    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/image.jpghttps://www.foxnews.com/video/6405384566112

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/image.jpghttps://www.foxnews.com/video/6395684566112

American Muslim reformers are torching political commentator Wajahat Ali after he warned that “the fire will rise” and people will be “radicalized” if Democratic candidate Abdul El-Sayed loses his Michigan Senate bid, saying his language echoes a “Jihad First” intimidation rhetoric used by religious tyrants before elections in the Middle East.

On Monday, Ali drew fire on X when he wrote: “If, God forbid, Abdul loses, this will be a watershed moment in Democratic politics. The fire will rise. It’s over. People will be radicalized against corporate, pro-Israel Dems. There will be a reckoning. If, when, he wins, it will be a watershed moment. And that reckoning will still come.”

After facing backlash, Ali posted another message Tuesday morning, expressing no regrets and instead scolding critics for alleged bigotry. “Ah, that Islamophobia and anti-Arab bigotry are so pure and naked,” Ali wrote. “People are just coming out in the open about how they’ve always felt. Great. Please, be honest. Just share the ugliness with the world so we can all see.”

    A Fissure Among Muslims

    Reform-minded Muslim leaders aren’t buying Ali’s rhetoric.

The divide with Muslim reformers reflects a broader fissure within American Muslim politics: between establishment organizations and leaders who accept political Islam, or Islamism — the idea that religion should shape government and political life — and reform-minded critics who challenge orthodoxy, reject anti-Israel and anti-Western rhetoric and support secularism, including the separation of mosque and state.

“What Wajahat Ali said on the eve of elections is actually the language we’ve seen Islamists use before elections in countries in the Middle East, including Egypt,” Dalia Ziada, an Egyptian Muslim reformer and critic of political Islamism, told Fox News Digital.

“The threat is usually: If you don’t choose us, this will lead to radicalization, and this will lead to violence,” added Ziada, who is Washington, D.C., director at the Institute for the Study of Global Antisemitism and Policy. “Maybe we need to expect troubles coming up.”

EL-SAYED’S PAST MUSLIM BROTHERHOOD COMMENTS RAISE RED FLAGS AS HE EYES POWERFUL ROLE

Soraya Deen, a Muslim reform activist, attorney and co-founder of the Los Angeles Women’s Multifaith Alliance, said Ali’s language shouldn’t be treated as a routine social-media outburst.

“His words are deeply troubling,” Deen told Fox News Digital. “His warning that ‘the fire will rise,’ that people will be ‘radicalized,’ and that a ‘reckoning’ is coming deserves serious scrutiny.”

“Losing an election is not a license for radicalization,” added Deen, . “We must reject intimidation, political extremism and the politics of perpetual grievance.”

    ‘Jihad First’ Lens

Dr. Zuhdi Jasser, a Muslim reformer and founder of the American Islamic Forum for Democracy, said Ali’s comments reflect what he describes as a “Jihad First” lens for viewing political conflict.

“Wajahat Ali, like Abdul El-Sayed, proves yet again their decades of anti-American Islamist obsession and the ‘Jihad First’ lens through which they view every cultural, social, military and political conflict,” said Jasser, who is running for Congress as a Republican candidate in Arizona’s 4th Congressional District.

Jasser’s comments were directed at what he described as the political rhetoric surrounding El-Sayed’s campaign. The reformers didn’t accuse Ali of belonging to an Islamist organization. Their criticism focused on language they said resembles tactics used to pressure voters by warning that rejecting a candidate could produce violence or radicalization.

EL-SAYED TRIES TO MAKE PEACE WITH JEWISH DEMOCRATS BUT DRAWS LINE AT DUMPING HASAN PIKER

    El-Sayed’s Political Network

Ali’s comments came as El-Sayed’s campaign draws support from a wide network of Muslim advocacy groups, Palestinian activist organizations, progressive groups, labor organizations and political influencers.

