Trump to ask Supreme Court to rehear birthright citizenship case after ‘insane decision’

House Speaker Mike Johnson says Republicans are also exploring a congressional fix under the 14th Amendment

DHS Secretary Mullin criticizes Supreme Court’s birthright citizenship ruling

Homeland Security Secretary Markwayne Mullin voices his strong disagreement with the Supreme Court’s ruling to uphold birthright citizenship. Mullin contends that the decision, which President Trump opposed, is ‘dead wrong,’ highlighting the national security risks posed by ‘birth tourism,’ primarily from China. He explains how foreign nationals exploit the system for citizenship, undermining U.S. security.

NEW You can now listen to Fox News articles!

President Donald Trump will ask the Supreme Court to reconsider its decision on the birthright citizenship case, he announced on Wednesday.

Trump wrote in a post on Truth Social that the court’s decision to uphold birthright citizenship even in case of children of illegal immigrants and those in the U.S. temporarily was “absolutely insane.”

The president said he was already seeing examples of the ruling being exploited.

“Signs and Billboards are being put up all over our Southern Border, and Mexico, advertising BIRTHRIGHT CITIZENSHIP, with ‘Deliveries starting at $4000.’ Likewise, similar signs going up all over our Country. Billions of Dollars will be illegally made by this SCAM, with Citizenship going to anyone willing to pay,” Trump wrote.

“I will be asking for a Rehearing by the United States Supreme Court, IMMEDIATELY. This miscarriage of justice will destroy America if they don’t change their absolutely insane decision,” he added.

The court’s ruling allows the losing party to file a petition for a rehearing within 25 days of the ruling being handed down. However, a majority of justices on the court would have to agree to rehearing in order for it to be considered again.

TRUMP SUFFERS MAJOR SUPREME COURT DEFEAT AS JUSTICES UPHOLD BIRTHRIGHT CITIZENSHIP

The 6-3 decision, handed down on the court’s final day of session, saw Chief Justice John Roberts writing that all children born on U.S. soil “to parents unlawfully or temporarily present” are “citizens at birth” under the 14th amendment.

Conservatives have sought for a way to move forward against birthright citizenship in the days since the ruling, with some saying a constitutional amendment may be necessary.

TRUMP’S ‘HERO’ JUSTICE OFFERS ROADMAP AFTER SUPREME COURT REJECTS BIRTHRIGHT ORDER

Others have pointed to arguments from justices like Bret Kavanaugh, who sided with the majority, but did not outright state that the Constitution enshrines birthright citizenship.

Kavanaugh argued in a concurring opinion that Trump’s mistake was imposing limits via executive order, but said those limits might rightfully be imposed by an act of Congress.

More than a dozen immigration detention facilities have gone over a year without inspection under revised ICE policies

    July 9, 2026 / 6:00 AM EDT / CBS News

Fifteen of the 45 immigration detention facilities holding 500 or more people hadn’t been inspected in over 12 months as of late June, while five had no inspection on record, a CBS News analysis of inspection reports found.

This follows a shift in Immigration and Customs Enforcement’s policies from inspecting most of its facilities twice a year to once a year or once every two years. It’s a move immigration custody experts said weakens an oversight mechanism that was already flawed.

“A lot of facilities have deficiencies and it takes frequent reassessments to ensure that those deficiencies are being addressed,” said Dr. Annette Decker, an assistant professor at UCLA’s medical school who has studied health outcomes among immigration detainees and co-authored a 2024 paper calling for inspection reforms.

“It’s concerning if now they’re doing this less frequently, because that’s a pretty big time gap between evaluations to just ensure that healthcare and other conditions are being met,” Decker told CBS News.

Concern about conditions in detention has mounted as the Trump administration’s deportation crackdown has pushed the detention population to heights. Deaths in ICE custody were at their highest rate since 2020 last year. In May, concerns about spoiled food and poor medical care sparked a hunger strike inside New Jersey’s Delaney Hall and weeks of protests outside the facility. And last month, a government review found dangerous conditions at ICE’s largest facility, Camp East Montana in El Paso.

Since 2019, ICE’s inspections identified at least one deficiency in nearly 90% of inspections they carried out, ranging from staff failing to perform suicide checks often enough to not storing food at adequate temperatures or properly filing incident reports, CBS News’ analysis found.

A Department of Homeland Security spokesperson defended the changes in inspection policy, telling CBS News that the “frequency of inspections is based on facility type, detention capacity, and operational function,” and added that “ICE maintains a robust, multi-layered compliance program designed to promote compliance with ICE’s contractually obligated detention standards.”

