    Washington— Some White House officials hope embattled GOP Rep. Max Miller exits the congressional race in Ohio immediately, and President Trump has expressed a similar sentiment behind closed doors, multiple U.S. officials familiar with the matter tell CBS News.

    Mr. Trump called Miller on Monday and raised concerns about his reelection bid following allegations that Miller assaulted his ex-wife, Emily Moreno, and their 2-year-old daughter, two sources directly familiar with the call confirmed to CBS News. But Miller, who has adamantly denied the allegations, told the president he has no plans to leave the race, according to one of the sources.

    Miller, the GOP nominee, has until 4 p.m. Wednesday to withdraw his candidacy and give Republicans a chance to replace him on the ballot in November. Semafor first reported that the president and some White House aides said privately that they wanted Miller out of the race.

    On Tuesday morning, Miller said he would file the paperwork to launch a congressional ethics investigation into himself in an effort to clear his name.

    “In light of all the renewed interest in my family affairs I am going to file my own paperwork for an ethics investigation into myself to clear my name from these horrific attacks on myself and family,” Miller wrote on X. “I have absolutely nothing to hide. We will be providing the committee all necessary documents needed for a detail[ed] examination. The accusations continue to change, but my facts stay the same. I am looking forward to my colleagues reading everything for themselves.”

    On Monday, the president said he thought Miller was a “very good person” and said he would let the families involved resolve the situation.

    “Well, it’s a very sad thing,” the president told reporters in the Oval Office Monday. “I know Max, he’s a good person, I mean, I always thought he was a very good person. And I’m going to let the families figure that out. Those families, I know they’re working on it. It’s a very sad thing. Especially when you know somebody so well to be going through that. But it’s accusations. And I’m going to let them figure that out.”

    In an earlier statement to CBS News on Monday, Miller said: “If I dropped out of this race, it would mean we as a nation have fallen so far from our American values. I will not validate false claims by removing myself just to please the court of public opinion. I am innocent of all of the allegations that have been attributed to me. I have done well representing my constituents’ interests. Why would I drop out?”

    Emily Moreno, Miller’s ex-wife, is the daughter of Ohio GOP Sen. Bernie Moreno. The senator said in a statement on Sunday that Miller “should not serve in the House of Representatives” and “needs serious psychological help.”

    The US military has exhausted nearly 80% of its interceptors for a key missile defense system as senior US military commanders are warning that the Pentagon’s munitions stockpile is “dangerously low,” according to multiple sources familiar with the matter.

    Stockpiles of key air defense systems have been particularly depleted during the war with Iran. The US military has burned through nearly four-fifths of its THAAD missile inventory compared to pre-war numbers and roughly half of its Patriot interceptors since the start of the war, according to two sources familiar with the latest inventory report. The disclosure of the low THAAD inventory has not been previously reported.

    The Center for Strategic and International Studies estimates the United States had around 2,200 Patriots (of the platform’s two most-modernized variants) and 452 THAAD missiles in its stockpile before the Iran war started.

    Gulf countries have also raised fresh concerns about how a shortage of air defense systems could impact their ability to ward off potential Iranian retaliation if President Donald Trump decides to escalate the ongoing conflict.

    Several of those countries rely on US air defense systems and have acknowledged the stockpile shortage could hinder their own ability to intercept incoming Iranian missile and drone attacks – particularly if they are targeted in response to any American escalation, multiple officials said.

    The stockpile issue was raised again prior to the president’s decision last weekend to cancel new strikes on Iran, marking at least the second time in recent weeks that Trump’s senior military advisers have specifically voiced concerns about the dwindling number of key US munitions during discussions about potentially escalating the conflict with Iran.

    The US Army has also used “virtually all” of its highly accurate long-range, surface-to-air weapons during the conflict, according to the source familiar with recent internal Pentagon reports. Reuters first reported the specific concerns about US stockpiles of long-range strategic missiles.

    The recent warnings about munitions shortages — coupled with other intelligence presented to Trump about the potential negative effects of striking Iran’s critical infrastructure, including energy-related targets, and concerns voiced by Gulf countries — have been compelling enough to convince some of Trump’s most hawkish advisers there were was reason to call off planned operations over the weekend, the sources said.

