Supreme Court says Alito’s verbal reaction to Sotomayor was a ‘misunderstanding’ by Alito

The highly unusual exchange between Justice Samuel Alito and Justice Sonia Sotomayor over a dissent read from the bench was based on a “misunderstanding” by the conservative justice, the Supreme Court said Friday.

“Justice Alito was notified in advance by Justice Sotomayor’s chambers that she would be reading a dissent from the bench,” the court spokesperson said in a statement in response to questions from CNN.

“It was a misunderstanding on Justice Alito’s part,” the spokesperson added.

The rare statement came a day after a tense back-and-forth between the two justices when Sotomayor, the court’s senior liberal, publicly read a dissent in a case involving asylum claims. Alito, a conservative who was then set to summarize the next opinion, appeared taken aback by his colleague’s remarks.

“There’s much that I would have added to my bench statement had I known there would be a dissent read,” Alito said, an unusual break from protocol during what is normally a highly choregraphed release of opinions.

Alito, who authored three of the four opinions released Thursday, suggested at the time that he didn’t realize Sotomayor would read her dissent verbally. Verbal dissents are rare and usually underscore a justice’s strong disagreement with the majority’s opinion.

The back-and-forth came amid signs of strife behind the curtain of the high court as it veers toward its final days of the current term juggling a number of cases involving President Donald Trump and culture war issue. The Alito-Sotomayor exchange came in a case dealing with a policy of turning asylum seekers away at the border, which the conservative majority approved in a 6-3 decision.

Newsom begs Californians to vote ‘no’ on billionaire’s tax in face of mass exodus, pitches nationwide tax hike

FOX Business Host Cheryl Casone reports on California’s controversial billionaire tax, a one-time 5% levy on residents worth over $1 billion. This measure, which would retroactively apply from January 1, 2026, is opposed by Gov. Gavin Newsom. Critics question its legality and potential for billionaires to exit the state.

California Democratic Gov. Gavin Newsom is facing another blow after a massive wealth tax he warned could cause a wealth and business exodus from the state was officially added to the November ballot.

Despite his opposition, the measure’s sponsor, Billionaire Tax Now, announced Thursday that it was officially being added to the state’s ballot. The measure, called the California Billionaire Tax Act, would impose a one-time, “emergency” 5% tax on Californians with assets exceeding $1 billion. The tax has been endorsed by socialist Sen. Bernie Sanders, I-Vt., who called it “reasonable and necessary” “at a time of unprecedented and growing wealth consolidation and income inequality.”

However, Newsom, a rumored frontrunner for the Democratic Party’s presidential nomination, has come out strongly against the tax, citing fears that billionaires will simply up and leave to states like Texas or Florida.

In a lengthy Substack post on the tax, Newsom wrote, “Last night, it became certain that a wealth tax would be placed on the November ballot in California. I’m voting no.”

“You may not be able to pick up and move to Texas or Florida to shelter your income from taxation, but I promise you that billionaires can, and do,” he wrote, adding, “Wealth is movable, and it shops for the state with the lowest taxes.”

In a state that has already lost prominent business figures such as Elon Musk, Google co-founder Larry Page and Oracle founder Larry Ellison, Newsom is not the only one warning that the billionaire tax could worsen California’s ongoing exodus.

Earlier this year, Silicon Valley tech entrepreneur Allison Huynh predicted in an interview with Fox News Digital that the tax would cause a “mass migration,” starting with “not just the billionaires, but the people who are investing in new ideas, in new infrastructure, whether it’s AI, healthcare, tech, robotics.”

Huynh likened the proposed tax hike to a restaurant about to go out of business.

“Instead of lowering the price, they increase the price,” she said. “And then you go into the restaurant, and it’s like $50 for a bowl of really bad dumplings.”

Fox News Digital reached out to Billionaire Tax Now for comment.

After news of the measure being added to the ballot broke, Newsom called on the U.S. to institute a national billionaire tax and what he referred to as “a new social contract.”

In an X post, Newsom wrote that “the system is fundamentally broken. The federal tax code, a corporate code, and an inheritance code were written for a different set of Americans. It’s time for an economic reset.”

