    Justice Samuel Alito cautioned on Monday that the Supreme Court’s decision to allow ballots received after Election Day to be counted could lead large sections of the public to view elections as illegitimate.

    While Alito had legal concerns with the majority’s ruling, arguing that they misinterpreted when the “electorate’s choice” occurs, he closed his dissent by issuing a practical warning. Allowing late-arriving ballots to determine the outcomes of elections long after Election Day will, according to Alito, severely damage the trust Americans place in their electoral system.

    “Not only is today’s decision inconsistent with statutory text, legal context, historical practice, and precedent; it also threatens to produce lamentable consequences,” he wrote. “The majority’s holding spawns a slurry of troubling election-law questions and risks further undermining Americans’ confidence in election integrity.”

    Alito went on to describe a hypothetical scenario where the outcome of a presidential election hinges on a single state that allows late-arriving mail ballots to be counted. In the scenario described by the justice, one candidate leads by 15,000 votes on election night only for the opposing candidate to slowly gain votes and, a few days before electors are scheduled to vote, pull ahead by just under 100 votes.

    “If the apparent winner the morning after the election ends up losing due to late arriving ballots, charges of a rigged election could explode,” Justice Brett Kavanaugh also noted during the case’s oral arguments.

    Alito didn’t simply claim that the ruling could affect how people view elections; he argued that it could open the door for fraud.

    “Today’s decision leaves open opportunities for voter fraud that may further undermine Americans’ faith in the integrity of this country’s elections. Diverse sources have recognized that mail-in ballots increase the potential for fraud,” Alito continued. “In 2005, a committee chaired by former President Jimmy Carter and former Secretary of State James Baker found that absentee voting was ‘the largest source of potential voter fraud’ in American elections.”

    While instances of voter fraud carried out using mail-in ballots have been recorded, there is no evidence that widespread fraud occurred in the 2020 or 2024 presidential elections.

    Democrats, meanwhile, argue that allowing states to process ballots that are postmarked by Election Day but arrive afterward, is essential to ensuring that all eligible voters have a say in who governs them.

    “I’m relieved the Supreme Court is not interfering with Washington’s mail-in ballot system,” Rep. Marie Gluesenkamp Perez, D-Wash., wrote on X. “If you work a shift job, have young kids, or live out in the woods, you can’t just knock off for the day to go stand in line at a polling place. For decades, Washington’s secure vote by mail system has made it easy for these folks to participate in democracy and make their voice heard.”

    The majority, however, did not address whether allowing late ballots to be counted was good policy, stating that such a consideration is outside the scope of what the court has authority to rule on.

    “Finally, plaintiffs assert that requiring ballots to be received by Election Day protects election integrity and increases voter confidence in election results,” Justice Amy Coney Barrett wrote. “As we have said time and again, however, policy arguments are properly directed to legislatures, not courts.”

    For more than 40 years, since his service as a young Reagan administration lawyer, Chief Justice John Roberts has pressed for an exceptionally powerful US president, one who could fire the heads of independent agencies at any time.

    In one memo to the White House counsel in 1983, Roberts asserted, “the time is ripe to reconsider the constitutional anomaly of independent agencies.”

    When he was appointed chief justice in 2005, he began laying the groundwork to reverse Supreme Court precedent that permitted Congress to limit the president’s firing power.

    “Without such power,” Roberts wrote in a 2010 case, “the President could not be held fully accountable for discharging his own responsibilities; the buck would stop somewhere else.”

    Roberts’ effort climaxed on Monday as he led a majority to reverse a 1935 case, Humphrey’s Executor v. United States, that had allowed Congress to restrict the president’s authority to fire agency heads to ensure their independence. From his seat at the center of the elevated bench, the chief justice observed that the court had been steadily backing away from the 1935 precedent, which he insisted conflicted with constitutional history and structure.

    “If anything more is left of Humphrey’s, we overrule it,” he declared.

    Controversy over the regulatory sphere can seem dry, compared to Supreme Court battles centered on the Second Amendment, abortion and reproductive rights, religion, and immigration. But the work of US independent agencies cuts a swath across American life, for better or worse, imposing requirements on businesses and individuals in areas of public health and safety, consumer protection, with the goal of enhancing the common good.

    “Our Constitution creates three branches, but only one President,” Roberts wrote, expanding on his position in his 36-page opinion. “That President is not all powerful – not by any means. But he is not impotent either. He and he alone is vested with ‘the executive Power’ of the United States.”

    Roberts’ sweeping approach to presidential power has manifested itself in multiple cases over the years, perhaps most notably in 2024 when the chief justice and fellow conservatives gave Trump substantial immunity from criminal prosecution, pointing to the president’s “conclusive and preclusive” authority.