    Trump on Friday was planning to move forward with massive strikes, and Defense Secretary Pete Hegseth received the final “go ahead” order on Friday, according to a senior Trump official.

    But Trump decided to back off after talking with Middle East allies on Saturday, who told him they were afraid of Iranian retaliation, specifically retaliatory attacks on their energy infrastructure, according to the official. Trump agreed to hear them, and Iran, out. He subsequently told Hegseth to stand down, for now, but is not taking the planned strikes off the table for a future date.

    “America’s military is the most powerful in the world and has everything it needs to execute at the time and place of the President’s choosing,” Chief Pentagon spokesman Sean Parnell said in a statement to CNN.

    “We have executed multiple successful operations across combatant commands while ensuring the U.S. military possesses a deep arsenal of capabilities to protect our people and our interests,” he added.

    White House spokesperson Anna Kelly told CNN that the US military “has more than enough munitions, ammo, and stockpiles to serve all of President Trump’s strategic goals and beyond.”

    “Operation Epic Fury has exposed what happens when you mess with the United States. Even still, the President has urged our defense contractors to constantly produce more made-in-America weapons, which are the best in the world,” Kelly added.

    Chairman of the Joint Chiefs Gen. Dan Caine similarly raised the stockpile issue during another White House meeting late last month where military options for escalating the conflict were discussed, CNN previously reported. The potential for massive civilian casualties inside Iran if the US resumed major combat operations was also raised, another person familiar with the matter said.

    But the persistent concerns about stockpile estimates provided to CNN underline the seriousness of the shortages and call into question the US’ ability to carry out strikes against Iran for an extended period.

    The stockpile shortage could also impact the American military’s ability to fight a potential future war with China, Russia or even North Korea, experts have told CNN.

    “The lack of interceptors means that conventional attacks can backfire if the suicide drones start making it through in-masse,” one of the sources familiar with the stockpile concerns said. “Tit-for-tat will never end this.”

    The long-range missiles that have been primarily used up during the war with Iran are known as Army Tactical Missile Systems (ATACMS) and Precision Strike Missiles (PrSM), the sources noted.

    The US’ stockpile of Tomahawk missiles also remains significantly depleted, as close to half of those weapons have been used during the war, one of the sources said.

    CNN reported in April that the US military had used nearly 30% of its Tomahawks during the early stages of the war.

    On Monday, Trump called Iranian leadership “unbelievably duplicitous” on social media after Tehran contradicted his claim that negotiations would resume.

    He later insisted that this is Iran’s “last chance”to sign a deal, but he also said he has no time constraintson negotiations because he’s not seeking reelection.

    The early phase of the Iran conflict, dubbed Operation Epic Fury, saw the US military expend thousands of key missiles used for long-range precision strikes and to defend against enemy air and missile attacks, according to analysts and previous CNN reporting.

    Replenishment rates are low for key missiles, analysts tell CNN — according to current fiscal year delivery schedules, the Pentagon is receiving roughly 15 new Tomahawks and 20 new Patriot missiles per month. The Center for Strategic and International Studies estimated it would take three or more years to rebuild THAAD inventories to pre-Iran war levels.

    The Defense Department has accelerated its efforts to expand interceptor missile production in recent months, including two deals inked this week to boost Patriot and THAAD rocket motor manufacturing, but a spokesperson declined to answer questions about when the expansion will lead to results.

    Analysts say it could take years to fully replenish the US stockpile of high-end munitions, like Patriot missiles, due to the lead time for producing those weapons.

    Other missile inventories, such as those for the Precision Strike Missile and the Joint Air-to-Surface Standoff Missile, will be quicker to rebound and should reach their pre-war level by mid-to-late 2027, according to analysis from the Center for Strategic and International Studies.

    Aug 4 (Reuters) – A federal appeals court said the U.S. Environmental Protection Agency cannot freeze about $20 billion of clean energy grants awarded to several nonprofit groups, handing a defeat to the Trump administration.

    Tuesday’s decision by a divided U.S. Court of Appeals in Washington, D.C. restored an April 2025 injunction against EPA Administrator Lee Zeldin’s decision to terminate the grants, which had been awarded during the Biden administration with a goal of reducing greenhouse gas emissions.

