    Legal experts and conservatives are taking aim at newly published ethics guidelines that allow federal judges to speak out on certain issues, arguing the guidance issued by the court’s policy-making body is hypocritical and has been unfairly applied.

    At issue is new ethics guidance published this month by the U.S. Judicial Conference, the national body led by Supreme Court Chief Justice John Roberts in his official capacity and tasked with setting policy for the federal courts.

    It is unclear whether Roberts himself was directly involved in the guidance, but critics assailed it all the same. Article III Project founder Mike Davis told Fox News Digital that Roberts is “giving judicial saboteurs new tools” for the courts to overstep.

    In a departure from earlier guidance, the new advisory opinion states that judges may engage in a “measured defense” of the judiciary, including defending against “illegitimate forms of criticism and attacks” that risk “undermining judicial independence or the rule of law,” and doing so “regardless of whether these comments rise to the level of persecution,” according to a copy of the opinion reviewed by Fox News Digital.

    It goes on to list four areas of illegitimate activity identified by Chief Justice Roberts in his 2024 year-end report, including activities that “either threaten the judges themselves” or threaten the rule of law: “Violence, intimidation, disinformation and threats to defy court orders.”

    “It does not follow, however, that every activity that involves the law or the legal system is considered permissible activity,” the report said.

    The new guidance comes as Trump has assailed so-called “rogue” or “activist” judges who have paused or blocked some of his biggest policy priorities from taking effect during his second term as president.

    It also comes as threats against federal judges saw a sharp uptick in 2025 compared to the previous 12-month period, according to federal data, including increases in online harassment, threats of physical violence and “doxxing” incidents targeting judges and their families.

    The guidance in question seemingly attempts to give judges a forum to dispel some of the criticism against them.

    But it also invited fresh backlash from Trump allies, conservative commentators and court watchers, who argued the guidance is being unfairly applied to protect certain members of the judiciary.

    “The first thing to note” about the new guidance is its timing, said Josh Blackman, a constitutional law professor at the South Texas College of Law, in an interview.

    “It is clearly a response to conservative criticism of liberal judges,” Blackman said. “We didn’t see much of this in the last four years, [when] there were routine death threats against conservative judges.”

    The timing, he added, “is a bit unfortunate, because it gives a sense that only [certain] criticisms warrant a response.”

    Davis went further. In a statement, he railed against the ethics guidance as “sabotaging the exercise of core Article II powers of the duly-elected president,” and another example in which he argued the federal judiciary has overstepped its powers.

    “Friendly reminder: when federal judges take off their judicial robes, climb into the political arena, and throw political punches, they should expect powerful political counterpunches,” Davis said.

    The opinion comes as dozens of former judges have voiced concern over the Trump administration’s rhetoric towards the federal court judges, describing them in a series of interviews with Fox News Digital as unnecessarily inflammatory and amounting to “pouring oil” on an already fast-burning fire.

    The new guidance also stressed that judges “should avoid sensationalism” and commentary that “may result in confusion or misunderstanding of the judicial function or detract from the dignity of the office.”

    The news comes as several judges have been criticized formally for overstepping their duties on the bench, and for otherwise making overtly political comments.

    The Supreme Court last year condemned U.S. District Judge William Young, a Reagan appointee, for failing to respect the commander-in-chief in repeated opinions that assailed Trump as a bully, and as being laser-focused on “retribution.”

    He has also accused the administration of “racial discrimination” and “discrimination against the LGBTQ community,” and asked in one order, “Have we no shame?”

    Trump blames Maryland, D.C. and Virginia for massive sewage spill, offers help if they ask “politely”

    Washington— President Trump is blaming government leaders in the metro Washington, D.C. area, among them Maryland Gov. Wes Moore, following a massive sewage spill into the Potomac River in the Washington, D.C. area, perhaps the largest in American history.

    President Trump said in a post on Truth Social Tuesday that the federal government would help clean up the spill, which occurred in mid-January, if local leaders ask “politely,” though he had said Monday in another post that he would direct federal authorities to “immediately provide all necessary management, direction and coordination” to protect the Potomac.

    After Moore indicated the federal government bears the responsibility for maintaining the collapsed 60-year-old Potomac Interceptor behind the spill, Mr. Trump said in his post that Maryland, Virginia and Washington, D.C. were responsible for the “massive sewage spill,” and if they can’t fix it, “they have to call me and ask, politely, to get it fixed.” He added that the “federal government is not at all involved with what has taken place, but we can fix it.”

