    A federal judge on Friday allowed the Pentagon to move forward with terminating three employees of the Stars and Stripes military newspaper.

    In a 24-page ruling, U.S. District Judge Trevor McFadden turned down a request by the newspaper’s publisher, editor-in-chief and Middle East reporter to halt their firings while a lawsuit challenging the terminations works its way through the court system.

    McFadden found the government likely did not violate their First Amendment rights by firing them last month.

    The plaintiffs — publisher Max Lederer, editor-in-chief Erik Slavin and reporter Lara Korte — were given separation notices in August and placed on administrative leave over allegations of insubordination. The move raised questions about the future of the Stars and Stripes, which is operated by the military and is partially funded by taxpayers, but has traditionally operated independently of military leadership or the White House.

    For Slavin and Korte, the alleged insubordination cited in their termination notices was related to interviews they gave to CBS News for a piece on “CBS Sunday Morning” that aired in July. In the story, Korte said that she worked for Stars and Stripes, “not for the Pentagon, not for any administration, not for any policymaker.”

    The firings took place shortly after the newspaper published a piece detailing flagging mental health concerns and food and water shortages aboard the USS Abraham Lincoln aircraft carrier, which had been deployed for nine months.

    A day after that story ran, the lawsuit said, Pentagon officials ordered Lederer, the Stripes’ publisher, to issue notices of separation to Slavin and Korte. Lederer declined to present them and opted to resign, but he was fired before he could do so.

    Parts of McFadden’s ruling analyzed whether Korte and Slavin spoke with CBS News in their capacity as Stars and Stripes employees. Prior Supreme Court cases have found that government employees’ right not to be fired for their speech hinges partially on whether they were speaking as private citizens or as part of their official job duties.

    McFadden found Korte and Slavin’s speech was likely the latter.

    “[At] bottom, on the current record, Plaintiffs’ real complaint seems to be that they were victims of a cruel bait-and-switch. They are being fired for giving pre-approved interviews on their paper’s behalf in which they largely toed the company line,” the judge wrote. “Whatever else such a scheme may violate, it does not clearly offend the First Amendment.”

    The ruling came shortly after lawyers for the three fired Stars and Stripes employees squared off against Justice Department attorneys in federal court earlier Friday, arguing that the Pentagon had unlawfully terminated the journalists in violation of their protected free speech.

    In federal court, attorney Taryn Wilgus Null told McFadden in the District of Columbia that her journalist clients were appearing as sources — and not as reporters — for the CBS piece and were speaking “on matters of public concern” outside of their official duties at Stars and Stripes.

    “Government employees do not lose their First Amendment free speech rights,” she told the court, noting as well they “were not acting within their ordinary job duties” and had a choice about whether to be interviewed for CBS News.

    Brett Covington, a Justice Department lawyer who argued for the Pentagon on Friday, told McFadden that all three journalists routinely did interviews as part of their normal duties, and noted that the CBS News interview had taken place at the Stars and Stripes headquarters with other employees visible in the background.

    He also cited an email from Korte in which she wrote she would “rather eat glass” than allow the federal government to tell her what she could or couldn’t write.

    He said that email offered context which shows she was concerned about “being able to perform her job duties.”

    He also told the court that the publication of the story about the USS Abraham Lincoln was unrelated to the firings, and that the process for those started more than a month before the story ran.

    “Our position is, it’s a red herring,” he said.

    McFadden, prior to ruling, acknowledged that both sides appeared to have some case law on their side to support their arguments, and said the case struck him as requiring a very “fact-driven analysis” that could be different for each of the three journalists.

    美国最高法院周五支持了共和党竞选团体的诉求,允许其为今年的中期选举购买打折电视广告,这是高等法院一系列有利于共和党的紧急裁决中的最新一例。

    Supreme Court backs Republican request to lower TV ad rates

    The Supreme Court on Friday endorsed a request from Republican campaign groups that want to buy discounted TV advertising for this year’s midterms, the latest in a series of emergency rulings from the high court benefiting the GOP.

    The decision effectively upholds guidance issued by the Federal Communications Commission in March that allowed the campaign arms of House and Senate Republicans to pay lower ad rates that were previously reserved only for candidates.

    The court’s order will primarily benefit Republicans, who generally raise more money through party committees than Democrats.

