    Trump seeks do-overs at a Supreme Court that rarely grants them

    When it comes to the Supreme Court, President Donald Trump has become a believer in unlikely second chances.

    In the days since the court’s term ended last week with a flurry of high-profile opinions, the president and his legal team have floated the idea of invoking a longshot request to have the justices reconsider decisions they just made — a procedure that, in some cases, hasn’t worked in more than half a century.

    Trump’s lawyers have already filed for a rehearing of the court’s decision to deny an appeal over a $5 million verdict finding that he sexually abused and defamed magazine columnist E. Jean Carroll. And on Wednesday, Trump vowed to ask the court to re-do its decision shutting down his birthright citizenship order.

    “The Supreme Court’s ruling is wrong,” Trump posted on social media. “I will be asking for a Rehearing by the United States Supreme Court, IMMEDIATELY. This miscarriage of justice will destroy America if they don’t change their absolutely insane decision.”

    Supreme Court rules technically allow parties to file for a rehearing within 25 days of a decision. But in practice, the court usually only grants such requests when a significant development comes to light in the aftermath of a ruling, not because the losing party simply disagrees with the outcome.

    The court voted 6-3 on June 30 to invalidate Trump’s effort to end automatic birthright citizenship through executive order. A five-justice majority concluded that the order violated the citizenship clause of the 14th Amendment and a sixth justice, Brett Kavanaugh, reasoned that the order was constitutional but was nevertheless barred by federal immigration law.

    The last time the Supreme Court entertained a request to review a decision in an argued appeal was in 1965. That case, Maryland v. US, involved a 1958 airplane crash between a commercial plane and a Maryland National Guard training flight and the question dealt with whether the plaintiffs could seek damages against the United States government. The court ruled in 1965 that the pilot was an employee of the state of Maryland, not the federal government.

    But the plaintiffs argued that the lower courts had reviewed only the liability of the pilot, not government air traffic controllers. And so the Supreme Court, in a brief order, allowed that separate issue to move forward in lower courts.

    Almost a decade earlier, the court granted a request to rehear a case involving the court martial of two civilian wives who killed their military husbands overseas — one in England and the other in Japan. On rehearing, the court concluded that the women could not be tried by court martial. To this day, it remains the only time the Supreme Court ever reheard a case it had decided and reversed itself.

    “It is extremely rare for the court to grant reconsideration,” said Michael Dorf, a constitutional law professor at Cornell Law School.

    “When it does so, it is typically because some vital information was not before it originally,” Dorf told CNN. “Simple attempts to re-litigate a decided issue invariably fail.”

    The Department of Justice did not respond to questions about Trump’s promise to seek a rehearing.

    Trump’s odds, based on past practice, might be slightly better in the case of Carroll — but it’s still highly unlikely.

    The president’s attorneys urged the Supreme Court this week to reconsider its decision to deny his appeal of the $5 million verdict in the Carroll case. And they have subsequently asked lower courts to delay that payment so the justices may consider that request.

    Trump has noted that he will soon appeal a separate case involving Carroll and it has suggested the Supreme Court should wait to consider the two cases together. But the president’s lawyers already made that suggestion in a letter to the court last month. The court nevertheless denied the appeal last week without dissent.

    Lawyers for Carroll declined to comment for this story.

    Reconsiderations of decisions to deny an appeal are somewhat more common than rethinking a final decision, though they almost always involve a significant change in circumstances since the court acted. The last time the Supreme Court granted such relief was more than a year ago, in a case involving a federal anti-doping law for the horseracing industry. There, the Supreme Court sent the dispute back to a federal appeals court for additional review after a different federal appeals court drew the opposite conclusion of the law’s constitutionality.

    In asking a lower federal court to withhold payment to Carroll, Trump’s attorneys cited about a dozen cases — dating back to in 1940 — in which the Supreme Court had reconsidered a decision to deny an appeal.

    “Rehearing is not some legal impossibility,” Trump’s lawyers told the lower court this week. “The court must not ignore the grave and irreparable consequences of disbursing funds that may never be recovered.”

    The federal judge in that case rejected that argument on Wednesday, ordering the release of the funds to Carroll.

    Trump quickly appealed. A federal appeals court quickly denied the request Wednesday for immediate relief while it considers Trump’s ask for a longer pause on the payment.

