Trump admin’s mail-in ballot fight lands back at Supreme Court

The Trump administration filed a new appeal with the Supreme Court on Sunday seeking to enforce restrictions on mail ballots, as the ballots begin entering states across the country ahead of the midterm elections.

The filing asks the high court to stay a preliminary injunction issued Friday by U.S. District Court Judge Indira Talwani that prevents the U.S. Postal Service from enforcing several requirements for ballot mail in the November elections.

“Ballots have already begun to be mailed in North Carolina, and more States will begin the mailing process as the injunction remains in place — including Alabama on September 9 and at least five States the week of September 13,” Solicitor General John Sauer wrote.

FEDERAL JUDGE AGAIN BLOCKS TRUMP’S MAIL BALLOT ORDER JUST BEFORE MIDTERMS

“Once those ballot envelopes enter the mailstream, there is no retrieving them,” he added.

Sauer argued that allowing the injunction to remain in place risks “sowing confusion and chaos” as more states begin mailing ballots because preparations to comply with the Postal Service rule remain voluntary rather than mandatory.

The administration maintains the rule is “a lawful and modest exercise of rulemaking authority delegated by Congress to the Postal Service” and “regulates the U.S. Mail, not federal elections.”

Wake County Board of Elections employees prepare absentee ballots to be mailed on Thursday, Sept. 3, 2026, in Raleigh, N.C.(AP Photo/Matt Ramey)

The rule requires federal election ballots sent through the mail to use envelopes that include the official Election Mail logo, meet automation requirements and carry unique barcodes, according to the filing. State election officials would also have to submit envelope designs for review and provide the Postal Service with information about intended ballot recipients.

The administration says the requirements are intended to improve the handling and delivery of ballot mail and protect the mail system from being used to facilitate voter fraud.

MAIL-VOTING CRACKDOWN MOVES AHEAD AS TRUMP COURT WIN OPENS DOOR TO FEDERAL ACTION

The rule would not give the Postal Service authority to determine who is eligible to vote by mail or whether ballots should be counted, responsibilities that would remain with state and local election officials.

Democratic-led states and voting rights groups challenging the restrictions contend the changes are unconstitutional, while election officials have argued there is not enough time to revise their systems to comply before November.

A large box of pre-assembled mail-in ballots at the Wake County Board of Elections on Thursday, Sept. 3, 2026, in Raleigh, N.C.(AP Photo/Matt Ramey)

The administration disputes those arguments, saying Congress gave the Postal Service broad authority to regulate the handling and delivery of mail and that the rule does not dictate ballot content, determine voter eligibility, establish election deadlines or govern how ballots are counted.

The filing marks the third time the administration has asked the Supreme Court to intervene in the dispute. The high court previously allowed the administration’s plan to move forward but has not ruled on whether the restrictions themselves are legal.

The battle could have major ramifications for the November elections, when control of Congress is at stake. Nearly one-third of U.S. voters cast ballots by mail.

After ‘Lake America,’ Trump suggests a new name for the state of New Mexico

    September 6, 2026 3:44pm EDT / Fox News

The post follows executive orders renaming Lake Ontario as ‘Lake America’ and the Gulf of Mexico as the ‘Gulf of America’

The White House on Sunday amplified President Donald Trump’s call to rebrand New Mexico as “New America,” reposting an image from the president’s Truth Social account showing the state’s name crossed out and replaced with “America.”

Trump’s original post featured a map of the Southwestern state with the word “Mexico” crossed out in bright red and replaced with “America,” effectively depicting it as “New America.”

TRUMP RENAMES LAKE ONTARIO ‘LAKE AMERICA’ AMID INTENSIFYING US-CANADA TRADE DISPUTE

The White House later shared the image on its verified X account. Neither post included an explanation or indicated whether it reflected an actual policy proposal.

The post comes just days after Trump signed an executive order renaming Lake Ontario “Lake America” for U.S. federal use. The executive order followed a series of tariff disputes between Washington and Ottawa.

Trump said he directed Interior Secretary Doug Burgum and the department to update the Geographic Names Information System to reflect the name change. Google and Apple later updated their maps for U.S. users to reflect the change.

MAJORITY OF AMERICANS REJECT TRUMP’S RENAMING OF LAKE ONTARIO TO ‘LAKE AMERICA,’ POLL FINDS

Trump also signed an executive order renaming the Gulf of Mexico the “Gulf of America” early in his second term.

Unlike lakes and other geographic features that can be renamed for federal use through executive action, a president cannot unilaterally rename a U.S. state. Trump and the White House have not announced any formal effort to change New Mexico’s name.

The name “New Mexico” predates the state by centuries. Spanish explorers began using “Nuevo México” in the late 1500s. The territory kept the name after becoming part of the United States in 1848 and later achieved statehood on Jan. 6, 1912.

Mamdani under fire after symbolic 9/11 pen goes to former al Qaeda defense lawyer

Chief counsel Ramzi Kassem previously represented Guantanamo detainee Ahmed al-Darbi, brother-in-law of a Flight 77 hijacker

    September 6, 2026 12:07pm EDT / Fox News

9/11 families are calling for NYC Mayor Mamdani to be banned from the 25th-anniversary ceremony in September. Giovanni Galante, who lost his wife Grace, organized a petition citing Mamdani’s public record and alleged minimization of 9/11 attacks.

NEW You can now listen to Fox News articles!

New York City Mayor Zohran Mamdani is facing backlash after giving a ceremonial pen from a 9/11 remembrance ceremony to a top aide who once represented a convicted al Qaeda member whose brother-in-law hijacked the plane that struck the Pentagon.

