Brett Kavanaugh, President Donald Trump’s “hero” Supreme Court justice, isn’t closing the door on the United States Postal Service (USPS) enacting Trump’s ballot-mail rules in the future, although he agreed with the majority that implementing them ahead of the 2026 midterm elections is too soon.

“In my view, based on the briefing the Court has received at this interim stage, there is at least a fair prospect that the final rule falls within the Postal Service’s statutory authority,” Kavanaugh wrote in his concurring opinion in United States Postal Service, et al. v. California, et al.

The concurrence comes roughly three months after Kavanaugh laid out a legal pathway for Trump to implement his executive order curtailing birthright citizenship in his concurrence in Trump v. Barbara. Kavanaugh also offered a blueprint for implementing Trump’s sweeping tariffs in his dissent in Learning Resources, Inc. v. Trump.

“I would note though that Justice Kavanaugh threw the government a lifeline by saying that he views it as likely that they do have the statutory authority. And I think if you read the dissent, you can see where Justices Thomas and Alito are on questions like that as well,” Jason Snead, executive director of Honest Elections Project, told Fox News Digital.

The Supreme Court on Monday denied the Trump administration’s emergency request to lift a lower court injunction blocking the U.S. Postal Service rule, ruling that the government was “unlikely to succeed on the merits” of its challenge.

The decision leaves the rule blocked for the 2026 midterms after ballots have already been sent. But as the litigation continues, the case could return to the Supreme Court.

“I think there’s a fair chance that it winds back up in front of the Supreme Court eventually,” Snead told Fox News Digital.

A dissent written by Justice Samuel Alito and joined by Justice Clarence Thomas also raised questions about whether the policy could ultimately survive the legal challenge and take effect before 2028.

“I do think that as a practical matter, the rule is not going to be implemented in time for the midterms. I think that’s a done deal at this point. But I do hold out hope that there will be some additional litigation over this that could allow this rule to be implementing ahead of the 2028 presidential election,” Snead said.

The Postal Service rule requires federal ballot-mail envelopes to include an election-mail logo, be scannable by high-speed processing equipment, and carry a specialized barcode unique to each voter. States would also have to upload certain voter information to a Postal Service portal.

A coalition of 24 Democratic state attorneys general sued the Trump administration, alleging the rule violates the Constitution’s Elections Clause, which grants Congress the power to regulate elections. The Trump administration argued the USPS is regulating the mail, not election procedures.

“So this case is still alive and well, and I think that Kavanaugh has given us all some hope that as it progresses eventually, this rule might be allowed to go into effect hopefully in time for the 2028 election since the left has successfully killed it for 2026,” Snead continued.

Iowa Solicitor General Eric Wessan also pointed to timing as a major factor, noting that earlier litigation and an injunction in Massachusetts delayed the Postal Service’s ability to publish the final rule.

“So I’m not surprised now, close to the deadline when ballots have to go out to people that the Supreme Court took the approach of maintaining the status quo, although I think that Justice Alito’s dissent highlights a lot of issues with the approach taken by the majority, and I would not be sure that the same result would be what the Supreme Court reaches in advance of, for example, the 2028 election,” Wessan said.

Alito, joined by Justice Clarence Thomas, dissented, arguing that the government had made the necessary showing for a stay. He also questioned whether some plaintiffs had standing and described that those plaintiffs relying on a “Hail Mary pass” the Supreme Court has previously said “rarely succeeds.”

“The hail mary passes seem to be succeeding to a certain extent,” Wessan said. “So the president’s executive order was issued five months ago, and the injunction followed pretty shortly after. And as the Supreme Court recognized in the litigation earlier, that injunction against the executive order was improper.”

“But the amount of time that it took to get that resolved by the Supreme Court put the Postal Service in a very tough spot timing-wise with rolling it out for the election coming up in November, especially because states are on the verge of having to send ballots out, whether to the armed services or otherwise,” Wessan continued.

Abhishek Kambil said the lack of a fuller explanation from the court’s majority stood out to him.

