    A person was killed during a shooting in Maine involving U.S. Immigration and Customs Enforcement on Monday morning, state House Speaker Ryan Fecteau said.

    The police department in Biddeford, Maine, said in a statement that it responded to an incident involving ICE personnel at the intersection of Pool and Hill streets on Monday morning and was providing security at the scene. The department directed inquiries about the incident to ICE.

    Project Relief Maine, an immigrant advocacy group, said in a statement on social media that the person who was killed was one of their community members.

    “We are in contact with the family and are committed to supporting them during this unimaginable time,” the group said. “This was a young person whose life was cut short, and our community must come together to stand with their loved ones and ensure they are not alone. They must get justice.”

    Fecteau said on Facebook that state police and the state Department of Public Safety were on the scene gathering details. He said he didn’t immediately have other information to provide.

    Maine shooting comes after deadly incident in Houston

    The shooting comes after an ICE officer shot and killed a Mexican man in his work van last week in Houston.

    In that incident, security camera footage obtained by CBS affiliate KHOU-TV shows ICE officers in unmarked vehicles followed Lorenzo Salgado Araujo after he picked up co-workers for a construction job.

    The Department of Homeland Security said officers thought one of the men resembled someone they were looking for and that Araujo attempted to run over an officer who fired in self-defense. An attorney for two of the men in the van said the ICE officer fired into the vehicle through a window on the passenger side.

    “Lorenzo had already parked the van. The ICE agent reaches in, fires a shot directly in front of Victor’s face, strikes Lorenzo on the side,” attorney Hugo Balderas-Ibarra said in an Instagram video.

    The ICE officers involved in the shooting weren’t wearing body cameras and didn’t have dashboard cameras in their vehicles. The FBI is investigating the shooting.

    EXCLUSIVE: Sen. Jim Banks will introduce legislation Monday aimed at ending birthright citizenship for children of illegal immigrants and birth tourists by defining them as children of “invaders” under federal law after a Supreme Court ruling last month dealt a setback to President Donald Trump’s executive order on the issue.

    Trump recently urged Senate Republicans to move faster on his legislative agenda, including ending birthright citizenship, telling them they were “not fighting hard enough,” Banks, R-Ind., recalled in a June 30 interview with Human Events.

    Banks told Fox News Digital he plans to introduce the Citizenship Act as soon as the Senate opens for business Monday afternoon – crafting it with a nod to Trump-appointed Justice Brett Kavanaugh’s concurrence in last month’s Trump v. Barbara case.

    Kavanaugh, concurring in the judgment and dissenting in part, said Trump’s order conflicted with federal birthright citizenship law but suggested Congress could amend that statute to create new exceptions.

    TRUMP’S ‘HERO’ JUSTICE OFFERS ROADMAP AFTER SUPREME COURT REJECTS BIRTHRIGHT ORDER

    The Citizenship Act would declare that children of statutory “invaders” are not entitled to birthright citizenship under the law and codify a 2025 executive order that cites the term.

    In its summary, Banks’ bill declares “any person who enters the United States without authorization or for the purpose of engaging in birth tourism is considered an invader…” and amends the Immigration and Nationality Act to exclude children of such “invaders.”

    Banks’ key use of “invaders” cites Trump’s executive order declaring illegal immigration across the southern border an “invasion,” while the bill notes the Barbara decision leaves that avenue open for Congress to crack down on.

    Without touching the constitutional amendment process or attempting to overturn any court ruling, the Citizenship Act will codify Trump’s declaration of “invasion” and amend federal law to revoke birthright citizenship from children of illegal immigrants under exceptions listed in the same case the Barbara ruling’s majority used as its precedent.

    Kavanaugh found that Trump’s order didn’t violate the 14th Amendment but did conflict with a federal statute on birthright citizenship passed in the spirit of the amendment conservatives said was intended mainly for freed slaves and their children

    Chief Justice John Roberts, appointed by George W. Bush, relied on the landmark 1898 U.S. v. Wong Kim Ark case to rule against Trump in Barbara and “guarantee citizenship to all children born in the United States and subject to its power” – but Banks’ bill would use that same case as precedent to secure an end to birthright citizenship for progeny of illegal immigrants and birth tourists.

