

    “There is no excuse for a politician, or otherwise, to be against the above three requirements,” he wrote in a Truth Social post.

    Mississippi Attorney General Lynn Fitch, a Republican, urged state lawmakers to eliminate the post-Election Day deadline for mail ballots.

    “With the bedrock constitutional principle of federalism now affirmed, I am hopeful that the Mississippi Legislature will take this opportunity to amend the law and require absentee ballots be received on the same day ballots are cast at the polling place,” she said in a statement. “President Trump is right to prioritize improving public trust in our elections.”

    All 50 states require ballots to be marked and submitted by the day of the election. But in 14 states and the District of Columbia, election officials will accept and count mail ballots that are postmarked by Election Day but received after that day. Twenty-nine states and D.C. allow at least some military and overseas ballots to be received after Election Day.

    Under the Mississippi law at issue in the case, ballots received up to five days after the election are tallied so long as they were postmarked by Election Day.

    The case is one of four involving elections that the Supreme Court heard in its current term. In January, the court revived a Republican congressman’s lawsuit that challenged Illinois’ law for counting late-arriving ballots, though its decision was procedural. The Supreme Court’s conservative majority also weakened a key provision of the Voting Rights Act, setting off a redistricting scramble in some Southern states just as primary season got underway.

    The high court is also weighing a significant campaign finance case involving the legality of federal caps on the amount of money a political committee can spend in coordination with a candidate.

    The dispute over Mississippi’s law dates back to 2024, when the Republican National Committee and Mississippi’s Libertarian Party filed lawsuits challenging the ballot-receipt deadline. The parties argued that federal statutes enacted in the 1800s, which set a uniform day for the election for president and Congress, require ballots to be received by the day.     Cook challenged Trump’s attempt to oust her in federal court, arguing that the move was unlawful and threatened the Federal Reserve’s independence. Her lawsuit, filed Aug. 28, did not address allegations that she listed two homes as a primary residence on mortgage documents.

    The allegations originated with Bill Pulte, a Trump appointee who oversees the federal agency that regulates Fannie Mae and Freddie Mac. Pulte, who is now acting Director of National Intelligence, linked Cook to the trio of properties in referrals sent to the Justice Department, which later confirmed it had opened a criminal investigation into allegations of mortgage application fraud.

    The mortgages cited in the Justice Department probe were issued in 2021, before former President Joe Biden nominated Cook to the Federal Reserve Board.

    At issue were the preferential terms that come with primary-residence loans, which lenders typically view as lower risk than mortgages for vacation homes or rental properties.

    Cook disclosed all three mortgages in a financial filing with the U.S. Office of Government Ethics in June 2025, listing them alongside her income, retirement accounts and investments.

    The filing also showed that Cook earned more than $50,000 a year in rental income from her Cambridge, Massachusetts, condominium. Pulte alleged in his DOJ referral that Cook represented the Cambridge condominium as a second home rather than an investment property, despite reporting rental income from the unit.

    Cook bought the condo in 2002 when she was a professor at Harvard University. For this property, she obtained a 15-year loan for $361,000 at a rate of 2.5% in April 2021.

    Two months later, Cook secured a mortgage for a three-bedroom home in Ann Arbor, Michigan. The 15-year loan for $203,000 at a 2.87% rate through the University of Michigan Credit Union covered the 1,800-square-foot property. At the time, she taught economics and international relations at Michigan State University, roughly an hour’s drive away.

    She also obtained a $540,000, 30-year mortgage for a luxury condo above the Four Seasons Hotel in Atlanta, Georgia.

    The loan, issued by the Bank Fund Staff Federal Credit Union, carried a 3.25% interest rate.

    In that loan agreement, Cook “affirmed that this property would serve as her primary residence within 60 days of the execution of the mortgage and would serve as her primary residence for a full year,” according to Pulte’s referral letter to the Justice Department.

    Cook has not publicly explained why both the Michigan and Georgia properties were designated as her primary residence.

    Her attorney, Abbe Lowell, denied the allegations in a Sept. 2 filing, writing that Cook “did not ever commit mortgage fraud.”

    Washington —_ The Supreme Court on Monday allowed Lisa Cook to continue in her post as a member of the Federal Reserve Board of Governors while legal proceedings over President Trump’s attempt to fire her continue.

    In a 5 to 4 decision, the high court rejected the president’s bid to allow him to oust Cook from her role as Fed governor following allegations of mortgage fraud. Mr. Trump first came to the Supreme Court for emergency relief last September, and the justices had let Cook remain in her job at the central bank while they considered whether to freeze a lower court decision that blocked her firing.

    The Supreme Court has now left that lower court decision intact while Cook’s legal challenge to her removal proceeds.