A Fox News Digital review of campaign endorsements, public statements and voter-mobilization efforts identified 70 Muslim groups and influencers supporting El-Sayed’s political orbit one way or another. The records include formal endorsements, campaign-listed support, voter mobilization and public amplification. Not every organization has the same relationship with the campaign.

They include CAIR Action, Americans for Justice in Palestine Action, Bangladeshi Americans for Political Progress, Emgage Action and the US Campaign for Palestinian Rights. El-Sayed’s official website includes endorsements from “Muslims for Abdul,” the Yemeni American Michigan Democratic Caucus, the Michigan Bangladeshi American Democratic Caucus and Palestinian American political operative Linda Sarsour’s MPower Action, among others.

ABDUL EL-SAYED REPORTEDLY CALLED HASAN PIKER WARNING HIS RHETORIC WAS ‘COSTING’ VOTES

The broader coalition supporting El-Sayed includes Democratic Party organizations and Democratic Socialists of America chapters, as well as online commentators and political figures including Hasan Piker, Linda Sarsour, Rep. Ilhan Omar and Rep. Rashida Tlaib.

The organizations and individuals have overlapping priorities, including opposition to U.S. support for Israel, demands for an arms embargo or cease-fire, support for Palestinian activism, criticism of Democratic moderates and efforts to mobilize Muslim and progressive voters.

The coalition’s critics have described it as a “red-green” alliance involving “red” left-wing political organizations and “green” Muslim advocacy groups.

“Their red-green ‘Jihad First’ filter — threatening fire and radicalization — is simply an unmooring of their own dreams to live the jihad of Islamism and destroy the American dream and everything for which it stands,” Jasser said. “Patriotism is not in their vocabulary.”

TRUMP SAYS ISRAEL WILL STOP RECEIVING $4B IN US AID BY YEAR’S END, CAN STILL BUY WEAPONS

    A warning about political intimidation

For Ziada, the significance of Ali’s post lies in the suggestion that an election loss could trigger radicalization.

“Muslims like Wajahat Ali are just using the political movement backing Abdul El-Sayed as a staircase to bring them to the power of a chair they want to claim,” Ziada said. “Once they get there, they don’t care what they may have promised. And if they don’t get there, they will turn it into fire.”

Ziada also criticized El-Sayed’s campaign rhetoric about Israel, comparing what she described as repeated attacks on Israel to political tactics used by leaders in the Middle East. Tuesday morning, President Donald Trump announced that he would cut off $4 billion of aid to Israel, one of the network’s demands, designed to isolate the nation.

“The demonization of Israel that we saw very prominently in the campaign of El-Sayed is a tactic that we saw Middle Eastern dictators resorting to every now and then,” Ziada said.

“Whenever they are stuck with economic issues or politics, they just bring up the ‘Israel is bad’ card,” she added. “Again, he is just copying dictators in the Middle East.”

Jasser said the episode should prompt Muslim voters and Democratic leaders to examine the language used by political influencers who claim to speak for Muslim communities.

“Any honest Muslim who reads that post will see ‘Jihad First’ and everyone else be damned, including patriotic Muslims,” Jasser said.

Ali has emerged as a prominent media figure over more than two decades, writing for and appearing on outlets including The Daily Beast, The New York Times, CNN and The Guardian. He also hosted programming for Al Jazeera America.

His political activism began after the Sept. 11, 2001, terrorist attacks, when he became involved in campus protests at the University of California, Berkeley. He later worked with Democratic operative Faiz Shakir, who became campaign manager for Sen. Bernie Sanders’ 2020 presidential campaign, at the Center for American Progress, a nonprofit established by former Clinton administration chief of staff John Podesta.

Ali has continued to weigh in on Israel, Democratic Party strategy and Muslim political activism, regularly drawing fire. Earlier this year, in a broadcast with former MSNBC host Joy Reid, the two decried “weak White mean” in a heated anti-Trump rant.

Most recently, Ali hosted a speaker who criticized Democratic House Speaker Hakeem Jeffries for receiving political contributions from the American Israel Public Affairs Committee, calling him an “AIPAC monkey.” The smear drew cries of racism against Jeffries, who is Black.