    Former Florida Gov. Jeb Bush praised President Donald Trump for his efforts in crippling the Iranian regime, but warned that Cuba is now believed to have hundreds of explosive drones from Tehran.

    Bush made the statement at a United Against Nuclear Iran (UANI) event on Wednesday, standing next to an Iranian Shahed-136 drone. The Shahed family of drones are cheap but effective kamikaze weapons that Iran has used extensively in the Middle East, in addition to shipping them to Russia for use against Ukraine.

    “We have decimated Iran’s capability to make mischief in the region. There’s no doubt about it,” said Bush, who is UANI’s chairman, adding that he applauds the Trump administration for their work.

    “I also want to point out that the press reports are that there are 300 of these in Cuba,” Bush said, gesturing toward the drone.

    “We have very good defense capabilities, so this is not a press conference to scare the bejesus out of people. The United States does have capabilities of defending the homeland, for sure,” Bush qualified before saying the drones nevertheless pose “a threat.”

    Bush was joined at the event by Rep. Carlos Gimenez, R-Fla., who warned attendees that while Shahed drones are a “terror weapon,” they are also the future of how wars are going to be fought.

    Gimenez emphasized the effectiveness of drones in the war in Ukraine, where Kyiv’s forces have manufactured millions of small explosive drones for their defense, and to great effect.

    Former U.S. Ambassador to the U.N. Mark Wallace, now CEO of UANI, also spoke at the event, calling the Shahed drone “the ubiquitous terror weapon of mass destruction in modern warfare.”

    A federal judge in Brooklyn has ordered Indian billionaire Gautam Adani to answer questions about whether there was any sort of quid pro quo made in connection with the Justice Department’s decision to dismiss criminal foreign bribery and securities fraud charges against him.

    In a court filing early Thursday, U.S. District Judge Nicholas G. Garaufis told Adani he has until July 15 to answer whether he is aware of “anything promised, offered, sought, received, agreed to, or accepted, by anyone in connection with the dismissal of the indictment” and whether he knows of any “agreement exchanging anything for the dismissal of the Indictment.”

    The demand represents an escalation between the Justice Department and the court, after senior politically-appointed DOJ officials sought to dismiss all the charges against Adani and other executives over an alleged scheme to pay more than $250 million in bribes to Indian government officials to secure solar energy supply contracts.

    The decision to dismiss the case has raised eyebrows and sparked questions from Garaufis. Two career prosecutors who were involved in the case withdrew from the matter after the motion to dismiss was filed. Additionally, politically-appointed officials — the U.S. Attorney for the Eastern District of New York and Trent McCotter, the Principal Associate Deputy Attorney General — were the only signatories on the motion to dismiss.

    Although the Adani case in the Eastern District of New York previously survived a DOJ and Securities and Exchange Commission review ordered by the White House into all Foreign Corrupt Practices pending prosecutions, the decision was later reversed by McCotter.

    McCotter made the determination after he and other government officials met with Jamie McDonald, Bob Giuffra and Andrew DeFilippis of Sullivan & Cromwell who represented Adani, sources previously told CBS News. McDonald has since been nominated by President Trump to serve as U.S. Attorney for the Southern District of New York. He returned to the U.S. Attorney’s office in Manhattan this week to help lead it until its current top prosecutor, Jay Clayton, is confirmed by the Senate to oversee the Office of the Director of National Intelligence.

    In one of these meetings at the Justice Department about the Adani case, Giuffra made a presentation that disputed evidence of the alleged bribery scheme, according to sources familiar with the matter and records reviewed by CBS News. One slide touted how one of Adani’s companies is “powering India’s progress,” and another slide said the Trump administration “would not have brought the case.”

    If prosecutors were to drop the charges, Giuffra also said at the meeting, Adani would be willing to invest $10 billion in the American economy, sources told CBS News.

    McCotter, in a recent letter to the court, aggressively pushed back against any effort by the judge to question the Justice Department’s decision to dismiss the charges.

    “Demanding the rationales for dismissal will hurt defendants—not just the defendants here, but untold other defendants in future cases—by potentially chilling the Department from seeking dismissal of criminal charges it determines are not in the interests of justice,” he wrote in a July 4 filing.

    McCotter also addressed the media reports about the offer by Adani to invest in the U.S. economy, telling the judge that those stories were leaked by current and former prosecutors and had no bearing on his decision-making.