    Chief Justice John Roberts wrote the opinion for the majority, joined by Justices Sonia Sotomayor, Elena Kagan, Brett Kavanaugh and Ketanji Brown Jackson.

    To accept the government’s arguments that Mr. Trump can fire Cook “would in effect transform the Federal Reserve’s for-cause protection into at-will employment — an interpretive leap out of step with the statute Congress enacted and our Nation’s tradition of central banking protected from political interference,” the chief justice wrote.

    The court declined to define what constitutes “cause” under the federal law that created the Fed, but said such a definition must reflect the central bank’s “unique historical status and role.”

    The Supreme Court did, however, find that Mr. Trump failed to afford Cook the procedural protections that she was entitled to under the law — namely notice and the opportunity to respond to the allegations leveled against her before she was fired.

    “At minimum, Cook was entitled to some explanation of the evidence at issue, some avenue for a response, and a deadline by which a response would be due,” Roberts wrote. “Because Cook did not receive such process, her removal was ‘erroneous and void’ from the start.”

    In response to the decision, Mr. Trump wrote on Truth Social that his administration “will take appropriate action immediately to make sure that someone who has committed wrongdoing will not be making vital decisions concerning the Welfare of the United States of America!”

    Cook’s firing

    Mr. Trump moved to fire Cook from the Fed Board last August, a move that was without precedent across the central bank’s 112-year history. It came amid similar efforts to fire officials appointed by Democrats at a slew of multi-member independent agencies, and as Mr. Trump frequently voiced frustrations with the Fed’s interest rate decisions.

    The president claimed Cook made misrepresentations on mortgage filings related to two properties, one in Michigan and another in Georgia, before she was nominated to the Fed by President Joe Biden in 2021. In a letter posted to Truth Social announcing her purported firing, Mr. Trump said he had “sufficient cause” to remove Cook because of what he claimed was “deceitful and potentially criminal conduct in a financial matter.”

    Cook has denied wrongdoing and has not been charged with a crime. She swiftly filed a lawsuit to challenge her removal, arguing that Mr. Trump violated the Federal Reserve Act. That law, enacted in 1913, gives the president the authority to remove a Fed governor “for cause,” though the term is not defined.

    Cook also argued Mr. Trump’s actions violated her due process rights because she was not afforded notice of the claims against her and the opportunity to respond before she was fired.

    A federal judge ordered Cook to be reinstated and found that Mr. Trump had not validly removed her for cause. U.S. District Judge Jia Cobb also said Cook was likely to succeed on her argument that she was deprived of her due-process rights because she did not receive notice and the opportunity to be heard.

    A divided panel of three judges on the U.S. Court of Appeals for the District of Columbia continued to allow Cook to remain at the Fed. The Trump administration then turned to the Supreme Court for emergency relief.

    Unlike with officials at other independent agencies, the Supreme Court let Cook continue in her position as a Fed governor while it considered whether to grant Mr. Trump’s request to fire her. In other cases, the high court allowed the president to remove members of the National Labor Relations Board, Merit Systems Protection Board and Consumer Product Safety Commission while they pursued litigation.

    The Supreme Court also let Mr. Trump fire Rebecca Slaughter from the Federal Trade Commission and heard arguments in December over the constitutionality of a federal law that limits the president’s ability to remove members of the FTC to instances of inefficiency, neglect of duty or malfeasance in office.

    The decision from the Supreme Court came at the same time that it ruled in the president’s favor in the Slaughter case, expanding executive power over those bodies. In an opinion also authored by Roberts, the court’s conservative majority struck down removal protections for members of the FTC, a ruling that could have ramifications for similar agencies.

    The high court had indicated before that it views the Fed differently than other independent agencies. In a May 2025 decision allowing Mr. Trump to oust two members of the two labor boards, the Supreme Court singled out the central bank as a “uniquely structured, quasi-private entity that follows in the distinct historical tradition of the First and Second Banks.”

    The dispute over Cook’s firing raised concerns that a decision from the Supreme Court allowing her removal by the president would damage the Fed’s independence. Looming over the arguments in January was a Justice Department investigation into then-Fed Chairman Jerome Powell stemming from renovations to the central bank’s Washington, D.C., headquarters. Days before the Supreme Court convened to weigh Cook’s case, Powell revealed that the central bank had received grand jury subpoenas.

    A federal judge blocked the subpoenas in March and rejected Justice Department efforts to revive them in early April. U.S. Attorney Jeanine Pirro, whose office in Washington, D.C., was leading the investigation involving Powell, then announced her office would be closing the probe.

    Mr. Trump had repeatedly attacked Powell over the scope and timing of interest-rate cuts. Powell’s term as Fed chairman expired in mid-May, and Kevin Warsh took over the role shortly after.