Mamdani signed executive orders Friday ahead of the 25th anniversary of the Sept. 11 attacks, designating the date a citywide day of remembrance and service and strengthening efforts to prevent future terrorist threats.

After signing the final order, Mamdani handed the pen to NYPD Commissioner Jessica Tisch and asked her to pass it to chief counsel Ramzi Kassem. Kassem previously represented Ahmed al-Darbi, who pleaded guilty to war-crime charges tied to al Qaeda plots against commercial ships and was the brother-in-law of Khalid al-Mihdhar, one of the hijackers aboard American Airlines Flight 77, which crashed into the Pentagon, killing 184.

The handoff drew criticism on social media, with users arguing on X that Kassem’s role in the ceremony distracted from an event meant to honor those killed in the attacks and the first responders who died trying to save them.

“This is a slap in the face to victims ahead of the 25th anniversary of 9/11,” wrote podcaster Benny Johnson on X.

“I sincerely hope the rest of the country understands just how hard it is to be in New York City with this mayor, and especially as we’re approaching this most serious and solemn day for NYC: 9/11,” wrote former New York state Senate candidate Maria Danzilo.

Another user on X called it a “deliberate gesture by Mamdani that undermines 9 / 11 yet again with impunity.”

ACCUSED 9/11 MASTERMIND KHALID SHEIKH MOHAMMED, 3 CO-DEFENDANTS SET FOR 2028 TRIAL

City Hall told the New York Post that Kassem attended the ceremony because he and his team drafted both executive orders as part of his duties as chief counsel.

That role has drawn scrutiny because Kassem previously represented Ahmed al-Darbi, a Guantánamo Bay detainee who pleaded guilty to war-crime charges tied to al Qaeda plots against commercial ships, including the 2002 bombing of a French oil tanker off Yemen’s coast. Al-Darbi’s sister was married to Khalid al-Mihdhar, one of the hijackers aboard the plane that crashed into the Pentagon on Sept. 11, 2001.

Trump says US no longer needs troops in Iraq

President Donald Trump says Iraq is ready to stand on its own without U.S. troops, while Iraqi Prime Minister Ali al-Zaidi says armed groups outside state control will have “no justification” after the coalition mission ends.

The Trump administration’s push to compel the new Iraqi Prime Minister Ali al-Zaidi to dismantle pro-Iran terrorist militias is moving forward — even with some setbacks.

As Mideast experts are taking a wait-and-see approach tinged with mild optimism, a senior Iraqi official announced in late August that Baghdad will not treat Sept. 30 as a deadline to disarm the pro-Iran groups known as the Popular Mobilization Units (PMU), also called the Popular Mobilization Forces.

The Iraqi government is seeking to exercise control over the rogue state-affiliated militias with a strategy to integrate them into the state apparatus. The radical Iraqi Shiite cleric Muqtada al-Sadr, who leads Saraya al-Salam armed group, said in May that he favored integration. Some of the more hardline pro-Iranian regime militias, like Kataeb Hezbollah and Harakat Hezbollah al-Nujaba, declared that they will not disarm or integrate into the state.

The official, Qasim al-Araji, security advisor to the prime minister, told Al Iraqiya on Aug. 23, “Sept. 30 is the date for the international coalition to depart, not the deadline to hand over weapons.” The international coalition is the U.S.-led force that defeated the Islamic State in Iraq and Syria during President Trump’s first term. It is unclear why Iraq’s government is walking back the disarmament deadline for the PMU.

A spokesman for the Iraqi embassy declined to comment on the mixed messaging from Iraq’s government and on the timetable for dissolving or integrating the PMU.

Just days before al-Araji’s announcement, a representative of the Iraqi government sent Fox News Digital a statement: “Prime Minister Ali Faleh Al-Zaidi: All political forces fully agree on moving forward with restricting weapons to state control, and work is underway on mechanisms for surrendering weapons and bringing this issue to a complete end.”

Al-Zaidi told the Baghdad Dialogue Conference at the same time that “all political forces agree on moving forward to ensure that all arms remain under state authority and on developing mechanisms for the handover of weapons. There are no intentions or prospects of any military confrontation, and we will not allow Iraq’s enemies to exploit any opportunity. The presence of weapons outside state authority creates an environment that discourages investment, which is unacceptable because it does not serve the interests of Iraqis.”

In May, the U.S. Treasury Department sanctioned Ali Maarij Al-Bahadly, Iraq’s deputy minister of oil, because he, according to the designation, “abuses his position to facilitate the diversion of oil to be sold for the benefit of the Iranian regime and its proxy militias in Iraq.” Treasury Secretary Scott Bessent said at the time, “Like a rogue gang, the Iranian regime is pillaging resources that rightfully belong to the Iraqi people,” adding “Treasury will not stand idly by as Iran’s military exploits Iraqi oil to fund terrorism against the United States and our partners.”

In late August, the UAE’s The National paper reported that “Iraq’s anti-corruption body announced that deputy oil minister, Al-Bahadly, was sentenced to seven years in prison and fined millions of dollars for corruption.

Reacting to reports that Iran approved passage of Iraqi oil tankers via the Strait of Hormuz, Alberto Fernandez, former U.S. ambassador and Mideast analyst, claimed that “the profit from that Iraqi oil goes, in part, to pay for Iran’s own Iraqi militias/death squads on the Iraqi government’s payroll.”