    Walking back reforms

After a DHS watchdog found in 2018 that ICE Office of Detention Oversight inspections were not frequent enough to ensure facilities remedied violations, Congress increased funding to require inspections twice a year by the end of fiscal year 2021.

That changed last year, when ICE moved to conduct annual inspections on dedicated facilities, or those that exclusively hold ICE detainees, and inspections every other year on non-dedicated facilities, such as county jails. It also added biennial “assisted self-inspections” for non-dedicated facilities holding fewer than 50 people, some of which were not previously regularly inspected.

Border czar Tom Homan told sheriffs in February 2025 that the administration was aiming to reduce the number of federal inspections in a move to encourage local law enforcement agencies to allow their jails to be used as detention facilities, Reuters reported. By April of this year, there were 203 facilities holding ICE detainees, up from 104 last February.

A DHS spokesperson told CBS News that the new framework allows ICE to “allocate oversight resources based on facility type and operational complexity.”

The spokesperson emphasized that all dedicated ICE facilities, “regardless of population size,” are scheduled for inspections this fiscal year, which ends Sept. 30. Under the new framework, they wrote, “smaller or non-dedicated facilities with limited detention populations and/or shorter-term detention functions receive biennial rated inspections,” meaning every other year.

But some non-dedicated facilities hold just as many immigrants as dedicated facilities. Five of these facilities hold an average of more than 500 detainees, ICE data shows.

The budget measure passed in April that funded DHS outside of ICE and Customs and Border Patrol earmarked $20 million for immigration detention facility inspections by the agency’s Inspector General, responsible for watchdog functions across DHS. The measure that funds those two agencies, passed this month, does not include requirements for ODO inspections.

‘No question that more is better’

Even when ODO was inspecting facilities semiannually, a review by the Government Accountability Office found it lacked a way to determine whether its inspection program was effective at maintaining detainees’ health and safety. Some say it wasn’t.

“Often there are deficiencies noted at facilities without any repercussions,” said Decker, the UCLA physician and assistant professor. ODO refers to areas where facilities fall short of standards as deficiencies.

By law, ICE must terminate a facility’s contract after two consecutive failures, but facilities have accumulated multiple significant deficiencies without failing an inspection, CBS News’ analysis found.

Stewart Detention Center in Lumpkin, Georgia, for example, a dedicated contracted facility holding an average of about 2,000 people, received an “acceptable/adequate” rating at its most recent inspection in March 2025. Inspectors found 12 deficiencies, including two they labeled “priority components” pertaining to suicide prevention. Since then, two detainees have died by suicide, one last June and one in April, the county coroner told CBS News.

The DHS spokesperson pushed back on claims ICE does not hold facilities accountable, writing that “ICE works directly with the responsible field office and facility operator to correct identified deficiencies and bring the facility into compliance with ICE detention standards.”

Inspectors have broadly found fewer deficiencies per inspection each year since 2019, when they started inspecting facilities twice a year, CBS News’ analysis found. That trend continued in 2025, but so far this year, the number of deficiencies per inspection is trending upward for larger facilities.

Those included inspections that found more than 23 use-of-force violations at a facility in Natchez, Mississippi, and 22 at the El Paso detention center where inspectors outside DHS uncovered several health and safety issues. ODO’s inspection of the family detention center in Dilley, Texas, also identified 16 deficiencies in the facility’s education program for children.

Knowing an inspection is coming prompts facilities to “self-review,” and sometimes rectify their own issues, said Margo Schlanger, who served as head of civil rights and civil liberties at DHS during the Obama administration.

“You want that to happen on a pretty regular cadence,” she said. “Then the inspections themselves uncover things that are going wrong.”

“There’s just no question that more is better,” she added. “And so when you make it less often, things can really go astray in between.”

    Dwindling oversight

The Department of Homeland Security also moved to cut other oversight mechanisms last year, including gutting the Office of the Immigration Detention Ombudsman and the Office for Civil Rights and Civil Liberties, which were responsible for investigating complaints of misconduct and abuse.

“People whose rights might previously have been protected are now vulnerable to serious medical neglect in detention, to abuse by guards in detention, to loss of their rights to fight fairly their immigration cases,” said Anthony Enriquez, who is litigating a case against the government for dissolving the offices. “Where we might have seen those issues resolved at least individually for some people if a complaint was filed, we’re no longer seeing that.”