    A section of the sewer line collapsed in January in Montgomery County, Maryland, sending more than 200 million gallons of wastewater into the Potomac. Although DC Water — the public utility that’s responsible for the District’s drinking water, wastewater collection and sewage treatment — has diverted the wastewater spill and is working to sanitize the water, it didn’t manage to do so before the wastewater severely tainted the Potomac with high levels of E. coli and other bacteria. DC Water is overseen by the Environmental Protection Agency.

    “This is a Radical Left caused Environmental Hazard,” the president wrote in his post Tuesday. “With all of their talk about carbon footprints and everything else, they’re allowing hundreds of tons of sewage to pour into the Mighty Potomac, making it much less mighty. ACT FAST. I am awaiting your call.”

    The president placed most of the blame for the spill squarely on Moore and Democratic officials in Maryland. He said over the weekend that the Federal Emergency Management Agency is responding to the incident, but that the ongoing funding lapse for its parent agency, the Department of Homeland Security, is affecting the agency.

    But on Tuesday, Moore said it’s the federal government that has long been responsible for the sewage project.

    “I know this is breaking news to everyone, but the president is not telling the truth,” Moore told reporters in Maryland. “Because what you’re looking at with the Piedmont sewage project, that’s not something that the federal government has had responsibility for for the past year; it’s not something that the federal government has had responsibility for the past decade — in fact, the federal government has had responsibility for that for the past century.”

    He added that Maryland Department of the Environment workers were, in fact, among the first to respond to the spill, testing the water quality and sewage. And Moore said the EPA declined to join a congressional briefing that Maryland officials had invited the agency to join.

    “Now that it is essentially 99% contained, I love the fact that the president of the United States is finally realizing that this was his job, and he hasn’t been doing it for the past month,” Moore added. “So I say, ‘Listen, we’d welcome you to help to address the remaining 1% that hasn’t been complete while we’ve been doing your job.’”

    Mr. Trump has made it clear recently he’s no fan of Moore. The Maryland governor is one of two Democrats whom Mr. Trump deemed “not worthy” to be invited to an annual White House meeting and dinner with governors from both parties this week. Moore discussed the slight with CBS News during a “Things That Matter” town hall that aired Sunday night.

    He shrugged off the White House snub, saying that “if the point of the meeting is to turn it into name-calling … I will not go.”

    In another social media post, the president called Moore “foul mouthed,” criticized his performance as Maryland governor and accused him of lying about receiving a military medal. Moore said Mr. Trump’s post was “full of lies” and “unhinged.”

    “I will work with anyone. But I will bow down to no one,” Moore told CBS News. “And I think the president has a problem with that.”

    CBS News has reached out to DC Water, D.C. Mayor Muriel Bowser’s office, the Maryland Department of Environmental Quality, Moore’s office, Virginia Gov. Abigail Spanberger’s office, the Virginia Department of Environmental Quality and the EPA for comment.

    “The damaged portion of sewage infrastructure is owned and operated by DC Water, and the location of the break is in Montgomery County, MD,” the Virginia Department of Environmental Quality told CBS News.

    The Potomac Interceptor was built as a result of a law Congress passed in 1960 that authorized the District of Columbia to construct, operate and maintain a sewer line connecting Dulles to the Washington, D.C. sewer system, according to DC Water.

    An 18-year-old in a tactical vest who charged the US Capitol with a loaded shotgun Tuesday was quickly arrested, US Capitol Police said.

    Police identified the man as Carter Camacho of Smyrna, Georgia, and said he acted alone. They are working to determine a motive.

    Capitol Police Chief Michael Sullivan said Camacho, armed with the loaded shotgun and carrying additional rounds, drove a white Mercedes SUV near the Capitol before exiting and running toward the building.

    He was intercepted by Capitol Police, who drew their firearms and told him to drop his gun and get on the ground, Sullivan said. Camacho complied and laid down before being arrested and taken into custody.

    “Who knows what could have happened if we didn’t have officers” at their posts, Sullivan said.

    “This individual had a tactical vest on,” the chief said, as well as “tactical gloves.” A Kevlar helmet and gas mask were found in the man’s car, Sullivan said. Police found the car in front of the US Botanic Garden, near the Capitol. They said the vehicle was not registered in his name.