An Iraqi government spokesman dismissed Fernandez’s comments, telling Fox News Digital, “That is not accurate.”

A State Department spokesperson told Fox News Digital, “Iraq has embarked on a new direction under the leadership of Prime Minister Al-Zaidi in full partnership with the United States. As President Trump made clear when he hosted Prime Minister Al-Zaidi’s historic July 14 visit, the United States strongly supports his vision to ensure a brighter future for all Iraqis free from terrorism, to prevent attacks in and from Iraqi territory, and to deliver a strong and mutually beneficial U.S.-Iraq partnership.”

Entifadh Qanbar, a former spokesman for the deputy prime minister of Iraq during the George W. Bush administration, told Fox News Digital: “We were all hoping that Prime Minister Ali al-Zaidi would take decisive action against the militias, especially after his visit to the White House and the widespread praise he received from President Trump. I was always skeptical, very skeptical, but I believed he deserved a chance.”

Qanbar added, “Initially, some militias such as Asaib Ahl al-Haq and Kataib Imam Ali (sanctioned by the U.S.) merely issued statements claiming they would hand over their weapons. There has been no credible evidence that they have actually disarmed.”

Qanbar claimed that “any remaining hope was further diminished after IRGC Islamic Republic Guard Corps Quds Force commander Esmail Qaani visited Baghdad. According to multiple reports, he instructed militia leaders to slow down any discussion of disarmament, reject the September 30 deadline, and maintain their weapons as part of Iran’s broader regional deterrence strategy.”

When asked about Iraqi state efforts to dismantle the PMU, Elizabeth Tsurkov, a senior non-resident fellow at the New Lines Institute in Washington, D.C., told Fox News Digital, “The Iraqi government is trying. It genuinely carried out some moves. Unfortunately, because the militias are extremely willing to use force against their own people, including against security forces, the government finds itself in a position of backing down in the face of these militias.”

She noted, “The militias have penetrated most state institutions… and you see repeated situations of the state backing down.” Kata’ib Hezbollah, an Iran-backed group designated by the U.S. as a terrorist organization, kidnapped Tsurkov in 2023 and held her hostage for nearly two years. The Trump administration secured her release in 2025.

The power of the PMU was demonstrated in a recent setback for the Iraqi government.

Both Qanbar and Tsurkov cited the case of the Iraqi Counter Terrorism Service (CTS), which arrested Abbas al-Yaqubi, the head of intelligence for the Popular Mobilization Forces’ Baghdad Belt Operations Command.

A few days after al-Yaqubi’s arrest, he was transferred to the PMU intelligence branch. Qanbar said: “Al-Yaqubi has long been involved in violence against Iraqi activists, and many viewed his arrest as an important signal that the government was finally willing to confront powerful militia figures. What seemed like a significant step forward turned into a major setback.”

Trump admin renews Supreme Court ask to let mail ballot rule to take effect ahead of midterms

    2026-09-06T16:18:21.530Z / CNN

President Donald Trump’s administration on Sunday again asked the Supreme Court to allow the US Postal Service plan for mail ballots to take effect immediately, a mostly procedural move that nonetheless underscores the president’s desire to restrict mail voting during the critical midterm elections.

In its emergency appeal, the Postal Service noted that mail ballots for the November midterms are already being sent in one state, North Carolina, and that other states will soon follow. The USPS asked the high court to quickly allow it to implement its rule, setting up one of the most significant election cases on the court’s quick-turn docket in years.

The Supreme Court was already considering an emergency appeal filed by the USPS on Sept. 3 that urged the justices to allow the agency to implement the new ballot rule ahead of the November elections that will determine which party controls Congress. In that appeal, the USPS asked the Supreme Court to stay a temporary restraining order from US District Judge Indira Talwani in Massachusetts that barred the agency from moving forward for two weeks.

On Friday, a day after the Justice Department filed that appeal, Talwani ruled again, handing down a preliminary injunction. That subsequent order blocked the USPS plan indefinitely. It is that second, indefinite block on the plan that the administration appealed to the Supreme Court on Sunday. Shortly after filing the second appeal on Sunday, the administration withdrew the first case.

In a letter to the court on Sunday, the Justice Department said it had filed the new appeal out of “an abundance of caution” and that it withdrew the first case “to simplify proceedings.”

For voters and states, the difference between the cases will make little or no difference.

The high court is being asked to rule with an extraordinarily quick timeline on an effort by the administration to give the USPS an unprecedented role in elections. North Carolina has already begun mailing out ballots. Alabama will begin doing so on Sept. 9. At least five additional states will begin mailing ballots on September 13, according to the Justice Department.

“Once those ballot envelopes enter the mailstream, there is no retrieving them,” the Justice Department told the Supreme Court in its filing on Sunday. “And while the injunction allows the Postal Service and the states to continue taking steps to ensure that their envelopes satisfy the rule’s requirements, each day the injunction is in place risks sowing confusion and chaos because the injunction makes those preparatory steps voluntary, rather than mandatory.”

The USPS rule would require state and local election officials to upload lists of their mail voters to a portal. It would also require election officials to use special barcodes on the envelopes to ease tracking of that mail. Many election officials have argued that it’s already too late to implement those requirements.

The administration has argued that the changes are needed to secure the ballots and ensure that only eligible voters receive one. But a coalition of 23 Democratic-led states and voting groups have described the effort as a power grab by a president who has long falsely alleged widespread voter fraud in mail ballot systems, even as he has frequently voted by mail himself.