    Over the dissent of liberal Justice Ketanji Brown Jackson, the court said that the challenge to the guidance was premature. The GOP groups had said that broadcasters were rescinding the cheaper ad rates based on a lower court’s decision blocking the guidance.

    “Cur­rent and future recissions will require the party committees to pay more for advertising space, thereby hampering their efforts to reach the electorate in the critical weeks leading up to the midterms,” the court wrote in an unsigned opinion. “That injury, which implicates their First Amendment rights to speak and coordinate their po­litical activities freely, cannot be remedied after the fact through refunds or reimbursements.”

    Under federal law, candidates are entitled to deeply discounted ad rates in the run up to an election. Guidance this year from the FCC extended that benefit to other campaign entities, like the National Republican Senatorial Committee, that run TV ads on behalf of candidates across the country. Both Republicans and Democrats have long made use of those groups.

    The Republican groups told the Supreme Court in their emergency appeal that they had already budgeted “tens of millions of dollars” in advertising based on the FCC guidance. A divided 4th US Circuit Court of Appeals ruled that the law clearly limited the lower rate benefit only to candidates. Those lower rates, according to court documents, are set to take effect on Friday.

    The Trump administration, eager to keep Republican control of Congress, supported the GOP groups at the Supreme Court. The Justice Department argued that the FCC guidance wouldn’t harm the Democratic candidates who sued because the rule is applied universally.

    Four Democratic candidates sued over the FCC’s decision: Rep. Kristen McDonald Rivet of Michigan, former Sen. Sherrod Brown of Ohio, Sen. Jon Ossoff of Georgia, and former Gov. Roy Cooper of North Carolina. The campaign arm for House and Senate Republicans intervened to defend the FCC’s decision.

    The ad rates case is closely tied to another the Supreme Court decided this summer. In that case, the court’s 6-3 conservative majority rolled back longstanding limits on how much political parties may coordinate with federal candidates. Since the 1970s, political party committees were capped at how much money they could spend in coordination with a campaign. The court ruled that those caps violated the First Amendment.

    Judge extends block on Postal Service’s new Trump-backed mail-in ballot requirements

    Washington — A federal judge on Friday extended her block on the U.S. Postal Service’s new requirements for mail voting, as states prepare to begin sending mail ballots to voters for the November midterm elections.

    U.S. District Judge Indira Talwani issued a preliminary injunction barring the agency from enforcing the rules, which were finalized and published late last month, during the midterms. Talwani had temporarily blocked the measure on Aug. 26 and, following a hearing Thursday, agreed to grant a request for longer relief sought by two dozen Democratic-led states and voting rights groups.

    In her 49-page decision, the judge said the Postal Service’s new rules are likely unconstitutional and said states’ difficulties with implementing the regulations so close to the November elections “nearly guarantee[s] significant disenfranchisement for eligible voters.”

    The judge also said the Postal Service likely exceeded its authority by moving ahead with the new requirements because “the Constitution reserves election regulation to Congress and the States, Congress has not authorized the USPS to make requirements of States before permitting use of the USPS for mailing their ballots, and … the Final Rule impermissibly establishes a new category of nonmailable material.”

    “Unauthorized by the Elections Clause, the Final Rule clashes with Congress’s statutory scheme, and is unconstitutional where it intrudes not only on Congress’s Elections Clause powers but also that power left to the States,” she wrote.

    Talwani reiterated concerns raised by state and local election officials about their ability to comply with the regulations in the weeks before the election and said they are already “consumed” with completing other election-related tasks, like registering voters, maintaining voter lists, conducting early voting and processing applications to vote by mail.

    “The Final Rule’s new requirements would be an extraordinary amount of work for local officials at any time,” she wrote. “But imposing these mandates on election officials at present poses greater difficulties than otherwise because election officials are actively administering elections.”

    The Justice Department is likely to appeal the decision.

    During a hearing Thursday, government lawyers said that if Talwani continued to block the requirements, it would bypass the federal appeals court and seek the Supreme Court’s intervention. The Trump administration asked the high court later Thursday to let it enforce the mail-ballot limits — before the judge could issue her decision on the preliminary injunction.