ICE also relaxed detention standards that apply to some facilities in June to “reduce the burden on our detention operators,” including removing compensation requirements for detainee labor. Last year, ODO also allowed facilities operated by the U.S. Marshals (USMS) to operate under the USMS standards, a handbook one-third the length with fewer requirements in areas such as access to calls to legal counsel, accommodations for detainees with disabilities and how long detainees are allowed in disciplinary segregation.

“The guard rails are continuing to come off,” said Dora Schriro, an expert in detention standards who served as a special adviser to former President Barack Obama’s DHS secretary, Janet Napolitano. “I’m very concerned about what the ramifications are that we’re not only capitulating to sheriffs but to U.S. Marshal as well.”

ODO also allows USMS facilities to conduct “assisted self-inspections.”

On average, USMS facilities reported many fewer deficiencies after switching to self-inspections or the new set of standards, CBS News found. Among the 26 facilities that have been inspected both before and after ICE began making these changes, ODO found an average of 12 deficiencies before the changes and an average of two after the changes.

Critics have also pointed to a lack of independence for ODO, which is housed within ICE, as hampering its ability to conduct adequate oversight.

“There’s no reason to think that they’re actually going to take a hard look at what the conditions are on the ground and make the required changes that would come from such an honest review,” said Azadeh Erfani, director of policy at the National Immigrant Justice Center, a D.C.-based advocacy group that provides legal services to immigrants.

Some public officials have taken oversight into their own hands. A group of lawmakers sued ICE for access to conduct their own inspections, which sometimes surface more issues than ODO inspections do.

At the Adelanto ICE Processing Center, for example, California state inspectors found that medical and detention staffing levels were inadequate for the surge of detainees, and detainees reported they were unable to receive timely treatment, even in emergencies. At Adelanto’s most recent ODO inspection in September 2025, officials recorded no medical deficiencies.

Four detainees in Adelanto have died since President Trump took office, three after the facility’s most recent inspection. It’s unclear when it will be inspected next.

“If [ICE is] looking to consolidate inspections or conduct fewer inspections without knowing what’s working or how effective your current system is, it’s hard to make those changes,” said Heather MacLeod, director of Homeland Security and Justice Issues at the Government Accountability Office, which conducted the review of detention inspection practices in 2024. “While we haven’t had a chance to review the effect of changing the inspections that ODO is conducting we would hope that they would have data to support such a decision to make that change.”

    About the data

To measure the frequency of inspections and types and number of deficiencies those inspections found, CBS News extracted and analyzed data from the Office of Detention Oversight inspection report posted to ICE’s webpage. As of July 8, the most recent posted inspection was completed on June 18, 2026. If an inspection occurred over multiple days, CBS News used the end date as the date of the inspection. To identify facilities holding 500 or more detainees each day, CBS News used ICE’s most recent Detention Management Statistics, current as of early April, which include facilities’ average daily population for the current fiscal year to date. The Florida Everglades facility known as “Alligator Alcatraz” was never inspected by ODO, but was excluded from the analysis due to its closure in June.

Ukraine launched one of its broadest recent drone offensives against Russia’s maritime and energy networks this week, claiming strikes on 21 vessels in three days as attacks on major refineries deep inside Russia intensified pressure on Moscow’s fuel supplies.

The wave of attacks offered a striking display of Ukraine’s growing long-range capabilities.

On Wednesday, President Volodymyr Zelenskyy met President Donald Trump at the NATO summit in Ankara, where Trump said the United States would allow Ukraine to manufacture Patriot air-defense interceptors and the two leaders discussed a potential drone agreement.

Zelenskyy made air defense his top priority during the bilateral meeting and said the two governments had also begun working on a separate drone agreement.

“Air defense is the priority,” Zelenskyy said. He described the emerging drone deal as “a very good beginning” and said he hoped to discuss additional details with Trump.

The timing allowed Zelenskyy to arrive at the summit with evidence that Ukraine’s domestic drone industry can threaten Russian assets far beyond the conventional battlefield.

Trump praised Zelenskyy as “very effective” and credited Ukrainian forces with successfully operating American weapons against Russia’s much larger military.

“He’s had the best equipment because he had our equipment,” Trump said. “But somebody has to use that equipment. And you have a lot of brave people that are using that equipment.”