“With fewer than 60 days to go before the November election, there is not a shred of evidence that states could comply with it without disenfranchising voters who rely on mail ballots,” said Sophia Lin Lakin, director of the Voting Rights Project at the ACLU, part of the legal team challenging the USPS proposal.

In the appeal on Sunday, Solicitor General D. John Sauer argued that, “Contrary to the claims of the district court and respondents that the Postal Service is trying to federalize the rules for mail-in voting, the Postal Service’s final rule imposes only modest envelope-design and addressee-information requirements for federal-election ballots sent via US mail.”

The Constitution empowers states and Congress to set the rules for elections, not the president nor the Postal Service. That was a point that Talwani stressed in her latest decision on Friday.

“The Constitution’s elections clause tasks the States with the role of election administration, subject only to Congress’s superseding legislation, and the executive has no inherent authority in this joint endeavor,” she wrote.

The new appeal is unlikely to change the timeline of the high-profile case very much. Justice Ketanji Brown Jackson, who handles emergency appeals rising from the Boston-based 1st US Circuit Court of Appeals, had required the states to respond to the first appeal on Tuesday. On Sunday, Jackson ordered the states and voting rights groups challenging the USPS to respond to the new appeal on Wednesday, instead.

This story has been updated to include new details.

House GOP conference chair says Rep. Max Miller is “our nominee right now” despite abuse allegations

    September 6, 2026 / 3:02 PM EDT / CBS News

    By Sophia Vlahakis News Associate

House Republican Conference Chair Lisa McClain said while she hopes abuse allegations against fellow GOP Rep. Max Miller are “not true,” she is supporting his reelection bid for a third term because “I will support anyone with an R behind their name.”

“At the end of the day, he’s our nominee right now,” the Michigan congresswoman said on “Face the Nation with Margaret Brennan.” “I wish the allegations weren’t true. “

McClain also said that “divorces are ugly,” but “at the end of the day, we got to let the process play out.”

“I’m focused on winning the House back, taking the House back, keeping the House because we are the only party that’s actually putting more money in your pocket, making sure that crime is down, securing the border, and rooting out waste, fraud, and abuse,” McClain said. “And Max Miller has been a good advocate for his constituents doing that.”

Despite numerous Republican lawmakers, including Sens. Katie Britt, Jim Banks and John Husted, calling on Miller to drop out, GOP leadership is standing by Miller with the midterms approaching. House Speaker Mike Johnson told reporters on Aug. 31, “He’s been a great member of Congress.”

The abuse allegations against Miller gained attention after his ex-wife, Emily Moreno, asked a court on July 30 to issue a restraining order that would prevent Miller from contacting her lawyers. Moreno, the daughter of GOP Sen. Bernie Moreno of Ohio, alleged Miller verbally and physically abused her and their two-year-old daughter.

She says the Ohio congressman once threw boiling water at her, pointed a gun at her and tossed her against a wall, as well as allegedly caused a clavicle fracture and bruise on their daughter.

Miller has denied the allegations. CBS News reached out to him on Sunday for comment as well.

“My former wife is engaging in a pattern of reporting incredible, serious and destructive allegations with absolutely no evidence,” Miller said in a livestream on Aug. 2. “Every single one of these allegations were already investigated, and I cooperated fully every single time because I had nothing to hide.”

In an effort to discredit the allegations, while also facing accusations from former White House press secretary Stephanie Grisham and a woman from high school, he released a Dropbox folder with documents to defend himself. That folder, however, appeared to include naked photos of his daughter, adding to the hostilities of the divorce and custody battle.

Sen. Moreno in August said his daughter “lives in constant fear of this man,” and he has to pick up his granddaughter at a police station for exchanges because he doesn’t know “what this guy’s capable of.” During one custody exchange, Moreno claimed his former son-in-law would not hand over a blue stuffed bunny and “literally held it hostage” from his daughter.

The senator said Miller “should not serve in the House of Representatives” and “needs serious psychological help.”

To avoid a special election primary in Ohio, Miller needed to withdraw by Aug. 4, and President Trump even called Miller a day before the deadline to raise concerns, a sources CBS News at the time.

Republicans hold a slim majority in the House, and the party in the White House has traditionally faced losses in midterm elections. The combination means Republicans must fight to retain every seat.

“Come From Away”: Transforming tragedy into art, darkness into light

    2026-09-06 11:11 AM EDT / CBS News
    By David Morgan

One of the most affecting stories to come from the terror attacks of September 11, 2001 – one that instills a faith in humanity in spite of the horrifying events of that day – was about the generosity of the residents of a small Canadian town towards several thousand stranded, anxious travelers.

In the wake of the attacks, the Federal Aviation Administration grounded all air traffic, forcing 38 international flights headed to the United States to land at an airport in Newfoundland near the small town of Gander. The locals responded to the emergency by providing aid and comfort to seven thousand passengers and flight crew members, many desperate for news from home. The locals’ individual and collective acts of kindness became the basis of the acclaimed musical “Come From Away.”

With book, music and lyrics by the husband-and-wife team of Irene Sankoff and David Hein, the show features an ensemble cast of 12 actors playing all the characters, from the “plane people” stranded on the island, to the Newfoundlanders who took them in. Sankoff and Hein conducted research while visiting Gander during the 10th-year reunion held in 2011. With a book and lyrics taken from their interviews, and a score infused with folk music, “Come From Away” bowed in New York in March 2017, and went on to win three Drama Desk Awards (including outstanding musical and outstanding book of a musical) and a Tony Award (for best director). It played on Broadway for 5 1/2 years (with a break for COVID), and has been produced around the world ever since. A live capture of the show featuring the Broadway cast is currently available on Apple TV+.