    The money for so-called National Clean Investment Fund and Clean Communities Investment Accelerator entities was expected to help fund renewable energy products, including in communities that have lacked access to green financing.

    Funds came from the Greenhouse Gas Reduction Fund, a $27 billion program established in 2022 by Congress in former Democratic President Joe Biden’s Inflation Reduction Act. No Republicans voted for that law.

    The EPA said it is reviewing the decision. Its next steps could include an appeal to the U.S. Supreme Court. Lawyers for the nonprofits did not immediately respond to requests for comment.

    Zeldin sought to freeze the grants in March 2025, saying they did not align with his agency’s priorities and might be tainted by fraud, waste and abuse.

    The injunction required the disbursement of the disputed funds, but was put on hold while the EPA appealed.

    NO CLAWBACK BASED ON POLICY DISAGREEMENT

    Last September, the appeals court sided with the agency, voting 2-1 that the nonprofits should have sued in the Court of Federal Claims, which hears monetary claims against the government.

    In Tuesday’s decision, an equally divided 10-judge panel of the court upheld the entire injunction, while six judges upheld the specific provision governing the grants.

    The majority said the EPA’s attempt to terminate the grants and claw back funds “based solely on a policy disagreement” likely violated the Inflation Reduction Act, and the EPA provided no assurance it would leave the funds alone if the injunction were lifted.

    Four judges would have vacated the provision governing the grants. They cited Congress’ passage last year of Republican President Donald Trump’s One Big Beautiful Bill Act, which repealed the section of the 2022 law creating the grant program.

    The disputed funds were being held by Citibank, and awarded to several entities such as the Climate United Fund, Coalition for Green Capital and various U.S. state-sponsored entities.

    Allegations that Miller abused his ex-wife and their young child have emerged in recent legal filings, which gained widespread attention after Sen.     FIRST ON FOX:Vice President JD Vance will host members of Congress at the White House on Wednesday morning for a fraud task force meeting where members will discuss potential legislative action to address the administration’s crackdown on fraud.

    A source familiar with the meeting told Fox News Digital that roughly 20 members from both the House and Senate are expected at the meeting. Vance will also detail how members can target fraud in the various states and districts they represent.

    Vance has previously hosted meetings at the White House to address fraud with a number of attorneys general alongside other members from the administration involved in the task force led by Vance.

    “Our task force is using every tool at its disposal to end fraud once and for all. Congress has an important role to play in cracking down on fraudsters and protecting federal programs from abuse,” a White House official told Fox News Digital. “President Trump, Vice President Vance, and all of the task force’s interagency partners will not relent until every fraudster is brought to justice.”

    On Tuesday, the Justice Department announced that it is expanding its Northeast Health Care Fraud Strike Force to Philadelphia as federal and state authorities target alleged Medicare and Medicaid fraud involving home healthcare services, adding Pennsylvania to a number of states across the country where the administration is honed in on fraud.

    Federal and state law enforcement charged 19 defendants accused of participating in schemes involving more than $4 million in claims submitted to Medicare and Medicaid, according to a DOJ release obtained by Fox News.

    On Sunday, Pennsylvania Attorney General Dave Sunday also announced a plea agreement involving the final defendant in a previously charged 21-defendant case tied to more than $1.7 million in claims.

    “The vice president’s task force continues to stop the flow of taxpayer funds before they fall into the hands of fraudsters and deliver savings to the American people,” a spokesperson for Vice President JD Vance told Fox News Digital. “This is great momentum in the fight for the President’s War on Fraud.”

    The task force has suspended payments to a number of healthcare providers who have been suspected of fraud across the country. As of May, Vance and Centers for Medicare & Medicaid Services (CMS) Administrator Dr. Mehmet Oz withheld more than $1.4 billion in federal funding for home health and hospice providers nationwide.

    In June, the Trump administration revealed new figures that show a drastic 7,100% spike in Medicare claims for skin substitutes in just six years, surging from $200 million to $14.4 billion from 2019 to 2025.

    CMS identified 4,200 suspicious claims for skin substitutes, known as allografts, totaling $224 million in charges through May of this year.

    “That’s a lot of money,” Oz said during a news conference in Milwaukee, Wisconsin, on Wednesday. “And that bankrupts not just hospital systems and physician groups, but it causes major problems across the entire landscape.”