Now, Muslim reformers are scolding Ali for making comments that seem to threaten voters with “fire,” a “reckoning” and a “radicalized” citizenry if his preferred candidate loses.

Deen said the response to an election should be political disagreement, not warnings of unrest.

“Losing an election is not a license for radicalization,” Deen said. “We must reject intimidation, political extremism and the politics of perpetual grievance.”

Early CNN Voter Poll results find an electorate deeply unhappy with Trump and the economy

    2026-11-03T22:12:33.268Z / CNN

Voters are broadly unhappy with the state of the nation, the condition of the economy and President Donald Trump’s job performance, according to the preliminary national results of CNN’s Voter Poll.

Roughly three-quarters of voters nationally say they feel dissatisfied or worse with the way things are going in the country, with around 4 in 10 describing themselves as angry.

There are two factors driving that unhappiness, the early results suggest: negative views of Trump and dissatisfaction with current economic conditions. How precisely those dynamics play out remains to be seen — particularly in some of the deeply Republican states that have become home to unexpectedly competitive Senate races.

Roughly 6 in 10 voters nationally disapprove of Trump’s job performance, with about half saying they disapprove strongly. About one-fifth of voters who backed Trump in 2024 now disapprove of his performance.

The share of voters who say inflation has caused them hardship is similar to where it stood in 2024. But this time, many voters lay the blame directly on Trump. Around two-thirds say they feel he has worsened economic conditions in the country, with most attributing higher costs directly to his policies, rather than factors outside of his control.

Most voters doubt that Trump has the right priorities and say he puts his own interests above those of the country. And despite the president’s exhortations to his base to vote as though he were on the ballot, less than a fifth of voters say their House vote was cast in support of Trump, with the rest saying either that they were voting in opposition to Trump or that he was not a factor in their decision.

Around three-quarters of voters call economic conditions bad, and roughly 9 in 10 say the cost of living was “crucial” or a major factor in their vote choice.

Asked to choose the most important issue facing the country, voters are most likely to say it’s the economy, followed by the state of democracy — a broad issue that often encompasses Democratic opposition to Trump. Relatively few call immigration, healthcare, foreign policy or crime their top concern.

The CNN Voter Poll, a successor to previous years’ exit polls, combines traditional in-person interviews at polling places on Election Day with tens of thousands of interviews conducted nationwide in the weeks before the election. That scope makes the polls a powerful tool for understanding the demographic profile and political views of voters in this year’s election. And their findings will eventually be weighted against the ultimate benchmark: the results of the elections themselves.

Even so, exit polls are still polls, with margins for error — which means they’re most useful when treated as estimates, rather than precise measurements. That’s particularly true for the earliest numbers, which haven’t yet been adjusted to match final election results. Learn more about how this year’s surveys were conducted here.

Many of the early Voter Poll findings align with political dynamics seen through the midterm campaign. Voters’ unhappiness with the first two years of this Trump White House go beyond economic discontent, with most saying his administration has gone too far on immigration enforcement and that the US made the wrong decision in taking military action against Iran.

Voters’ unhappy views of Washington don’t stop with the executive branch. Views of Congress and the Supreme Court are also negative, and opinions of both political parties are underwater, the GOP more deeply so than the Democrats. In the initial results, Democrats hold a slight edge over the Republicans on trust to handle the economy — a striking number, given their disadvantage on this issue in past cycles — with roughly one-fifth saying they don’t trust either party.

And voters also express pessimism about the US more broadly, with most expecting life for the next generation to be worse than life today, and only about one-third saying the economic system is fair to most Americans.

