    The Internal Revenue Service improperly disclosed the confidential taxpayer information of thousands of people with the Department of Homeland Security as part of the agencies’ controversial agreement to share immigrant data to help identify those living in the country illegally, according to a new court filing.

    The Treasury Department, the IRS and the Department of Homeland Security finalized a deal last spring to allow taxpayer data to be shared with immigration authorities to help them find illegal immigrants.

    The agreement, which led to the resignations of top IRS officials, authorized Immigration and Customs Enforcement to submit names and addresses of illegal immigrants to the IRS for cross-verification against tax records.

    In a declaration filed Wednesday, IRS Chief Risk and Control Officer Dottie Romo said the IRS was able to verify roughly 47,000 of the 1.28 million names ICE requested that were then disclosed to the immigration enforcement agency.

    SECOND FEDERAL JUDGE BLOCKS IRS FROM SHARING ADDRESSES WITH ICE

    The IRS gave ICE additional address information for under 5% of those names, potentially violating privacy rules created to protect taxpayer data.

    The tax-collecting agency said it recently discovered the mistake and is working with other federal agencies to resolve the matter.

    Romo said the Treasury notified DHS last month of the error and asked for its assistance in “promptly taking steps to remediate the matter consistent with federal law,” which includes “appropriate disposal of any data provided to ICE by IRS based on incomplete or insufficient address information.”

    The agreement last year between the IRS and DHS sparked litigation against the Trump administration and broke a longstanding IRS policy that encouraged immigrants to pay taxes even if they are not in the U.S. legally by assuring them that their data was safe.

    A lawsuit was filed against Treasury Secretary Scott Bessent and Homeland Security Secretary Kristi Noem on behalf of several immigrant rights groups shortly after the agreement was signed.

    Last week, a federal judge ordered the IRS to stop disclosing residential addresses to ICE, marking the second ruling blocking the IRS-DHS agreement.

    In November, a different federal judge blocked the IRS from sharing information with DHS, saying the IRS illegally disseminated the tax data of some migrants over the summer, violating a taxpayer confidentiality law.

    Advocate groups expressed concern that the potential unlawful release of taxpayer records could be used to maliciously target U.S. citizens and violate their privacy.

    “Once taxpayer data is opened to immigration enforcement, mistakes are inevitable and the consequences fall on innocent people,” Tom Bowman, policy counsel for the Center for Democracy & Technology, told The Associated Press. “The disclosure of thousands of confidential records unfortunately shows precisely why strict legal firewalls exist and have — until now — been treated as an important guardrail.”

    How Trump failed in his latest bid to weaponize justice

    Here’s three things we know about Donald Trump.

    He thirsts for revenge; he’ll stretch the limits of presidential power to enact it; and he never gives up after a defeat.

    No wonder that six Democratic lawmakers, all military and intelligence veterans, are bracing for what comes next despite a grand jury refusing to indict them for warning service personnel against obeying illegal orders.

    “I don’t put anything past them. Donald Trump has a pretty limited … capacity to move on from things, and he doesn’t take bad news well, and he’s got quite, quite the ego,” one of the six, Arizona Sen. Mark Kelly, said Wednesday.

    Another of the six, Michigan Sen. Elissa Slotkin, was asked by CNN’s Anderson Cooper on Wednesday whether she thought the administration may make a new attempt to indict her. She replied: “I wouldn’t be surprised.”

    Rep. Jason Crow, a former army ranger and paratrooper who deployed to Iraq and Afghanistan, has launched a counterattack by warning of legal action unless the Department of Justice folds its retribution effort. “We are taking names, we are creating lists,” he told reporters Wednesday.

    The lawmakers’ warning to the troops that started the showdown came in the form of a social media video that tipped Trump into a rage. He lambasted the six as “traitors” guilty of “sedition at the highest levels” who should potentially be eligible for the death penalty. His bid for revenge was backed by Defense Secretary Pete Hegseth, who has launched an effort to lower Kelly’s last rank of captain and clip his retirement pay.

    But it emerged on Tuesday that federal prosecutors in Washington had failed to convince a grand jury to indict the lawmakers. The attempt was the latest blatant example of Trump’s authoritarian bent and weaponizing of the DOJ.

