路透社9月22日电——唐纳德·特朗普总统政府已请求美国最高法院推翻一项导致一名倡导巴勒斯坦权利、反对以色列在加沙战争的乔治敦大学学者获释的判决。

美国司法部周一请求高等法院考虑联邦移民法是否禁止下级法院法官下令释放巴达尔·汗·苏里,此前苏里辩称其扣押违反了美国宪法规定的正当程序和言论自由权利。

这名印度公民于2025年3月被移民当局逮捕,当时特朗普政府正推行一项政策,扣押并驱逐那些在大学校园参与亲巴勒斯坦激进活动的外国国民。

他被关押后转移至得克萨斯州,并于2025年5月根据一名地区法院法官的命令获释,理由是他很可能成功证明自己的逮捕是对其受宪法保护的言论的报复。特朗普政府辩称,该法官不应干预此案。

位于弗吉尼亚州里士满的美国第四巡回上诉法院以2比1的投票结果在7月就苏里案作出裁决,称即使某一质疑与移民法院待决的驱逐程序相关,也没有任何规定禁止法官审理针对据称违宪扣押的异议。

美国副检察长D.约翰·佐尔在周一的请愿书中辩称,第四巡回法院的裁决是错误的,且可能会为被扣押者提供在移民法院之外挑战驱逐程序的途径,从而破坏全国范围内的移民执法工作。

“这实际上全都是灾难性的,”他写道。

他指出,今年早些时候另一家上诉法院得出了相反的结论,该法院推翻了一项导致另一名亲巴勒斯坦活动家、曾就读于哥伦比亚大学的马哈茂德·哈利勒获释的判决。

哈利勒的律师表示,他们计划就该判决向最高法院提起上诉,而佐尔在周一的文件中辩称,大法官们应当同时受理苏里案和哈利勒案,以确保该问题能一劳永逸地得到解决。

苏里的律师未立即回应置评请求。

Sept 22 (Reuters) – President Donald Trump’s administration has asked the US Supreme Court to overturn a decision that led to the release of a Georgetown University scholar who had advocated for ​Palestinian rights and opposed Israel’s war in Gaza.

The Department of Justice on Monday ‌asked the high court to consider whether federal immigration law barred a lower-court judge from ordering Badar Khan Suri released, after hearing his claims that his detention violated his due process and free speech rights under the ​US Constitution.

The Indian citizen had been arrested by immigration authorities in March 2025 as the ​Trump administration pursued a campaign to detain and deport foreign nationals who had ⁠engaged in pro-Palestinian activism on their college campuses.

He was brought to Texas after his detention, and ​freed in May 2025 on the orders of a district court judge, on the grounds that ​he was likely to succeed in proving his arrest was in retaliation for his constitutionally protected speech. The Trump administration has argued that the judge should not have interfered in the case.

A 2-1 panel of the Richmond, ​Virginia-based 4th US Circuit Court of Appeals in July ruled in Suri’s case that nothing prevented a ​judge from hearing a challenge to someone’s allegedly unconstitutional detention, even if it related to deportation proceedings pending ‌before ⁠the immigration courts.

Solicitor General D. John Sauer in Monday’s petition, opens new tab argued that the 4th Circuit’s ruling was wrong and risked disrupting immigration enforcement nationwide by giving detainees a means to challenge their deportations outside of immigration court.

“That is all practically disastrous,” he wrote.

He noted that a different appeals court had ​reached the opposite conclusion ​earlier this year when ⁠it overturned a ruling that had led to the release of another pro-Palestinian activist, Mahmoud Khalil, who had attended Columbia University.

Khalil’s lawyers have said they ​plan to appeal that decision to the Supreme Court, and Sauer in ​Monday’s filing ⁠argued that the justices should take up that case as well as Suri’s to ensure that the issue can be resolved once and for all.

Suri’s lawyers did not immediately respond to a request for ⁠comment.

Suri is ​a postdoctoral fellow at Georgetown’s Alwaleed Bin Talal Center ​for Muslim-Christian Understanding, part of the Jesuit university’s School of Foreign Service. At the time of his arrest, he had ​resided in Virginia with his wife, a US citizen.
