    The Fifth U.S. Circuit Court of Appeals on Thursday dismissed as moot a challenge to President Donald Trump’s use of the Alien Enemies Act to deport alleged Tren de Aragua members, leaving the legality of his invocation of the 18th-century law unresolved.

    The New Orleans-based court said the case became moot after all three Venezuelan plaintiffs, whom the administration alleged were members of Tren de Aragua, had already been removed from the United States under other immigration authorities.

    While the Alien Enemies Act dates back hundreds of years, prior to Trump, it was most recently invoked by President Harry Truman in 1946. The law allows the president, under specified wartime or invasion circumstances involving a foreign nation or government, to detain and remove certain non-naturalized individuals of that hostile power.

    The Trump administration has argued that Tren de Aragua’s gang activity amounts to an “invasion or predatory incursion” under the law and has sought to use the authority as part of its broader immigration agenda, including efforts to speed the removal of suspected gang members.

    DC APPEALS COURT ORDERS JUDGE BOASBERG TO HALT TRUMP CONTEMPT PROBE OVER DEPORTATION FLIGHTS

    The Supreme Court previously blocked the administration from removing the detainees under the Alien Enemies Act while the case proceeded, but stopped short of deciding whether Trump had lawfully invoked the statute, sending the dispute back to the Fifth Circuit.

    Advancing American Freedom senior legal fellow Bryce Poole described the ruling as a mixed result for the Trump administration.

    “The Fifth Circuit’s en banc decision in W.M.M. v. Trump represents one step forward, one step sideways for the Trump Administration,” Advancing American Freedom senior legal fellow Bryce Poole told Fox News Digital. “Last year, in A.A.R.P. v. Trump, the Supreme Court blocked the removals but declined to decide whether President Trump’s invocation of the Alien Enemies Act was lawful, sending that question back to the Fifth Circuit.”

    Advancing American Freedom is a conservative public policy advocacy organization founded by former Vice President Mike Pence.

    “It’s a step forward because it vacates the prior ruling that said Trump’s invocation was unlawful, leaving the President’s AEA powers intact,” Poole explained. “It’s a step sideways because the court dodged the merits, so the AEA’s legality remains a live question the Supreme Court will likely decide — probably in a different case like J.A.V. v. Trump, which has a certified class, so mootness won’t apply.”

    BIDEN JUDGE OVERRULED ON KEY TRUMP IMMIGRATION POLICY

    Even though the court declined to rule on the merits, two judges signaled their belief that the president’s use of the law was appropriate in their concurring opinions.

    “I agree that this case is moot,” Judge James Ho wrote. “But I also agree with the United States that we should address the merits questions directed to us by the Supreme Court — and affirm the President’s actions under the Alien Enemies Act and the Due Process Clause.”

    “As I’ve also noted, judges are supposed to defer to a President’s declaration of a state of invasion — including the ones issued on January 20, 2025.” Ho, a Trump appointee, added. “And if courts must defer when the President treats illegal immigration as an invasion, see id., then a fortiori we must defer when it comes to the narrower question of an invasion by Tren de Aragua.”

    Ilya Somin, a George Mason law professor and scholar at the libertarian Cato Institute, disagreed strongly with Ho’s rationale.

    “If the president could create an ‘invasion’ simply by claiming that it exists, it would convert dangerous emergency powers that can only be used in extreme circumstances into blank checks the president can invoke any time he wants” he wrote. “That’s contrary to the text of the AEA (which limits its use to situations where these circumstances actually exist) and to the text and original meaning of the Constitution.”

    Judge Andrew Oldham, another Trump appointee, also agreed that the president’s invocation of the Alien Enemies Act was legally sound.

    With all 17 active Fifth Circuit judges participating, the court refused a request from the plaintiffs’ lawyers to substitute in new plaintiffs for the men who the Trump administration deported.

    The Iran war has underscored how disruptions to a key shipping route thousands of miles away can have a material impact on what American consumers pay at home for essentials like gasoline.

    The conflict, now nearing its six-month mark, has throttled traffic through the Strait of Hormuz, a key artery for global energy shipments, as strikes on commercial vessels raise concerns about the passageway’s safety. The slowdown has caused global oil prices to surge, pushing gasoline past $4 a gallon and fueling broader inflation.

    The U.S. and Iran have made multiple attempts to broker a peace deal, but talks have unraveled as the two sides continue to vie for control of the Strait of Hormuz, an indication of how key waterways can become instruments of leverage during geopolitical conflicts.

    A new report from Oxford Economics outlines 26 other major chokepoints with high trade volumes that could also threaten the economy if shipping were to grind to a halt.

    Where is global trade concentrated?