    His long-game effort to curtail independent agencies such as the Federal Trade Commission, at the center of the ruling Monday, is not unlike his successive moves curtailing the reach of the 1965 Voting Rights Act. That drive culminated earlier this term as the court rolled back federal protections for Black and Latino voters.

    Roberts’ strategic patience paid off. In both, he was assisted by the additional appointments of likeminded conservative justices that created a 6-3 supermajority.

    And in the same vein, the three liberal justices again were left only to dissent.

    On Monday, Justice Sonia Sotomayor delivered an oral dissent for the left-wing justices, emphasizing the importance of insulating independent regulators from the pressure of a president who may want to infringe on fair-trade regulations, such as overseen by the FTC, but also workplace safety, nuclear energy and chemical hazards that regulatory agencies manage.

    Sotomayor said Congress had long relied on the 1935 precedent to set up a workable regulatory system of government.

    “(T)he Court gives the President a power unknown even to the English Crown against which the Founders revolted,” Sotomayor wrote, “elevating him above his once-coequal branches by transforming a duty to take care that the laws be faithfully executed into a license to act in defiance of those very laws.”

    Congressional legislation establishing the Federal Trade Commission and other independent agencies dictates certain terms in office for commissioners and permits removal only for some wrongdoing, defined as “inefficiency, neglect of duty, or malfeasance in office.”

    When Trump returned for his second term, he set out to remove Democratic-appointed commissioners at a number of agencies, including Rebecca Slaughter, who was in the middle of a seven-year term at the FTC. The commission was established in 1914 to protect consumers and safeguard against unfair business practices.

    Slaughter received an email from Trump in March 2025 saying her “continued service on the FTC is inconsistent with my Administration’s priorities.”

    Lower court judges sided with Slaughter as she tried to claim her post, based on 1935 precedent. As the Trump administration appealed, it lifted phrases from Roberts’ past decisions to argue that it was time to fully reverse the nine-decade decision.

    Trump officials, along with Roberts and many fellow conservatives, subscribe to a “unitary executive theory” of presidential control that gives him power over the vast bureaucracy.

    The justices did carve out an exception on Monday for the Federal Reserve, which Roberts said in the separate case of Trump v. Cook is based on the country’s long tradition of an independent central bank.

    Slaughter, at a news conference after the court action, decried the decision against her and the Fed exception.

    “Somehow Wall Street is special and gets special treatment, but other than that, the agencies that look out for everyday Americans do not,” Slaughter said.

    After oral arguments in her case last December, and remarks from conservatives who hold the majority, it seemed inevitable that the Trump administration would prevail. And given Roberts’ history in transforming this area of the law, it appeared he would write the opinion himself.

    In the courtroom Monday, Roberts began by explaining that James Madison took the lead among America’s founders in conceiving of all executive power vested in the president, to appoint and oversee those who carry out the nation’s laws.

    The chief justice portrayed Humphrey’s Executor as an outlier. The case began when President Franklin D. Roosevelt tried to fire an appointee of his predecessor, President Herbert Hoover, to the Federal Trade Commission. The Supreme Court ruled unanimously that the president lacked the power unless authorized by Congress.

    That decision undermined an earlier ruling, the 1926 Myers v. United States, that had allowed the president to remove postmasters from office without congressional consent.

    For as long as Roberts has worked in government, first for Presidents Ronald Reagan and George H.W. Bush and then as a jurist, he has put forth a robust concept of executive power. He has sought a return to the “seminal,” as he called it, Myers ruling.

    On Monday, he highlighted his prior decisions, in 2010 and 2020, that lifted Congress’ restrictions on the president’s removal power and relied on the 1926 Myers case.

    From the bench on Monday, he noted the Myers decision had been written by Chief Justice William Howard Taft, who had earlier been president of the United States. Taft believed, Roberts recounted, that the vesting of the executive power in the president was essentially a grant of the power to execute the laws, which included the ability to remove officials over whom he lacks responsibility and control.

    As Roberts inflated that 1926 ruling, Sotomayor diminished it.

    “If Myers is the ‘best’ support for the majority’s position, its theory is a castle built on sand. For one thing, as the majority admits, Myers did not address for-cause removal protection; the challenged statute instead required Senate consent to removal.”

    Her sharpest comments came as she scoffed at Roberts’ reasoning tied to presidential accountability.

    Sotomayor, who has often criticized President Trump, suggested that rather that “accountability,” the decision would lead to “instability.”