    Justice Horace Gray – an appointee of Republican President Chester Arthur – ruled in Wong Kim Ark that those exceptions include diplomats’ kids, “enemies within” and those engaged in hostile occupation of U.S. territories who are not “bound to render obedience to the sovereign [U.S. government] whose domains are being invaded.”

    ‘WEAPONS OF MASS REPRODUCTION’: WATCHDOG UNVEILS ACTION PLAN TO CURB BIRTH TOURISM AFTER SUPREME COURT RULING

    By Roberts reaffirming Wong Kim Ark’s precedent with its exceptions, Banks’ bill would essentially use it against itself.

    “The Supreme Court’s birthright citizenship decision was an unprecedented assault on American sovereignty, and we must do whatever it takes to save our country,” Banks told Fox News Digital.

    “I’m leading the Citizenship Act to reverse the effects of this consequential ruling and ensure the millions of illegal aliens that invaded our country can’t continue to exploit our immigration system.”

    In U.S. v. CASA, a similar 2025 case that went against Trump, Obama-appointed Justice Sonia Sotomayor separately confirmed “children born of alien enemies in hostile occupation” do not qualify for birthright citizenship, while not taking the extra step to classify illegal immigrants as such “invaders” mentioned in the original ruling.

    Banks also makes a textual constitutional argument in his bill, writing that Article IV requires the feds to “protect each [state] [against invasion]” while Congress’ Article I power includes “establish[ing] a [uniform rule of naturalization].”

    He also cited James Madison’s 1788 analysis that the Constitution vested Congress – not the states – with authority over naturalization through a uniform national rule.

    The Citizenship Act lays out that some Mexican nationals view migration northward as a means of re-conquering territory the U.S. won during 1840s military hostilities finalized in the Treaty of Guadalupe Hidalgo in 1848 that established Texas and beyond as part of the U.S.

    It also points to Chinese birth tourism being encouraged directly by the CCP – which brings the birthright citizenship debate over what defines an invasion by a hostile government full circle.

    Banks’ bill argues those examples demonstrate that birthright citizenship has become intertwined with broader questions of national sovereignty and foreign influence.

    Washington — Congress is returning to Washington on Monday facing limited time to address a number of priorities ahead of a lengthy August recess and the sprint to the midterm elections, while the sudden death of Sen. Lindsey Graham hangs over Capitol Hill.

    Graham, who was 71, died Saturday evening, sending shockwaves through Washington and beyond. Now, his GOP colleagues are coping with the loss of a friend and key White House liaison at a time when their agenda has been repeatedly stalled by the other end of Pennsylvania Avenue.

    Before the recess, President Trump poured fuel on internal divisions within the Republican Party over his focus on a voting regulations bill known as the SAVE America Act. His fixation on the bill — which lacks enough GOP support in the Senate — has undermined unrelated Republican priorities in both chambers and nearly paralyzed legislative business in the House.

    There was also growing dissent among Republican lawmakers over the president’s handling of the Iran war, now-stalled plans for the Justice Department’s $1.8 billion “anti-weaponization” fund and funding for a massive new ballroom at the White House. Then, the president’s controversial pick for temporary intelligence chief scuttled an extension of a key warrantless surveillance program.

    The House and Senate now return with limited time to pick up the pieces, as the GOP majorities work to get their priorities across the finish line before the midterms. The House has just eight remaining days in session before lawmakers begin their five-week recess, while the Senate is scheduled to be in Washington through the first week of August.

    SAVE America Act

    The most pressing issue facing House Speaker Mike Johnson is how to navigate around a blockade on the floor by Republican hardliners who are demanding passage in the Senate of the SAVE America Act.

    The members, led by Rep. Anna Paulina Luna of Florida, prevented most legislation from moving forward late last month. They have vowed to hold firm until the measure passes the Senate, where leaders have repeatedly stressed that it lacks the necessary support. To appease holdouts, Johnson proposed merging the SAVE America Act with the annual defense policy bill, known as the National Defense Authorization Act, before sending it to the Senate. But the hardliners voted against moving forward on the plan.

    The standoff led Johnson to send the House home early for the Fourth of July recess. As the chamber returns, Vice President JD Vance is set to attend the House GOP conference meeting on Tuesday as they look to move forward.