Sankoff (a native of Ontario) and Hein (born in Saskatchewan) talked with “CBS Sunday Morning” about the origin of the show, and about the impact it has had on the people of Gander.

Sankoff and Hein, who were living in New York City in a residence for international students on September 11, 2001, said they were not aware of what was happening at Gander at the time that Manhattan was shrouded in the dust of the collapsed World Trade Center: “All of our neighbors came out and took care of us,” Hein said. “There’s a lot of musicians there, they played music, we had meals together, they checked in on us. My cousin was in the towers, but fortunately escaped, she was on the first floor. And so, we were all waiting for news together, and this community, this international community, came together to take care of each other.

“At the time, one of the residents actually said thank you to us for taking planes on that day, and we didn’t even know what they were talking about. But later, when we heard the story of what happened in Gander, it resonated with us because, not only the kindness that we saw in our immediate community, but in the kindness and generosity that New Yorkers showed on 9/12 and the days afterwards – giving blood, being there for one another – and that the theater community did as well.”

In interviewing the residents of Gander and the passengers, what was your initial intent, or did you not have one?

Sankoff: “Well, we had been commissioned to write a musical for Sheridan College out in Oakville for the very new Canadian Musical Theatre Project. I remember being afraid, like, there are so many stories, this cannot be, like, the typical musical. How do we do this? I think maybe this is like a ‘Laramie Project’ sort of play.”

Hain: “But I had grown up on Newfoundland music, and everyone we interviewed out there brought out an instrument, and brought up the music that they played growing up. Music is how the Newfoundlanders get through hard times. They have terrible winters out there, and they all come together in kitchen parties and play music and tell stories, and we knew that they had entertained everyone who had been there [on 9/11]. It was this amazing story of music and art, and also generosity.”

Sankoff: “It was at a benefit concert to give back to the survivors of 9/11 and the family members, and so, as soon as that music started, I turned to David, and I was like, ‘Oh my God, you’re right, it is a musical.’

“As soon as we told people this is what we were talking about, they wanted to talk to us. They wanted the story told, and at that time, you know, we were doing this for a college, and they still would travel two hours on the train to come out and talk to us in person and say, like, you can’t understand how smart and generous and kind these people were, and this story deserves to be told. And that was really what fueled us: okay, these people who experienced it firsthand and are so grateful want this told. We’ve gotta do it. We’ve gotta tell it.”

Using people’s testimony as book and lyrics is reminiscent of “A Chorus Line” and “Studs Terkel’s Working.” What were the models for you in translating the interviews with the Gander locals and the plane people into book and song?

Hein: “We did talk about ‘Chorus Line,’ I remember when we did a lot of the direct address, and obviously the testimony, [and] Irene’s memories of seeing ‘Chorus Line’ as a kid. We obviously looked at ‘Laramie Project,’ because it was about interviewers going into a community that had, you know, dealt with a tragedy, and also finding some hope in the middle of it. ‘Into the Woods’ was a strong one. It was group storytelling, and it was a group that goes through an experience and comes out changed on the other side. ‘Once’ told us that that musical vocabulary could be on a Broadway show.

Sankoff: “‘Peter and the Starcatcher,’ the direct address into scenes, you know, and just the theatricality of pulling things out of nothing, which is a very big Canadian thing to do. But, you know, we just didn’t know if that was a Broadway thing to do. But the other thing was, we weren’t aiming to Broadway at that point.”

Hein: “We thought Canadian high schools would be forced to do the show as some sort of Canadian high school project.”

Sankoff: “Well, having been in New York after 9/11, I was, like, no one’s gonna wanna see this. No American is gonna wanna see this. And I’m like, okay, well, you know, the story deserves to be told. The people who it happened to want the story told, so even if we’re just doing it for them, we’re gonna do it. Like, we have to follow through on this, and see what happens, you know? And it was kind of freeing to know that like, okay, well, we’re not aiming for Broadway. This isn’t gonna be a regular musical. We just wrote it the way that the story could best be told, and that meant the music propelling us forward into sort of montage scenes, and not having one lead character. I mean, it was a lot of fun. It’s a lovely world to live in as you’re developing it and, you know, having these voices in your head. I remember going back to Gander, like, four or five years later, and talking to Oz and Bonnie and Claude as if they were old friends, because they were in our heads for four or five years. But you know, they’d forgotten we’d ever gone out there to interview them, so it took them a minute to be like, why are you here? And these are Broadway producers? What’s happening? It was a very unique journey, I think, not like a lot of shows going to Broadway.”

Was there consolidation of real people into single characters?

Hein: “We often say that we were telling the story of 7,000 passengers who were on the tarmac and 9,000 locals in Newfoundland, so we were telling 16,000 stories, so to make it just coherent for people, we met a lot of women named Diane and a lot of men named Kevin, and we had to consolidate some stories together.”

Is that why you had two Kevins?

Hein: “There actually were two Kevins! And the firefighter’s name, Hannah’s son, is Kevin as well, and we refer to him as Kev. I think we only refer to him once by name. And some stories shared themes of faith or food or translation. There were two translation stories that we found a way to combine. But we always wanted the real people who experienced the story, the plane people around the world, who saw that kindness, to say that’s actually what happened. So, when we made small changes, it was always to try to illustrate larger stories that actually happened.”