    The synergy of the department and the president’s personal and political goals was also on display on Capitol Hill Wednesday when Attorney General Pam Bondi attacked and taunted Democrats while declaring Trump “the greatest president in American history.”

    Trump makes no secret of his zeal for vengeance and lets no attack go unanswered.

    “If you go after me, I’m coming for you,” he wrote on Truth Social in August 2023, defining a life mantra that as president he again has vast powers to enact. And the president told talk show host Dr. Phil McGraw in 2024 that “sometimes revenge can be justified.”

    The failure of the DOJ to secure an indictment was unusual, since the bar for launching a prosecution is quite low. But it was also a remarkable constitutional moment. It’s rare when a president is directly thwarted by citizens in a validation of the republican system. If Trump’s strongman reflexes are to be defied over the next three years, it may take many more small acts of citizenship.

    “What was extraordinary was that an ordinary group of American citizens, a grand jury, stood up for the rule of law, stood up to this outrageous abuse of power and of taxpayer dollars,” Democratic Rep. Maggie Goodlander, another of the six, told CNN’s Kasie Hunt on Wednesday.

    “That is a win for the Constitution,” said Goodlander, a former intelligence officer in the US Navy Reserve.

    A controversial video

    Many Americans might question the motives of the six members of Congress in putting out such a video, which was certain to incite Trump. The lawmakers each took turns to read statements warning that Trump’s actions threatened the Constitution. Kelly, a former Navy aircraft carrier pilot and space shuttle astronaut, told service personnel “our laws are clear,” and added, “You can refuse illegal orders.”

    For some, the video represented an unwise decision to embroil the military in a campaign-style stunt. Others worried the video created new political complications for military officers already walking a tightrope with the Trump administration. The video was released amid a series of US strikes against alleged drug traffickers in the Pacific and the Caribbean that are taking place on questionable legal and constitutional grounds.

    Defenders of the lawmakers, however, view the administration’s response as absurd, since they were simply reminding officers of the Constitution’s requirements — and exercising free speech rights granted to every American. A successful prosecution against lawmakers who oppose the president would deal a devastating blow to democracy by seeming to outlaw criticism of a president by a member of Congress, a separate branch of government.

    Kelly has already taken legal action, alleging that the Pentagon is infringing his First Amendment rights. Senior US District Judge Richard Leon seemed sympathetic to Kelly’s argument that retired service members in Congress would be hampered in their work if they could not speak out against the Pentagon.

    “Is it your position that they’re not supposed to offer their position” on military matters, Leon asked the counsel for the administration in a hearing this month. “How are they supposed to be able to do their job?”

    But this is a White House that doesn’t try to hide its contempt for Congress and its oversight role. It disdains any form of dissent. And it has reshaped the justice system to accommodate Trump’s demands, shattering the wall that has traditionally been intended to exist between the DOJ and the Oval Office.

    “You turned the people’s Department of Justice into Trump’s instrument of revenge,” Maryland Rep. Jamie Raskin, the top Democrat on the House Judiciary Committee, told Bondi on Wednesday. “Trump orders up prosecutions like pizza, and you deliver every time.”

    The attempted indictments of the six Democratic lawmakers also raise a darker possibility — that Trump’s second-term prosecutors prefer to present hopeless cases than disappoint a president who demands retribution.

    Had they succeeded, it would have sent a message not only that members of Congress can be silenced by a president — but that ordinary citizens would be even more defenseless.

    Bondi, however, argued on Wednesday that the department had been weaponized against Trump by the Biden administration, referring to cases it pursued charging Trump with 2021 election meddling and with keeping classified documents at his Florida home, and possibly to the Russia investigation in the president’s first term.

    ‘I trust our judicial system’

    The six Democrats, also including Reps. Chrissy Houlahan and Chris Deluzio of Pennsylvania, are angry their GOP colleagues failed to defend them and their branch of government.

    On Tuesday, House Speaker Mike Johnson said that the lawmakers “probably should be indicted.” He moderated his position slightly on Wednesday while maintaining his criticism of the video. “It’s a very dangerous gambit that they were playing. Should they be sent to jail? Hopefully not. But we need to call it out as being wildly inappropriate,” Johnson said.