    Though the House has passed various versions of the elections measure, Mr. Trump has pushed for the legislation to go further and include bans on mail-in voting and transgender athletes’ participation in women’s sports. Johnson told Fox News that the president understands the mail ballot prohibition “is a bigger reach.”

    Johnson said there’s a “big urgency” in passing the legislation and the House would “try one more time” to approve the measure via the party-line budget reconciliation process — which would pose its own obstacles.

    Reconciliation 3.0

    Mr. Trump has called on Congress to approve a spending bill without the help of Democrats through the budget reconciliation process, with $350 billion in defense funding and the SAVE America Act. In a Truth Social post last week, the president said House and Senate leadership must “make this their Number One Priority,” requesting progress in the Budget Committee upon Congress’ return.

    House Republicans have been pushing to move forward on the reconciliation bill, which would be the third such effort this Congress, despite serious expressions of doubt from some key Senate Republicans.

    In the upper chamber, a number of Republicans, like top appropriator Sen. Susan Collins of Maine, have thrown cold water on the possibility of another reconciliation bill. And Senate Majority Leader John Thune has expressed skepticism, pointing to the chamber’s tight margins that have grown even slimmer with Graham’s death and the prolonged absence of Sen. Mitch McConnell of Kentucky due to health issues.

    The path forward is especially complicated by Graham’s passing. As chairman of the Senate Budget Committee, Graham kickstarted the process in the upper chamber for the first two reconciliation bills, and would have led the new effort in the Senate.

    Blanche and Clayton confirmation hearings

    Senate Republicans are pushing forward with the confirmation process for both attorney general and director of national intelligence this week.

    Acting Attorney General Todd Blanche is set to appear before the Senate Judiciary Committee on Wednesday for his confirmation hearing, which was already poised to be contentious. Some Republicans have voiced concern about the “anti-weaponization” fund, among other issues, and threatened to withhold support. Graham’s death leaves Republicans with a slimmer margin on the Judiciary Committee.

    Also on Wednesday, the Senate Intelligence Committee is scheduled to hold a confirmation hearing for Jay Clayton to be director of national intelligence. Mr. Trump torpedoed the original plans in June, demanding that senators first move forward on confirming a new U.S. attorney for the Southern District of New York, the position Clayton currently holds.

    The Senate had sought to quickly confirm Clayton last month with the hope of ending the stalemate over a warrantless surveillance program that lapsed earlier in the month after Mr. Trump’s temporary pick to lead the Office of the Director of National Intelligence, Bill Pulte, rattled lawmakers.

    FISA reauthorization

    Lawmakers are still grappling with Section 702 of the Foreign Intelligence Surveillance Act, after it expired on June 12 amid opposition to Pulte’s leadership. Since then, there’s been debate over the effects of the lapse given that the Foreign Intelligence Surveillance Court recertified the program through March. But concerns about potential national security risks remain.

    Even before Pulte’s appointment complicated its path to renewal, the law was already on a bumpy path as civil liberties-minded lawmakers in both parties demanded reforms on warrant requirements. The demands led Congress to punt the issue twice since it was initially set to expire in April.

    Lawmakers reached a bipartisan deal to extend the surveillance authority for three years that they said would have more than enough support for passage before Mr. Trump disrupted the plans. With Clayton’s confirmation, lawmakers are also hoping to unlock a path forward.

    But the president’s will could still stand in the way. In addition to the demand that Clayton’s replacement be installed, Mr. Trump also linked the renewal of the surveillance authority to the SAVE America Act, threatening not to sign it without the election bill attached.

    NDAA

    Congressional leaders are also aiming to approve the must-pass defense policy bill known as the National Defense Authorization Act in the coming weeks. The Senate is hoping to make progress on the bill as soon as this week, but opposition from Democrats amid the renewed conflict with Iran is threatening its path forward.

    Senate Minority Leader Chuck Schumer said in a letter to colleagues on Monday that Republicans are “pushing to advance the annual NDAA while refusing to negotiate on the president’s bloated, partisan topline budget request.” Democratic Sen. Brian Schatz of Hawaii said over the weekend that he would vote against advancing the bill, citing authorization for the Iran war and defense spending. He added, “I usually vote yes on NDAA but this is an easy call for me.”