METHODOLOGY |The CNN Voter Poll conducted by SSRS was conducted from October 19-November 3, and is expected to include a representative sample of approximately 100,000 voters nationwide. The Voter Poll combines data collected from verified registered voters online and by telephone, with data collected in-person at polling locations in 15 states. Data collected before Election Day includes both pre-election and Election Day voters and has been weighted by voters’ probability of turning out. Recontact interviews were conducted among people who could not be verified as having voted prior to Election Day to confirm their choices and turnout. Respondents could complete the poll in English or Spanish. Results for the full national sample have a margin of error of plus or minus 0.6 percentage points; it is larger for subgroups and in individual states.

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/image004-10.png

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/image005-4.png

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/image007-5.png

See CBS News exit poll results for the 2026 midterm elections

By Jennifer De Pinto, Fred Backus

    Updated on: November 3, 2026 / 5:28 PM EST / CBS News

Note: Results will continue to update throughout the night.

Overview of CBS News 2026 exit polls for the midterm elections

President Trump is on track for the lowest approval rating for a president in a midterm election, according to early exit polls. Currently at 38%, it’s lower than it was during Mr. Trump’s first term, and lower than it was for George W. Bush in 2006 when his party lost both houses of Congress.

Midterm elections have often been a referendum on the sitting president, and this one is no exception. Roughly six in 10 say Mr. Trump is a factor in their vote for the House.

This is being driven largely by voters backing Democrats, who are overwhelmingly motivated by opposition to Mr. Trump.

But for those backing Republicans, it’s less about the president. Back in 2018, most Republican voters said their vote was to support Mr. Trump. That figure is lower today.

The president has often told his supporters to pretend he is on the ballot, and for many in the MAGA base, they may be doing just that. Most MAGA Republicans say their vote is to support Mr. Trump, but most non-MAGA Reps say he is not a factor.

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/image003-9.png

The mood of the electorate is a sour one

Voters are just plain not happy.

Current exit polls show roughly three-quarters of voters are at least dissatisfied with the direction of the country. More are angry now about how things are going than they were in 2024, as economic anxiety persists. Those voting for Democrats are particularly likely to be angry.

The issue of the economy and trust in Mr. Trump to fix it helped propel him to victory in 2024, but voters feel no better about the condition of the economy today.

In fact, more voters have negative views of the economy now than they did two years ago, and views of the economy are more in line with what we saw in the 2022 midterms, when the party in power lost seats.

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/image004-10.png

Cost of living: Voters are feeling the pinch

Voters are feeling it in their pocketbooks. They are more than twice as likely to say their finances are worse rather than better, based on early exit polls.

Voters across parties express concern about affording everything from gas to groceries to utilities.

For two consecutive elections, most voters have said inflation caused hardship for their family, including about one in five who describe that hardship as severe.

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/image005-4.png

All this adds up to the cost of living being a major factor for voters across parties, but it’s more crucial for those backing Democrats. Immigration enforcement is more crucial for those backing Republicans.

When voters are asked to pick their most important issue from a list, the economy comes out on top, followed by the state of democracy. Those voting for Democrats prioritize the state of democracy — an issue that has long concerned them.

For those backing Republicans, the economy is their most important issue, followed by immigration.

Voters who pick the state of democracy as their top issue are particularly likely to say government corruption is a crucial factor in their vote.

Government corruption: It’s a major factor for voters across party lines

Roughly nine in 10 voters nationally say government corruption is a major factor in their vote — about the same as cost of living — and it’s crucial to those voting for Democrats.

About six in 10 voters think President Trump puts his own personal interests over the country.

    The Iran War

While the war with Iran is less of a factor for voters than the cost of living, the conflict is not popular. Most think the U.S. made the wrong decision to take that military action, including about a quarter of Republicans.

Those most concerned about affording gas are the most likely to disagree with the decision to attack Iran.

Does all this dissatisfaction translate to satisfaction with the party out of power?

Neither political party is viewed favorably by a majority of voters.

About one in five backing Democrats for the House have an unfavorable view of the Democratic Party. Most Democrats are motivated by their opposition to Mr. Trump.

And the Democratic Party isn’t overwhelmingly seen as the party better able to handle key issues.