“I think the biggest surprise was the fact that it came with an unreasoned order, especially right after they granted a stay in Missouri, which was also on an unreasoned order. So, in cases like this, where there’s a lot at stake, you would hope that in a stay opinion that the Supreme Court would explain its reasoning,” Kambil said.

“So, I think the biggest thing that surprised me was the lack of explanation, especially given Justice Alito had a pretty methodical dissent explaining all the ways the majority got wrong, and we don’t know exactly how the majority decided to deny the stay,” Kambil told Fox News Digital.

Wessan said that he expects the rule to remain sidelined this year while leaving open the possibility of a different outcome later.

“This rule won’t be in effect for the 2026 election, but it very well may end up in effect for the 2028 election, and this is just one of many actions the administration is taking to help with voter integrity,” Wessan said.

Snead argued that without a looming election, Democratic states may have a tougher time fighting against implementing the USPS rules.

“So they’re going to have a difficult time and a steeper hill to climb if they’re trying to explain in 2027, for instance, why they can’t possibly comply with basic rules like this over a two-year time frame,” Snead told Fox News Digital. “And just so folks understand what we’re talking about. We’re talking about taking best practices about mail ballot envelope design that have been long-standing and making that mandatory guidance.”

“And we’re also talking about getting lists of eligible mail voters that states already have so that the Postal Service can essentially create manifests and that will allow them to know who they’re sending ballots to, and it will allow those ballots to be tracked. So this is a very basic, very simple thing,” Snead continued.

The Trump administration is preparing a $2.8 billion military aid package for Israel that would include 40,000 heavy bombs, according to multiple reports. It would be the largest proposed transfer of the powerful munitions to Israel in recent years, if it clears Congress.

The proposed package includes 20,000 unguided bombs designed to destroy buildings and bunkers, known as MK-84 bombs, and 20,000 BLU-117 bombs, which are warhead versions fitted with precision-guidance kits — both bombs are 2,000 pounds per unit. Additionally, according to Reuters and The Washington Post, the proposal includes 20,000 much-tougher I-2000 penetrator warheads, which are designed to penetrate concrete or underground facilities before exploding.

The package, which is not yet final, has been informally communicated to congressional committees that review major U.S. arms sales — and it’s already drawing opposition from Democratic lawmakers.

Sen. Bernie Sanders, I-Vt., is calling on Congress to reject the White House’s proposal, and Sen. Chris Van Hollen, D-Md., vowed that lawmakers will “work to stop it.”

“The American people are sick and tired of funding Israel’s genocide in Gaza,” Sanders wrote on social media, accusing the Trump administration of “doubling down” by providing $2.8 billion in bombs to the Israeli government.

“Not acceptable. Congress must reject these agreements.”

Van Hollen similarly criticized the proposed package and its use of U.S. taxpayer funds, writing, “How is this America First? We will work to stop it.”

The State Department did not respond to Fox News Digital’s request for comment. Israel’s Ministry of Defense declined to weigh in.

“All foreign arms sales are moving through the appropriate process. We do not comment on pending sales,” a senior administration official told Fox News Digital.

Most of the package would be financed through Foreign Military Financing, which uses congressionally appropriated U.S. funds for eligible allies to purchase American-made defense equipment.

If completed, the package would be the largest single sale of 2,000-pound bombs to Israel in recent years. It would exceed a 2025 sale that included more than 35,500 of the bombs. The Trump administration approved that nearly $3 billion sale after bypassing the normal congressional review process.

It’s unclear whether that bypass could or will be used again this time around.

The weapons were at the center of a previous U.S. policy dispute, as well.

During President Joe Biden’s term, his administration paused a shipment of 2,000-pound bombs to Israel in 2024 over concerns of the potential for mass casualties in densely populated Gaza. President Donald Trump lifted that hold after returning to office.

The 2,000-pound bombs have multiple variants designed for different targets, including hardened and underground structures.

Israel has used U.S.-made heavy munitions during its military operations in Gaza and Lebanon, while the United States has used similar weapons against hardened targets in previous conflicts.

The proposed transfer comes as Israel remains engaged on multiple fronts.

Israeli forces have continued strikes against Hamas in Gaza despite a fragile ceasefire, while tensions with Hezbollah persist following fighting in Lebanon.