    Senate Majority Leader John Thune, a South Dakota Republican, also didn’t like the video but drew the line at prosecutions. “That wouldn’t have been my response to that,” Thune said. “I trust our judicial system. That’s the conclusion they arrived at. I think that pretty much lays things to rest, as far as I’m concerned.”

    The administration may not show similar acceptance. In December, for example, a grand jury in Virginia refused to indict another Trump foe — New York Attorney General Letitia James — for alleged mortgage fraud. Federal prosecutors tried again a week later, but with the same result.

    But Trump’s vengeance list keeps growing.

    Another case, against former FBI Director James Comey, whom Trump fired in his first term, was dismissed by a judge who ruled that the prosecutor, former White House aide Lindsey Halligan, had been appointed unlawfully.

    Numerous people considered by Trump to be enemies are under investigation, including ex-special counsel Jack Smith and California Sen. Adam Schiff. On Wednesday, Republicans on the House Judiciary Committee asked Bondi whether John Brennan, a former director of the CIA who is now a Trump critic, would be indicted. The attorney general said she’d received a referral from the Judiciary Committee on Brennan but could not discuss an ongoing case. However, she added, “No one is above the law.”

    Crow is not waiting around. His lawyer Abbe Lowell wrote to US Attorney Jeanine Pirro threatening legal action if there was a second attempt to indict his client.

    “The baseless and absurd allegations by Donald Trump, followed by your carrying out of the President’s political retribution campaign has already gone too far, and are evidence of yet another abuse of power directed at those who dare speak out and criticize this Administration,” Lowell wrote.

    Crow was more direct.

    “Every American should be raving pissed that they’re using taxpayer dollars in the public trust of the Department of Justice to go after political opponents, weaponizing their justice system,” Crow told reporters.

    A panel of judges in New York appointed a new top federal prosecutor in Albany on Wednesday after a Trump nominee was found to be serving in the role unlawfully — but within hours, the Justice Department announced it had fired the judges’ new hire.

    The back-and-forth adds to months of friction between the Trump administration and the federal judiciary over who is allowed to lead U.S. attorney’s offices around the country.

    In a somewhat unusual move, the judges in the Albany-based Northern District of New York said Wednesday they had appointed and sworn in a new person to lead the U.S. attorney’s office: Former prosecutor Donald T. Kinsella. They cited a law that allows judges to temporarily name people to that job if the role becomes vacant because an interim U.S. attorney’s term has expired.

    A month earlier, a federal judge had ruled that acting U.S. Attorney for the Northern District of New York John Sarcone was serving in that role unlawfully, opening up the job.

    Then, late Wednesday evening, Deputy Attorney General Todd Blanche rebuked the judges’ decision, writing on X: “You are fired, Donald Kinsella.”

    “Judges don’t pick U.S. Attorneys, the president does. See Article II of our Constitution,” wrote Blanche, referring to the section of the U.S. Constitution that lays out presidential powers, including the authority to appoint people to federal offices.

    CBS News has reached out to Kinsella for comment.

    The conflict in Albany began last year. Sarcone, a former campaign attorney for President Trump, was initially appointed interim U.S. attorney. But that interim role is limited to 120 days, and when that term limit elapsed in July, the judges in the district declined to extend it.

    Attorney General Pam Bondi responded by naming Sarcone to the role of first assistant U.S. attorney in the Northern District — effectively the office’s second-in-command — so that, under federal law, he could continue to lead the office by serving as acting U.S. attorney. Bondi also named Sarcone to the role of “special attorney” and gave him the power of a U.S. attorney.

    Last month, U.S. District Judge Lorna Schofield ruled that Bondi’s maneuver wasn’t permitted under the laws governing vacancies in U.S. attorney’s offices, finding Sarcone “is not lawfully serving as Acting U.S. Attorney.”

    The judge also barred Sarcone from overseeing an investigation into New York Attorney General Letitia James and quashed two subpoenas issued in that probe. Sarcone’s office had been looking into James for her handling of a civil fraud investigation into Mr. Trump and an investigation into the National Rifle Association, CBS News has previously reported.

    The government appealed Schofield’s ruling last month and asked her to temporarily stay her ruling while a federal appellate court considers the issue.

