    Trump imposes 10% tariffs on all countries after Supreme Court struck down earlier tariffs

    President Trump signed a proclamation Friday night that will impose 10% tariffs on most foreign imports to the United States, just hours after the Supreme Court struck down a set of sweeping global tariffs that were issued under a different legal authority.

    The new tariffs take effect early Tuesday morning and will be in place for 150 days, according to a White House fact sheet. Some foreign goods are exempted from the 10% duties, including certain food imports, critical minerals, electronics and cars. Goods from Canada and Mexico that are covered by a 2018 trade deal also aren’t subject to tariffs.

    “It is my Great Honor to have just signed, from the Oval Office, a Global 10% Tariff on all Countries, which will be effective almost immediately,” the president wrote in a Truth Socialpost.

    The move comes as Mr. Trump tries to resurrect the worldwide regime of steep tariffs and trade deals that form a core part of his economic agenda. Most of his tariffs hinged on a law called the International Emergency Economic Powers Act, or IEEPA, which the Supreme Court ruled Friday cannot be used to impose tariffs.

    Friday’s tariffs were issued under a different law: Section 122 of the Trade Act of 1974. That legal provision lets the president impose duties of up to 15% for 150 days to deal with “large and serious” balance-of-payment issues.

    The new levies are similar to the 10% baseline tariff rate Mr. Trump rolled out on goods from dozens of U.S. trading partners starting last spring. He argues that blanket tariffs are necessary to address trade deficits and revive American manufacturing, but many economists warn that the costs of tariffs are largely borne by consumers.

    Many trading partners faced higher rates under Mr. Trump’s previous tariffs, including a set of “reciprocal” tariffs on a litany of countries, and levies on many goods from China, Canada and Mexico that were linked to drug trafficking concerns. Some countries negotiated down those rates as part of broader trade deals. But those measures relied on the Trump administration’s interpretation of IEEPA, which was struck down by the high court on Friday.

    It’s not clear whether the administration will try to reinstate those higher tariff rates. Asked whether his trade deals still stand, Mr. Trump told reporters Friday: “Some of them stand. Many of them stand. Some of them won’t, and they’ll be replaced with the other tariffs.”

    Mr. Trump also directed U.S. Trade Representative Jamieson Greer’s office to open investigations into “certain unreasonable and discriminatory acts, policies, and practices that burden or restrict U.S. commerce” under Section 301 of the Trade Act, the White House said. That law allows the government to impose tariffs and other measures to correct unfair trade practices.

    Greer said in a statement late Friday he expects the Section 301 probes “to cover most major trading partners.” He said they will be conducted on an “accelerated timeline” and could result in tariffs.

    Judge who held government lawyer in contempt blasts DOJ’s handling of immigration cases: “Real consequences on real human beings”

    A federal judge who took the extraordinary step of holding a government lawyer in contempt of court earlier this week blasted the Justice Department for its handling of immigration cases on Friday, accusing the department’s Minneapolis office of skirting orders and blaming staffing shortages “again, and again, and again.”

    The order adds to months of sparring between federal judges and the Trump administration, as Immigration and Customs Enforcement’s mass deportation efforts cause an unprecedented flood of legal cases by detainees seeking to be released. Several judges in Minnesota have accused ICE of failing to follow orders in those cases.

    In a hearing Wednesday, U.S. District Judge Laura Provinzino held an Army lawyer who was assigned to the Justice Department in civil contempt. She ordered the lawyer, Matthew Isihara, to pay $500 per day until the government returned identification documents to Rigoberto Soto Jimenez, who was released by ICE in Texas without his ID last week despite a court order requiring him to be flown back to Minnesota with his personal property.

    After the government quickly gave back the man’s documents, Provinzino lifted the contempt finding on Friday. She said no fines would be issued against Isihara, an Army lawyer who was temporarily assigned to assist the Justice Department last month.

    But in a nine-page order on Friday, Provinzino sharply criticized the federal government’s actions in the case — and argued it was not an isolated incident.

    Provinzino said Isihara “had taken no action to ensure compliance with the Court’s order, notwithstanding the fact that it was his responsibility to communicate the Court’s order to ICE to effectuate [Soto Jimenez’s] lawful release.”

    She cited Isihara’s comments at Wednesday’s hearing, where he acknowledged that he didn’t immediately send Provinzino’s release order to ICE, and didn’t get back to Soto Jimenez’s lawyer when asked for help in transporting him to Minnesota and returning his IDs.