The United States and Israel also conducted military operations against Iran earlier this year.

Informal congressional notification allows relevant committees to review a proposed transfer before the administration proceeds to formal notification.

Virginia’s data center boom saves homeowners thousands on property taxes, expert says

Tax Foundation senior fellow Jared Walczak explains how data centers transformed Loudoun County’s tax base, helping fund schools and infrastructure while keeping homeowners’ property tax bills lower.

Billions in build-outs of facilities to support the artificial intelligence (AI) boom have become a lightning rod in communities across America, but homeowners in the nation’s data center capital are seeing a surprising payoff — thousands of dollars in property tax relief.

The massive projects have emerged as an issue in the 2026 midterm elections, as voters raise concerns about electricity costs, water use, land development and the strain on local infrastructure. Opposition has crossed party lines, forcing candidates to confront an industry that state and local governments spent years courting.

Yet just outside Washington, D.C., the richest U.S. enclave of Loudoun County, Virginia, offers a striking case study of the industry’s economic upside.

Home to the sprawling tech corridor known as “Data Center Alley,” Loudoun has the highest concentration of data centers in the world. Decades of development have transformed the county’s landscape and dramatically expanded its tax base, offering a real-world look at the financial benefits proponents say the industry can bring to local communities.

“Loudoun County has more data centers than anywhere else in the country. It’s been sort of the capital of data center development for decades,” Jared Walczak, vice president of state projects at the Tax Foundation, told Fox News Digital.

“And because of that, Loudoun County property taxes are about half of what they would be without data centers. In fact, data centers provide about 45% of all local tax revenue to Loudoun County, not just property taxes, but all local tax revenue.”

Walczak said the impact translates into significant savings for individual homeowners.

“The average homeowner would pay $5,800 more a year in property taxes if you didn’t have data center development,” he said, noting that data centers occupy only about 3% of the county’s land.

But the rapid expansion of data centers has also fueled concerns that their enormous electricity demands could leave residents footing a higher utility bill, potentially offsetting some of those savings.

Walczak pushed back on that worry, arguing the industry’s impact on homeowners’ property taxes is clearer.

“The property tax relief is real, measurable, and significant,” he said. “The energy costs are largely a solved problem.”

Walczak told Fox News Digital that the increased demand could require utilities to build new generation and transmission infrastructure, while adding more customers and electricity usage can also spread the grid’s fixed costs across a larger base.

The critical question, he said, is who pays for the additional infrastructure.

“You pay for the additional generation and transmission capacity. The data center pays for that,” Walczak said. “And then you actually see a slight reduction in energy costs for everyone.”

He pointed again to Northern Virginia, arguing that its experience challenges fears that a heavy concentration of data centers inevitably translates into higher electricity prices for residents.

“If you look at the places with the largest data center development, you actually see declines in energy prices relative to the rest of the country,” Walczak said. “You look at Northern Virginia, it has lower energy prices.”

WASHINGTON, Sept 17 (Reuters) – A key Senate Democrat has asked Secretary of State Marco Rubio to ensure that U.S. diplomats are involved in a Pentagon-led review of America’s military presence in Europe ​that has alarmed NATO allies.

In a letter addressed to Rubio, who is also the national ‌security advisor, Senator Jeanne Shaheen, the top Democrat on the Senate Foreign Relations Committee, wrote that diplomats, including U.S. ambassadors in potentially affected countries, are being kept out of the loop. The letter was first shared with Reuters.

The review, ​which began in June and is due to conclude by the end of the year, is ​part of a push by the Trump administration to have Europe rely less ⁠on the United States and instead take more responsibility for its own defense.

The U.S. has around ​80,000 troops stationed in Europe.

“The Department of State, which is responsible for managing our bilateral relationships, has traditionally ​played a substantial role in reviews of this kind,” read the letter.

“Yet what we are hearing through our own conversations, travel across Europe and engagement with our Allies tells a different story. U.S. Ambassadors and Chiefs of Mission in ​affected countries have been excluded from consultations.”

The Europe force posture review is being handled almost exclusively by ​the Department of Defense, with Pentagon policy chief Elbridge Colby taking a leading role.