    “I’m going to guess,” she said, looking up from her page at courtroom spectators, “… maybe you should, too.”

    Sotomayor concluded, “The president emerges with more power than ever before.”

    Roberts, composed as ever, appeared unfazed: More power for the president – that has been precisely his aim.

    A spokesperson for Sen. Ruben Gallego said Monday that President Donald Trump is “targeting” the Arizona Democrat with a Justice Department investigation into his campaign finances.

    Reacting to a report of the inquiry in Axios, the spokesperson accused the Justice Department of having been “weaponized” and said the administration was effectively trying to quiet those who criticize it.

    “Trump is targeting Senator Gallego while the most weaponized Department of Justice in history is turning a blind eye to Trump’s unprecedented corruption that’s raising costs for families, and instead targeting anyone who gets in their way — like the Federal Reserve, members of Congress doing their oversight duty, and now Senator Gallego,” the spokesperson said in a statement.

    The spokesperson said Gallego’s office did not have independent knowledge, outside of the Axios report, into the DOJ investigation or what it was seeking to uncover. Axios reported that the investigation stemmed from a “whistleblower complaint” out of Southern California.

    The Justice Department did not immediately respond to a request for comment.

    “It’s the least surprising news of the week that this comes immediately after the Senate Ethics Committee cleared Senator Gallego of rightwing smears pushed by the administration weeks ago,” the Gallego spokeperson said.

    Earlier Monday, Gallego’s office released a letter from the Senate Ethics Committee revealing the panel closed a complaint filed against him by Republican Rep. Anna Paulina Luna. The inquiry, which alleged “campaign finance violations and inappropriate conduct of a sexual nature,” would be separate from an investigation by federal law enforcement.

    “Based on the investigation of the Committee, the Committee did not find evidence that your actions violated Federal law, Senate Rules, or related standards of conduct,” the letter said.

    The Senate Ethics Committee has dismissed a complaint against Sen. Ruben Gallego, D-Ariz., that alleged the lawmaker committed sexual misconduct and campaign finance violations.

    The probe was spurred by Rep. Anna Paulina Luna, R-Fla., who earlier this year charged that there were “very disturbing” allegations against a sitting senator in the wake of the scandal-filled downfall of former-Rep. Eric Swalwell, D-Calif., a close friend of Gallego’s.

    But after a nearly monthlong investigation into the matter, the committee told Gallego in a letter on Monday that there wasn’t evidence to back up Luna’s claims.

    ‘DISTURBING’ ALLEGATIONS AGAINST UNNAMED SENATOR UNDER REVIEW IN WAKE OF SCANDALS ROCKING CONGRESS

    “We are writing to inform you that the Select Committee on Ethics (the Committee) dismissed a complaint filed against you by Representative Anna Paulina Luna,” the panel stated. “Specifically, the complaint alleged campaign finance violations and inappropriate conduct of a sexual nature.”

    “In response to your request for an investigation, the Committee referred these allegations to you and requested additional information on April 17 and May 15, 2026,” the letter continued. “Based on the investigation of the Committee, the Committee did not find evidence that your actions violated Federal law, Senate Rules, or related standards of conduct.”

    Gallego said in a statement that the Ethics Committee’s decision “reaffirms what I have said about these accusations from the beginning: they were right-wing conspiracies peddled by far-right activists like Anna Paulina Luna, the White House and their allies.”

    “I look forward to an apology from Rep.     But an apology from Luna is unlikely.

    The lawmaker shot back on X that the allegations “are not conspiracy theories. You’re a gross example of representation.”

    “The good news about D.C. is everyone talks, and eventually the reporters come forward with your texts,” she continued. “Do yourself a favor and keep raising for your legal defense fund. Once a creep, always a creep, and you’re gonna need it.”

    Luna’s allegations against Gallego came shortly after Swalwell resigned from the House following a bombshell report from The San Francisco Chronicle that the ex-lawmaker allegedly sexually assaulted a former staffer.

    Gallego moved to quickly put distance between himself and Swalwell and argued that his tight-knit relationship “clouded my judgment,” regarding rumors that swirled about the ex-lawmaker for years in Washington, D.C.

    Gallego has recently come under scrutiny for a report from Politico that he spent thousands in campaign cash on luxury travel, Super Bowl tickets and childcare.

    “This is not breaking news,” Gallego told the outlet. “With the rising costs of childcare and the burden it has on the budgets of American families, Democrats and Republicans in Congress and the White House alike regularly travel with their wives and children, as is permitted by the FEC.”