    The fast-moving legal battle is unfolding as states gear up to send mail ballots to voters. At least two municipalities in Wisconsin have already mailed ballots out, and in North Carolina, they will go out to certain voters Friday. More states will begin sending mail ballots around mid-September.

    At issue in the case is a final rule issued by the Postal Service that requires states and localities to meet design requirements for mail ballots, including unique barcodes, and to submit to an online portal information about residents who will vote by mail, including their names, addresses and individualized barcodes.

    Those voters will be enrolled with the Postal Service and included on state-specific “Mail-In and Absentee Participation Lists.”

    The rule requires postal workers to review and verify ballot mail being sent to voters. Any ballot mailings that don’t comply with the requirements “will not be accepted and will be returned” to the election offices, the Postal Service said.

    The Trump administration has said the rule imposes “modest informational requirements” on states and localities, and “should not prevent a single voter from voting by mail.”

    But state and local election officials have warned that it will be expensive and logistically challenging to meet the Postal Service’s new mandates for the November elections.

    An anonymous whistleblower has also warned of “potentially catastrophic problems” with the Postal Service’s system. The agency’s new mail ballot portal is “untested” and its development “rushed,” the whistleblower said in a disclosure provided to Congress. The federal official also warned that the Postal Service’s new verification process could keep significant numbers of mail ballots from being delivered.

    The Postal Service has said it continues to make “refinements” to the new ballot mail portal and anticipates the portal will be available for voluntary use “by sometime next week.”

    Because of Talwani’s earlier order that blocked implementation of the rule, the Postal Service is not requiring states and localities to submit ballot envelopes for review to ensure they comply with the new design rules.

    The agency has, however, “made that review available for states that wish to voluntarily submit their envelopes for review to ensure that they meet the standards set forth in the Final Rule,” Steven Monteith, executive vice president of the Postal Service, said in a filing.

    Could the AfD become Germany’s first far-right party to lead a state since WWII?

    Magdeburg, Germany— At first glance, Magdeburg may seem an unlikely stage for a political upheaval of international significance. But this weekend, the city of only about 244,000 people will be at the center of an election that could leave a far-right party in control of a German state for the first time since World War II.

    Magdeburg is the capital of the East German state of Saxony-Anhalt — where the Alternative for Germany (AfD) party is hoping to rise to power in Sunday’s state election.

    Supporters and opponents of right-wing populist movements across Europe and beyond are watching closely to see if the AfD can turn a significant lead in opinion polls into real power.

    The latest surveys show the AfD polling at 41%, well ahead of its closest rival, German Chancellor Friedrich Merz’s Christian Democratic Union (CDU), which stood Friday at 23%.

    Should the AfD win, it would be an extraordinary breakthrough for a party founded in 2013 largely as a protest movement against the European Union, but which has since shifted far to the right.

    What is the AfD?

    Since 2023, the state Office for the Protection of the Constitution has classified the AfD Saxony-Anhalt as a “confirmed far-right extremist” organization.

    According to the office, which is the state branch of Germany’s national domestic intelligence agency, the AfD chapter’s core positions violate fundamental principles of Germany’s constitution and are “substantially permeated by the racist ideology of ethnopluralism.”

    “Numerous anti-Muslim, racist and antisemitic statements by officials and elected representatives of the state association demonstrate that the AfD in Saxony-Anhalt seeks precisely such an ethnoculturally homogeneous national population and calls for the exclusion of people on the basis of their origin or religion,” the agency says.

    AfD Saxony-Anhalt’s main candidate in this election, 35-year-old Ulrich Siegmund, rejects the assessment. In an August interview, he accused the state intelligence agency of being politically weaponized against his party.

    “It monitors the opposition,” he said. “It is being used as a political instrument.”

    If his party wins power, it would consider either abolishing the state intelligence agency or restructuring it, he added.

    Siegmund comes across as composed, charismatic and approachable. But the August cover of the widely-read Der Spiegel magazine branded him “Germany’s most dangerous man,” noting his combination of a winning demeanor, a realistic chance of gaining power of a state, and a radical platform.

    The article noted that Siegmund’s close party associates include former officials from the “Heimattreuen Deutschen Jugend,” a neo-Nazi youth organization that was banned in 2009.

    Siegmund was at the 2023 “Potsdam meeting,” a gathering of German and other far-right figures where Austrian anti-immigration extremist Martin Sellner presented his “master plan” for “remigration.”

