Senate fails to extend FISA surveillance program as deadline nears, with 7 Republicans joining Democrats

    2026-06-05T12:55:57-0400 / CBS/AP

Washington — The Senate on Friday blocked an extension of a key warrantless surveillance program used by U.S. intelligence agencies, meaning Section 702 of the Foreign Intelligence Surveillance Act will expire on June 12 without further intervention.

Seven Republicans joined Democrats in the 47-52 vote against a procedural motion that would have set up a final vote on the extension next week. The vote comes amid concerns over President Trump’s controversial pick of federal housing finance regulator Bill Pulte to serve as acting director of national intelligence.

But a key objection from Republicans who blocked the reauthorization is that the law can be used to spy on Americans without a warrant. The seven Republicans who voted with Democrats were Sens. Josh Hawley of Missouri, Mike Lee of Utah, Rand Paul of Kentucky, Eric Schmitt of Missouri, Rick Scott of Florida, John Kennedy of Louisiana and Tommy Tuberville of Alabama. Democratic Sen. John Fetterman was the only Democrat who voted to move ahead with the reauthorization vote.

“No warrant to protect Americans? No FISA,” Lee posted on X.

Senate Majority Leader John Thune said following the vote that the Senate “will take another run at it” next week but that Democrats’ opposition is a “terribly irresponsible position,” even though some of the conservatives in his conference voted with Democrats.

“The naming of Pulte to that position, although the timing arguably wasn’t the best, I still don’t think it ought to derail something that’s this important,” Thune said.

Democratic Sen. Ron Wyden of Oregon, a longtime critic of the surveillance system, said the bipartisan vote was proof that “reform efforts transcend red and blue.”

“It’s a message that Americans aren’t going to stand for law-abiding people being spied on,” Wyden told The Associated Press.

The vote marked the latest setback for Mr. Trump and intelligence officials, who have spent months pushing to extend a key provision of FISA that allows agencies such as the CIA, National Security Agency and FBI to collect communications from foreign targets without a warrant.

Concerns that the program can incidentally sweep up Americans’ communications left Republican leaders only able to pass short-term extensions while negotiations continued. Critics wanted a warrant requirement when those communications are accessed.

Sen. Mark Warner, the top Democrat on the Senate Intelligence Committee who had worked to negotiate the bill, voted against it. He said earlier Thursday that he and committee Chair Sen. Tom Cotton had reached what he described as a “compromise” on a “strong bill,” but that the “complete irresponsibility of putting forward” Pulte had changed the equation.

Pulte has seen pushback to his appointment from both Democrats and Republicans for his lack of experience and past controversies. Thune said the position shouldn’t be “weaponized” and the office should be led by “professionals.”

“Does anybody think it makes good sense to give him the keys to the 18 intelligence agencies?” Warner said.

Mr. Trump on Thursday said Pulte would not be his “permanent” choice for the critical security post. But the president may not have helped his case for Pulte’s appointment when he said he may investigate “rigged elections.”Tulsi Gabbard, the outgoing director, raised eyebrows even among Republicans when she joined an FBI search of an election center in Fulton County, Georgia, earlier this year.

“It’s an acting position, it’s not permanent, he’s not going to be permanent because, you know, I don’t think he’d want to be permanent,” Mr. Trump said in the Oval Office. “But he’s a very smart guy and he may find out some things about the rigged elections, etc., etc. I think he’d like to do it. I’d like to — I think he wants to do it very much. Got a lot of energy. But he’ll be very good. Again, it’s not a permanent position. We’re looking at, we’re interviewing people right now. But it’s somebody just to take it over for a little while.”

The Senate is expected to revisit the legislation when lawmakers return next week.

Any agreement would still need to clear the chamber’s 60-vote threshold before heading to the House, where lawmakers have yet to resolve differences over a provision restricting a central bank digital currency that House Republican leaders added to secure support for the bill.