    As Oxford’s report points out, Asia has the densest concentration of key global chokepoints. The region is home to several vital waterways, including the Strait of Malacca, situated between the Indonesian island of Sumatra and Malaysia, and the Taiwan Strait, through which one-fourth of global trade passes, according to Oxford.

    The Mediterranean Sea is also a hot spot for global trade activity. Around one-fifth of global trade transits the Strait of Gibraltar, which connects the Mediterranean Sea with the Atlantic Ocean, and the Suez Canal, an artificial waterway in northeastern Egypt, according to Oxford’s report.

    While the Panama Canal is less significant to global trade, it remains an important chokepoint for the Americas. Some 40% of all U.S. container traffic traverses the artificial waterway annually, according to the Council on Foreign Relations, a nonpartisan think tank.

    What are the major threats to global trade?

    Geopolitical disruptions pose one of the greatest threats to global trade. That includes countries looking to use critical chokepoints for their own political or geopolitical gain, Harry Murphy Cruise, head of economic research and global trade at Oxford, told CBS News.

    That’s playing out in the Strait of Hormuz, as the U.S. and Iran both try to exert control over shipping traffic.

    Another, more insidious threat is climate change, which is driving more frequent and more harmful natural disasters. Just one example is the Panama Canal, where a combination of drought conditions and El Niño, a weather pattern that causes “warmer-than-average” surface temperatures in the Pacific Ocean, is lowering water levels and limiting the amount of cargo ships can carry.

    Backup routes?

    As Oxford’s report points out, the risks associated with each chokepoint depend on whether it can reroute traffic if and when disaster strikes.

    The Strait of Hormuz, through which one-fifth of the global oil supply normally flows, is particularly vulnerable to disruptions because there isn’t another option to redirect energy supplies, according to Murphy Cruise.

    “There’s no alternative path that it can take because the Strait is effectively where the oil is coming from,” he said. “If we look at some of the other chokepoints around the world, they’re slightly less tied directly to key production.”

    To be sure, even chokepoints that have backup routes can still run into issues. Rerouting vessels prolongs the shipping process, which can drive up operational costs, Murphy Cruise said.

    “The longer they’re out at sea, there’s higher wages, there’s higher oil prices and [other] costs,” he said.

    When vessels are out at sea longer than expected, it can also limit the number of available commercial ships, creating additional cost pressures.

    “That mismatch between supply and demand gets worse, and that pushes up freight costs,” Murphy Cruise added.

    Jason Arday, former Cambridge professor, dies week after resigning amid plagiarism allegations

    Jason Arday, who was Cambridge’s youngest Black professor, died in London on Friday, a week after he resigned from the university amid plagiarism allegations, his family said. He was 41 years old.

    “Jason was subjected to a campaign of sustained abuse for the more than three years since he accepted the role of Professor at Cambridge University by those who would leave no stone unturned in their quest to undermine him,” his family said in a statement.

    “The campaign of misinformation was too much for Jason, who was a gentle man and who always wanted to see the best in everyone. We are in shock to have lost this amazing father, partner, brother, uncle and son.”

    London’s Metropolitan Police did not identify Arday, but said in a statement that officers responded to a report of a 41-year-old man found unresponsive inside a property at 3:12 p.m. local time Friday. Police said the man was pronounced dead at the scene and his next of kin have been notified.

    His death is “unexpected, but is not believed to be suspicious,” police said. The case is under investigation.

    U.K. Education Secretary Lucy Powell said in a social media post that she was “deeply shocked & saddened” to hear about Arday’s death.

    “My heartfelt condolences are with his friends and family at this very sad time,” Powell said in the post. “I urge people to give them privacy through this incredibly difficult period & to remember there are real people with loved ones involved.”

    Arday resigned from Cambridge Aug. 5 following allegations of plagiarism and fabrications in his biography, saying in a statement, “The relentless accusations, speculation and public commentary have taken a profound toll on me and on those I love.”

    He said his resignation should not “be mistaken for an acceptance of the narratives that have surrounded me.”

    “We are desperately saddened to hear this tragic news. Our heartfelt sympathies go to Jason Arday’s family and friends at this incredibly difficult time,” Vice-Chancellor Professor at Cambridge Deborah Prentice said in a statement.

    Arday joined the University of Cambridge in 2023 at age 37, becoming one of Britain’s most high-profile academics after sharing an extraordinary account of his life. He said he was autistic and dyslexic, did not speak until age 11 and was unable to read or write until he was 18.

    Born and raised in south London, he went to college to earn a degree in education and physical education, and then went on to earn two master’s degrees before qualifying as a teacher. He then earned his PhD at Liverpool John Moores University.