    Isihara was apologetic at the hearing, saying the case “slipped through the cracks” and he “dropped the ball.” He said the U.S. Attorney’s Office in Minneapolis — which has faced a surge of ICE arrests and a wave of resignations in recent months — has been overwhelmed by the sheer number of requests to release detainees, which are known as habeas corpus petitions.

    Still, Provinzino rejected that defense, writing that “administrative burden has never been a reason to sacrifice the constitutional and statutory rights of individuals.”

    She also said “the Government has offered that excuse to this Court again, and again, and again (and to other judges in this district again,and again, and again, and again, and again, and again) to excuse its oversights and disobedience of court orders in immigration habeas cases.”

    Provinzino said she has been patient with the U.S. Attorney’s office in the past.

    “But at this point, the refrain of ‘understaffing’ and ‘too many cases’ has worn out its welcome, particularly when it comes at the expense of individual rights,” she wrote. “This Court would never allow a private attorney or litigant to rely on an ‘I’m too busy’ excuse to justify disobedience of a court order. The Government is no different.”

    And the judge argued that “it has become painfully clear over the past several months that the attorneys working on immigration habeas cases lack the basic resources and, in some cases, training necessary to comply with judicial orders.”

    The issue has “real consequences on real human beings,” the judge continued. In Soto Jimenez’s case, after he was released in Texas without his IDs last week, he stayed in a shelter for a night until his lawyer could arrange a flight back to Minnesota, where the Mexican citizen has lived with his lawful permanent resident wife since 2018.

    Going forward, Provinzino said she expects government lawyers who become aware that an order might be violated to inform the court “promptly.” She said she would “look favorably on such submissions” and avoid holding those lawyers in contempt.

    “What the Court will not tolerate is what happened here: disobedience and radio silence from the Government,” the judge wrote.

    President Donald Trump on Friday said the administration has “alternatives” to tariffs, noting he will sign an order imposing a 10% global tariff.

    President Donald Trump on Friday signed an order imposing a 10% “global tariff” following the Supreme Court’s 6-3 decision that he does not have the authority to levy sweeping tariffs under a specific emergency powers law.

    “It is my Great Honor to have just signed, from the Oval Office, a Global 10% Tariff on all Countries, which will be effective almost immediately,” Trump wrote in a Truth Social post Friday evening.

    The order was issued under Section 122 and applies in addition to the standard tariffs that are already in place, the president announced during a White House press briefing Friday afternoon.

    He also announced the launch of several Section 301 investigations and other inquiries aimed at shielding the U.S. from what he described as unfair trade practices by foreign governments and companies.

    The high court blocked Trump’s tariffs levied under the International Emergency Economic Powers Act in what amounts to a major test of executive branch authority.

    The president noted he will pursue “alternatives” to tariffs under emergency law.

    “Other alternatives will now be used to replace the ones that the court incorrectly rejected,” Trump said. “We have alternatives. Great alternatives. Could be more money. We’ll take in more money, and we’ll be a lot stronger for it. We’re taking in hundreds of billions of dollars. We’ll continue to do so.”

    Trump called the ruling “deeply disappointing,” saying he was “ashamed” of certain members of the court.

    “I’m ashamed of certain members of the court, absolutely ashamed, for not having the courage to do what’s right for our country,” the president said. “In actuality, I was very modest in my ask of other countries and businesses because… I wanted to be very well-behaved.

    “I didn’t want to do anything that would affect the decision of the court, because I understand the court. I understand how they are very easily swayed. I want to be a good boy. I have very effectively utilized tariffs over the past year to make America great again,” he said.

    A source outside the Trump administration told Fox News that an aide came into the closed-door White House breakfast with governors earlier Friday and handed Trump a note about the Supreme Court ruling.

    The source said Trump “called it a disgrace, and then he went on with the remarks.”

    Some of the Supreme Court’s nine justices will likely be sitting in the audience when the president delivers the State of the Union address on Tuesday.

    “The Democrats on the court are thrilled, but they will automatically vote no,” Trump said during the news conference. “They also are a, frankly, disgrace to our nation… They’re very unpatriotic and disloyal to our Constitution.It’s my opinion that the court has been swayed by foreign interests and a political movement that is far smaller than people would ever think.”

    In the opinion, the high court declared, “Our task today is to decide only whether the power to ‘regulate… importation,’ as granted to the President in IEEPA, embraces the power to impose tariffs. It does not.”

