The Department of Homeland Security is accusing Minnesota officials of staging a “political stunt” as federal and state authorities square off over whether an ICE agent accused of pointing a gun at motorists should be prosecuted in state or federal court.

The dispute centers on Gregory Morgan Jr., an Immigration and Customs Enforcement agent charged with two counts of second-degree assault after prosecutors said he pointed a handgun at motorists during a traffic confrontation while returning from a federal immigration enforcement operation in the Twin Cities.

Morgan’s attorneys, backed by federal officials, argue he is protected under legal doctrines stemming from the Supremacy Clause of the U.S. Constitution, which establishes that federal law supersedes conflicting state laws. Courts have recognized that federal officers may, in certain circumstances, be shielded from state prosecution for actions taken in the course of their official duties. But Minnesota prosecutors say those protections do not apply here, arguing Morgan’s alleged conduct fell outside any legitimate federal law-enforcement function.

The case has grown into a broader fight over the legal protections afforded to federal officers. Hennepin County prosecutors are seeking to keep the matter in state court, while the federal government has joined Morgan’s effort to move it to federal court. Earlier this week, the Department of Justice filed a notice seeking to have Senior Trial Attorney Paul Quast appear on behalf of the United States in the case.

“These actions by Minnesota sanctuary politicians are nothing more than a political stunt,” a DHS spokesperson said in a statement. “States do not have the authority to charge a federal law enforcement officer while performing his official duties.”

The statement came as Hennepin County Attorney Mary Moriarty’s office urged a federal judge to reject Morgan’s request to transfer the case out of Minnesota state court.

In filings submitted this week, prosecutors argued Morgan is attempting to “transform his moment of road rage — committed on a state highway against Minnesota victims — into a federal enforcement action.”

The filing, submitted by the Hennepin County Attorney’s Office along with the Institute for Constitutional Advocacy and the Washington Litigation Group, contends there is no meaningful connection between the alleged assault and Morgan’s responsibilities as an ICE agent.

According to prosecutors, Morgan’s authority to arrest and detain individuals suspected of violating immigration laws did not extend to confronting motorists on a Minnesota highway.

“There is no evidence of any job-related circumstance requiring the defendant to rush to his destination or to drive on the highway shoulder to get there,” the filing states. “It was the defendant’s decision to drive illegally on the shoulder to avoid the inconvenience of rush-hour traffic, and to draw and point his firearm at motorists who got in his way.”

Morgan’s attorney, Ryan Pacyga, filed the removal petition last week, arguing the alleged conduct occurred while Morgan was performing federal law enforcement duties and that both he and his partner feared “imminent bodily harm” during the encounter.

According to court records, Morgan was returning to the Whipple Federal Building at Fort Snelling on Feb. 5 after participating in Operation Metro Surge when the incident occurred on Highway 62 near the Interstate 35W interchange.

Prosecutors say Morgan and another ICE agent were driving on the highway shoulder during rush hour when a Cadillac moved over and blocked their path. Authorities allege Morgan then pulled alongside the vehicle, drew a handgun and pointed it at the occupants.

One of the motorists called 911 and reported that a man had aimed a Glock at his face, while both occupants later told investigators they feared for their safety. Morgan was charged with two counts of second-degree assault and was released after posting $100,000 bail.

Morgan’s case is not the only prosecution stemming from Operation Metro Surge.

Moriarty’s office later charged another ICE agent, Christian Castro, with multiple assault counts in connection with the alleged shooting of Julio Sosa-Celis, an incident that sparked protests in north Minneapolis.

Judge blocks DOJ from releasing Biden’s conversations with biographer for 3 weeks

Washington — A federal judge on Friday temporarily blocked the Justice Department from giving a conservative think tank a redacted transcript and recordings of former President Joe Biden’s decade-old conversations with his biographer, Mark Zwonitzer.

U.S. District Judge Dabney Friedrich granted Biden’s request for an injunction to give a federal appeals court a chance to decide whether to take action on the case, effectively delaying her own order from earlier in the day. She said her order will remain in place for three weeks.

Earlier Friday, Friedrich had denied Biden’s bid to stop the Justice Department from disclosing the material to the Heritage Foundation. The judge said Biden’s privacy interests in the case are mitigated by “extensive redactions” by the Justice Department.

The government had agreed to delay the release of the material to the Heritage Foundation until 5 p.m. Friday.