    The concept envisioned asylum seekers, non-Germans living legally in the country, and German nationals with immigrant backgrounds who had failed to “assimilate” in the country, all being expelled to live in an unspecified African nation. A version of the plan has become central to AfD Saxony-Anhalt’s platform.

    The state party calls for a “deportation and remigration offensive,” with more detention centers to handle people destined for deportation, and advocating for new, tight limits on the number of people permitted to migrate to Germany. Currently there is no cap on the number of immigrants allowed into Germany every year, but the state AfD party has dismissed suggested caps of around 200,000 as far too high.

    It may sound familiar to Americans, given the controversy over ICE detentions and the Trump administration’s aggressive deportation policies. But the concept of “remigration” is seen as a step further, given its association with the idea of expelling people living legally in a country, even passport holders.

    AfD Saxony-Anhalt has also drawn criticism for the way it refers to Germany’s past.

    Hans-Thomas Tillschneider, a leading state AfD politician, has spoken disparagingly of “memorial site stuff” and criticized a “guilt-laden” approach to German history. Such statements resonate in a country where memories of the repression and the orchestrated mass violence of Nazism and the Holocaust have shaped political discourse for at least three generations.

    For the AfD, a complicated path to power

    Just winning the most votes in Sunday’s election will not be enough to bring the AfD to power in Saxony-Anhalt.

    The only guaranteed route to governing on its own and appointing the state’s next premier — the equivalent of a U.S. governor — is to win an absolute majority, taking more than half of the seats in the state parliament.

    Polling made that look unlikely as of Friday.

    If it wins a large number of seats, even more than any other party, but fails to make the threshold to govern alone, the AfD would have to find another party that also won at least 5% of the votes — and that is willing to partner up in a coalition government.

    That could prove a very high hurdle. Germany’s other major parties have long ruled out any cooperation with the AfD.

    Siegmund has said himself that he would only lead a full AfD government, ruling out any coalition.

    So the party could win the election by a wide margin, but still end up wielding no real power in the state, and there is a recent precedent for that outcome.

    The AfD won more seats than any other party in neighboring Thuringia last state election in 2024 — but not a decisive majority. Other parties with lower vote shares agreed to work together to form a coalition without the AfD, so while Thuringia has more lawmakers from the AfD than any other single party, they’re not part of the administration running the state.

    What do the locals say?

    Migration has been a dominant topic of debate on the streets of Magdeburg in the run up to the election, fueled by a 2024 attack on its Christmas market. A doctor originally from Saudi Arabia drove his vehicle into the revelers, killing five people.

    He was not an Islamic extremist, and called himself a former Muslim. He was, in fact, critical of Islam and had expressed sympathy with the far-right and even the AfD. But despite that, and the fact that the perpetrator had been in the country legally for decades, the case still touched a nerve.

    “I feel that the situation is particularly tense following the attack,” one woman, who declined to give her name, told CBS News this week in Magdeburg. “I think that has given the AfD a particular boost.”

    Justin, 27, told CBS News that he supports the AfD and believes the party will take action against “uncontrolled migration.”

    He said Syrians in particular, some 300,000 of whom were welcomed into Germany as refugees more than a decade ago during their country’s vicious civil war, have failed to adapt to life in the European nation.

    “The AfD is good for Germany because they see Germany’s problems,” he said, adding that Syrians in Magdeburg “behave like animals.”

    “I am sorry, but they sit on these plastic chairs with their children outside in the middle of the night and they are never quiet,” he said, admitting that, “there were Germans misbehaving” in Magdeburg, too, “but now it’s really bad. I think the AfD sees that and they will help Germans to also get more pension.”

    His argument about Syrians is eroded by the fact that tens of thousands of have adapted to life in Germany — including one who came as a refugee in 2015 and has now been mayor of a village in the country’s southwest for several years.

    Another local voter, Birgit, sees the party very differently. She told CBS News she was “quite afraid of the AfD,” which she considers “far too extreme.”

    A couple out on a date, who described themselves as left-wing former punk rockers in their 40s, told CBS News they were firmly opposed to the AfD and voiced consternation over the party’s stance on migrants.

    They argued that foreign workers are and would continue to be indispensable to the health and social services, given Saxony-Anhalt’s aging population.