Ukraine is increasingly forcing Russia to defend refineries, airfields, shipping routes and other infrastructure far beyond the front. Kyiv has not achieved a comparable breakthrough in the grinding ground campaign, and Russia continues to bombard Ukrainian cities. But repeated long-range strikes have begun disrupting fuel production and maritime logistics while imposing costs on parts of Russia that were once largely insulated from the fighting.

On Tuesday, Ukraine’s Unmanned Systems Forces said nine Russian-linked vessels were struck in the Sea of Azov on Wednesday, bringing the number targeted over 72 hours to 21.

Commander Robert “Magyar” Brovdi said the targets included 19 oil tankers, a cargo ship and a ferry operating near Russian-occupied Crimea, according to East2West news agency. He described the campaign against the fleet as reaching an “industrial scale.”

Ukrainian and Russian officials confirmed that the overnight offensive targeted tankers, refineries, pipeline facilities and a military airfield across several Russian regions.

Ukraine says many of the vessels were part of Russia’s so-called shadow fleet and were being used to transport fuel to Crimea, the Black Sea peninsula Moscow seized and illegally annexed in 2014.

The maritime strikes were accompanied by attacks on the Saratov refinery and energy facilities in the Russian regions of Tatarstan and Bashkortostan. Russian authorities said one person was killed in Saratov.

Ukraine also said it struck the Borisoglebsk military airfield in Russia’s Voronezh region. The base has been used by Russian combat aircraft involved in attacks against Ukraine, according to Kyiv.

The latest wave followed a Ukrainian strike Monday on the Omsk refinery in Siberia, approximately 1,700 miles from Ukrainian-controlled territory. The facility is Russia’s largest oil refinery and processed about 460,000 barrels of crude per day last year, according to Reuters.

UKRAINE LAUNCHES WHAT APPEARS TO BE ONE OF ITS LARGEST DRONE ATTACKS AGAINST RUSSIA: REPORT

Two industry sources subsequently told Reuters that the Omsk facility had halted oil processing following the attack.

The disruption comes as parts of Russia face gasoline and diesel shortages attributed in part to repeated Ukrainian attacks on refineries and fuel depots.

Long lines have formed at filling stations in several cities, while some regions have introduced purchasing restrictions. Russia announced Wednesday that it was temporarily banning diesel exports through July 31 to protect domestic supplies.

The shortages have become one of the most visible ways the war is reaching ordinary Russians.

Margarita Simonyan, editor-in-chief of the Kremlin-funded RT network, acknowledged the hardships during an appearance on Russian state television and urged Russians not to respond by challenging the country’s leadership.

“There is no petrol,” Simonyan said in a translated clip distributed by regional media.

Recalling food rationing after the collapse of the Soviet Union, she said: “We endured it. And we will endure it now.”

Simonyan argued that Russia’s enemies wanted the population to react as it had during the 1917 revolution and “run off to overthrow” the czar.

“Yes, it is hard, yes, very hard,” she said, urging Russians to remain calm.

The pressure on Russia’s energy infrastructure formed the backdrop to Zelenskyy’s Wednesday meeting with Trump at the Beştepe Presidential Compound.

Russia continued its bombardment of Ukraine during the summit, striking Kyiv and other cities with missiles and drones. Kyiv Mayor Vitali Klitschko said storage facilities were burning in the capital’s Desnyanskyi district and reported another fire in the Sviatoshynskyi district.

  • 演唱《Total Eclipse of the Heart》的邦妮·泰勒去世,享年75岁

她在自传《Straight From the Heart》中提到,自己13岁时买的第一张唱片是The Swinging Blue Jeans的《Hippy Hippy Shake》,并且会准时收看《Top of the Pops》节目。

斯坦曼向她推荐了自己的作品《Total Eclipse of the Heart》,这首歌后来成为她第五张录音室专辑《Faster Than the Speed of Night》的首支单曲。

    《Faster Than the Speed of Night》获得了格莱美最佳摇滚人声表演提名,最终输给了佩特·班纳塔的《Love Is a Battlefield》;泰勒也凭借《Total Eclipse of the Heart》获得最佳流行人声表演提名,最终输给了艾琳·卡拉的《Flashdance – What a Feeling》。

    2013年,她转型尝试乡村音乐风格,在纳什维尔录制了专辑《Rocks and Honey》,其中收录了与文斯·吉尔合唱的《What You Need From Me》以及一首名为《Believe in Me》的抒情小曲。

当月球遮挡太阳时,他们演奏了《Total Eclipse of the Heart》。

Bonnie Tyler, who sang “Total Eclipse of the Heart,” dies at 75

London — Bonnie Tyler, the gravelly voiced, Grammy-nominated Welsh pop star best known for singing the chart-topping power ballad “Total Eclipse of the Heart” in 1983 and seeing new generations succumb to its bombastic charms during solar and lunar eclipses, has died. She was 75.