“Biden has not identified any public harm that would arise absent an injunction in this case,” Friedrich wrote in a 26-page decision. “And, as with the Department’s FOIA balancing discussed above, the harm to Biden’s diminished privacy interest is outweighed by the public’s interest in the Zwonitzer materials and FOIA’s ‘policy of broad disclosure of Government documents in order to ensure an informed citizenry, vital to the functioning of a democratic society.’”

On the heels of Friedrich’s decision, Biden’s lawyers filed an emergency motion asking the judge to block the disclosure of the transcript and tapes to the Heritage Foundation while it appeals her decision — a motion Friedrich later granted.

“This Court should grant an injunction pending appeal to prevent an irreversible change in the status quo,” they wrote. “President Biden’s motion for a preliminary injunction raises serious legal questions, and the disclosure of his private conversations cannot be undone. The resulting damage to his privacy and to weighty law enforcement interests will be permanent.”

The dispute over Biden’s discussions stems from a Freedom of Information Act request that the Heritage Foundation filed in March 2024. The group sought records that former special counsel Robert Hur relied on to write specific portions of his report on Biden’s handling of sensitive government records, which included passages referring to the former president’s recorded conversations with Zwonitzer in 2016 and 2017.

The interviews were used for Biden’s 2017 memoir, “Promise Me, Dad.”

Hur’s report referenced the former president’s “diminished faculties and faulty memory” shown in Zwonitzer’s recordings, and called Biden’s recorded conversations with his ghostwriter “painfully slow, with Mr. Biden struggling to remember events and straining at times to read and relay his own notebook entries.”

While the Justice Department initially withheld the audio tapes and most of the written transcripts, citing certain FOIA exemptions, the department under President Trump said it intended to disclose the material to Congress and the Heritage Foundation.

Biden moved to intervene and asked the court to issue a preliminary injunction blocking the disclosure. He also filed a separate lawsuit last month that seeks to block the release of the audio files to the House Judiciary Committee. The judge overseeing that case has yet to rule on Biden’s effort to prevent the disclosure to lawmakers.

In her decision in the Heritage Foundation case, Friedrich wrote that the department “made substantial redactions to the audio and transcripts since its earlier stance in opposition to release.”

The material, she said, does not mention sensitive topics like illness or death, nor any private people, including members of Biden’s family. Friedrich said the case involves an “unusually strong public interest” in the release of the conversations.

“In short, this case presents a confluence of significant public disclosures of prosecutorial decision-making, explicit reliance on particular records, and the statements of a high-profile public figure to support the Department’s decision,” she wrote.

The former president had argued that his conversations with Zwonitzer were never intended to be shared broadly. He said the Justice Department has the recordings only because of Hur’s investigation, which resulted in no charges.

Hur said in his report that while the investigation uncovered evidence that Biden “willfully retained and disclosed classified material” after his vice presidency, the evidence didn’t establish his guilt beyond a reasonable doubt.

“It is not ordinary for the Department to abandon its duty to protect law enforcement records containing sensitive personal information, instead offering them up to political operatives,” Biden’s lawyers wrote in a May filing.

California Attorney General Rob Bonta doubled down on Gov. Gavin Newsom’s claims that the Trump administration is weaponizing the Justice Department after being pressed on reports that the federal probe involving Newsom and his wife originated in California and was not opened by the Trump Administration in Washington, D.C.

“I know what I’ve concluded is that this is highly dubious — there’s no trust in it,” Bonta said. “This is someone who’s weaponized the U.S. DOJ time and time again. I think he’s doing it now.”

Newsom took to X on Monday to publicly announce his uncovering that he and his wife, Jen Siebel Newsom are being investigated by the DOJ, claiming President Donald Trump directed the DOJ to investigate them and that they’ve joined “Donald Trump’s hit list.”

He is also widely claiming that Trump is targeting him because of recent speculation of Newsom as a promising 2028 presidential bid.

“Newsom is the governor for the biggest state, the bluest state in the nation, the fourth largest economy in the world,” Bonta said “Everyone knows that he could be president of the United States. So you put that situational awareness and context into this, and what do you conclude?”

Bonta told Fox News Digital that Trump has “weaponized” the Justice Department, saying it has shifted from pursuing criminal prosecutions to conducting “political persecutions against political enemies.”

“If that doesn’t destroy trust and make you doubt the intent behind this probe, I don’t know what else I can tell you,” Bonta said.

Bonta claimed Trump has used the DOJ to commit “political persecution” of his enemies, including a specific reference to “shifty Schiff.”

Sen. Adam Schiff, D-Calif., declined to answer questions from Fox News Digital about reports that the probe was opened by federal prosecutors in California rather than the administration in Washington.