    Trump has made tariffs a key plank of his economic agenda since retaking the Oval Office last year, but his policies have not come without controversy.

    Republican reaction to the ruling has been mixed.

    Rep. Buddy Carter, R-Ga., slammed the high court’s decision.

    “The Supreme Court just undercut the President’s ability to defend American workers. President Donald Trump was elected to fight unfair trade and stop the United States from being ripped off. I’m outraged by this decision; it’s clearly judicial overreach,” Carter asserted in a post on X.

    But Sen. Rand Paul, R-Ky., welcomed the ruling.

    “In defense of our Republic, the Supreme Court struck down using emergency powers to enact taxes. This ruling will also prevent a future President such as AOC from using emergency powers to enact socialism,” Paul noted in a post on X.

    Rep. Don Bacon, R-Neb., also hailed the decision.

    “The Constitution’s checks and balances still work. Article One gives tariff authority to Congress. This was a common-sense and straightforward ruling by the Supreme Court. I feel vindicated as I’ve been saying this for the last 12 months. In the future, Congress should defend its own authorities and not rely on the Supreme Court. Besides the Constitutional concerns I had on the Administration’s broad-based tariffs, I also do not think tariffs are smart economic policy. Broad-based tariffs are bad economics,” Bacon wrote in a post on X.

    House Speaker Mike Johnson, R-La., said Congress and the administration will determine the “best path forward” in the coming weeks.

    “No one can deny that the President’s use of tariffs has brought in billions of dollars and created immense leverage for America’s trade strategy and for securing strong, reciprocal America-first trade agreements with countries that had been taking advantage of American workers for decades,” Johnson wrote in an X post.

    Appeals court clears way for Louisiana law requiring public schools to display Ten Commandments

    A U.S. appeals court has cleared the way for a Louisiana law requiring poster-sized displays of the Ten Commandments in public classrooms to take effect.

    The 5th Circuit Court of Appeals voted 12-6 to lift a block that a lower court first placed on the law in 2024. In the opinion released Friday, the court said it was too early to make a judgment call on the constitutionality of the law.

    That’s partly because it’s not yet clear how prominently schools may display the religious text, if teachers will refer to the Ten Commandments during classes, or if other things like the Mayflower Compact or Declaration of Independence will also be displayed, the majority opinion said.

    Without those sorts of details, the panel decided it didn’t have enough information to weigh any First Amendment issues that might arise from the law. In other words, there aren’t enough facts available to “permit judicial judgment rather than speculation,” the majority wrote in the opinion.

    But the six judges who voted against the decision wrote a series of dissents, some arguing that the case was ripe for judicial review and others saying that the law exposes children to government-endorsed religion in a place they are required to be, presenting a clear constitutional burden.

    Circuit Judge James L. Dennis wrote that the law “is precisely the kind of establishment the Framers anticipated and sought to prevent.”

    The ruling comes after the full court heard arguments in the cases in January following a ruling by a three-judge panel of the court that Louisiana’s law was unconstitutional. Arkansas also has a similar law that has been challenged in federal court.

    Louisiana Attorney General Liz Murrill said Friday in a statement: “Don’t kill or steal shouldn’t be controversial. My office has issued clear guidance to our public schools on how to comply with the law, and we have created multiple examples of posters demonstrating how it can be applied constitutionally. Louisiana public schools should follow the law.”

    Texas’ law took effect on Sept. 1, marking the largest attempt in the nation to hang the Ten Commandments in public schools. Multiple school districts were barred from posting them after federal judges issued injunctions in two cases against the law, but they have already gone up in many classrooms across the state as districts paid to have the posters printed themselves or accepted donations.

    The laws are among the pushes by Republicans, including President Trump, to incorporate religion into public school classrooms. Critics say it violates the separation of church and state while backers argue that the Ten Commandments are historical and part of the foundation of U.S. law.

    The laws have been challenged by families representing a variety of religions, including Christianity, Judaism and Hinduism, and clergy, in addition to nonreligious families.

    In 1980, the U.S. Supreme Court ruled that a similar Kentucky law violated the Establishment Clause of the U.S. Constitution, which says Congress can “make no law respecting an establishment of religion.” The court found that the law had no secular purpose but served a plainly religious purpose.

    And in 2005, the Supreme Court held that such displays in a pair of Kentucky courthouses violated the Constitution. At the same time, the court upheld a Ten Commandments marker on the grounds of the Texas state Capitol in Austin.

    • 优势:无须预先调查,只要总统认定事实存在即可实施