Takeaways from the appeals court hearing on the White House ballroom project

    2026-06-05T17:53:49.790Z / https://www.cnn.com/2026/06/05/politics/white-house-ballroom-appeals-court-hearing

    • A federal appeals court sharply questioned the Trump administration’s claim that no court could stop the White House ballroom project.
    • The Justice Department argued that even if construction is ruled unlawful, courts lack authority to order the ballroom torn down.
    • Two judges appeared skeptical of the administration’s legal justification for building without congressional approval as construction continues.

AI-generated summary was reviewed by a CNN editor.

President Donald Trump’s push to construct a massive ballroom at the White House without congressional approval was sharply questioned by a federal appeals court on Friday during a high-stakes hearing in a case testing the president’s power.

The two-hour-long hearing before a three-judge panel of the US DC Circuit Court of Appeals was the latest flashpoint in a protracted legal fight over the project. Work has continued on the nearly 90,000-square foot event space even as courts have looked skeptically at the legality of it.

The administration is asking the panel to indefinitely pause a lower-court ruling that said Trump could not continue with above-ground work on the ballroom until lawmakers explicitly bless the project.

That ruling, issued earlier this year by US District Judge Richard Leon, was frozen by the appeals court in April, permitting Trump to move ahead with construction for now. In recent weeks, above-ground parts of the new space have risen on the site of the former East Wing, which was fully demolished nearly two months before the nation’s top historic preservation group sued in December.

The case is one of nearly 10 brought in recent months by individuals and groups seeking to stop pet projects pursued by Trump in his second term. Other challenges question the lawfulness of the president’s desire to rename the Kennedy Center, erect an American version of Paris’ l’Arc de Triomphe and paint the Reflecting Pool “American Flag Blue.”

Here’s what to know from Friday’s hearing:

As a Justice Department attorney urged the appeals court to reverse Leon’s ruling and made clear that even if the administration loses during this round of wrangling and again before the Supreme Court, the DOJ attorney didn’t think any court would have the power to order Trump to tear down the ballroom.

“I’m asking you a straightforward question: That court, this court, the Supreme Court – no court could stop the building of this?” Judge Patricia Millett, an appointee of former President Barack Obama, asked DOJ lawyer Yaakov Roth, who quickly responded, “Yes.”

“When did it become a fait accompli? Was it when the destruction happened? Was it when you started doing the underground work?” the judge asked. “When did it become impossible for courts to stop this project?”

“I think it would have been improper to enjoin it even on day one,” Roth said, referring to the day the lawsuit by the National Trust for Historic Preservation was filed.

“If this were complete lawlessness by the government, it couldn’t be stopped?” Millett asked, to which Roth replied: “On these theories, I think that’s right.”

He went on to say that he thought construction could only be frustrated by an act of Congress and that courts had no independent role to play in disputes over the ballroom.

Tad Heuer, an attorney for the Trust, later seized on that argument and said it conflicted with a landmark 1803 Supreme Court case that established the power of judicial review.

“Under Marbury v. Madison, it is emphatically the province of the judicial department to say what the law is. And the government’s position, apparently, is that even a lawless action of this type could never be stopped by the court.”

“That is entirely wrong,” Heuer said. “That’s exactly the court’s job.”

    ‘Move fast and break things’

Millett, who was especially inquisitive during Friday’s hearing, at one point skewered Roth over his argument that the bar for being able to challenge a government action is much higher after it’s already occurred.

Much of Trump’s strategy in the dispute has been to question whether the National Trust has the legal right – known as “standing” – to bring its lawsuit. Among other things, the president has argued that the harm the group says it has suffered from the demolition of the East Wing and construction of the massive ballroom is not sufficient to give it standing, which would mean the case would fail on technical grounds.

Had the case been brought before the East Wing was demolished last fall, Roth argued, their claims would be much stronger than the ones that were raised nearly two months after that part of the White House was flattened.

The government’s position, Millett said, was “move fast and break things and then nobody has standing.”

She later raised a hypothetical in which Trump decided to quickly bulldoze the Statue of Liberty.

“The people whose ancestors – that was the first thing they saw coming to this country, but the government moved too fast – nothing can be done (by them to challenge it)?” the judge asked.

“I think that’s right, yes,” Roth said.

Pushing back on Millett’s “move fast and break things” assertion, Roth posited that Trump had previewed his plans for the ballroom many months before demolition got underway.