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/image006-4.png

    https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/image007-5.png

    Emerging issues

Data centers arose as an issue in this campaign. In all the Senate battlegrounds, majorities oppose the construction of a data center in their community.

More voters see artificial intelligence as doing more to harm society than to help it.

    Voter confidence

Large majorities of voters are at least somewhat confident that their votes will be counted accurately both nationwide and in their own states, and that eligible voters will be allowed to vote. But while they are confident in their votes being counted, those voting Republican are far less confident that people who are not eligible to vote will be prevented from voting.

This national exit poll measures the general preference for voters nationwide in their choice for the House of Representatives. The House of Representatives, of course, is elected seat by seat.

A quick note on the states

Mr. Trump’s job approval is currently underwater in nearly all the Senate battleground states, according to early exit polls, including in states that he won by double digits in 2024.

In all the Senate battlegrounds, more say their finances are worse, not better, compared to years ago.

And party control of the Senate was on the minds of voters. Majorities of those voting for Republican candidates and those voting for Democrats say which party controls the Senate was a major factor in their vote.

The CBS News exit poll interviewed thousands of voters across the country at polling locations on Election Day and in the weeks leading up to Election Day. This is how the voter polling was conducted.

Justice Department sends criminal target letters in Alaska probe to people aligned with Democratic party

The Justice Department sent target letters to more than a dozen people it believes helped recruit a Senate candidate with the same name as the Republican incumbent, in Alaska — an indication that the department is working towards bringing federal charges, according to two sources familiar with the investigation.

The recipients include the leadership of the Elias Law Group, the law firm that represents both the Democratic Senatorial Campaign Committee and the Democratic candidate Mary Peltola’s campaign, the sources said.

In a statement posted online, its chairman Marc Elias said, “No one should be surprised that President Trump’s Department of Justice is targeting me and my law firm on Election Day.

“We will not be intimidated by a sham investigation,” Elias said. “We are going to keep working around the clock to support our clients and make sure President Trump and his party enjoy a well-deserved beating at the ballot box.”

The target letters, which were largely sent to individuals aligned with the Democratic Party, are a remarkable move so close to Election Day.

Typically, the letters are sent to warn individuals that they may imminently face charges

These letters also warn that the people must preserve documents, records, and communications while the investigation continues, a law enforcement official told CNN.

Related article https://news-multimedia-1393112320.cos.ap-guangzhou.myqcloud.com/1089822-2248-r-20241209184128171.jpg Dan Sullivan, a candidate in Alaska’s US Senate race who shares a name with the incumbent seeking reelection, talks in front of a welcome sign near downtown Petersburg, Alaska, on July 3. Becky Bohrer/AP Justice Department’s Dan Sullivan criminal probe accelerates after Alaska campaign revelations 5 min read

A New York Times report alleged that Peltola’s campaign worked with senior aides at the committee — which directs the party’s campaign strategy in Senate races — to find another Dan Sullivan to stave off votes from the Republican incumbent.

The incumbent is Dan S. Sullivan. The man running against him is Daniel J. Sullivan.

The Justice Department has dramatically accelerated the criminal probe since the report, CNN previously reported.

The story provided investigators new material, US Attorney Michael Heyman said in a press conference Friday.

Heyman and other department officials say their election-related efforts in Alaska and other states are intended to safeguard votes, not sway the election as critics have alleged.

The department has also issued more than 100 grand jury subpoenas and preservation letters, one law enforcement official said, and investigators have begun conducting witness interviews.

Among those interviewed is Matthew Salisbury, a one-time candidate for the US House of Representatives. Salisbury said an operative attempted to recruit him to run as a spoiler candidate against Sen. Sullivan. Salisbury told CNN that he reached out to the bureau and was subsequently interviewed at the local field office.

He provided agents with information on the political operative who approached him in December. The interview had “no pressure, no leading questions or allusions to what they were investigating,” Salisbury said.