The Trump administration has frequently excluded State ‌Department ⁠personnel from policy debates relevant to their portfolios, sources have told Reuters. They declined to be named due to the sensitivity of the issue.

Advocates of that approach say that, by keeping decision-making circles small, the administration can move quickly while minimizing leaks. Opponents say it means weighty decisions are made without ​sufficient input from experts and ​allies.

The Pentagon, State ⁠Department and White House did not immediately respond to requests for comment.

Shaheen wrote that adjustments in troop levels would have an effect on bilateral relationships that ​the State Department would be left to manage, with the Baltic nations ​of Estonia, Lithuania ⁠and Latvia among the countries with the most at stake.

“Even changes that may appear modest from a purely military standpoint can have outsized effects on our bilateral relationships, particularly with Baltic Allies, as Russia continues ⁠to intensify ​its hybrid actions along NATO’s eastern flank,” read the letter.

European ​leaders have warned of hybrid incidents, often attributed to Russia, that fall below the threshold of conventional military attacks but undermine European security — ​such as sabotage, arson and drone incursions.

I slept in the room where Lizzie Borden’s stepmother was murdered. Here’s what I discovered.

You can’t get much closer to a murder case than actually sleeping at the crime scene in the very bedroom where the crime occurred. That’s exactly what “48 Hours” did in the summer of 2019.

A brave team of “48 Hours” producers and I decided to take a trip to Fall River, Massachusetts, to spend the night in the house where, on August 4, 1892, 70-year-old Andrew Borden and his wife, 64-year-old Abby Borden, were found hacked to death.

The prime suspect in the murders: Andrew’s 32-year-old daughter, Lizzie Borden.

It’s easy to understand why Lizzie became the main suspect. She was at home at the time of the murders, which took place in the middle of the day. Lizzie also had a strained relationship with Abby, her dad’s second wife and her stepmother.

The deaths were so violent that investigators believed the killer was someone who knew and hated the couple. What’s more, the murder weapon was believed to be a small hatchet found in the basement. And yet, despite overwhelming evidence that pointed to Lizzie as the killer, a year later, following a high-profile two-week trial, an all-male jury, deliberating for a little more than an hour, decided to acquit her.

We went back to the scene to try to determine what happened.

We certainly aren’t the first people to try to solve the case that remains such a tantalizing mystery to this day. Lizzie Borden has inspired countless books, films and even a nursery rhyme: “Lizzie Borden took an ax and gave her mother 40 whacks. When she saw what she had done, she gave her father 41.” This week, “Monster: The Lizzie Borden Story,” a part of Ryan Murphy and Ian Brennan’s true-crime anthology series, premieres on Netflix.

We now know that the murder weapon wasn’t an ax and Abby was actually stabbed fewer than a dozen times, but that doesn’t diminish the brutality of these murders that still resonate more than a century later.

The green-frame house on Second Street, more than 180 years old, has been restored and is now known as the Lizzie Borden House and Museum. It operates as a Bed and Breakfast and is advertised to a very select clientele since the house is filled with macabre black and white photos, including actual crime scene photos of Abby’s Borden’s body on the floor of an upstairs bedroom.

It’s in that bedroom where I decided to spend the night. After all, if the house is haunted as its current owners suggest, maybe Abby would appear and give me the interview of an “after-lifetime.”

Why revisit a crime scene nearly 135 years later? One question I had, after reading what Lizzie told investigators, was why Lizzie, who said she had been on the first floor, didn’t hear anything when her stepmother Abby was attacked upstairs. And walking through the house today made that statement seem even less likely. The walls and floors of the house are thin and the dining room, where Lizzie says she was, is located directly below Abby’s bedroom. It seems difficult to believe that Abby didn’t cry out when she was attacked.

And when you see how small the house actually is, you wonder how anyone could have killed Andrew and Abby without leaving a blood trail or blood spatter. If Lizzie used a hatchet to kill her parents, how did she manage to do it without a drip of blood left on her dress? There was testimony that she may have destroyed a dress, but the murders were reported quickly. How could she have changed clothes and cleaned up?