    WASHINGTON/HOUSTON, Aug 4 (Reuters) – The White House ​is expected to extend a waiver of the century-old Jones Act in the coming days, sources say, reaching for one of the ‌few tools it has to try and hold down gasoline prices as President Donald Trump escalates his attacks on Exxon Mobil (XOM.N), opens new tab and Chevron (CVX.N), opens new tab for making “too much money.”

    The Jones Act requires cargo moving between U.S. ports to be carried on ships built in the U.S., owned by U.S. companies and crewed by American workers, and the waiver aims to lower gas prices ​by increasing shipping flexibility and reducing transport bottlenecks.

    The oil industry had expected an extension by the end of July. But administration officials have continued ​meeting with maritime industry representatives and lawmakers over potential changes to narrow the scope of the waiver while preserving flexibility to move ⁠critical fuel supplies, according to three people familiar with the discussions who requested anonymity because they are not authorized to speak publicly.

    The current waiver is set ​to expire on August 16 and has already become the longest suspension of the Jones Act rules in the program’s history. The exemption has been used nearly 200 ​times over four and a half months through the end of July, according to U.S. government data.

    Trump is running out of easy options to lower gasoline prices — currently averaging over $4 a gallon in the U.S. — ahead of the midterm elections in November. The administration has already leaned on measures including increased oil supply efforts and regulatory flexibility, while Trump on Monday escalated rhetorical pressure ​on Exxon and Chevron by saying they should return money to consumers at the pump.

    Bob McNally, president of Rapidan Energy Group, said the most effective option ​for any U.S. president would be to press Saudi Arabia to increase oil production – an option not feasible because exports remain constrained by disruptions around the Strait of Hormuz amid ‌the Iran ⁠conflict.

    Other potential measures, including a windfall profits tax, gasoline price controls or legal action against oil companies, are either politically unrealistic, economically risky or unlikely to meaningfully reduce prices, McNally said.

    McNally said the Jones Act waiver increases the availability of tankers to move fuel but would probably reduce gasoline prices by only pennies per gallon.

    WAIVER CRITICS PUSH FOR LIMITS

    Critics of the extension are pushing for geographic limits and tighter scrutiny on each shipment.

    White House trade adviser Peter Navarro, Office of Management ​and Budget Director Russell Vought and ​the White House Energy Dominance Council, ⁠among others, have been involved in discussions over the waiver extension, the people said.

    No final decision has been made and details are subject to change, the sources said.

    Key Republican lawmakers, including House Speaker Mike Johnson and House Majority Leader Steve ​Scalise, have pressed the administration to limit the exemption, warning that broad use of waivers could weaken the domestic ​fleet and undermine the ⁠Jones Act’s national security goals.

    A White House official said the administration was continuing to monitor how the waiver was being used and that discussions were ongoing. Any further announcements would come directly from the president or the administration, the official said.

    Maritime groups have been escalating their campaign against extending the Jones Act waiver, with the American ⁠Maritime Partnership ​restarting advertising on CNBC and Fox News and AMP and the American Waterways Operators running digital ​ads.

    AMP President Jennifer Carpenter argued the waiver has benefited foreign operators and energy companies more than consumers.

    “The waiver has shifted routine domestic commerce to foreign operators, including entities linked to China and Russia, ​while undermining the U.S. maritime industrial base,” Carpenter said.

    Allegations against several GOP congressmen highlight the party’s quandary

    Pressure is growing on Rep. Max Miller to end his reelection campaign amid an ugly series of allegations from the Ohio congressman’s ex-wife.

    But new developments concerning another GOP congressman underscore how dicey the political situation is becoming for Republicans clinging to a narrow House majority — and how fine a line they might need to walk in the weeks to come.

    Miller, North Carolina Rep. Chuck Edwards and Florida Rep. Cory Mills are all facing concerning accusations (they all deny wrongdoing). All three represent districts President Donald Trump won by around 10 points in 2024 — in other words, districts they could lose, especially if it’s a bad year for Republicans nationally.

    But while the GOP might want these lawmakers to end their campaigns, they would probably prefer they don’t resign, given how tight the party’s 218-212 majority is in the House.

    Still, the nature of the allegations — and the growing set of them — could make the pressure to resign tough to avoid, particularly if the accusations risk feeding an unhelpful narrative for the GOP heading into the fall.