Tyler died “unexpectedly” in a hospital in Portugal where she was being treated for an illness, her family said Thursday in a statement on her website. She was hospitalized in May in Faro, where she had a home, for emergency intestinal surgery and was later placed in an induced coma.

“Bonnie’s family and team are heartbroken to announce that Bonnie unexpectedly passed away last night in hospital in Portugal as a result of the illness that she was being treated for,” her family said.

Tyler earned three Grammy nods, represented Britain at the Eurovision Song Contest 2013 – where she came in 19th – and was awarded an MBE for her services to music by Queen Elizabeth II in 2023, all largely thanks to “Total Eclipse of the Heart,” which has had more that 1 billion streams, boosted by real eclipses in 2017 and 2024.

The song spent four weeks at No. 1, the video has surpassed 1 billion views and when Stereogum reevaluated it in 2020, the music outlet declared it an “extinction-level event rendered in musical form.”

“It’s pop music as heart-pounding, chest-thumping, blood-gargling, heavens-falling passion explosion. It’s sheer spectacle. It’s fireworks and lasers and lightning and thunder. It soars and swoops and barrel-rolls,” the site said.

The song has never really gone away, covered by the English singer Nicki French in 1995 and the band Westlife in 2006. Cate Blanchett sang it while hitting Billy Bob Thornton with her car in 2001’s “Bandits,” it appeared at a wedding scene in 2003’s “Old School” and One Direction sang it in 2010 on a U.K. version of “The X Factor.”

An April 2024 total eclipse of the sun led to a “Total Eclipse Of The Heart” for many music fans who streamed it to celebrate the celestial event. The song soared up the music charts during the day and even reached No. 2 on the Apple charts.

Tyler was born – as Gaynor Hopkins – a coal miner’s daughter in public housing with an outside toilet in Skewen, Wales, about seven miles outside Swansea. She grew up with three sisters and two brothers.

She adored the Beatles and her first album was “A Hard Day’s Night.” The first song she bought was “Hippy Hippy Shake” by the Swinging Blue Jeans at 13 and watched “Top of the Pops” religiously, according to her memoir, “Straight From the Heart.”

She would record “Top of the Pops” on a reel-to-reel two-track recorder and write down the lyrics of songs she loved. Her favorites were songs by Janis Joplin, Nina Simone, Tina Turner, Wilson Pickett and Otis Redding.

“I used to sing them into my hairbrush for hours and hours, and that’s how it all started for me. I fell in love with singing just from doing that. Looking back, even then my voice had a husky tone to it, but I didn’t think much of it. I thought everyone’s voices were different from each other’s,” she wrote.

In 1976, she had to have surgery to remove nodules on her throat, leaving her with that trademark vocal sound. Changing her name to Sherene Davis, she was fronting a soul band when she was discovered by talent scout Roger Bell, who brought her to London for demo sessions. Then she waited for a label until RCA said it was interested.

Under her new RCA-sanctioned name Bonnie Tyler, her debut album “The World Starts Tonight” in 1977 contained her first chart hit, “Lost in France,” and she was nominated for a breakthrough artists award at the Brits Awards. She then had a No. 3 hit in 1978 with “It’s a Heartache,” but soon drifted. She then signed with Sony and saw Meat Loaf perform “Bat Out of Hell” on the BBC. Impressed, she requested to work with Meat Loaf songwriter and producer Jim Steinman.

Steinman introduced her to his song “Total Eclipse of the Heart,” which would become the debut single for her fifth studio album, “Faster Than the Speed of Night.” He borrowed one of the song’s lyrics – “Turn around, bright eyes” – from his 1969 musical “The Dream Engine” written as a student at Massachusetts’ Amherst College. He told her the song was from a prospective musical version of “Nosferatu.”

“Jim liked to put down a basic rhythm track, do nine takes of the song, choose the best one and then put the kitchen sink on there, like Phil Spector used to,” Tyler told The Guardian in 2023. “He gave me a cassette to listen to in my hotel and we both preferred take two.”

Featuring E Street Band members Roy Bittan on piano and Max Weinberg on drums, “Total Eclipse” is a rumination on lost love: “Once upon a time there was light in my life/But now there’s only love in the dark,” she sings.