I was wrestling with those questions when it was time to go to bed. After my colleagues had gone to sleep in various rooms in the house, I settled into the second floor front bedroom, Abby’s room. Right beside the bed was the area where her bloodied body had been found. I went to bed in running gear, in the event I wanted to make a quick exit, but I am sorry to report that I slept undisturbed the entire night.

Forensic science was very rudimentary back then. Today, investigators would have sealed the scene immediately and would have been able to recover even the tiniest traces of blood, if any existed, on Lizzie Borden’s clothing. And it’s likely that today, modern jurors would have looked at the case and the defendant very differently. In 1893, 12 men found it difficult to believe an affluent, educated single woman was capable of such heinous acts. They let her walk free.

The House Democrats’ campaign arm is embracing a far-left candidate with a long trail of controversial and inflammatory comments — along with an arrest record — who won their party’s nomination in a crucial congressional swing district in battleground Michigan, after holding off on helping him for over a month.

The Democratic Congressional Campaign Committee (DCCC) this week expanded its target list of GOP-controlled House seats it is aiming to flip as Democrats work to recapture control of the chamber in the midterm elections. One of the three candidates added to the committee’s “Red to Blue” program is Will Lawrence of Michigan.

Lawrence was arrested in 2013 on charges of resisting police during a protest. Documents obtained by Fox News showed Lawrence was charged with trespassing and with resisting and obstructing an officer. He has said the conviction was later expunged.

Lawrence has also deleted hundreds of past controversial social media posts, including support for scrapping police and prisons, open borders, abolishing the Senate, calling for a Democratic Party “civil war” and bashing the nuclear family, which he characterized as part of a “violent way of organizing society.”

A former Democratic Socialists of America (DSA) member who says he let his membership lapse, Lawrence has walked back many of his previous statements, including once calling for defunding the police.

He told Fox News Digital in a statement last month, “I don’t support defunding the police. I follow the lead of first responders and gun violence prevention advocates I have met with here in the district, who support increased funding for youth programs, mental health resources, and community violence intervention, working in collaboration with law enforcement.”

Lawrence has also distanced himself from some of his other comments, telling CNN, “Like many millennials, I’ve done my fair share of thinking out loud on the internet.”

Lawrence, a co-founder of the progressive Sunrise Movement, topped two establishment-backed rivals in last month’s Democratic primary in Michigan, in a heated nomination showdown that further fueled the party’s civil war between the far-left and the center-left.

He’s now challenging first-term Republican Rep. Tom Barrett in Michigan’s 7th Congressional District, a Lansing-anchored seat that President Donald Trump carried by just one point in the 2024 election.

Lawrence’s addition to the DCCC program came more than a month after his primary victory. That’s not out of the ordinary, as the DCCC and the rival National Republican Congressional Committee (NRCC) sometimes take a few weeks before elevating primary winners, as they consider polling, fundraising and other considerations.

But Democratic sources told Fox News Digital that some progressives had grown frustrated with the delay. The DCCC waited, in part, out of deference to Congressional Black Caucus (CBC) leaders, according to a CNN report, as Lawrence faced criticism over past comments about Black politicians.

The CBC has yet to endorse Lawrence, in part because of his 2024 podcast comments criticizing Black political leaders, calling them a “pillar” of the “capitalist, imperialist” American establishment. Lawrence has apologized for those comments and for also charging that Black political leaders “defang the White left.”

Fox News Digital reached out to the CBC, but didn’t receive a response at the time this article was posted.

Adding Lawrence to the DCCC list is getting some pushback by centrist Democrats.

“I think they waited so long because he is a pretty far-left candidate running in a swing district that is currently held by a Republican, and two, he has said something very, very controversial about African Americans and that’s not a great combination when you’re trying to win a swing district,” Matt Bennett, co-founder and executive vice president of the Democratic centrist think tank Third Way, told Fox News Digital.

“It could further exacerbate tensions within the party” if Lawrence hasn’t been able to patch up his relationship with the CBC, Bennett added.

In making her announcement on Tuesday, DCCC Chair Rep. Suzan DelBene said that Lawrence and the two other candidates added to the “Red to Blue” program, Democrat Mitchell Berman of Wisconsin and independent Bill Hill of Alaska, “represent the very best of their communities — unbought, practical leaders who know what it takes to win in tough districts.”