    In addition to the growing Miller fallout, the big news Monday was that the House Ethics Committee released a report about Edwards, in which it recommended the House censure him — the first time since 2010 the panel recommended that for one of its members.

    The bipartisan committee found “substantial evidence” that Edwards had made unwanted advances toward two young female staffers, including by showering them with gifts and unwanted attention.

    Mills also faces a lingering ethics investigation related, in part, to allegations of assaulting a woman and threatening to disseminate sexually explicit videos and images of another woman. While the story has faded from national headlines, it may get more attention thanks to the Miller and Edwards situations.

    All three lawmakers are so far standing their ground, with Miller — who says he won’t drop his reelection bid — even saying Tuesday he’s taking the unusual step of asking the House Ethics Committee to investigate him in an effort to clear his name. The Ohio congressman says his ex-wife (who is the daughter of Ohio GOP Sen. Bernie Moreno, who recently said Miller “should not serve” in Congress) made up the abuse claims that he denies.

    GOP leaders have been split on how to handle the allegations with Miller, with some calling for him to end his campaign but others steering clear of the situation. Trump declined to pass judgment Monday and even praised Miller as a person, but appears to be privately hinting that Miller might need to drop out.

    Edwards, meanwhile, emphasized that Monday’s ethics report did not find he engaged in sexual activity with or directly propositioned the aides. And Mills has claimed the allegations against him are politically motivated.

    But as Republicans confront what looks to be a pretty tough midterm election, there is increasing worry that the allegations against these lawmakers will jeopardize their seats.

    “(The districts) wouldn’t be vulnerable for Republicans in a normal year,” David Wasserman of the Cook Political Report said Monday on CNN’s “Erin Burnett OutFront.” “But these are not normal circumstances, and this is not a normal year. President Trump’s approval rating in all three seats is underwater.”

    History backs up the notion that these seats could be in play.

    Two GOP congressmen, then-Reps. Chris Collins of New York and Duncan Hunter of California, were indicted in August 2018.

    Both won that November, but Collins won by less than 1 point in a district Trump had carried by 25 points in 2016. And Hunter won by just 4 points in a district Trump had carried by 15 points.

    In 2006, Pennsylvania GOP then-Rep. Don Sherwood ran for reelection after reaching a settlement with a former mistress who accused him of assault. He wound up losing by 6 points, despite running in a district George W. Bush had carried by 20 points in 2004.

    All of those results suggest districts like Miller’s, Edwards’ and Mills’ could be vulnerable under certain circumstances.

    The problem for Republicans is that while it might be preferable for these lawmakers to bow out of their reelection campaigns, the fact that there are three of them means the party might not want them to resign right now. Resigning, after all, could shrink a majority that’s already so small it’s caused frequent headaches for leadership trying to enact Trump’s agenda.

    Some in the party resisted calling for the expulsion of Rep. George Santos of New York in 2023 and the resignation of Rep. Tony Gonzales of Texas earlier this year for precisely that reason.

    Gonzales, who had an affair with a staffer who later died by suicide, eventually resigned in April in the face of his own expulsion threat. But Republicans only seemed to embrace expulsion after Democratic Rep. Eric Swalwell’s resignation for alleged sexual assault meant both parties were losing a seat. Perhaps further illustrating Republicans’ hesitance over their dwindling numbers, Mills avoided the same type of removal pressure at the time, despite the public accusations against him.

    Given the Gonzales and Swalwell precedents, it would seem difficult for Republicans to tell these lawmakers to drop their campaigns but not exit Congress. Why would the allegations against Miller, for example, be bad enough to end his campaign but still allow him to keep serving?

    And if the party decides Miller needs to be pushed out, it would likely face questions about what’s different about Mills and Edwards. GOP leaders already walked this tightrope once on Mills, but no party trying to defend its majority wants to be spending time answering questions about the differences between the allegations and why one situation rises to that level, but another doesn’t.

    Republicans also have to contend with the things they said very recently when Swalwell and Democratic Maine Senate candidate Graham Platner were accused of sexual assault. (Both men have repeatedly denied the accusations.)