    “Not many teachers at school had any belief in me,” he told CBS News in 2023. “Educational psychologists and behavioral therapists were … very robust in their assessment that I would struggle in later life and I would need assisted living .”

    Allegations of plagiarism were raised last month by Nathan Cofnas, a philosopher of biology and former Cambridge researcher who has publicly criticized diversity, equity and inclusion policies. Cofnas previously wrote that in a meritocracy, “Blacks would disappear from almost all high-profile positions outside of sports and entertainment.”

    Arday previously denied any intentional wrongdoing, saying errors in his academic work were inadvertent and arguing that much of the criticism against him was an ideologically and racially motivated campaign against him.

    Supporters of Arday also argued the scrutiny went far beyond legitimate academic criticism and said he became the target of an ideological campaign because of his work on race, inequality and diversity.

    Liverpool John Moores University previously investigated allegations relating to his doctoral thesis and said it found no evidence of academic misconduct, according to The Times of London.

    Articles by The Times of London and The Telegraph reported last month on possible embellishments in Arday’s personal history, including claims that he raised millions for charity through endurance challenges, which he later amended. The Telegraph questioned his claim to have published a book, “Being Young, Black and Male: Challenging the Dominant Discourse,” saying it could not find evidence it was ever published.

    Criticism mounted ahead of this week’s release of Arday’s memoir, “Great and Unfortunate Things,” which chronicles his life from childhood through his appointment at Cambridge.

    In his resignation statement, Arday did not address the specific allegations against him, but said his resignation should not “be mistaken for an acceptance of the narratives that have surrounded me.”

    “It is simply the decision of someone who has reached the limits of what any person should reasonably be expected to endure,” he said.

    President Donald Trump, surrounded by his top law enforcement officials, touted Friday the significant drop in murder and other crimes following the FBI’s 2025 crime report.

    The murder rate is now at lows not seen since the 1950s, according to the agency’s report, following a downward trend since the numbers spiked in the 2020s, as the Covid pandemic took hold of the US.

    The trend is continuing in 2026, with murder, violent crime, and robbery rates continuing to drop in the first half of the year, according to data from the FBI and independent organizations.

    “I’m thrilled to announce that the FBI has just released a new Uniform Crime Report showing that in 2025 we achieved the single largest reduction in violent crime in American history,” Trump said at an event Friday on Long Island, New York. “Pretty amazing. And last year there were over 3,100 fewer murders than the year before I took office.”

    Trump and his officials, including FBI Director Kash Patel, have pointed to the administration’s efforts to surge federal resources to cities across the US and, in a refrain used often by Patel, letting “good cops be cops.”

    Others are less dogmatic about the cause of declining crime rates, which have been dropping since before Trump’s second term began.

    What has caused this welcomed decline in crime across the US is “as clear as a glass of milk,” Adam Gelb, the president of the nonpartisan think tank Council on Criminal Justice said in releasing its own report Thursday on 2025 crime rates.

    “The homicide drop is historic and crystal clear. But right now, what’s driving it is about as clear as a glass of milk,” Gelb said. “Rates are falling in cities with very different public safety strategies, economic conditions, and political leadership. The consistency across the map should make us cautious about handing credit to any one leader, party, policy, or program before the evidence catches up.”

    While no single cause can easily explain the decline across a country of over 340 million people, researchers at CCJ told CNN that a range of possible influences include changes in how criminal justice is enforced as well as societal and culture change and technological advances have likely all contributed to the decrease.

    Trump says his administration, including Patel and newly confirmed Attorney General Todd Blanche, are deserving of the credit.

    “Let’s say they don’t have good leadership, like Chicago has very bad leadership. But we have the numbers down because of what the federal government’s doing,” Trump said Friday. “They like to take all the credit, but everyone knows we’ve done an amazing job. The US attorneys and the FBI, all the people, Kash, and Todd has been unbelievable.”

    The Justice Department is planning its next move after a federal judge in Boston dismissed its case accusing Harvard University of repeatedly turning a “blind eye” to antisemitism on campus.

    “We disagree with the ruling and are assessing next steps,” Assistant Attorney General for the Civil Rights Division Harmeet Dhillon said in a statement.

    “The Civil Rights Division has an extensive and active portfolio of antisemitism enforcement, including indictments, prosecutions, settlements and investigations across the country.”

    Justice Department sues Harvard over alleged antisemitism

    The Justice Department filed an unprecedented federal lawsuit against Harvard University, accusing the Ivy League institution of failing to protect Jewish students from harassment and antisemitism. Kenneth Marcus, chairman of the Brandeis Center for Human Rights, discusses the legal action, stating the Trump administration is holding Harvard accountable for its alleged deliberate indifference towards Jewish students amidst ongoing campus protests.