Sources familiar told Fox News that the investigation has been ongoing since 2025 and that the probe is based on whistleblower complaints related to Newsom and his wife’s personal finances. The case is being handled by the U.S. Attorney’s Office in Sacramento.

A source also said that Washington was not involved in the decision to open the probe, according to the Associated Press.

An investigation launched last year under then-President Joe Biden resulted in corruption charges against Newsom’s former chief of staff, Dana Williamson. She pleaded guilty to lying about sharing internal information with a former associate. Newsom was not involved in the probe personally. It is reported that Newsom’s office believes the Trump administration’s federal investigators widened the efforts of the probe to also look into Newsom.

The Governor’s office announced on Monday that it filed a public records request to the DOJ seeking documents that mention Newsom or his wife during Trump’s second term, including messages to and from Justice Department leaders.

Washington— The federal government awarded a company owned by a Trump donor a $1.7 million contract to install a new water cleaning system for the Lincoln Memorial Reflecting Pool, federal records show, as President Trump pushes to overhaul the pool — and struggles with a bout of algae and a peeling paint job.

The no-bid contract to install a “Nano Bubble” filtration system went to Green Water Solutions, an Ohio-based company whose owner is listed on federal contracting documents as “JJ Cafaro Investment Trust.” The president and CEO of that trust is identified as John J. Cafaro on Federal Election Commission filings.

Cafaro has donated to several GOP candidates and conservative causes in recent years. He has donated extensively to Mr. Trump’s campaign and to Trump-linked groups, giving $250,000 to the Trump Victory fundraising committee at one point in 2020. FEC records show he also made donations to Democrats at various points.

A businessman and real estate developer, Cafaro pleaded guilty to campaign finance violations in 2010 over donations to his daughter’s congressional campaign. Nearly a decade earlier, he pleaded guilty to conspiring to bribe Democratic Rep. James Traficant, and cooperated with prosecutors.

Cafaro and his wife own a home in Palm Beach, Florida, less than a mile from the president’s Mar-a-Lago resort.

Green Water Solutions is also known as Greenwater Services. Inquiries to Cafaro did not yield a response, and the company referred CBS News to the National Park Service, a division of the Department of the Interior. The New York Times was first to reported on Cafaro’s involvement in the Reflecting Pool project.

On its website, Green Water Solutions describes its specialty as purifying water to remove algae, bacteria and other contaminants using a system that injects ozone-infused “nano bubbles” into the water.

Federal contracting records show that the company received one other government contract: A $1 million contract in 2025 for a feasibility study on using its Nano Bubble system to treat sewage flows in the Tijuana River.

Green Water Solutions also appeared to do work on a Trump Organization property. On its LinkedIn page, the company posted photos of water treatment work it performed on a pond at the president’s golf club in Bedminster, New Jersey, more than a year ago.

Now, Green Water Solutions has been hired to take on the Lincoln Memorial Reflecting Pool, a century-old basin of shallow water that spans more than 300,000 square feet and has struggled with algae blooms for years. Mr. Trump has taken a personal interest in the Reflecting Pool’s overhaul, discussing the project at length, visiting the site and handpicking the color of an industrial-grade sealant that was installed on the pool’s stone floor: “American Flag Blue.”

Green Water Solutions was hired in April by the Department of the Interior to install a Nano Bubble system at the Reflecting Pool, replacing “the existing, failing filtration infrastructure.”

The contract was awarded without a full competitive bidding process. The government cited a contracting rule designed for projects of “unusual and compelling urgency,” pointing to the need to fix the Reflecting Pool in time for the nation’s 250th birthday on July 4. It also called the Nano Bubble system a “highly specialized and niche technology with limited domestic suppliers.”

White House spokesperson Taylor Rogers rebuffed any suggestion of a conflict of interest.

“This contract was awarded by the Department of Interior; the White House did not play any role in the selection process,” Rogers said. CBS News has reached out to the Interior Department for comment.

Cafaro on Friday told The Vindicator, a local newspaper in Youngstown, Ohio, that Mr. Trump “doesn’t know a thing about” his company’s work with the Reflecting Pool, saying he would “never talk to [the president] about it” because “you don’t do things to put friends in awkward positions.”

Cafaro also said, “I have no idea why this is an issue,” arguing “the system is working” to kill algae, and the public attention is driven by “people who don’t seem to like Trump.”

A separate $14.7 million no-bid contract was given to Virginia-based Atlantic Industrial Coatings to install sealant on the floor of the Reflecting Pool, federal contracting records show.