    In the case of Platner, Republicans pilloried Democrats for failing to call for Platner’s exit amid a series of personal accusations before the allegation of sexual assault. (Democrats quickly pushed out Platner after the rape allegation that he denies.)

    And when Swalwell and Gonzales resigned, Republican House Speaker Mike Johnson said both had made the right decision.

    “My views have been made known about the terrible allegations that were made and obviously the facts that they both admitted to and I believe it was the appropriate thing,” Johnson told CNN.

    Indeed, allegations of a sexual misconduct or abuse have often been treated more seriously and urgently in these circumstances.

    And now Republicans need to figure out how to treat them in a hurry.

    FBI not conducting civil rights investigation into ICE shooting in Maine despite questions about use of force, sources say

    The FBI is not conducting a civil rights investigation into the shooting death of a Colombian man in Maine who was killed by a federal immigration officer in July, several sources told CBS News, though the shooting took place under circumstances that have raised questions about the use of force.

    The deadly encounter between an ICE officer and Johan Sebastián Durán Guerrero on July 13 in Biddeford, Maine, is the latest in a growing string of clashes between civilians and ICE agents as they carry out immigration enforcement surges across the country.

    Other shootings involving federal immigration officers that have garnered national attention include the killings of Renee Good and Alex Pretti in Minneapolis, and the shooting death of Lorenzo Salgado Araujo in Houston.

    In the Maine incident, the Department of Homeland Security has said that the agent discharged his weapon because he feared for “public safety” after Guerrero allegedly tried to flee in his vehicle from the officers.

    The shooting was captured on surveillance videos in the Biddeford neighborhood, and a witness told CBS News he heard Guerrero say “I tried to stop” as he was pulled from the car.

    Border czar Tom Homan has also since publicly acknowledged the agent may not have been properly vetted, after the Associated Press revealed his identity and reported he has a history of abusive and violent behavior.

    Given the high-profile nature of the shooting, which was widely covered by news outlets, and the questions surrounding the officer’s decision to open fire multiple times, civil rights legal experts say the FBI and the Civil Rights Division would usually take the lead on conducting a criminal civil rights investigation in a case like this one.

    “I would expect that if things were operating as they traditionally have, that this would be a case where the FBI would be investigating,” said Sam Trepel, a former federal civil rights prosecutor who is now the Rule of Law Program Director at States United Democracy Center.

    “The FBI is the federal agency that has the most experience and the most expertise in investigating potential civil rights violations, which would include deadly shootings by federal agents.”

    A spokesperson for the FBI Boston field office, which has jurisdiction over criminal investigations in Maine, referred all questions to the DHS inspector general’s office and the Maine attorney general’s office.

    When the shooting occurred, the FBI initially responded to the scene to investigate it as a possible assault on a federal officer case. Lawmakers at the time, including Senators Susan Collins and Angus King of Maine, issued statements saying they understood the FBI was investigating and urged the bureau to cooperate with state and local authorities.

    But in a statement to CBS News, a Justice Department official clarified that since then, the DHS Office of the Inspector General and the Maine attorney general’s office are leading the investigation.

    “Per any officer-involved-shooting, DHS IG took the lead, and FBI would offer assistance,” the official said.

    “Should evidence present itself during the course of an investigation, DOJ will evaluate and act accordingly. The U.S. takes seriously any referral of a civil rights violation, and we will work with law enforcement and OIGs to properly and fully review credible allegations of violations of civil rights law,” the official added.

    A spokesperson for the Maine attorney general’s office declined to comment, saying the office had no information about investigations by other agencies.

    The Maine state attorney general’s office, which is also investigating the shooting, interviewed Guerrero’s partner and the mother of their young daughter, Karolina Rojas Alvarez, about a week after the July 13 incident, according to her attorney Ben Gideon.

    He added that no one from the FBI, DHS or any other federal government agency has contacted him or his client to date. “I’m not aware of the FBI or any federal agency having boots on the ground in Maine to conduct any investigation into this matter whatsoever,” he added.

    According to DHS, Guerrero was not the intended target of the operation, though his vehicle had four visible bullet holes in the driver’s side of the windshield.

    Law enforcement sources confirmed to CBS News that ICE officers were not wearing body cameras at the time of his death, and subsequently, ICE required at least one activated body camera during vehicle stops. DHS’ public explanation does not specify exactly whom the officer believed Guerrero was endangering or how.