In his Substack post, he argued “the fight to make the wealthiest Americans pay more in taxes is not one we should be fighting state by state.” Instead, he wrote, “The fight belongs at the federal level, where this broken system was created in the first place.”

In January, Newsom said he felt vindicated in opposing the proposed wealth tax after reports showed some of California’s wealthiest residents moving money and businesses out of the state, warning the measure would damage the economy and drive away investment.

“This is my fear,” Newsom said in a Politico interview on Monday. “It’s just what I warned against. It’s happening.”

“The evidence is in. The impacts are very real — not just substantive economic impacts in terms of the revenue, but start-ups, the indirect impacts of … people questioning long-term commitments, medium-term commitments,” he continued. “That’s not what we need right now, at a time of so much uncertainty. Quite the contrary.”

Despite Newsom’s opposition, the group behind the tax effort — Billionaire Tax Now, sponsored by the Service Employees International Union – United Healthcare Workers West — proceeded to add it to the ballot.

The union posits that the tax will “prevent the collapse of California healthcare and help fund California public K-14 education and state food assistance programs.”

Billionaire Tax Now is confident the measure will pass, posting on X that “while a few controversial billionaires and their buddies in Sacramento want to see California’s hospitals close and tax breaks for billionaires protected – popular support is on our side.”

Meanwhile, some of Newsom’s detractors claim that his opposition to the measure is driven by a desire to appeal to potential presidential donors.

Billionaire Tax Now reposted an X post by David Sirota, founder of the progressive investigative news outlet The Lever, in which he asserted that “Gavin Newsom is trying to protect 250 prospective 2028 presidential donors, even if that means 3 million of his constituents are medically bankrupted.”

Reached for comment, Newsom’s office directed Fox News Digital to his Substack and video.

Trump says Iran strike in Strait of Hormuz is a ‘foolish violation’ of agreement

President Donald Trump called Iran’s strike on a vessel in the Strait of Hormuz a “foolish violation” of the agreement to end the war with Tehran, but offered little indication the episode would prompt a return to active hostilities.

“The Islamic Republic of Iran shot at least four One Way Attack Drones at Ships transversing the Strait of Hormuz. One of the Drones solidly hit the upper deck of a large and very expensive Cargo Carrying Ship,” he wrote on Truth Social midday Friday, hours after news of the strike.

“Damage was done, but the Ship was able to proceed on its way,” he went on. “We knocked down three other Drones. Obviously, this is a foolish violation of our Ceasefire Agreement.”

A few hours later, Trump said the incident demonstrated Iran had retained some of its military capabilities, despite the monthslong US war.

“We still have a fight. They have some capability, not much. They’re not winning or anything, but they have some capability; they can still shoot,” he told a crowd of conservative Christians in Washington, DC.

“Nobody saw it coming,” he said of the Iranian strike, “and it hit a ship and did some damage. Can’t do that stuff.”

Trump did not say how or whether the United States might respond to the incident, which occurred a day earlier and underscored the ongoing difficulties in restoring traffic to prewar levels in the critical waterway.

US Central Command, which oversees US military operations in the region, referred to Trump’s statement when asked about the attack. An X account for the Department of Defense posted three American flag emojis atop a screenshot of Trump’s Truth Social post.

It was the first such incident since the US and Iran signed a memorandum of understanding to open the strait and launch more in-depth negotiations over Iran’s nuclear program. Trump has offered few signs he is prepared to resume the war, which he acknowledged last week may have led to “economic catastrophe” if it had persisted.

Iran sees control of the waterway as a key point of leverage in negotiations. On Thursday, the Islamic Revolutionary Guard Corps warned that safe passage would only be given to ships via routes declared to Iran.

The US-Iran agreement stipulated that traffic in the strait would return to the same volume as before the war began, but did not provide detailed conditions for fulfilling the terms.

The two sides have offered differing understandings of whether Iran would be able to charge fees for passing vessels. Trump has insisted the strait would remain toll-free, but Tehran has maintained it will have the right to charge passing ships.

Thursday’s attack came hours after Iran’s powerful revolutionary guards warned that vessels would only be given safe passage via Iranian routes in the strait, challenging the Trump administration’s claim that the waterway is free and open once more. The US dropped its blockade of Iranian ports once the agreement was signed.