Salisbury did not enter the race, telling CNN that “I just felt as if this was never intended to support me. It was intended to split the ticket, and I didn’t want to be a part of that because it just didn’t feel right. It felt unethical and it felt like it would be deceptive.”

FBI agents have also begun visiting the homes of Daniel J. Sullivan’s campaign donors in the remote Alaska island he lives on, CNN previously reported. The agents are asking people if they knew which Dan Sullivan they donated to.

CNN’s Curt Devine contributed to this report.

“I have the ultimate power — it’s called ‘veto,’” President Trump told CBS News in an exclusive phone interview before polls closed across the country in this year’s midterm elections, when asked about the prospect of a Democratic-controlled Congress next year.

Mr. Trump says he is prepared to veto Democratic legislation if necessary, and he welcomes the moniker “Mr. Veto,” in terms of describing his approach to Democrats, should they win a majority in the House or Senate.

Pollsters have been predicting some GOP losses and in late October, CBS News’ polling suggested Republicans could be on track to lose control of the House.

Still, Mr. Trump remained optimistic on Tuesday when asked about the Republican Party’s chances during the phone interview. And he said that regardless of the results and the makeup of Congress next year, he feels confident about his ability to pursue his agenda in the coming two years. He remarked that recent Supreme Court decisions have empowered him and his administration to wield expansive executive powers inside the federal government even if Congress tries to block him.

In the interview, Mr. Trump cited Trump v. Slaughter , a Supreme Court decision from earlier this year that allowed him to fire Rebecca Slaughter, a member of the Federal Trade Commission, and said that 6-to-3 decision enables him to exert sweeping control over many federal agencies, boards and commissions, regardless of who holds majorities in the House and Senate.

“We won the Slaughter case and the Slaughter case gives the president tremendous powers that it never had before,” Mr. Trump said.

The president said that he plans to move forward his agenda next year in numerous federal areas with this ruling as part of the foundation for his coming executive actions.

“The presidency, our presidency, is considered a strong presidency. You can do a lot,” Mr. Trump said.

Mr. Trump also believes his veto power could eventually force Democrats to cut bipartisan deals with him, should they make gains.

“Historically, you veto for a couple of months and then they come and say, ‘We’ve got to make a deal,’” Mr. Trump said.

Mr. Trump’s comments signal that there will likely be a dramatic showdown between the executive branch and Congress next year, should Democrats win majorities in each respective chamber, and he asserted that he could ramp up his use of executive power if Democrats try to constrain him on Capitol Hill.

Two people close to Mr. Trump, who requested anonymity to discuss private conversations, said discussions over executive actions have taken place at the White House in recent weeks, with deputy chief of staff Stephen Miller and Office of Management and Budget Director Russell Vought central figures in those talks. The range of issues being considered for further executive action includes immigration and trade, the people said.

One person close to the president said that “while Democrats may win power,” Mr. Trump will “keep the power to do almost everything he wants” next year on trade, the border, managing the federal government and handling U.S. foreign policy and national security.

Regarding the midterm elections, Mr. Trump said he believes he did everything he could to help Republicans across the country in recent weeks, and said his efforts helped to recast the elections as a possible blue wave into something more competitive.

“If you remember, about 30, 40 days ago, people were saying it’s going to be a big loss, and now people are talking about, like we could even win it,” Mr. Trump said. “I think the tour made a big difference. I did 29 days, 33 of these things, and they were all massive rallies, they were big rallies. No one has ever done anything like it. And I think we got the word out. I think we got the enthusiasm out, too.”

When asked about his motivation for his extensive tour of campaign stops, Mr. Trump said, “I just think that we’re doing so well that I didn’t want to see anything get in the way of what we’ve done,” and he argued that the passage of last year’s One Big Beautiful Bill Act and his efforts on trade are driving growth in different economic sectors.

The president did not make any firm predictions about Tuesday’s outcome.

“We’ll have to see,” Mr. Trump said, noting that most Election Days come with surprises and unforeseen developments. “Will we win? We have a good chance. But we’re not going to be embarrassed.”