    Another man said he had moved to Magdeburg from western Germany, and if the AfD does manage to take power, he said he couldn’t imagine staying.

    As the father of a young girl, he said he was particularly concerned about how an AfD government might change the way Germany’s history, including its darkest chapter of Nazi rule and the Holocaust, is taught in schools.

    WASHINGTON, Sept 4 (Reuters) – A group of three ​military veterans and ‌an architectural historian on Friday asked ​a U.S. ​judge to block the ⁠Trump administration ​from breaking ground ​on an arch in Washington.

    The U.S. Interior Department ​on Thursday ​announced plans to soon ‌move ⁠forward with excavation work for the a 250-foot (76-meter) ​arch near ​Arlington ⁠Memorial Cemetery despite legal ​challenges and ​the ⁠lack of final approval from a ⁠government ​planning ​authority.

    After a scathing report that called into question Sen. John Fetterman’s willingness to do the basic duties of a senator, some of his Democratic colleagues in Pennsylvania are eyeing ways to dislodge him from the upper chamber.

    An explosive report from The Wall Street Journal painted Fetterman as a politician more interested in appearing on Fox News to discuss Israel than meeting with paralyzed veterans from his state, and blowing off a funeral for slain police officers because it would have taken too long.

    And members of his own delegation are furious.

    “There is a lot I could say about this report of John Fetterman’s pathetic behavior as a senator,” Rep. Chris Deluzio, D-Pa., said on X. “But between the laziness, disrespect, and willingness to carry water for a foreign government, it shows us something we already know: this man has no sense of duty.”

    “He is not up for the high office he was elected to — and we in Pennsylvania will do something about it in 2028,” he continued.

    Behind the scenes, The Wall Street Journal’s report revealed through leaked text messages between Fetterman and his aides that the lawmaker was unwilling to do some of the core functions of the job, like meeting with constituents.

    “John Fetterman is a disgrace,” Rep. Brendan Boyle, D-Pa., said on X. “Our state deserves better than a lazy trust fund baby who is too lazy to do the job.”

    In one instance, Fetterman was told by an aide that representatives of the Children’s Hospital of Philadelphia (CHOP) wanted to meet over concerns about Medicaid cuts. Fetterman asked why he had to keep meeting with CHOP, and the aide noted that they were worried about “vaccines and Medicaid cuts.”

    “Well, I’m not,” Fetterman responded. “I’m convinced they just want free trips to D.C.”

    Another instance came when an aide told Fetterman that there would be a dress code at a funeral for three police officers killed in Pennsylvania last year, and that the service was expected to last for three hours.

    “This may be a nonstarter,” Fetterman wrote.

    Years before his time in the Senate, Fetterman rose to prominence as a progressive who appeared to emulate the formula laid out by Sen. Bernie Sanders, I-Vt., who he backed early on in his runs for the White House.

    When Fetterman won his seat in 2022 against Dr. Mehmet Oz, who now runs the Centers for Medicare & Medicaid Services, Fetterman ran on a platform of universal healthcare, pro-labor policies and higher tax rates on wealthy Americans — key hallmarks of progressive politics.

    Since ascending to the Senate, however, his voting record has shown a more moderate flair, and questions are swirling over whether he will jump ship and join the GOP. He’s bucked his party on several occasions since taking office, too.

    During the government shutdown fight last year, he joined Republicans as Democrats stayed unified in their push to renew lapsing Obamacare tax credits, has become one of the most vocal proponents of Israel, and helped to confirm some of President Donald Trump’s nominees, including Department of Homeland Security Secretary Markwayne Mullin — notably, he voted against his old political rival Oz.

    The desire to boot Fetterman extends beyond just his colleagues in the Pennsylvania congressional delegation.

    Pennsylvania state Rep. Malcolm Kenyatta, who is the vice chair of the Democratic National Committee, has his sights set on Fetterman, too.

    “This report is horrifying, but not new to many of us in PA. John barely showed up as Lieutenant Governor and is constantly MIA as our senator,” Kenyatta said on X.

    “When he’s not on FOX cheerleading Trump & endless wars, he is attacking the very neighbors who gave him a chance,” he continued. “2028 can’t come soon enough.”

    Fetterman did not respond to a request for comment.