“They did not sue in August or September or October or November,” he said.

One panel member, Trump appointee Judge Neomi Rao, was sympathetic to the president’s arguments on this front. In an order this year during a different stage in the case, she said she believed the Trust lacked standing to bring the challenge, and she repeated that view on Friday.

Rao also brought up the non-ballroom purposes of the East Wing replacement project.

“The president has talked about the national security interests,” below the ballroom and in the structure itself, Rao said.

“On the other side, the Trust has some aesthetic concerns of someone who walks past once a month,” she said, referring to a member of the Trust’s board who has said the changes to the White House have caused an “aesthetic injury” to her.

At issue in the case is whether a series of federal statutes the government is leaning on as legal justification for the project actually give Trump the authority he claims to have.

Leon said they did not, and a majority of the panel on Friday appeared ready to agree with that view.

Judge Bradley Garcia, an appointee of former President Joe Biden, questioned Trump’s argument that a law permitting the National Park Service to “promote and regulate the use of the National Park System,” authorized the project.

“You have to agree it doesn’t give express authority to construct anything,” Garcia said at one point.

Garcia also seemed unpersuaded that another law the government has invoked, which gives Trump the power to undertake regular maintenance of the White House, gave him the legal right to pursue his ballroom project.

“He’s authorized to make $2.5 million of maintenance changes to the White House. This cannot be a source of authority for demolishing and replacing part of the construction,” he said.

The judge seemed especially interested in a separate law that says anything erected on federal land in Washington, DC, needed to be approved by lawmakers. He said if the court just looked at that law in isolation, “that’s the end of the case.”

Millett, too, poised sharp questions to Roth, saying at one point, “You need to have an authorization somewhere.”

For its part, the Trust urged the appeals court to keep Leon’s ruling intact and lift the temporary pause it placed on it while the legal wrangling plays out.

“Congress is right to be able to be involved and say here is exactly what you can do,” he told the court. “Congress can allow a ballroom to be built.”

This story has been updated with additional details from the hearing.

In a 135-page opinion, Chief Judge John McConnell of the U.S. District Court in Rhode Island found the sweeping limits on legal immigration benefits to be arbitrary and capricious, contrary to federal law.

One of the policies McConnell invalidated had halted all legal immigration applications filed by citizens of 39 countries listed on President Trump’s so-called “travel ban” list, which restricts travel from countries whose nationals the administration says are too difficult to properly screen.

The Trump administration adopted the measures late last year on national security grounds, following the shooting of two National Guard members in Washington, D.C. An Afghan man who was brought to the U.S. in 2021 and granted asylum in 2025 has been charged with the shooting.

For months, the pause has largely banned officials at U.S. Citizenship and Immigration Services from giving out green cards, work permits, American citizenship and other benefits to citizens of the affected countries, many of them in Africa and Asia.

Initially, the policies also included a complete pause on the hundreds of thousands of asylum cases overseen by USCIS, regardless of the applicant’s nationality. In March, USCIS partially lifted the asylum pause, resuming the processing of applications filed by most nationalities, except for citizens of the 39 nations on the “travel ban” list.

In his order, McConnell noted the immigrants affected by the policies he found unlawful “filed the appropriate paperwork, paid the required filing fees, submitted to the requested biometrics collections, and attended the necessary in person interviews.”

“In enacting its latest immigration policies, USCIS: claims statutory and regulatory authority that it does not possess; makes decisions without the reasoned explanations that it must provide; acts without regard for the reliance interests of applicants that it must consider; and justifies its actions with pretextual concerns of ‘national security’ that mask anti-immigrant sentiments that it is forbidden from letting influence its decision-making,” McConnell said.

James Percival, general counsel for the Department of Homeland Security, criticized the ruling in a statement to CBS News.

“The Left has been running the same gambit with so called ‘animus’ claims since 2017,” Percival said. “It is sabotage dressed in legal clothing. It goes like this: (1) the admin is racist, (2) therefore a policy I don’t like is motivated by race, (3) therefore it is invalid. They have used it on virtually every Trump era Department of Homeland Security policy.”