Mr. Trump spent part of Monday delivering a speech in front of the Lincoln Memorial Reflecting Pool in Washington, D.C., where he talked at length about his push to renovate, clean or rebuild key structures at the White House and around the capital.

In the Tuesday interview, Mr. Trump said his speech was part of his desire to show the American people that he is using skills as a lifelong developer to redevelop Washington for their use.

“Obama criticized me,” Mr. Trump said, referring to former President Barack Obama’s criticism of Mr. Trump’s activity. “But we had broken windows by the front door” at the White House, he said, and “it was such a sad thing to look at.”

“It’s the White House,” Mr. Trump said. “You can’t have an area where the stone is cracked and half-falling off the side of the wall. And I fixed it. You know, I’m very good at that.”

“I actually enjoy doing it,” Mr. Trump said. “A lot of people, that doesn’t relax them, it makes them crazy, but with me, it relaxes me because I really do it well, and the White House is now pristine.”

When asked about what his focus is for 2027, in terms of renovations in and around Washington, the president said he expects to finish the new ballroom at the White House and to begin work on his proposed 250-foot arch, which has faced legal challenges.

“I’ll be finishing that,” Mr. Trump said of the ballroom. “It’s a ballroom and military complex.” As for the arch, “We hopefully will be starting that.”

“It’s a celebration of success,” Mr. Trump said of the planned arch.

“I do that stuff, it’s fun for me, but it’s important,” Mr. Trump said of his many building initiatives, and he framed his projects as a larger attempt to spruce up the country.

“We had 97 places where we had ‘S-G,’ which means ‘serious graffiti,’” Mr. Trump said of his administration’s cleanup of Washington, D.C. “Ninety-seven places, like at the base of the Supreme Court.”

As for his own political future, Mr. Trump said he is not yet talking with his advisers about pursuing a potential 2028 campaign, which would face steep constitutional and legal hurdles, and, for now, said the GOP has a “very good bench” of possible candidates.

LISTEN LIVE: Supreme Court hears Catholic preschool religious liberty case

The Supreme Court hears arguments over Colorado’s preschool funding program and religious discrimination claims.

NEW You can now listen to Fox News articles!

The Supreme Court’s conservative majority offered clear support Tuesday for Catholic preschools that claim Colorado’s taxpayer-funded program improperly excludes them by unconstitutionally intruding on their religious rights.

At issue is whether those private education institutions that deny admission to children of LGBTQ+ parents violate state anti-discrimination laws, and can therefore be denied a generally applicable public benefit.

It is the latest high-profile religious rights appeal to reach the high court in recent years, several of them originating from Colorado.

CATHOLIC SCHOOLS, BANNED RIFLES AND ‘CLIMATE LAWFARE’: BLOCKBUSTER FIGHTS AWAIT SUPREME COURT

In a lively two-hour oral argument, the justices debated competing interests involving both religious liberty and a state’s interest in ensuring equal opportunity for gay and lesbian parents.

“I’m hard-pressed to think that, given those [Catholic] teachings, that any homosexual family is going to choose to go to one of these schools, but that should be their choice, not your choice to exclude them,” said Justice Sonia Sotomayor to the lawyer for the plaintiffs. “That’s what you’re asking for… You want an official statement by the State that I will subsidize you with public money even though – because I have a right to reject children.”

ANDREA PICCIOTTI-BAYER: COLORADO’S UNIVERSAL PRESCHOOL REVIVES VILE ANTI-CATHOLIC LAWS

But Justice Brett Kavanaugh said the state’s motives, however well-intentioned, are promoting a kind of conformity that is not constitutionally permissible.

“Why not seek the win/win?” Kavanaugh asked the attorney for the state. “There are plenty of opportunities to respect the rights of the religious believers and respect the ability of LGBT parents to find among the 2,000 [Colorado] schools an appropriate fit for their children.