Several days ago, after water was pumped back into the Reflecting Pool, issues began to arise. A sheen of algae appeared in the water earlier this week, and by Thursday, the newly installed pool surface appeared to peel off in at least one location.

An Interior Department spokesperson said the algae bloom was caused by “residual algae” from stagnant water that sat in the pool’s supply lines, calling it “part of the normal startup process.” The department later said on X the Nano Bubble system “very effectively killed the algae.” CBS News has reached out to the department about the peeling sealant.

Work crews were then seen cleaning out algae and pouring hydrogen peroxide into the water. Also spotted in recent days: a Nano Bubble system.

Injured climber trapped alone on Mount Everest for days reveals how an avalanche saved his life

For three days, Nepali mountaineer Dawa Sherpa was trapped deep inside an Everest crevasse, surviving on biscuits, chocolates and chunks of ice, while back home his family had already begun mourning his death.

Sherpa himself had nearly given up hope of rescue, until an avalanche thundered into the 25-foot deep ice crack, filling it with snow and creating a route to freedom.

“I am very happy to be back, I thought I would die there,” Sherpa, 57, told AFP, giving his first full account of his dramatic self-rescue, as he recovers in an apartment in Kathmandu with his family.

He had clawed his way out of the crevasse and crawled down the world’s highest mountain with his frostbitten fingers, dragging his fractured leg and eventually nearly reaching Base Camp a week after he had been last seen.

Back home, monks had already begun performing last rite rituals for him, as his devout Buddhist wife and daughter mourned him, presuming him dead.

Initially, in the confusion of the rescue, it was reported he had been missing for six days, since May 30.

In fact, even more remarkably, Sherpa reckons he had collapsed exhausted a day earlier on May 29 — meaning he had been alone on the mountain for an entire week.

“Couldn’t move”

Sherpa, also known as Hillary like the legendary climber Edmund Hillary, was employed as a cook at Camp Two by a small expedition organizer, Himalayan Traverse Adventure.

But they roped him in as a substitute for a guide, despite never having summited Everest before.

Sherpa went as high as the Balcony, around 27,559 feet high, on May 28, before descending to Camp Four at dark with British climber Chris Thrall, Polish climber Mariusz Chmielewski and guide Pasang Kaji Sherpa.

They were returning after one of the final summit pushes of the spring climbing season, in what has become the busiest year on record for Everest.

Thrall was the last to see Sherpa, after descending to an altitude of around 26,000 feet.

Sherpa said he fell behind because he ran out of oxygen, and told Thrall to continue.

“I told him to keep going, and that I will come,” he said. “But when my oxygen ran out, I couldn’t move my hands or feet. So I stayed at the rope for about half an hour.”

Alone and exhausted, he slowly made his way to a tent and found some noodles.

“I ate it, and it helped me gain consciousness … I then came down to Camp Three,” he said, still around 23,000 feet high, where he spent a night in howling gales.

“I heated water … cooked some porridge and had it.”

By then, the rest of the team had reached Camp Two and raised the alarm with the expedition company.

But search and rescue efforts were delayed.

Sherpa said that he had a satellite phone, which he could not get to work, and a walkie-talkie radio — but its batteries went dead.

Dried coffee and ice

Sherpa struggled on the next day, reaching Camp Two, but by that time, all other climbers had gone on.

Again, he was alone.

He planned to continue to Base Camp in one go, but as he crossed the treacherous Khumbu icefall, the fractured head of a glacier, he fell into the crevasse.

“I slipped and fell from a ladder, and I hung there for a long time,” he said, saying he was still clutching a 62-pound bag with eight empty oxygen cylinders and the client’s sleeping bags.

Only after his hands tired did he let go of the bag into the icy depths.

Eventually, unable to hold on, he fell too.

“I hit my head but landed in a flat area,” he said, injuring his leg.

Digging into his jacket, he brought out frozen chocolate and dried coffee.

“I had some biscuits and some chocolates in my pockets, and coffee … I didn’t have any hot water, so I would break some ice and wet my mouth,” he said.

On June 3 — six days since he was left — a helicopter thundered overhead.

But he was still deep inside the crevasse.

“I knew that a helicopter came, I could hear its sound, but could not see it,” he said.

“I didn’t think I would be alive,” he told BBC Nepali from his hospital bed earlier this month. “I thought I would perish this way.”

“No one came”

Sherpa said he spent two nights in the crevasse, unable to climb out its “smooth walls.”