    Police have charged Camacho with carrying a rifle without a license, having an unregistered firearm and ammunition, as well as unlawful activities. He was not previously known to Capitol Police, they said.

    Law enforcement temporarily closed traffic and cautioned people to stay away from the area during the incident.

    The Capitol was quieter than usual on Tuesday, with lawmakers away from Washington this week on a pre-scheduled recess.

    WASHINGTON, Feb 17 (Reuters) – CBS late-night show host Stephen Colbert said on Monday that the network’s lawyers barred him from airing an interview with Democratic Texas State Representative James Talarico, who is running for his party’s nomination for the U.S. Senate.

    “Donald Trump’s administration wants to silence anyone who says anything bad about Trump on TV, because all Trump does is watch TV,” Colbert said on Monday’s broadcast of “The Late Show.”

    Until January, talk shows were deemed to have qualified for the equal opportunities exemption as genuine news interviews, ever since the FCC Media Bureau granted an exemption to the interview portion of Jay Leno’s “The Tonight Show” in 2006.

    Networks have relied on the ruling as a precedent for recent interviews with political candidates.

    Carr, Paramount Skydance and CBS did not respond to requests for comment on Colbert’s remarks. The White House declined to comment.

    FCC Commissioner Anna Gomez, a Democrat, criticized CBS’s decision not to air the interview, calling it censorship. She said the FCC has no lawful authority to pressure broadcasters for political purposes and CBS has free speech rights to air the interview.

    “This is yet another troubling example of corporate capitulation in the face of this administration’s broader campaign to censor and control speech,” Gomez said. “It is no secret that Paramount, CBS’s parent company, has regulatory matters before the government, but corporate interests cannot justify retreating from airing newsworthy content.”

    Paramount Skydance is seeking to buy Warner Bros Discovery.

    Carr faced bipartisan criticism after pressuring broadcasters to take ABC late-night talk show host Jimmy Kimmel off the air in September, warning they could face fines or loss of licenses, and said “it’s time for them to step up.”

    Two major broadcasters said they would pull Kimmel off the air and Disney briefly suspended Kimmel before restoring the show.     BOSTON, Feb 7 (Reuters) – Groups representing park conservationists, historians and scientists filed a lawsuit on Tuesday seeking to prevent President Donald Trump’s administration from scrubbing information from parks and monuments, after exhibits and signs touching on topics like slavery and climate change were removed.

    The National Parks Conservation Association, American Association for State and Local History and four other groups argue in a lawsuit filed in Boston federal court that the U.S. Department of the Interior is engaged in a “sustained campaign to erase history and undermine science.”

    The lawsuit argues the department is removing signs and exhibits from parks in violation of mandates from Congress governing how more than 430 national park sites should be operated and has adopted an unlawful policy that lacks any reasoned explanation for why various signs and exhibits must be removed.

    “Censoring science and erasing America’s history at national parks are direct threats to everything these amazing places, and our country, stand for,” Alan Spears, senior director of cultural resources at the National Parks Conservation Association, said in a statement.

    The Interior Department did not respond to a request for comment.

    The case was one of two filed on Tuesday challenging changes the department had implemented at national monuments and parks under its jurisdiction as part of Trump’s broader agenda.

    Several community organizations filed a lawsuit in New York arguing the department had unlawfully removed the Pride flag at the Stonewall National Monument, the first national monument dedicated to the LGBTQ rights movement.

    The case in Boston was filed a day after a federal judge in Pennsylvania ordered the National Park Service to reinstall an exhibit that was removed from the President’s House Site at the Independence National Historical Park in Philadelphia that described the history of slavery and the ownership of enslaved people by President George Washington, the nation’s first president.

    Tuesday’s lawsuit said that exhibit was one of several removed after Trump signed an executive order in March 2025 targeting what he called a “revisionist movement” that portrayed the U.S. as “inherently racist, sexist, oppressive, or otherwise irredeemably flawed.”

    Trump’s order directed the Interior Department to restore parks, monuments and memorials that had been removed or changed to perpetuate what the White House called a “false revision of history.”

    The lawsuit said that following a subsequent order from Interior Secretary Doug Burgum implementing Trump’s directive, the National Park Service had identified hundreds of signs and materials that it has begun removing from parks nationwide.

    Among them are signs that were posted in Maine’s Acadia National Park that described the impact of climate change on the park and the significance of Cadillac Mountain to the Wabanaki people who are indigenous to the region.