Ex-counterterrorism official Joe Kent endorses GOP Senate primary challenger as Trump backs Lindsey Graham

    June 5, 2026 2:08pm EDT / Fox News

Kent urged South Carolina voters to back Mark Lynch in Tuesday’s primary to stop ‘endless foreign wars’

    By Alex Nitzberg Fox News

NEW You can now listen to Fox News articles!

Former National Counterterrorism Center Director Joe Kent endorsed South Carolina Republican U.S. Senate primary candidate Mark Lynch, calling incumbent GOP Sen. Lindsey Graham a “war hawk, neocon.”

South Carolinians who would like to “stop sending billions of dollars overseas” and “stop us from getting entangled in endless foreign wars in the Middle East,” have the opportunity “to do all of us a great service and vote to get Lindsey Graham out of office this Tuesday, June 9th,” Kent declared in part of a video message posted to social media on Thursday.

“Vote for Mark Lynch,” Kent urged, calling Lynch “the America First candidate” and asserting that Lynch “is the best postured right now to get the war hawk, neocon, Lindsey Graham out of office.”

Graham campaign press secretary Abby Zilch said in a statement to Fox News Digital, “Mark Lynch is touting an endorsement from a man that President Trump called a ‘SLEAZEBAG,’ ‘LEAKER,’ and a ‘LOSER.’”

“This is to be expected since Lynch wants ‘more Massies’ in Congress,” Zilch wrote. “Senator Graham is proud to have the complete and total endorsements of President Trump, Governor McMaster, Senator Tim Scott, Congressman Russell Fry, Congressman Joe Wilson, Congressman William Timmons, National Right to Life, SC Citizens for Life, Tea Party Express, and Susan B. Anthony Pro-Life America.”

In a statement obtained by Fox News Digital, Lynch said, “Joe Kent is an honorable man who has dedicated his life to serving this country. He also lost his wife, Shannon Kent, the mother of his two young children. She was a Senior Chief Petty Officer in the U.S. Navy and was killed in Syria in a 2019 terrorist attack.

“Joe Kent is a patriot, and I am honored to have his endorsement, along with the support of many great American patriots, including Gregory Bovino, former Chief Patrol Agent of the U.S. Border Patrol’s El Centro Sector; Lt. Gen. Michael Flynn; the National Association for Gun Rights; Equal Protection South Carolina; Abby Johnson, former Planned Parenthood director and pro-life advocate; Republicans for National Renewal; South Carolina State Reps. Thomas Beach, Joe White, Jay Kilmartin, Mike Burns, & Ryan McCabe,” Lynch added.

Trump, who endorsed Graham for re-election last year, blasted Lynch in a Truth Social post earlier this year.

“Senator Lindsey Graham is doing a fantastic job. He is running against a LUNATIC named Mark Lynch, who supports perhaps the Worst Congressman in the History of our Country, Thomas Massie, of the Great Commonwealth of Kentucky. I don’t have to go into great detail, but needless to say, Mark Lynch would be a DISASTER for the Republican Party, and Lindsey Graham just, GETS THE JOB DONE. VOTE FOR LINDSEY ALL THE WAY. MAGA!” Trump declared in the April Truth Social post.

Lynch has previously expressed support for Rep. Thomas Massie, R-Ky., who lost his GOP primary in Kentucky last month.

“We need more MTGs and Gaetzes and Massies. Zero question about it,” Lynch wrote in a March post on X, referring to former Rep. Marjorie Taylor Greene, former Rep. Matt Gaetz and Massie.

Massie, who has served in the U.S. House of Representatives since late 2012, lost the Republican congressional primary in Kentucky’s 4th Congressional District last month to Trump-endorsed challenger Ed Gallrein, a former Navy SEAL.

In part of a Thursday Truth Social post, Trump declared, “This Tuesday, June 9th, all Republicans in South Carolina should vote for Lindsey Graham — HE HAS MY COMPLETE AND TOTAL ENDORSEMENT, AND WILL NOT LET YOU DOWN!”

Kent quit his government post back in March, citing his opposition to the Iran war.