“There was nowhere to go. I would wonder if I would live or die, just hoping that someone would come and rescue me,” he said.

“But no one came — instead, an avalanche did, to save me.”

The avalanche filled in the crevasse with snow, allowing him to crawl out.

“It was very difficult, it must have taken me an hour — holding onto the ice, and latching on with the crampons,” he said.

“I stepped on a piece of snow and moved up slowly. When I came out on the slope, I felt that I will now survive.”

Once out, he found a rope and followed it, eventually crawling down close to Base Camp.

There, on the morning of June 4, he was found by the Sagarmatha Pollution Control Committee, a Nepali team that helps set routes on Everest and clean up waste left behind.

“I was very happy to see them,” he said.

Sherpa was airlifted to Kathmandu, where doctors treated him for frostbite, severe dehydration and a fractured thigh bone.

His improbable survival has sparked celebration among fellow climbers, but also anger from family members and the mountaineering community over the failure to locate him sooner.

The government has launched an investigation.

Asked if he would return to the mountains again, Sherpa said his time climbing for work was over.

“I will not go to the mountains now, maybe just for some trekking,” he said.

“There should be a limit”

More than 1,000 climbers reached Everest’s summit, according to preliminary Nepali government figures, making it the busiest season on record.

The government collected more than $7 million from issuing climbing permits for Everest.

Climbers set a record on May 21, when 274 of them successfully ascended Nepal’s side of the mountain in a single day, officials said. Experts have warned of the potential dangers of overcrowding, especially after two climbers died around the time of that record-setting day.

Increasing popularity not only increases congestion on the mountain, but also means less experienced climbers are more likely to be among the groups attempting the trek, one sherpa told AFP.

“There is a need for authorities to control this number,” Kami Rita Sherpa said. “They should let in only climbers of quality — there should be a limit.”

From Chalamet to Messi, prediction markets are betting on celebrities to boost their brands

Prediction markets are betting that celebrity endorsements will help attract more users.

Kalshi, a trading platform that surged in popularity during the 2024 presidential election, has recently released a slew of celebrity advertisements featuring famous athletes as it seeks to capitalize on the hype around the NBA Finals and the FIFA World Cup.

The push could drive more people to Kalshi, where most wagers are driven by sporting events, according to Elizabeth “Zab” Johnson, a visual marketing professor at the University of Pennsylvania’s Wharton School.

“The platform is about sports betting and predictions, so they also know that they’re capitalizing on a market that’s happening right now,” she told CBS News.

A Kalshi spokesperson said the World Cup was a natural time to roll out new campaigns, given its cultural significance and impact on the sports world. The goal of the celebrity ads is to drive brand awareness, the spokesperson added.

“There’s a lot of merit in having them post, because they have a lot of fans,” the spokesperson told CBS News.

One recent addition to Kalshi’s roster of celebrity partners is soccer phenom Lionel Messi. He is part of a larger partnership with the Asociación del Fútbol Argentino, the governing body of Argentina’s national football team. The platform also recently struck a multi-year deal with actor Timothée Chalamet.

Both have since promoted the brand on their personal social media accounts. The ads feature the Kalshi logo but omit the Kalshi trading interface, leaving the viewer to focus on the celebrities.

Kalshi has also launched campaigns featuring Croatian soccer player Luka Modrić through a partnership with the Croatian Football Association, Milwaukee Bucks star Giannis Antetokounmpo and several other international soccer stars.

Kalshi competitor Polymarket plans to follow suit, with a spokesperson telling CBS News that they are gearing up to announce new partnerships soon. Neither disclosed how much they are spending. Johnson said the deal sizes would depend on contract details, but could easily be in the eight- to nine-figure range.

The celebrity push comes as prediction markets seek to broaden their reach. Kalshi and Polymarket have already inked major deals with news outlets, the National Hockey League and other notable companies like Venmo.

A familiar strategy

Prediction markets’ embrace of celebrity advertising follows a long-standing strategy used by companies seeking to build trust and attract customers through familiar faces.

“It’s maybe newer for prediction markets to go down this path, but it’s kind of just the age-old mass marketing approach you see, especially when you’re trying to establish legitimacy in a space,” said Jared Watson, an associate professor of marketing at New York University’s Stern School of Business.

Celebrities are also natural attention-grabbers. Research published in 2023 by Johnson and another Wharton marketing professor found that people are more likely to choose a product endorsed by a celebrity than by a non-celebrity.

“We prioritize information that comes to us from people that we think have valuable input, and celebrities are in that category,” Johnson told CBS News.