    Judge Richard Stearns, who was appointed by President Bill Clinton, dismissed the Trump administration’s lawsuit against the Ivy League school Thursday, determining the incidents of antisemitism were too isolated to establish a pattern showing that the school remained in violation of federal civil rights law after the federal government issued its complaint.

    “Without diminishing any concern arising from these occurrences, the court finds them, singly and collectively, to be too isolated and episodic to support a plausible inference that any institutionalized noncompliance with Title VI persists at Harvard to this day,” Stearns wrote.

    The Justice Department filed its lawsuit against Harvard March 20, 2026, after a wave of anti-Israel protests that erupted on college campuses nationwide after Hamas’ Oct. 7, 2023, attack on Israel and the ensuing war in Gaza.

    At Harvard, protests during the 2023-24 school year included repeated occupations of libraries and other campus buildings and a weekslong encampment in Harvard Yard. Jewish students reported being harassed, intimidated and excluded from campus spaces.

    The Justice Department alleged that Harvard violated Title VI by failing to protect Jewish and Israeli students from harassment despite complaints to university leaders about the conduct.

    But Stearns said the Justice Department referred to only three antisemitic incidents on Harvard’s campus during the following school year that the school had allegedly failed to address.

    Those incidents included protesters allegedly breaching barricades outside an event featuring former Israeli Prime Minister Naftali Bennett, a Harvard employee allegedly removing posters of Israeli hostages and more than 60 masked protesters staging a “die-in” outside Widener Library, where they chanted, “We will honor all our martyrs.”

    Stearns did not rule on whether Harvard had violated Title VI during the height of the campus unrest. Instead, his decision focused on whether the Justice Department had sufficiently alleged that violations continued after the government formally put Harvard on notice.

    The Trump administration sent Harvard a warning letter June 30, 2025, saying the school had violated Title VI over its response to antisemitism on campus.

    Under the statute, the government is required to notify a recipient of a violation and try to resolve it voluntarily before taking enforcement action.

    In his dismissal, Stearns said the Trump administration’s amended June 2026 complaint did not identify any incidents in which Harvard failed to address antisemitism after the government sent its warning letter.

    “The Government provided the requisite notice underlying this action on June 30, 2025,” Stearns wrote. “As noted above, the Amended Complaint is devoid of any factual allegations plausibly establishing that any events that might be construed as evidence of noncompliance occurred after June 30, 2025.”

    Stearns also rejected the Trump administration’s allegation that Harvard University’s failure to cooperate with every demand in the federal government’s proposed voluntary agreement showed that the school was not in compliance with Title VI.

    “Harvard’s refusal to follow every specific demand from the administration wasn’t enough, because the legal question was whether Harvard was complying with Title VI — not whether Harvard was doing exactly what the administration told it to do,” Stearns wrote.

    The dismissal comes as the Trump administration pursues two lawsuits against the University of California over alleged discrimination against Jewish and Israeli students, faculty and staff at UCLA.

    The U.S. Army said Friday it is temporarily halting Apache helicopter training flights after two soldiers were killed earlier this week in a crash near Fort Hood, Texas.

    “The stand-down will remain in effect until we have a better understanding of the root cause of the accident,” the Army said in a statement.

    The AH-64 Apache attack helicopter crashed Wednesday in a field in rural Salado, Texas, near its base in Fort Hood, the Army and local law enforcement officials said. The Army identified the deceased pilots as Chief Warrant Officer 2 Deontre T. Huey, 34, and Warrant Officer Seth L. Olmsted, 25, both Texas natives.

    “You could tell this was a violent crash,” said Bell County Sheriff’s Office spokesperson Bill Coleman, who told reporters the helicopter did not hit any buildings, but sparked a wildfire.

    The military has not specified the cause of the crash. It is not unusual for the military to order a temporary stand-down after a fatal crash, especially if the cause is still under investigation.

    “The Army is profoundly saddened by the loss of two Soldiers in the recent AH64 Apache helicopter crash near Fort Hood, Texas,” the Army said Friday. “We mourn these aviators, and our deepest condolences remain with their families, friends, and unit during this extraordinarily difficult time.”

    The Army has described the newest iteration of the AH-64 Apache, which has been manufactured by Boeing since the late 1990s, as “the most advanced aerial fighting vehicle in the world.” The twin-engine helicopter typically seats a pilot and a co-pilot gunner, and is equipped with a rapid fire gun and can launch Hellfire missiles.

    Hundreds of Apaches are operated by Army and National Guard units, and the helicopters have been used during the U.S.-Iran war. In June, an Apache that was patrolling the Strait of Hormuz was shot down by an Iranian drone, President Trump announced. The two pilots were then rescued by a sea drone.
