    A federal appeals court ruled Friday that U.S. immigration officials must offer detainees “a meaningful opportunity to contest” any deportation to countries where they have no ties.

    The ruling by the Boston-based U.S. Court of Appeals for the First Circuit marks a setback for the Trump administration’s controversial “third-country” deportation policy, which has dropped off some migrants thousands of miles from their country of origin — in some cases sending deportees who hailed from Latin America to sub-Saharan Africa.

    The appellate court largely upheld a lower court order finding that policy illegal, ruling against Department of Homeland Security rules that allow federal immigration officials to send deportees to so-called “third countries” with little to no notice or opportunity to challenge their deportation.

    The DHS policy in question, enacted last year, gave officials the power to send migrants to a third country without giving them any notice if that nation gave the State Department blanket assurances that it would not persecute or torture the deportees. In cases in which third countries do not make such assurances, the policy instructs officials to give detainees some notice.

    The appeals court affirmed, for the most part, a ruling from U.S. District Court Judge Brian Murphy, who has repeatedly rebuked the administration’s third-country deportation campaign on the basis that it has violated deportees’ due process rights.

    “An individual’s right to contest removal to a country based on a fear of persecution in that country means little if one does not receive prior notice of the intended removal destination and a meaningful opportunity to contest that destination,” the appeals court panel wrote.

    The National Immigration Litigation Alliance, one of the groups that sued over the policy, said the First Circuit “clearly held that the government cannot evade protections against persecution and torture by simply changing the deportation destination.”

    “For over a year, many class members [have] been deported to countries they had never been told they could be removed to, with little or no notice and without a meaningful opportunity to explain the dangers awaiting them there,” said Trina Realmuto, the group’s executive director.

    DHS General Counsel James Percival said on X late Friday: “The third country deportation policy continues, as the First Circuit’s ruling is not currently in effect. If you claim fear in your home country, DHS has the right to send you elsewhere.”

    Friday’s ruling will almost certainly be appealed to the Supreme Court. But it is nonetheless a significant legal defeat for an intensifying part of President Trump’s crackdown on illegal immigration.

    His administration has brokered third-country deportation agreements with more than 30 nations across the globe, including African countries like Liberia. In some cases, deportees are sent to a third country because a court order protects them from being sent to their country of origin, but does not bar the government from deporting them altogether.

    More than 25,000 migrants have been deported to third countries under the Trump administration, around 80% of whom have been sent to Mexico, according to one advocacy group.

    CBS News reported earlier this week on a group of deportees who were flown to Liberia last month, including citizens of countries in South and Central America — like Brazil, Colombia, Guatemala, Honduras and Venezuela — and people from other parts of Africa. The migrants, who are living in a hotel, said they were not notified by U.S. Immigration and Customs Enforcement that they would be removed to Liberia, and weren’t given the chance to challenge their deportation to West Africa.

    “I’m concerned,” Honduran native Elvis Rodriguez Venturas told CBS News. “I feel far away, on the other side of the world.”

    Sept 18 (Reuters) – U.S. ​President Donald Trump said on ‌Friday that he might bar other media outlets from the White ​House, hours after saying ​CNN, MSNOW (VSNT.O) and Politico were ⁠banned.

    Speaking from the Oval Office, Trump repeated his belief that the center should append his name ​to the building in exchange for his work to raise money to renovate the facility. ​He falsely claimed the center faced long-term financial strains that required dramatic action, ⁠although the facility posted profits in seven of the past nine years, according to its ​tax filings.

    “I think the Trump administration should be recognized as having saved the Kennedy Center because nobody ​else remembers,” Trump said.

    The Kennedy Center board, which has said the facility requires a $257 million renovation, earlier this week voted to close the facility for two years for the project. US District Judge Christopher Cooper subsequently ordered the ​Trump administration to explain whether the closure violates a court order limiting its ability to shut ​down.

    Cooper also ordered the administration to provide 30 days’ notice before taking steps to demolish the building.

    “President Trump is holding ‌the ⁠Kennedy Center hostage,” said Norm Eisen and Nathaniel Zelinsky, attorneys representing U.S. Representative Joyce Beatty, an Ohio Democrat and ex-officio member of the center’s board who is leading litigation against the administration over its plans for the facility.

    Representatives for the center did not immediately respond to a request for ​comment on Friday.

    The board, chaired ​by Trump and ⁠controlled by his appointees, earlier this year attempted to rename the facility the “Trump-Kennedy Center” and went so far as to add the president’s name to ​the building. After Cooper ruled that only Congress could rename the center, ​the board ⁠installed a tarp over the front facade of the building that has remained there as the legal fight continues.

    WASHINGTON, Sept 18 (Reuters) – US President Donald Trump said on Friday his son, Donald ​Trump Jr., has told him he would pay back ‌a Russian oligarch who bankrolled wedding celebrations for him in the Bahamas in May.

    Democrats in the US Congress launched an investigation this week into reports that Umar ​Kremlev, a wealthy Russian businessman and president of the International ​Boxing Association, paid hundreds of thousands of dollars for ⁠the wedding festivities.

    ProPublica, which first reported Kremlev’s involvement, said he has ​close ties to the Russian government.

    Trump told reporters on Friday that ​when he asked his son about the report, he responded, “‘No, I’m paying it back, Dad.’ And that was a while ago. So I heard he’s paying.”

    A person ​familiar with the situation confirmed that Don Jr. planned to ​reimburse Kremlev.

    Kremlev and the IBA did not immediately respond to requests for comment late ‌on ⁠Friday.

    The president, who did not attend his son’s wedding, said in a statement earlier in the week that he does not know Kremlev and that the wedding controversy is “not a big deal!”