The video, a staple of early-days MTV, was shot in a frightening gothic former asylum in Surrey, where the guard dogs apparently wouldn’t set foot in the rooms downstairs where they used to give people electric shock treatment. The visuals included slow-motion tossed doves, candles, dancing ninjas, dancing greasers, Tyler in frighteningly big shoulder pads, fencers, gymnasts, wind machines and shirtless boys wearing swim goggles being doused with water.

“Faster Than the Speed of Night” earned a Grammy nomination for best rock vocal performance – losing to Pat Benatar’s “Love Is a Battlefield” – and Tyler got another nod for “Total Eclipse of the Heart” in the best pop vocal performance category, losing to Irene Cara’s “Flashdance – What a Feeling.”

Tyler never reached such dizzying heights again but stayed current with such movie soundtrack singles as “Holding Out For a Hero” – from 1984’s “Footloose” – and “Here She Comes” from “Metropolis” also in 1984.

Her 2019 disc “Between the Earth and the Stars” featured duets with Rod Stewart, Cliff Richard and Status Quo’s Francis Rossi, and she ended that year performing a Vatican Christmas concert before Pope Francis.

In 2013, she switched gears to make a country-flavored record in Nashville, “Rocks and Honey,” which included the Vince Gill duet “What You Need From Me” and a little ballad called “Believe in Me,” written by American songwriter Desmond Child and British songwriters Lauren Christy and Christopher Braide. “Believe in Me” was picked to represent the United Kingdom at that year’s Eurovision Song Contest in Sweden.

“It was an absolutely wonderful atmosphere there,” she told the San Francisco Examiner in 2023. “I was being interviewed every 15, 20 minutes, and when I walked out onstage behind the British flag, I thought the roof was going to come off! It was awesome, just awesome!”

In 2017, she joined Joe Jonas’ band DNCE for a performance on the cruise ship Oasis of the Seas as part of a “Total Eclipse Cruise.” When the moon passed in front of the sun, they played “Total Eclipse of the Heart.”

Government regulations are adding nearly $132,000 to the cost of newly built houses, according to a new report released as Americans struggle to become homeowners.

The findings show that more than one-quarter of the final prices of newly constructed homes come as housing affordability remains a top concern nationwide, with elevated mortgage rates and limited inventory putting homeownership out of reach for many families.

The issue is also expected to be a key focus heading into the 2026 midterm elections, as lawmakers face growing pressure to address high housing costs and the affordability crisis overall.

The National Association of Home Builders (NAHB), which commissioned the report, argues that regulations imposed by federal, state and local governments have become a major driver of the nation’s housing shortage and affordability challenges.

The study found regulations add an average of $131,734 to the cost of a newly built home, representing 26.4% of the final sale price. The estimate, based on the average new-home price of $499,500, marks the largest increase between consecutive NAHB surveys since the organization began tracking the data in 2011.

Regulatory costs have climbed a whopping 40% since 2021.

“We update our study every five years and this reinforces what we have been saying all along — that the cost to build a single-family home in this country continues to escalate and exacerbate the housing affordability crisis,” NAHB President and CEO Jim Tobin told Fox News Digital. “We’re up 40% over the last five years, and now regulatory burdens at every level of government are totaling more than $130,000 for the cost of a new home.”

NAHB estimates the U.S. faces a structural housing shortage of 1.2 million homes, arguing rising regulatory costs make it more difficult to increase supply.

Tobin said regulatory costs vary across the country, with states in the Southeast, including Texas, Florida and the Carolinas, generally maintaining a lower-cost regulatory environment than states such as California, New York, New Jersey and Illinois.

He also said he expects regulatory costs to continue rising, but believes policymakers can help slow the pace through reforms.

“Anything we can do to lower that cost, I think would be really important,” Tobin said.

He pointed to the bipartisan 21st Century ROAD to Housing Act, which would streamline permitting, reduce barriers to new construction and expand financing tools intended to increase the nation’s housing supply.

The White House and the Department of Housing and Urban Development did not immediately respond to Fox News Digital’s request for comment on the report’s findings.

NAHB said the study is not intended to argue that all regulations should be eliminated but to quantify their cumulative effect on housing affordability.

“While regulations are important, they can go too far,” Tobin told Fox News Digital. “We need to make sure health and safety are protected while getting rid of the more onerous and costly regulations that do nothing more than drive up costs and keep Americans out of homeownership.”

The analysis is based on surveys of 54 land developers and 337 single-family builders conducted in March 2026.