Sankoff: “Even something as silly as, like, Captain Bristol, or the doctors cleaning the bathrooms: we were sitting with five women from Gander Academy, the teachers, and I think we were the first people to interview them, so they were completely fresh, and just, like, stream-of-consciousness talking to each other, and then they just say like, ‘Oh, remember the doctors, you know, the most educated people were cleaning the toilets,’ and just their excitement about them, and then this one teacher’s excitement about the captain. Okay, so what does that look like? Let’s have some fun with that. Captain Bass, she’s very much, that’s her story. ‘Me and the Sky’ is verbatim, pretty much.”

Hein: “Yeah, we interviewed her for, like, four hours, and we were ready to make ‘Captain Bass: The Musical.’”

Sankoff: “But it may happen to a different captain. So even someone like her, like, it’s all stuff that happened. Maybe happened to somebody else, and maybe happened slightly differently, but we didn’t exaggerate the kindness, the events. It was more like, okay, [Nick and Diane] kissed on a bus, not on a plane. Like, those were the liberties we took, nothing like let’s make them look nicer. If anything, we had to hold back, because we knew people wouldn’t believe it, you know?”

    The bravery of being kind

The show is very much about first responders, though they don’t treat it as their job or their calling; the show simply depicts it as the locals’ common-sense response to an emergency. Did the plane people appreciate how uncommon that might be? And did the Gander locals?

Hein: “No. The plane people told us how extraordinary the response was; the locals in Newfoundland told us how ordinary the response was. They said, ‘This is just what anyone would do.’ And what’s been amazing has been, time and time again, people from around the world saying, ‘This was extraordinary.’ It renews people’s faith in humanity, and reminded people that there was good in the world, and that’s what the stranded passengers saw.”

Sankoff: “To them, it just made sense. As Claude said, you know, we could have 7,000 scared, lonely, angry, and then he said hangry people sitting on the edge of town, but instead, just by treating them with respect and humanity, we had 7,000 friends. And then eventually, when they left, it was 7,000 new family members. So, I mean, to them, it just made sense to be like, okay, come off the planes, and let’s put you in some community buildings. They got off the planes, they went through some processing by mostly volunteers of the town, they got given a juice box, they got given a sandwich, they got put on a bus, and they got put in different community buildings. And then they said, ‘Oh, you’re eight months pregnant? You’re 87 years old? You’re not comfortable. Come to my house.’ You think of it, it just made sense. And they’re still a little, like, ‘What is wrong with the rest of you, that just doesn’t make sense?’”

The kindness and compassion, we’ve seen before with natural disasters, like hurricanes and wildfires; the community helps out. But this has the added dimension of a traumatic event where the people don’t know what’s going to happen, they don’t know what’s going to happen to them, they don’t know where they’re being driven to, and so forth. So that tension is really butting up against the generosity, where people want to help, and one guy is worried that they’re gonna take his wallet. That tension was very humanizing, in terms of telling their story, and that’s the bridge that had to be crossed between the two parties.

Hein: “I think there was so much unknown on both sides. People were getting off the planes, and they still hadn’t seen any of the images [of the attacks] by that time, after being cooped up on planes for 28 hours, and then eventually winding up in a hall with TVs set up. But on the other hand, the locals were also just getting the news, and were being told that any of the planes might be bomb threats, and yet still people were climbing into the holds to take care of the animals, and they were welcoming these people into their homes without knowing who they were. It’s a type of bravery that we rarely see or talk about these days. It’s the bravery of being kind.”

It’s 25 years later. Many in the audience weren’t even alive when it happened. And yet the show is still meeting success. It’s not like it only has something to speak of to the people who were there, who remember, who had experienced it at that time. How do you understand younger audiences taking away this story if they didn’t live through it themselves?

Hein: “I think we’ve been surprised that the show resonates with young people and old alike, for people who weren’t alive at the time when 9/11 happened. We’ve seen kids come up with Captain Beverly Bass on their shirt. A young Muslim woman said that this show helped her understand why the world changed that day, and what actually happened. It helped them give context to that event. And it’s been a safe way for teachers to explain 9/11 to their classrooms by starting off by saying there were people helping. And that’s extended to – time and again, unfortunately – tragedies around the world.

“People are able to take this story and say, this is how you respond to a tragedy, and to always look for the helpers in the background, because there’s far more of them than there are people trying to hurt people. So, I think it’s resonated with kids, when they see dark times, and remembering that this is how we can respond.”

I understand that the interview subjects were able to approve of their characters’ depictions. Was there anything they had objected to – not necessarily because they thought it was wrong, but because they wanted to be private about it?

Hein: “We were very lucky that when we first went out to Gander on the 10th anniversary, so many people were remembering the stories, and the people who wanted to tell the stories and share their stories, were the ones that came out and who we talked to. Obviously, they didn’t know this was going to be a musical, they didn’t know it was going to be a Broadway musical, and that it was going to go around the world, so I think they thought we were a bunch of kids who didn’t know what they were doing. And luckily, they then would come to workshops, and we would watch them from the back of the house and worry about what they thought, and time and again, they told us that the story needed to be told, and they approved it.

“There were small details. I remember Nick and Diane telling us that they kissed on a bus instead of kissing on a plane, and we said, ‘You know, we don’t have a scene on a bus right now, so it would really be better if you could kiss on the plane.’ And they’ve, you know, accepted those small alterations. But overall, these were people that we made friends with. We got ‘screeched in’ with Nick and Diane and Beverly Bass.”

    You kissed the cod?