“I cannot in good conscience support the ongoing war in Iran. Iran posed no imminent threat to our nation, and it is clear that we started this war due to pressure from Israel and its powerful American lobby,” Kent wrote in his resignation letter.

Trump said in part of an April Truth Social post that Kent “was really a SLEAZEBAG, and some would say, on top of it all, A LEAKER!” The president added he didn’t “know whether or not that was true” and called Kent “a LOSER.”

Congress didn’t kill Trump’s $1.8 billion ‘anti-weaponization’ fund. So where does it stand?

    2026-06-05 1:55 PM ET / CNN

    By Kaanita Iyer

Acting Attorney General Todd Blanche arrives for a closed-door meeting with Republican senators who are expected to abandon a proposal for $1 billion in security money for the White House complex and President Donald Trump’s ballroom after it has failed to win enough party support, at the Capitol in Washington, DC, on May 21.

    J. Scott Applewhite/AP

Senate Republicans rejected multiple attempts to kill President Donald Trump’s nearly $1.8 billion “anti-weaponization” fund amid bipartisan concerns and a temporary court ruling against it.

The Trump administration announced the creation of the $1.776 billion fund last month. The effort would allow the government to use taxpayer money to pay those who claim they were victims of political prosecutions by the Biden administration.

Critics of the fund have said it would serve as a slush fund for Trump’s allies. Some lawmakers, including key Republicans, raised concerns that the fund lacks guardrails. Lawmakers were particularly concerned that payouts would go to rioters, including those who assaulted police officers, at the January 6, 2021, attack on the US Capitol, which the Trump administration didn’t rule out.

Here’s where the status of the fund stands.

The fund has faced at least two legal challenges, including from a watchdog group and from police officers who defended the Capitol during the riot.

Last week, a federal judge in Virginia temporarily blocked the administration from taking steps to set up the fund and barred it from releasing any funds from it. But that ruling was highly technical: It didn’t address the legality of the program but was instead intended to get the court time to review a lawsuit seeking to kill the program in full.

The Trump administration is expected to file its response to the lawsuit in court on Friday.

In the meantime, the issue created a rift among Republicans in Congress with some stalling on considering an immigration funding bill until the White House committed to dropping the compensation fund.

In an attempt to convince Congress to vote for the immigration bill, Acting Attorney General Todd Blanche told House lawmakers on Tuesday that the Justice Department will not be “moving forward with the fund, period.”

Democratic Rep. Grace Meng then asked, “Not moving forward, ever?,” to which Blanche responded, “Correct.”

Ultimately, Republicans didn’t want to derail one of Trump’s key legislative priorities, and advanced the immigration bill without any language formally killing the fund early Friday after hours of talks between GOP leaders and Republican holdouts. One party member still defected.

Meanwhile, the president has not been so unequivocal, giving mixed signals about the future of the fund.

Trump, a day after Blanche’s vow to lawmakers, said that he doesn’t know if the fund is dead, which has led to confusion about its status.

“I’d have to ask the lawyers, I don’t know,” he said when asked whether the fund is fully dead or just on hold. “As far as I’m concerned, it was a beautiful thing.”

The fund is a result of a settlement between the Internal Revenue Service and Trump, two of his sons and the Trump Organization, after the president dropped his $10 billion lawsuit alleging that the IRS failed to protect them from an unauthorized leak of their tax returns.

Trump himself will not receive any payments, but will receive a formal apology, the Justice Department has said.

So far, the fund remains temporarily blocked by a court — but its future ultimately depends on who you ask.

Trump says he wants Bill Pulte to “start the process” of shrinking intelligence office

    June 5, 2026 / 2:45 PM EDT / CBS News

Washington — President Trump on Friday told the Wall Street Journal that he wants Bill Pulte, his controversial pick to run the Office of the Director of National Intelligence, to “start the process” of eliminating some workers and shrinking the office.

Mr. Trump told the Journal that the ODNI, which oversees the nation’s 18 intelligence agencies, is “unnecessary” or “too big,” and lamented holdovers from prior administrations. The president said the ODNI “should maybe even be terminated.”