    Sarcone is one of at least five Trump administration picks for interim or acting U.S. attorneys who have faced pushback from federal judges, following similar rulings in New Jersey, California, Virginia and Nevada.

    The role of U.S. attorney is typically Senate-confirmed, but in several districts, the Trump administration has sought to keep people in those jobs on a temporary basis.

    Critics have accused the administration of sidestepping the Senate’s confirmation process. But the Justice Department argues that the president and attorney general have the authority to choose prosecutors. In some cases, Mr. Trump has also accused Senate Democrats of obstructing his nominees.

    One conflict in the Eastern District of Virginia led a federal judge to toss out criminal indictments against Letitia James and former FBI Director James Comey — two Trump foes — on the grounds that interim U.S. Attorney Lindsey Halligan was serving in the role unlawfully.

    Halligan continued to use the title of “United States Attorney” in court filings, leading to a rebuke from a federal judge who suggested she could be making false statements — a move the Justice Department called a “gross abuse of power.” The judge hit back and warned Halligan could face discipline if she kept using the title. Halligan then left the Justice Department, with Bondi saying the “circumstances that led to this outcome are deeply misguided.”

    The chairman of President Donald Trump’s Religious Liberty Commission said Wednesday that he ousted a member of the commission after she sparred with fellow members during a contentious public hearing on antisemitism.

    Texas Lt. Gov. Dan Patrick, who chairs the commission, said on X that it was his call to remove Carrie Prejean Boller, a former Miss California USA, after tense exchanges during the hearing Monday over what constitutes antisemitism in the US.

    Boller, during the hearing, defended conservative commentator Candace Owens, who has boosted conspiracy theories and embraced antisemitic rhetoric to her millions of online followers.

    “Carrie Prejean Boller has been removed from President Trump’s Religious Liberty Commission,” Patrick said. “No member of the Commission has the right to hijack a hearing for their own personal and political agenda on any issue. This is clearly, without question, what happened Monday in our hearing on antisemitism in America. This was my decision.”

    Boller challenged Patrick’s authority to oust her, insisting on X, “As the name states, this is President Trump’s Religious Liberty Commission, not yours. You did not appoint me to the Commission, and you lack authority to remove me from it. This is a gross overstepping of your role and leads me to believe you are acting in alignment with a Zionist political framework that hijacked the hearing, rather than in defense of religious liberty.”

    CNN has reached out to the White House and the commission to confirm that Boller has been removed from the commission.

    During the hearing, Boller argued that Owens is not antisemitic.

    “I haven’t heard one thing out of her mouth that I would say is antisemitic,” she said.

    The hearing featured multiple witnesses, including first-hand accounts of students and others who said universities failed to protect Jewish students amid pro-Palestinian protests during the Israel-Hamas war in Gaza, the Associated Press reported.

    Seth Dillon, CEO of the conservative satirical site The Babylon Bee, which routinely lampoons progressives, was there to testify that conservatives need to push back against a growing antisemitic movement on the right, according to the AP.

    Boller challenged him, questioning whether critics of Israel should be considered antisemitic, the AP said. Dillon said no, but that context matters. There are “people who try to conceal their antisemitism under the guise of merely criticizing Israel,” he said.

    She also disputed Dillon’s criticisms of Owens.

    “You should look up more of her statements,” Dillon said, citing such things as Owens saying her critics were “of the synagogue of Satan.”

    President Trump created the commission last year and charged it with “exploring the foundations of religious liberty in America,” and “identifying current threats to domestic religious liberty.”

    Late Wednesday night, Boller was still listed as a member of the commission on the White House’s website.

    The commission is the subject of a new federal lawsuit this week from progressive religious groups, according to the AP. The suit says the panel fails to represent diverse views and religions and consists almost entirely of conservative Christian members.

    Trump excludes two Democrats from US governors’ meeting invite

    WASHINGTON, Feb 11 (Reuters) – President Donald Trump plans to host Republican and Democratic governors for a breakfast meeting next week, the National Governors Association chairman said on Wednesday, though Trump later insisted he was still excluding two Democratic governors.