    Supreme Court Justice Amy Coney Barrett faced the wrath of conservatives on social media on Monday after she authored the majority opinion ruling in favor of a Mississippi law allowing mail-in ballots to be counted in elections even if they are received after Election Day.

    The court was split 5-4 on the ruling with Barrett, appointed by President Donald Trump, writing the majority opinion joined by Chief Justice John Roberts, as well as justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson.

    Barrett’s opinion held that Election Day, in the context of federal law, set a deadline for when voters must make a choice regarding their preferred candidate but said that relevant laws have no standard for when ballots must be received to be considered valid.

    Barrett was quickly criticized by conservative commentators and politicians.

    “A shockingly wrong opinion,” Republican Sen. Eric Schmitt posted on X. “Justice Barrett joins with the liberal justices to hold that federal election law does not preempt states who allow late mail-in ballots to be counted. This is terrible for election integrity. Another reason we must pass the full SAVE American Act.”

    “Barrett is the biggest conservative judicial disaster since Souter,” conservative author Hans Mahncke posted on X. “The difference is that few conservatives expected much from Souter whereas Barrett was supposed to be the future of the Court. The worst part is that she’ll be there pushing leftist policies for another 40 years.”

    “Amy Coney Barrett continues to disappoint in far too many high-profile cases,” political commentator Josh Hammer posted on X.

    “Remember Election Day?” Republican Rep. Abe Hamadeh’s office posted on X. “This disastrous SCOTUS decision, authored by Justice Barrett, guarantees we’ll keep drifting away from it — as our sacred elections get bogged down by endless mail-in ballots and never-ending counts.”

    “Amy Coney Barrett is the worst choice ever among all GOP justices,” retired U.S. Army captain Seth Keshel posted on X. “And that includes Roberts. What a disappointment she is.”

    “She quotes Alexander Hamilton in Federalist No. 59, speaks of the Framers’ intent, and repeatedly invokes history as its guide,” Constitutional attorney Krisanne Hall posted on X. “But when the historical evidence becomes inconvenient, Barrett quietly sets it aside. Barrett engages in judicial activism disguised as selective originalism.”

    Jason Snead, executive director of Honest Elections Project, said in a statement that the ruling is “deeply disappointing and misses the mark.”

    “Federal law is clear: all ballots must be received by Election Day to be counted,” Snead wrote. “The Court missed a major opportunity to reinforce election integrity and instead sides with California-style chaos. As Justice Alito makes clear in his dissent, watching ballots trickle in after Election Day and flip races does nothing but damage public trust in our system of government.”

    Hans von Spakovsky, a former Federal Election Commissioner and Senior Legal Fellow in AAF’s Edwin Meese III Institute for the Rule of Law, said in a statement that the ruling is a “grave disappointment.”

    “As Justice Samuel Alito says in his dissent, joined by three other justices, not only is Justice Amy Comey Barrett’s opinion inconsistent with the plain text of those laws and historical practice and precedents, it ‘risks further undermining Americans’ confidence in election integrity,’” von Spakovsky wrote.

    The ruling prompted many to reiterate the importance of the SAVE Act, Trump’s long-sought voter ID and citizenship verification legislation, including Republican Rep. Greg Steube who posted on X, “The Senate filibuster is the only thing standing in the way. Nuke it!”

    Trump reacted to the ruling on Truth Social, calling it a “tremendous loss” and stressing the importance that all voters must show a photo ID and proof of citizenship and that there should be “no mail-in” ballots except for specific exceptions.

    “There is no excuse for a politician, or otherwise, to be against the above three requirements,” Trump wrote. “There is only one reason to oppose — CHEATING!”

    Trump added, “The House of Representatives has approved this vital Act, THREE TIMES. The United States Senate seems unable to do so. In a time when there is a powerful Communist Movement taking place in our Country, one more dangerous than World War I, World War II, Pearl Harbor, or September 11th, all Dumocrats, and our five Republican Senate Hold Outs, Lisa Murkowski, Susan Collins, Thom Tillis, Bill Cassidy, and Mitch McConnell must vote to SAVE OUR COUNTRY. There can be no more excuses!”

    A top DOJ prosecutor responded to concerns raised by a Virginia resident and fellow Trump administration official over alleged slow-walking of background checks after a judge temporarily blocked a sweeping “assault weapons” ban that otherwise was set to take effect Wednesday.

    The uproar comes as Richmond becomes the latest Democrat-run capital to pursue restrictions on Second Amendment-related activities. The Supreme Court’s recent rulings against New York’s and the District of Columbia’s gun laws have given conservatives major legal victories in their efforts to challenge similar measures.