“I’d like to see it smaller. I think there are a lot of people in there that shouldn’t be there,” the president said. Asked if he is calling on Pulte to fire ODNI workers, Mr. Trump said he wants Pulte to “start the process” that can be continued by a permanent director.

“We’ve made the Department of Education much smaller, and likewise, this should be much smaller,” the president told the paper. “And this should maybe even be terminated, and we’ll make that decision.”

Later on Air Force One Friday, the president didn’t outright confirm that Pulte will be making cuts at the agency but said, “I wouldn’t mind that,” and said the workforce at ODNI is “way too high.”

As an acting director, Pulte can serve for 210 days from when he starts the role. He’s also continuing to run the Federal Housing Finance Agency, which oversees Fannie Mae and Freddie Mac.

“You’re less shackled,” the president told the Journal, referring to Pulte operating in an acting role. “It sort of gives you more power, you know, for a somewhat limited period of time.”

“Frankly, it might be good for him to shake it up before people come,” Mr. Trump added.

An ODNI official said Gabbard already reduced agency staff by nearly 50% and saved taxpayers nearly $1 billion in a part of an effort dubbed “ODNI 2.0.” Gabbard, the official noted, has long said she was willing to be the last director of national intelligence if it was determined ODNI was unnecessary.

“We look forward to working with Mr. Pulte and President Trump on additional initiatives to advance savings and root out deep state bad actors,” the ODNI official said.

The president told reporters on Air Force One Friday that he’s interviewing five people for the permanent post at ODNI.

On Thursday, Mr. Trump told reporters in the Oval Office that Pulte may look into “rigged elections,” an apparent reference to the 2020 presidential election. As FHFA director, Pulte launched mortgage fraud investigations into Trump foes despite GOP concerns, demonstrating he doesn’t shy from political controversy.

“He’s a very smart guy and he may find out some things about the rigged elections, etc., etc.,” the president said. “I think he’d like to do it. I’d like to — I think he wants to do it very much. Got a lot of energy. But he’ll be very good.”

On Thursday, the president was asked if Pulte is qualified for the intelligence role, given that he has no known national security experience. Mr. Trump suggested Pulte is “smart” and will pick up on the job quickly.

“I think he does, actually, because he’s smart,” Mr. Trump responded. “Look, I wasn’t greatly experienced in national security and I think I’ve done a really great job with it, a lot of people would say that.”

The president’s selection of Pulte hasn’t gone over well on Capitol Hill, where senators on Friday failed to pass a reauthorization of a key surveillance program under the Foreign Intelligence Surveillance Act. Some lawmakers have said they won’t support the extension with Pulte overseeing the country’s intelligence agencies.

First on CNN: DOJ sends prosecutor to observe LA ballot counting amid Trump’s baseless ‘cheating’ claims

The Justice Department sent one of its attorneys to observe ballot processing in Los Angeles Friday morning, the county’s elections office told CNN, after President Donald Trump claimed earlier this week the US Attorney’s office there was investigating the vote counting.

A spokesperson for the county registrar-recorder said “our office was notified late yesterday that the U.S. Attorney’s Office would send an Assistant U.S. Attorney to the Ballot Processing Center to observe ballot processing activities.”

“The individual arrived this morning, was provided an overview of the public observation program, and participated in a walkthrough of the ballot processing operations,” the spokesperson, Mike Sanchez said in an email, noting that ballot processing in the county is open to public observation.

Trump has claimed repeatedly, without evidence, that the slow pace of the count from Tuesday’s primary was a sign of Democratic “cheating.” Several key races in the state have not been called, and California has long had a reputation for being slow to report the results. This is, in part, because a significant number of the total votes come in as mail ballots that are dropped off Election Day, according to the California Voter Foundation, a nonprofit organization that seeks to improve the election process.

The Justice Department did not immediately respond to CNN’s request for comment.

Earlier Friday, First Assistant US Attorney Bill Essayli — a Trump appointee who leads the Los Angeles-based US Attorney’s office — said his office had “multiple election fraud investigations underway” in a social media post that bashed California’s election system.