    The House is not currently scheduled to take up the NDAA again this week.

    Russia sanctions push

    Lawmakers are pushing for action on a long-stalled Russia sanctions bill as soon as this week as they look to honor Graham, a foreign policy hawk who had championed the sanctions effort as part of a push to end Russia’s war with Ukraine.

    On Friday, Graham announced that he and a group of senators had reached an agreement with the Trump administration to move forward with an updated sanctions package. The package would impose sanctions and tariffs on countries doing business with Russia, including those that buy Russian oil.

    Graham had been pushing for the sanctions for more than a year. But Senate Republicans waited for months for the go-ahead from the administration. As lawmakers paid tribute to Graham on Sunday following his sudden death, his colleagues on both sides of the aisle urged Senate leaders to move ahead on the sanctions bill in his honor. House colleagues pledged to introduce the bill in the lower chamber.

    Democratic Sen. Jeanne Shaheen of New Hampshire, who was part of the agreement reached with the White House on the sanctions bill, said it was one of Graham’s “most consequential efforts.”

    “There can be no more fitting memorial to Lindsey, his legacy, or the causes he fought for than to pass this legislation and realize his long-held dream of an independent and secure Ukraine,” she said.

    South Carolina faces a special primary election after Sen. Lindsey Graham’s unexpected death at 71.

    President Donald Trump is pushing for an unexpected replacement to fill the vacancy left by the late Sen. Lindsey Graham, R-S.C., in the Senate.

    Trump wants South Carolina Gov. Henry McMaster to tap Graham’s sister, Darline Graham Nordone, to be appointed to the lawmaker’s suddenly open seat for the remainder of his term.

    “I recommended, to Governor Henry McMaster, Lindsey Graham’s wonderful sister, Darline, to serve as interim Senator from the Great State of South Carolina,” Trump said on Truth Social on Monday. “This would be a fabulous tribute to Lindsey, who loved her dearly!”

    Graham and his younger sister, Darline, had a unique bond, given that, after their parents died, the lawmaker legally adopted and raised her.

    Trump’s announcement comes as a scramble behind the scenes is taking place to fill Graham’s spot, and further, find a new GOP nominee to run in November to keep his seat in the hands of Republicans.

    McMaster is expected to announce his pick for the seat at 4 p.m. on Monday. He has so far kept quiet about who he would prefer. Fox News Digital did not immediately hear back from McMaster’s office on who he is eyeing in the interim.

    Meanwhile, a key Republican, Sen. Tim Scott, R-S.C., also wants to see Graham’s sister get the nod for his seat.

    “Lindsey Graham’s sister, Darline Graham Nordone, would be a fantastic pick to serve out the remainder of the Senate term,” Scott said on X. “After speaking with Darline, there is no one better who understands Lindsey’s love for family, our state, and our country.”

    Scott, earlier in the day, floated both former Rep. Trey Gowdy and former Sen. Jim DeMint as possible replacements in the interim. He hoped that McMaster would “put a placeholder and let the voters decide” later during a forthcoming special election.

    “I think in the next several hours or next day or so we’ll figure out who that person is,” Scott said. “I love Trey Gowdy and Jim DeMint has been in the conversation.”

    “[Graham’s] sister would be a wonderful placeholder as well,” he continued. “So we’ve got lots of candidates who could hold the place so that the voters decide. And remember the election starts August the 11th in South Carolina, three weeks from now, we’ll have a primary process.”

    Both Gowdy and DeMint have served in Congress — Gowdy in the House and DeMint in the Senate, preceding Scott. Graham Nordone, however, has never held public office.

    Multiple sources close to Scott, who chairs the National Republican Senatorial Committee (NRSC) told Fox News Digital that he is pushing McMaster to choose one of the three to effectively be a placeholder and not seek a six-year term in the Senate.

    While the appointment race nears its conclusion, the race for the GOP nomination to run in South Carolina is still wide open.

    Reps. Nancy Mace, R.S.C., and Ralph Norman, R-S.C., are already hinting at leaping into the special election, which is set for Aug. 11. Rep. Joe Wilson, R-S.C., said that he would stay in the House, but the rest of the Palmetto State’s GOP congressional delegation have not said what their plans are.