“While Tom Barrett sides with Trump and the corporate special interests, Will Lawrence sides with the people. He stands up to anyone trying to take advantage of Michigan, and in Congress he’ll keep fighting to give the community that raised him a fair shot,” DelBene added.

But NRCC Spokesman Zach Bannon pilloried the move by the DCCC to add Lawrence to its list.

“D.C. Democrats are embracing Socialist William Lawrence, who wants to abolish the police, abolish prisons, ban fossil fuels, allow sex changes for kids and advance every other far-left liberal policy in mid-Michigan,” Bannon charged.

Meanwhile, NRCC national press secretary Mike Marinella took to social media to post a long list of Lawrence’s past controversial comments.

With the additions of Lawrence, Hill and Berman, the DCCC now has 40 races on its target list.

“This is just the latest sign that MI-07 is one of the most competitive races anywhere in the country,” Lawrence said on X as he commented on the DCCC’s move. “And it’s a vote of confidence that our people powered campaign fighting to bring down the cost of living and standing up to corporate power is gaining momentum.”

针对发生在南北交通廊道伦多道工地的一起致命工业事故，验尸庭研讯揭露事故由一连串安全疏失引发，导致重达11公吨的架桥机绞盘卷筒在未妥当固定下，只放置在两个混凝土块上，最终滑落倾倒压死两名员工。

这起事故发生在2024年9月17日。两名死者是38岁印尼籍工地工程师陈赫里延托（Heryanto Tan），以及39岁孟加拉籍建筑工人萨利姆（Hossain Salim）。验尸庭星期四（9月17日）就两人死因召开研讯，由警方和人力部调查官上庭供证。

调查显示，涉事的绞盘卷筒（winch drum）是架桥机的大型部件，用于运送预制桥段。绞盘卷筒包括其外围框架，长超过5米、宽超过2米、高超过2米，重达11公吨。根据公司的标准施工程序，必须摆在四个混凝土块上才能保持平稳，而且施工中不能使用千斤顶。

庭上揭露，绞盘卷筒原定2024年12月才进行组装，但陈赫里延托提前数个月自行安排工人动工。公司称这完全是他的自发行为，但人力部调查官指出，陈赫里延托可能觉得施工进度落后，而且手头刚好有闲置人手。由于这批工人是第一次组装绞盘卷筒，整个过程都由陈赫里延托主导。

此外，虽然公司制定了标准施工程序，但内容明显不足，并未提供每个步骤的详细指引。

案发当天的组装过程，因一连串沟通不畅与违规操作，埋下安全隐患。

事发当天上午，陈赫里延托通知吊运督工启用起重机吊起卷筒，将其摆放在两个一立方米的混凝土块上。由于框架未对齐，陈赫里延托叫工人用机械千斤顶撑起其中一边。随后，他要求起重机不要取下吊索，并保持张力以作支撑。吊运督工因与他合作多年，基于信任并未多加查问。

上午11时30分午餐时间，督工叫起重机操作员解下吊索去吃饭。下午1时复工后，工人没有重新挂上起重机的吊索，也没有人检查卷筒是否稳固。

公司事后聘请的专业工程师调查指出，在失去吊索支撑后，重达11公吨的卷筒下压，当时完全是靠千斤顶的支撑才没有立刻滑落。

下午1时10分左右，陈赫里延托为了调整部件之间的间隙，指示一名工人移除机械千斤顶。千斤顶一抽离，失去平衡的巨型卷筒瞬间滑落倾倒，当场压中在旁的两人。

萨利姆因被重压当场身亡；陈赫里延托被压中下半身，被救出送院后宣告不治。

人力部调查官指出，千斤顶并非完全不能用于支撑，但前提是必须事前制定妥当的施工程序，并进行风险评估。

新加坡警察部队已排除案件涉及他杀。人力部说不打算就这起事件起诉任何人，但在调查过程中发现多起与此事故无关的安全疏失，当局将在进一步调查后采取行动。验尸官将择日发表结论。