The US attorneys office in LA confirmed that one of its lawyers was sent to observe the ballot counting, but did not respond to CNN’s inquiry about whether that move was connected to the fraud investigations Essayli touted on social media.

The county registrar-recorder’s office has defended its processes, writing on social media Thursday that its “dedicated staff is working hard to ensure that every vote is accurately processed and verified for counting.”

The Los Angeles County District Attorney’s Office told CNN in a statement that it had “not received any complaints from the federal government regarding criminal misconduct related to vote-counting or fraud in the Los Angeles County primary election.”

    Closely watched races

California this year has two marquee races — the governor’s race and the contest for Los Angeles mayor — that feature prominent Republicans. The top two finishers in each race will advance to the November general election.

Typically, as more votes are counted, Democratic candidates improve their standing compared to Republicans, and that pattern has been borne out this year. This happens because votes cast in person on Election Day are almost entirely reported on election night, while the votes counted later are predominately mail ballots. In recent years, Democrats have been much more likely to vote by mail while Republicans have preferred to vote in person on Election Day.

California Secretary of State Shirley Weber noted in a statement Thursday that state law gives election officials 30 days to complete the counting and certification process.

“(O)ur commitment is immediate: in California, every ballot is counted properly and every ballot is accounted for,” the statement said.

Judge orders detention of ex-CIA official found with $40 million in gold bars

    June 5, 2026 2:15 PM EDT / CBS News

    By Callie Teitelbaum, Kelly Jones

A judge ordered the detention of an ex-CIA official found with gold bars worth about $40 million in his home last month.

U.S. Magistrate Judge William Fitzpatrick said in a detention hearing Friday that David Rush must remain in custody pending trial, determining that he poses a severe flight risk. Fitzpatrick said Rush has the means and motive to flee law enforcement and evade detection.

David Rush was charged with one count of stealing public money. Alexandria Sheriff’s Office

In May, as FBI investigators were looking into whether Rush had lied about his educational and military background, they searched his home and discovered 303 gold bars, $2 million in cash and more than 30 luxury watches. The government’s lawyers alleged he was diversifying funds into commodities that could be traded. They claimed there is “strong evidence” Rush was trying to hide the funds.

During the open part of the hearing, which followed an hourlong sealed hearing, government lawyers called Rush a “master manipulator” who lied to his neighbors about being a pilot, lied to his co-workers and leveraged his “access to seniority.” A Justice Department lawyer said Rush “cannot be trusted” and is “fully willing and able to skirt the rules.”

Rush is currently being held in solitary confinement.

So far, Rush, who attended the Alexandria, Virginia, hearing Friday, only faces one charge alleging about $70,000 in fraudulent timesheets.

Prosecutors said large sums of funds remain unaccounted for, but Rush’s defense attorney, Jessica Carmichael, said all the gold bars have been recovered and are a “non-issue.” She said that when the FBI searched his home, Rush told the FBI about the gold bars and gave them the codes to access them in his basement.

The government contended Rush should not have had the gold bars in his home. The funds that are not yet accounted for may have been a reference to foreign currency, but Rush’s lawyer said the government has not provided any information about how the foreign currency was intended to be used or what steps it has taken to find it. An FBI affidavit alleges that around November 2025 to March 2026, Rush made several requests to obtain a significant amount of foreign currency.

Carmichael said it’s “not the defense’s burden to find foreign currency that’s unaccounted for.” She argued that the government is bringing “sensational” allegations.

“Mr. Rush never claimed the gold bars to be his,” she said in court.

Carmichael said that while some of Rush’s defense claims may “sound bizarre and secretive,” the nature of his job “can be bizarre and secretive.” She contended that Rush could have been held at home with an ankle monitor, rather than remaining in custody.

Rush’s attorney characterized the Justice Department’s allegations as being “like Whack-a-Mole” but said she’s playing with “a blindfold on.” Carmichael also said that during the sealed portion of the hearing, she learned about new evidence. She told the court she had asked prosecutors about discovery and did not receive a response.

FBI Director Kash Patel, CIA Director John Ratcliffe and Acting Attorney General Todd Blanche briefed Gang of 8 lawmakers on the case earlier this week, sources said.