    “Current or former department attorneys who unethically fed those stories have suggested that I sought dismissal of the securities charges at least in part because of some promise by those defendants to invest money in the United States. That is false. Before that topic first arose, I had already firmly concluded I would seek dismissal of the securities charges no matter what, because they were so indefensible,” he wrote.

    Garaufis on Thursday highlighted those comments in his order, saying they raised fresh concerns about the potential for an improper quid pro quo.

    The statement”raises-for the first time- the specter of a possible agreement (involving one or multiple defendants) in connection with the dismissal of the indictment that has neither been memorialized nor previously brought to the attention of this court,” he wrote.

    This is not the first time that the Justice Department has had a standoff with a federal judge over the dismissal of criminal charges.

    Last year, a federal judge in New York’s Southern District raised questions after senior political officials sought to dismiss public corruption charges against former New York City Mayor Eric Adams.

    The move sparked resignations in protest from 11 federal prosecutors in New York and Washington, and it raised questions about whether the Trump Justice Department was dismissing the case in exchange for Adams’ cooperation with the president’s immigration priorities.

    U.S. District Judge Dale Ho forced the government to dismiss the case with prejudice, meaning it could not be brought again, and said the entire thing “smacks of a bargain.”

    Two of the officials said security personnel felt more comfortable with the president aboard the older vessel — which was built from scratch with the commander-in-chief’s safety in mind — rather than the plane that had recently been retrofitted after it was donated by Qatar.

    While sources said there was no specific, new threat to Trump’s life, the president had mentioned the possibility of an assassination attempt from Iran during the NATO summit, following fresh US strikes on the country that shares a border with Turkey.

    “I’m number one on the list for killing,” he said.

    The specific reason why the older plane was considered a safer option than the newer one was not immediately clear. Two sources familiar with the matter said the newer plane did not possess the same capabilities to ensure its safety in international settings, though a third said it was equipped with many of the same features as the older plane.

    “Threat assessments change all the time,” one source said.

    Before Trump left the NATO summit in Turkey, officials sent the Qatari-gifted jet ahead to England’s Mildenhall Air Force Base. Trump said in a post on social media that the change in planes was simply to give US service members stationed at the base “a chance to tour the Aircraft.”

    “Everybody is so excited, and we thought that they should be the first,” he wrote.

    Trump then switched planes at a secure US airbase in the UK and offered mixed messages on the reason for the change of plans.

    “There wasn’t a security concern, except we sent it a little early, same line going back. We sent it a little bit early, so that we could let them see,” he said.

    But when asked why reporters aboard the plane were asked to lower their window shades on the ascent out of Ankara, Trump allowed that security concerns related to Iran could be a factor. He said Air Force One could be on a “dangerous plane because of the sleaze bags we have to deal with.”

    “These are sick people, so I could see something like that,” he said, adding that he was unaware about the directive to press members to keep the shades down.

    The new jet, a gift from Qatar estimated to be worth about $400 million, has long generated legal, ethical and national security questions, though the Air Force has said it “is safe, secure and equipped with the most advanced technologies necessary to meet the requirements of the presidential mission.”

    One official, who declined to comment on the specific highly classified systems typically onboard Air Force One, noted the 747 gifted by Qatar was largely seen by the military and Secret Service as having been “rushed” into service.

    By contrast, the official noted two new jets acquired as part of a deal Trump renegotiated during his first term have faced serious delays and aren’t expected to be ready until at least 2028. That’s partially due to the host of classified communication and defensive countermeasures that must be affixed, comprehensive design requirements by the military and the time required to train pilots on the unique aircraft.

    “This was always considered a ‘bridge plane’ that the president would use until the other planes were fully loaded,” a different source said of the Qatari plane, comparing it to the pair of new Boeing jets that have been in the process of being modified for years. The Qatari jet, by comparison, took only roughly a year and a half to modify, which concerned some security officials at the time.

    That source noted that in private conversations long before this trip, top White House officials had discussed using the older plane in potentially high-risk international travel, as opposed to the Qatari jet, if needed.

    “The new plane is perfectly safe for the president to fly on,” the source said, but added that there are extra precautions needed when flying to high-risk areas internationally.

    The older plane that took Trump out of Turkey, a heavily-modified Boeing 747-200, has highly specialized capabilities, including mid-air refueling.