“It seems like this is a would-be solution in search of a problem that is unnecessary to create this clash,” he added. “There’s an ability for everyone to go to the school, a good school that’s a fit for them, and respect religious rights.”

Colorado established a Universal Preschool Program (UPK) in a 2020 ballot measure, distributing public funds for participating schools, with the requirement they “provide eligible children an equal opportunity to enroll and receive preschool services regardless of race, ethnicity, religious affiliation, sexual orientation, gender identity, lack of housing, income level, or disability.”

Two Catholic parishes sued, arguing the policy targets their sincerely held beliefs about same-sex marriage.

The archdiocese in the state manages 34 preschools, with a policy to only admit students from families who support Catholic ideology, including on same-sex relationships and gender identity.

They seek exemptions to the Colorado law, arguing their exclusion is a form of religious discrimination in violation of the First Amendment.

The Trump administration has signaled its support of the religious plaintiffs.

The state counters its public benefit conditions are neutral and generally applied to every preschool.

It provides a $6,300 annual benefit per child for up to 15 hours a week of preschool, with money coming from a tobacco tax.

Officials told the nine-member bench that religious schools are free to participate but must abide by nondiscrimination laws, similar to those affecting low-income and disabled students.

As part of its review of the Colorado dispute, the high court will decide whether to narrow a 36-year-old precedent that religious practices do not create exemptions from broadly applicable laws.

The First Amendment states, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.”

The Supreme Court in prior decades had focused on the first part, ensuring a constitutional separation of church and state, when disputes over religious rights reached the public sphere.

But the current conservative bench in the past few years — led by Justice Samuel Alito — has trended toward favoring religious institutions raising “free exercise” claims.

The justices have separately backed a Colorado baker, mental health counselor and website developer, who all challenged the state’s anti-discrimination policies.

The oral arguments Tuesday seemed to divide along ideological lines.

Conservative justices focused on the “free exercise” claims by the Catholic parishes that state requirements for receiving public benefits amounted to religious discrimination.

“Explain what the difference is between [explicitly excluding Catholic schools] and then choosing to impose a condition that you know that those schools will be unable to agree to?” said Justice Amy Coney Barrett.

But Justice Elena Kagan cited the court’s prior cases, which she said affirmed the idea “you can’t treat religious institutions differently.”

“That’s not the principle that’s at issue here,” Kagan said. “The principle at issue here is: Do you have to treat them better?”

Chief Justice John Roberts asked tough questions of both sides and his vote could prove determinative. At one point, he expressed skepticism that recent rulings favoring the rights of religious schools over similar claims should also prevail in the current petition.

“The law in those cases, in each of them, expressly discriminated against religious schools on its face,” Roberts told Reaves. “That’s not the case here,” suggesting Colorado’s law may be applied fairly across the board.

The current dispute was brought by plaintiffs including St. Mary Catholic School.

Erika Nagle, whose children attend the Littleton facility, told Fox News Digital that two of her children were denied access to the state’s preschool funding program, leaving her family to cover additional education expenses.

“We are being excluded from this benefit because we are Catholic,” Nagle said in an interview with Fox News Digital. “And so in a state that preaches inclusion, they are actively going out of their way to exclude a huge chunk of people because of our religious beliefs.

“We have had two preschools in the archdiocese that have been closed down,” she added. “The state is dangling a carrot over here, incentivizing people to leave their faith, to abandon the Catholic education that they want.”

The Becket Fund for Religious Liberty represented the plaintiffs in court, arguing the state’s policies are having severe consequences, with enrollment at archdiocesan preschools falling 20% and two schools shuttered.

The state counters that religious entities like Catholic Charities, at least three dozen Christian schools, one Muslim and three Jewish schools continue to participate in the preschool funding program.

“Colorado welcomes religious preschools” to its program, state attorney Helen Norton told the high court. “The only thing Colorado asks is that they comply with the same conditions that every publicly funded preschool must meet, religious and secular alike.”

The case is St. Mary Catholic Parish v. Roy (25-581), with a ruling expected by next spring.