    Republican Trump is inviting all the governors to the meeting, according to an email by National Governors Association Chairman Kevin Stitt on Wednesday, after the association canceled a White House meeting over the exclusion of Democrats.

    The meeting is scheduled for February 20. Governors from across the U.S. gather every year in Washington for the NGA meeting. It has become a tradition for the president to host the governors at the White House for a session with cabinet secretaries, among other officials, and a black-tie dinner for the governors and their spouses.

    “He was very clear in his communications with me that this is a National Governors Association’s event, and he looks forward to hosting you and hearing from governors across the country,” wrote Stitt, who is also the Republican governor of Oklahoma.

    “President Trump said this was always his intention, and we have addressed the misunderstanding in scheduling.”

    Trump said later on Wednesday that he invited all governors except Wes Moore and Jared Polis, the Democratic governors of Maryland and Colorado, respectively.

    He accused Moore in a social media post of doing “a terrible job” of rebuilding Baltimore’s Francis Scott Key Bridge, which collapsed in 2024 after a container ship crashed into one of its support pillars.

    Trump cited Polis’ decision to not release Tina Peters from prison as a reason he was denied an invitation to the meeting. Peters, a former Colorado county clerk, was sentenced to nine years in prison in October 2024 after being convicted of tampering with voting machines after the 2020 U.S. presidential election.

    Trump said he felt the two governors were “not worthy” of attending the event. The White House did not respond to a request seeking clarification of the comment.

    WASHINGTON, Feb 11 (Reuters) – The U.S. House of Representatives on Wednesday narrowly backed a measure disapproving of President Donald Trump’s tariffs on Canada, a rare rebuke of the president and leaders of his party in the Republican-majority House.

    Lawmakers voted 219 to 211 in favor of a resolution to terminate Trump’s use of a national emergency to put punitive trade measures on Canadian goods, as six Republicans joined all but one Democrat in favor.

    It was an important symbolic vote in the chamber, where Trump’s Republicans hold a slim 218-214 majority. The resolution stands a good chance of passage in the Senate, which has voted twice to block Trump from imposing tariffs on Canada despite his Republicans holding more seats.

    However, it is unlikely to become law, as it would take two-thirds majorities in both chambers to overcome an expected Trump veto. Most Republicans have been unwilling to oppose Trump’s policies.

    The House approved the resolution a day after three Republicans joined Democrats to narrowly defeat an effort by Republican leaders to block legislative challenges to Trump’s tariffs.

    Members of Congress have been expressing frustration over rising costs for U.S. consumers as well as the impact of the tariffs on businesses involved in international trade.

    ‘CANADA ISN’T A THREAT’


    Representative Gregory Meeks of New York, who introduced the resolution, said it was about lowering the cost of living for American families, disputing claims that there was a drug-related national emergency as Trump had claimed to justify tariffs against Canada.

    “Canada isn’t a threat. Canada is our friend. Canada is our ally,” Meeks, the top Democrat on the House Foreign Affairs Committee, said in a House speech before the vote.

    Trump warned that any Republican in the House or Senate who voted against the tariffs would “seriously suffer the consequences come Election time.”

    He also took a shot at Canada, saying it had taken advantage of the United States on trade. “They are among the worst in the World to deal with, especially as it relates to our Northern Border,” he wrote on social media.

    Some members of Congress have also objected to Trump’s repeated use of executive orders to set tariffs, especially on close allies like Canada, noting that the U.S. Constitution gives that right to Congress, not the president.

    Last month, the Yale Budget Lab said, opens new tab the annual median cost of the Trump administration’s tariffs stands around $1,400 for each U.S. household. The nonpartisan Tax Foundation estimated the cost at $1,000 per household in 2025, rising to $1,300 this year, in a report last week.

    Trump initiated a tariff war with Canada shortly after beginning his second term in January 2025. He ordered 25% tariffs on imports from Canada in February 2025, and in August signed an executive order increasing tariffs on Canadian goods to 35% for all products not covered by the U.S.-Mexico-Canada trade agreement.

    The move was linked to what his administration said was Canada’s failure to stop smuggling of the dangerous drug fentanyl. But both Canada’s government and the U.S. Drug Enforcement Administration say smuggling from Canada accounts for less than 1% of fentanyl on U.S. streets.