    Amid Virginia’s legal fight, critics accused state police of intentionally slow-walking background checks to effectively backdoor-enforce the law while it is litigated. Assistant Attorney General for Civil Rights Harmeet Dhillon responded that her office is “all over this” case and other instances of “gun-grabbing nonsense nationally.”

    Joined by Gun Owners of America, a Virginia resident seeking to purchase firearms from a dealer in Kilmarnock, Virginia, sued to block Richmond’s new law imposing criminal penalties for selling or purchasing “assault firearm[s],” which critics said is a sweeping violation of the Second Amendment.

    The inclusion of the Kilmarnock gun store established legal standing in GOP-friendly Lancaster County in Virginia’s Northern Neck, where Judge John Martin blocked enforcement of the law through Dec. 31.

    After the ruling, FTC Commissioner Andrew Ferguson tweeted that he encountered what he called an “en masse” delay in background checks after visiting his local gun store. The checks are handled by the Virginia State Police.

    The top cop at VSP, Col. Jeffrey Katz, is both a Spanberger appointee and listed the defendant in the Lancaster case.

    “The Virginia State Police is is delaying background checks en masse in one of the most flagrant violations of our rights that I’ve seen. This is outrageous,” Ferguson said.

    “Our police are aiding radical leftists to disarm Americans.”

    When asked about the allegation, VSP suggested there was no intentional slow-walking and said troopers have seen a spike in applications over the past month.

    “The Firearms Transaction Center is seeing a large number of transactions. The center has processed over 100,000 transactions in June alone and have been averaging over 5,000 transactions a day,” said Matthew Demlein, an ombudsman for the state police.

    “The center is working diligently to complete each transaction.”

    Philip Van Cleave — whose Virginia Citizens Defense League is a co-plaintiff in the case — also said he was not convinced VSP was intentionally holding up background checks in light of the Lancaster decision.

    “I don’t want to be unfair to the Virginia State Police,” Van Cleave tweeted. “I’m not convinced that the delays are intentional.”

    “I just don’t think VSP and their computer system is geared up to handle the immense volume that the gun-control idiots in the general assembly have created.”

    Another critic of the ban shared a section of the Code of Virginia that appeared to allow firearm transfers to proceed despite background check delays.

    If a dealer fulfills the requirements laid out by VSP but police do not respond within five business days, the dealer may complete the sale or transfer of the firearm without violating the law.

    Meanwhile, a spokesperson for Gov. Abigail Spanberger said Virginians overwhelmingly support stringent background checks and that the law keeps the Old Dominion safe.

    “Polls have repeatedly shown that more than 80 percent of Virginians support universal background checks — including a majority of gun owners and Virginians from every part of the political spectrum. Governor Spanberger signed this widely supported law to restore commonsense background checks and help law enforcement officers keep our communities safe,” the spokesperson said, pledging that Spanberger will “continue to take commonsense steps to protect law enforcement officers, kids, and families across the Commonwealth from gun violence.”

    Fox News Digital reached out to DOJ to determine what actions are being taken or planned, given allegations from Ferguson and others.

    Martin’s ruling stated that the firearm characteristics identified in the ban lack a rational basis because handguns are excluded despite fitting the lawmakers’ stated military-style rationale.

    The ban was originally authored in the House by Del. Dan Helmer, D-Fairfax, and in the Senate by Sen. Saddam Salim, D-Dunn Loring.

    In comments reported by Courthouse News Service, Van Cleave separately noted that a commission set up by Democratic then-Gov. Tim Kaine following the Virginia Tech massacre found that gun-magazine limits like those focused on in the new law would have “made no difference in the outcome.”

    Attorney General Jay Jones, arguing for the state, said in a statement that “gun violence is the key driver of violent crime in this commonwealth and nation, and assault weapons are designed intentionally to inflict maximum damage in a matter of seconds.”

    During his 2025 campaign, text messages surfaced showing Jones had envisioned the shooting of the former Republican speaker of the Virginia House.

    “The assault weapons ban passed by the General Assembly and signed by the Governor will save lives in the Commonwealth and is compliant with the Constitution of Virginia,” Jones said.

    When she signed the law in May, Spanberger lamented that the legislature declined to accept her proposed changes that would have carved out commonly used hunting firearms.

    “I am signing this bill into law because firearms designed to inflict maximum casualties do not belong on our streets. We are taking this step to protect families and support the law enforcement officers who work every day to keep our communities safe,” she said, adding that she would work with Salim and Helmer to clarify the law’s language to assuage hunters.

    Fox News Digital reached out to Virginia’s Republican legislative minority for additional comment. The House was expected to go into session late Monday, where the subject could come up.