    Trump said on ​Friday he has ​given wedding ⁠parties to “numerous people” at “beautiful places” like his Mar-a-Lago Club in Palm Beach, Florida.

    “They get married, I give ​them a party,” Trump said. “With all of that being ​said, ⁠I understand that Don’s paid him back.”

    Don Jr.’s wife, Bettina Trump, in an Instagram post on Monday called Kremlev a friend who extended an “extraordinarily ⁠generous ​wedding gift,” stressing that Kremlev paid for ​two after-parties, not the wedding itself.

    Russia sanctions bill gives Trump sweeping new tariff powers

    WASHINGTON, Sept 18 (Reuters) – The Russia sanctions bill signed into law by US President Donald Trump on Friday gives him new powers to impose tariffs that could last well beyond his presidency, injecting more uncertainty into the global economy after nearly two years of trade wars.

    The immediate impact ​may be limited, given Trump’s reluctance to take actions that could push consumer prices higher ahead of the November midterm elections, when control of Congress is at stake, analysts said.

    But critics say the legislation, ‌which imposes tariffs on Russia’s biggest trading partners, has broad language that could herald trouble for other countries as well if they find themselves in Trump’s crosshairs in the future.

    The bill requires Trump to impose tariffs of up to 100% within 30 days on all goods imported into the US from the five largest importers of Russian crude oil or gas as well as any country that knowingly made new purchases of oil or gas 30 days after the law was enacted or was among the top five countries helping Russia evade sanctions.

    China and India are among the ​biggest buyers of Russian oil, but critics say the law gives US officials enough leeway to name a range of targets since it does not name any country or spell out how the top-five lists would be ​calculated.

    “Given the discretionary authority that the president has, it is likely to be abused,” said Laura Brank, a lawyer at Bryan Cave Leighton Paisner who focuses on cross-border transactions.

    Since returning to ⁠office in January 2025, Trump has imposed tariffs of up to 50% on more than 80 countries, though the Supreme Court has struck down many of them, saying he exceeded his authority. Trump has cited a variety of reasons, including disagreements ​with foreign leaders, for his actions.

    Challenging the latest tariffs in court could be difficult since the law specifically calls for the duties, while previous challenges to tariffs have successfully argued that the Trump administration misapplied laws from decades earlier.

    US Representative Don ​Beyer, a Virginia Democrat, argued that Trump had wrongly used existing trade laws to pursue his agenda in the past and is likely to do the same with the new law. The White House has denied abusing any trade laws.

    “We don’t know when, but you don’t need a crystal ball to know what is likely to happen next,” Beyer said on social media.

    Once Trump agreed to move forward with the bill in July after over a year of delays, US officials pushed for quick passage to give Trump additional leverage in his meeting with Chinese President Xi ​Jinping next week, according to congressional sources.

    US officials have tried to reassure lawmakers that the measure has sufficient guardrails, while acknowledging its significance in handing control of tariffs to the White House.

    “It is the first time in nearly forty years that Congress ​has granted new tariff authorities to the executive branch,” White House legislative director James Braid said in a post on X on Wednesday.

    The White House did not respond to a request for comment on concerns about the broader scope of the measure.

    LACK OF CLARITY ON ‌TARGET COUNTRIES

    The sweeping package, ⁠which passed Congress on Wednesday, aims to deprive Russia of funds used to pay for its nearly five-year war on Ukraine. The legislation authorizes sanctions against Russia’s energy and defense industries, as well as its “shadow fleet” of tankers used to evade existing sanctions.

    Moscow on Thursday said further US sanctions against Russia would make it harder to reach a peace deal in Ukraine.

    Jeannette Chu, vice president of the National Foreign Trade Council, a trade group that advocates for open trade, said different entities had differing assessments of which countries could be hit with tariffs since no firm criteria were spelled out. The countries speculated as likely include Brazil, India, Japan and countries in the European Union, she said.

    China said it “consistently opposed long-arm jurisdiction that lacks a basis in ​international law” while India warned Washington that new tariffs could ​impact bilateral ties.

    In a worst-case scenario, Chu said, Ukraine ⁠itself could suffer if the new tariffs cut off Russian oil and gas supplies for refined products in EU countries, given it relies on diesel from refineries in Hungary and Slovakia.

    Not everyone agrees the bill gives the Trump administration too much leeway. The conservative think tank Foundation for Defense of Democracies argues that the bill lays out sufficient criteria on which countries can ​be hit and rejects the idea that it gives Trump a back door to imposing other tariffs. It noted that the original version of the bill required even higher tariffs ​of 500%.

    RISKY TIMING

    Any new duties would ⁠have to be announced just days before the midterm elections, which could push oil prices higher at a time when voters are already unhappy over rising costs. Trump’s popularity has declined since he launched a war on Iran in February that has disrupted oil shipments from the Middle East.

    “Given the state of the current energy markets, it certainly seems risky,” said Ryan Majerus, a former senior US official who served under both Democratic and Republican presidents and is now with law firm King & Spalding. He says Trump could get around ⁠the timing issue ​by imposing a zero-rate tariff and revising it later, at will.

    Others say Trump’s reluctance to take tough action against Russia since returning to office raises ​questions about how he will implement the legislation, which also gives Trump broad authority to waive tariffs or sanctions for national security reasons. That would let him avoid hitting Moscow or its backers harder, simply by notifying Congress, they said.

    “This is entirely discretionary,” said Ben Harris, a former senior Treasury Department ​official under former Democratic President Joe Biden. “The definitions are vague and the president has kind of a get-out-of-jail-free card in the form of a waiver.”