Hein: “We kissed the cod! But Irene, who has a slight fish phobia, could not kiss the fish, and Claude, Mayor Elliott, who was running the ceremony, very graciously said, ‘I’ll make you a deal: you can either kiss the fish, or you can kiss me.’”

Sankoff: “And he gave me a wink, like a very, whatever you do is gonna be fine.”

Hein: “So, Irene kissed the mayor, and then the next day we had an interview with him, and I said, ‘Hi, I’m David, and you’ve already kissed my wife.’”

Sankoff: “I will say that we were sensitive, though. When we were first talking to Kevin T, I remember asking him, ‘Are you okay if you’re in the story with your boyfriend, or do you want us to not include that?’ And he thought about it for a second. He was like, ‘No, no, it’s okay.’ And then with Ali, that’s actually based on five men. At least one of those men that we spoke to, you know, they didn’t want to be identified, and that’s fine. He’s seen the show, but he doesn’t come backstage, he doesn’t take part in anything else, and we just sort of keep his identity secret.”

Hein: “We had one, strange moment where we had a character in the show who was the boyfriend of another character, and we hadn’t had the opportunity to talk to them, and in the middle of doing the workshop in Seattle, one of our actors got an email saying, ‘I think you’re playing me in a musical?’ And we finally got to meet him, and fortunately, he was a musical theater fan.”

Sankoff: “His email address was the address of Grey Gardens. And I was like, ‘Oh God, we’re in trouble! He knows musical theater, he’s gonna know this is happening!’”

Hein: “But he was very gracious, and it was wonderful to meet him. We’ve always tried to have the real people believe in the show, but also believe that we were doing right by them, and that this was their story. And so, if ever there was something that they didn’t like, I think they felt comfortable coming to us. But also, we were telling their story with their words, and that’s what’s important to us.”

What was the reception to the show when it was performed for the first time in Gander?

Sankoff: “There’s not words in the English language. Just joy. At first, it was very quiet in the lines outside, because Newfoundlanders, they used to be the butt of jokes in Canada, so I think everyone was very like, How are we gonna be represented? And as soon as we got into the chorus of ‘I’m an Islander, I’m an Islander,’ people started, like, stomping their feet and clapping their hands, and oh my gosh, it was so fun. There’s an old folk song in the middle of ‘Screech In,’ where it’s a call-and-response song, but we’ve forgotten to tell the cast that.”

Hein: “So, when the cast sings, the entire audience yelled ‘Heave Away’ back at them, and everyone burst into tears. It was an extraordinary experience bringing the show back to Newfoundland the first time.

“We were doing a benefit concert in the world’s largest walk-in refrigerator, which is their hockey rink where they stored the food at the time. And the entire town came out, and we were so worried. The actors were so worried about getting their accents right; we were so worried about sharing the stories that had been shared with us. By the end of the show, in the final song, everyone stood up. Thousands of people in Gander stood up and started cheering.”

Sankoff: “The show wasn’t even over yet, but they were just like, we don’t even care. We couldn’t hear the actors.”

Hein: “We were all in tears. It was the best. Everything after that is a cherry on top. There’s nothing that will be better than that night. And bringing it back now to Newfoundland means the world, because we’re not just bringing the show back, we’re bringing the world back. We’ve shown people around the world, and they are coming to Gander, and they are filling the hotels, and filling the restaurants, and showing them, in a million different ways, that they’re thankful for the inspiration, for the hope that we saw the first time in 2011.”

The Apple TV filming of the show, with the Broadway cast, was recorded just as we were coming out of the COVID lockdown – a similar trauma where, just as the passengers didn’t know what was going to happen, we didn’t know what was going to happen with COVID, how long the lockdown was going to take, and so forth. So, what was it like to finally get back into the theater with people and have this story performed live?

Hein: “It was amazing. We had been working on ‘Come From Away’ potentially as a movie, and so when COVID hit, it was mostly awful, because our show and the theater community was struck so hard, and everyone was out of work. We very quickly tried to pivot to how do we bring people back to work, and doing a live capture of the show was a wonderful way to bring our band and our cast and our crew back. It was insanely challenging to bubble everyone in a hotel, to bring them over, to bring an audience in, all masked. I remember on the day when we had the audience in the theater, there was a shooter in Times Square, and we had to lock the doors, and everyone had to get their cell phones back, and tell their families that they were safe. And so, it was a tense, worrying time, with a lot of fear. And it was so joyous to bring our family back together, to bring these people back to work, and to create some art that had something to say, that reminded us that there can be light after darkness again. I’m so glad we were able to do it.

“It’s the most-produced show in the world now, I think, at least in North America.”

Sankoff: “There’ve been productions in Korea and Sweden. We’re just sort of signing a contract about China that’s sitting in my inbox. You can’t shake a stick without hitting a production of ‘Come From Away’! I was in, like, Colorado, and someone was like, ‘Your show’s playing 40 minutes from here,’ and they were like, ‘We want to go!’ And I was like, ‘Alright, let’s go!’ It’s remarkable. It’s insane.”

Hein: “And what’s extraordinary is seeing the show in Buenos Aires or Korea. In Japan, the cast told us that they weren’t affected by 9/11 very much, but they had their 3/11, which was the tsunami, and the show was about that. It was about how their community responded to that tragedy. And seeing the world say, ‘This inspires us, this moves us’ in the same way that we were initially moved when we came to Gander, is so affirming. It means that we all believe in the same thing. We all want to be good people and want to be good to one another, and it’s been an incredible gift.