The cargo vessel was struck on its starboard side by an unknown projectile, damaging the bridge, according to the United Kingdom Maritime Trade Operations, which monitors marine traffic in the region. No casualties or environmental impact were reported.

(CBS News)

(Alain Sherter)

Trump vows immediate 100% tariff if countries levy digital services tax

    June 26, 2026 / 2:04 PM EDT / CBS News

    By Alain Sherter

President Trump is threatening to impose a 100% tariff on countries that levy a tax on U.S. companies offering digital services.

In a social media post on Friday, Mr. Trump pointed to European countries considering implementing a so-called “digital services tax,” which is aimed at companies that do business in a country but lack a physical presence there and do not pay income tax.

“European Countries have been discussing the imminent implementation of a Digital Services Tax on American Companies,” he said on Truth Social. “Some of these Countries are close to actually doing this. Please let this statement serve to represent that any Country that imposes such a Tax will immediately be met with a 100% TARIFF on any and all Goods sent to the United States of America.”

A new U.S. tariff on other nations’ imports would override any trade agreements with a trading partner, Mr. Trump noted, adding that the 100% import duty would be imposed immediately if a country proceeds with a digital services tax.

Roughly half of all European members of the Organisation for Economic Co-operation and Development have proposed, announced or already implemented a digital services tax, according to the nonpartisan Tax Foundation, which notes that such taxes would mostly affect U.S. companies.

Mr. Trump has set a July 4 deadline for the European Union and the U.S. to finalize a trade deal that caps tariffs on most EU exports at 15%. Digital taxes were not part of the agreement and have remained a sticking point between the U.S. and the European bloc.

The president also threatened retaliation against countries that propose digital taxes during his first term in office. In 2020, the U.S. Trade Representative launched investigations into nine European Union countries that had adopted or were considering digital taxes.

Last year, Mr. Trump also threatened new tariffs on any country that imposed a digital tax, saying in an August 2025 post that digital taxes and regulations are intended to weaken U.S. companies.

“America, and American Technology Companies, are neither the ‘piggy bank’ nor the ‘doormat’ of the World any longer. Show respect to America and our amazing Tech Companies or, consider the consequences!” he wrote at the time.

Rep. Brandon Gill, R-Texas, sparred with a SNAP policy advocate during a House Oversight subcommittee hearing Thursday, pressing her to answer whether Americans “need Coca-Cola to survive” and whether taxpayer-funded food benefits should pay for sugary sodas.

The exchange came as lawmakers examined waste, fraud and abuse in the Supplemental Nutrition Assistance Program (SNAP), a roughly $100 billion program that serves more than 40 million Americans. During the hearing, Republicans argued lax oversight had enabled misuse of taxpayer dollars, while Democrats warned against restricting benefits for eligible families.

Gill first asked Gina Plata-Nino, director of policy and advocacy for the Food Research and Action Center, whether SNAP dollars should be spent on soda. She replied that the program exists to provide families with “food and beverages.”

When Gill narrowed the question to sugary sodas, she said she was “happy to talk about hunger and nutrition, but not dictate what Americans should or should not eat.”

Gill, clearly unsatisfied with the answer, continued pressing and asked whether “tax dollars should be used to pay for sodas” and whether Americans “need sugary sodas to survive.”

“Some of them do, who do have low blood issues,” Plata-Nino reasoned, adding that those “who have kidney issues” might need such drinks, as well.

Unrelenting, the congressman followed up: “Do the American people need Coca-Cola to survive?… What’s nutritional about Coca-Cola?”

“I am not a nutritionist. I am a food security expert,” Plata-Nino replied.

Gill later argued that “there’s not nutritional value to sugary sodas” and criticized the witness for declining to say taxpayers should not fund their purchases through SNAP.

“I think that focusing on soda when people are going hungry,” Plata-Nino began before Gill interrupted.

“We spend a lot of our tax dollars… on soda. That’s why I’m asking about it,” he lamented.

The exchange ended with Gill asking whether drinking soda every day is healthy. She replied that “the worst health outcome is hunger” and emphasized that her focus was ensuring families have access to food resources.