“And to have the show resonate now, especially – we’re here in Canada, but our second home is Newfoundland, and our third home is New York. I mean, we have many homes now, thankfully. But, to have a story that reminds us that our two countries can work together, and we’re there for one another, is another reminder that we can be better than we are right now.”

Since 2002, the Tribeca Festival, in addition to films, has grown to feature concerts, filmmaker talks, industry panels, podcasts, virtual reality and games at venues throuhgout the city. Tribeca Festival

    CBS News

Remembering 9/11: Robert De Niro on helping revive Lower Manhattan after September 11

    September 6, 2026 / 10:08 AM EDT / CBS News

Film legend Robert De Niro has lived or worked in Lower Manhattan for years. “You know, the East Side is another world to someone like me who’s Lower Manhattan,” he said.

So, for De Niro, the attacks on 9/11 hit especially close to home: “I was just about to fly to California. I was at a meeting in Midtown, and instead of going to the airport, I came back down here, and saw the tower, the North Tower, the smoke coming out, and so on. And then saw the South Tower fall. I couldn’t believe, I couldn’t believe it. I looked to my left where I have a big television and so confirmed it on CNN.”

“You had to look on the TV to confirm what you were seeing?” I asked.

“What I was seeing with my own eyes, yeah! It was weird.”

Robert De Niro and correspondent Tracy Smith in Tribeca. CBS News

And in the weeks that followed, he saw his old neighborhood become a ghost town. “The thing I remember most is, right up here it was with the dust that was wet down, as I say, every day, every few hours maybe, with the sanitation water trucks to keep that stuff down.”

In fact, most of Lower Manhattan was covered in the dust from nearby Ground Zero, a poisonous plague that drifted through the air, and into people’s homes and lungs. De Niro taped up his windows, worried that the dust was toxic. Which it was.

An ash-covered street near Ground Zero, after the collapse of the Twin Towers on September 11, 2001 in New York City. Anthony Correia/Getty Images

But when the dust finally began to settle, De Niro and his longtime business partner, producer Jane Rosenthal, started to look for ways to pull Lower Manhattan out of the ashes.

Rosenthal said, “As a mother of two little girls. I was scared: What’s going to happen again? I mean, it’s all those feelings. But it’s also like, okay, how can we help? If we can help, if we can do something, then something good will come of it.”

They’d kicked around the notion of starting a film festival in Tribeca before, but after 9/11, it took on a new urgency as a way to help heal a shattered city.

In May 2002, only eight months after the attacks, the very first Tribeca Film Festival opened, drawing big crowds and even bigger names, like Nelson Mandela.

Former South African President Nelson Mandela, left, shakes hands with Hugh Grant at the opening ceremony of the Tribeca Film Festival on the steps of City Hall, May 8, 2002, in New York. De Niro said, “It just seemed like the right thing to do.”

Rosenthal said, “How do you give your neighbors a hug and say, ‘This is going to be okay?’ How do you say to everybody, ‘Okay, we need something to look forward to?’”

And for the 150,000-plus people who lined up for the first festival, that’s exactly what it was.

De Niro says he never had a doubt: “I wasn’t thinking, I was just being, We’re going to do it.”

Nearly 25 years later, a new documentary about the history of the festival, “Tribeca 25,” premieres on Netflix this coming Friday, Sept. 11.

Since 2002, the Tribeca Festival, in addition to films, has grown to feature concerts, filmmaker talks, industry panels, podcasts, virtual reality and games at venues throuhgout the city. Tribeca Festival

De Niro is famous for bringing a certain level of passion to his film roles, and he’s just as fiery off-screen when it comes to politics.

He joined in the nationwide No Kings rallies last spring, and told the crowd in New York City, “We’re going from the streets to the ballot box, because we all deserve a country with no kings.”

The Tribeca Film Festival was created as a reaction to real-world tragedy – the 9/11 attacks – and the founders say they’re still on a mission to use art as an antidote to what they see is real trauma in America. Rosenthal said, “We’re a festival that was started because of an act of war. It was to say to the rest of the world, ‘We’re still here.’”

De Niro called the creation of the festival “an act of defiance,” and says it continues to be one towards the Trump administration. “Well, it is, it is,” he said. “And we felt if anyone was going to start coming at us or coming in with the nonsense, we’re going to be ready for it. And we now see more and more how insane this administration is, how insane Donald Trump is, and he has to be gotten out. And we’ve got to get back on track with this country. That’s all. So, however we can do something with this festival to oppose him and all the destruction he’s responsible for, we’re there.”

The administration’s usual response to De Niro’s criticism is that he has “Trump Derangement Syndrome.” Asked to comment, De Niro replied, “‘Trump Derangement Syndrome’ is because of what he’s done. They revert it. He reverts things and inverts them and twists them around. It’s a lot of silly nonsense. A three-year-old could do it. That’s just a way to deflect, and we all know that. But the point is, things being said now here have to be allowed to be said.”

    CBS News

De Niro’s a little less willing to talk about all he’s done to bring downtown back, but the city speaks for itself – and he says he never feared it wouldn’t recover from 9/11. “I always felt it would come back,” he said. “It could never not come back. Like anything, it could take time.”

In 25 years, the Tribeca Festival has brought thousands of films and millions of dollars to Lower Manhattan; helped launch the careers of directors like Ryan Coogler and Camien Chazelle, among others; and, yes, it also helped revive a city. “I’m very proud of what we’ve done,” he said. “That’s all.”

And while there are many film festivals in the world, he admits Tribeca needed this one. “Yeah, we did, I think.”