    A DHS OIG spokesperson declined to confirm the existence of an investigation, but said investigating DHS officer-involved shootings is part of its normal practice.

    “DHS OIG routinely reviews allegations involving DHS employees or contractors who, while acting under color of their official authority, are alleged to have deprived an individual of any Constitutional right or liberty,” a spokesperson said.

    A spokesperson for DHS referred all questions about the investigation to the FBI.

    It is customary for the DHS inspector general’s office to review use of force cases involving agency personnel. It has the authority to conduct both criminal and administrative investigations and it can make referrals to U.S. attorney offices.

    Recently, it helped investigate a criminal case in the Western District of Texas against a Customs and Border Protection agent indicted in July for allegedly using unreasonable force when he put someone into a choke hold during an August 2021 incident.

    But that case was also investigated by the FBI, in addition to the inspector general’s office and the CBP Office of Professional Responsibility.

    This is not the first time the FBI has been absent from investigating a high-profile ICE related shooting that has raised questions about whether the victims’ civil rights were violated.

    After Renee Good was shot and killed by ICE officer Jonathan Ross in January, the Civil Rights Division was ordered to stand down from assigning prosecutors to help investigate.

    The FBI, meanwhile, was ordered to treat the investigation as an assault on a federal officer case, rather than a civil rights case, prompting local prosecutors and an FBI official to resign in protest.

    That same month, two CBP officers shot and killed Alex Pretti. Initially, DHS took the lead in investigating the case, as then-DHS Secretary Kristi Noem publicly accused Pretti of “domestic terrorism.”

    After a public outcry, Acting Attorney General Todd Blanche agreed to open a criminal civil rights inquiry into Pretti’s death. That investigation remains ongoing.

    The FBI doesn’t investigate every officer-involved shooting, but has historically become involved in cases where the shooting results in death and the incident receives national attention.

    Under the Justice Department manual, the ICE shooting case in Maine would likely be deemed to be a matter in the national public interest because it involves allegations of a color-of-law violation — one that involves a government official acting in an official capacity — that resulted in death.

    Such a designation typically leads the Civil Rights Division’s criminal section to take a more direct role in managing the case and coordinating with the local U.S. attorney’s office. In such cases, the FBI typically conducts the investigation, and the bureau has squads that are specialized to handle civil rights criminal cases.

    Although such investigations often do not necessarily lead to criminal charges, the threshold for opening a case is relatively low.

    “In any universe that I ever operated in before now, something that is this high of a profile where there is a clear public concern around what happened, the Civil Rights Division and the FBI would be the lead of it,” said Kristy Parker, a former deputy chief in the Civil Rights criminal section who is now counsel at Protect Democracy, a nonprofit anti-authoritarian group.

    The Civil Rights Division’s criminal section has handled some of the nation’s most high-profile color-of-law cases involving excessive force by police.

    Those include the killing of George Floyd by Minneapolis Police officers and the prosecution of the Louisville Police officers involved in Breonna Taylor’s shooting death.

    Trepel said the FBI’s absence from the investigation in Maine is “detrimental to public trust” and “very concerning because it says that maybe this review will not be as comprehensive or independent as it has been in the past, and that federal officers won’t be held accountable for their actions.”

    随着亚细安成员国外长上个月与缅甸外长举行五年来首次面对面会晤,以及缅甸总统敏昂莱将于星期四(8月6日)访问泰国,缅甸军政府与亚细安的关系,正进入一个新的试探阶段。但受访分析员认为,双方重新接触并不等于接纳,亚细安的对缅政策并未出现根本性改变。

    同理,缅甸军政府高层重新坐回会议桌,并不代表真正的回归。亚细安与缅甸的重新接触是否成功,还须观察一些决定性指标。

    随着亚细安成员国外长上个月与缅甸外长举行五年来首次面对面会晤,以及缅甸总统敏昂莱将于星期四(8月6日)访问泰国,缅甸军政府与亚细安的关系,正进入一个新的试探阶段。但受访分析员认为,双方重新接触并不等于接纳,亚细安的对缅政策并未出现根本性改变。

    自2021年缅甸发生政变以来,亚细安一直限制缅甸军政府参与高层政治会议,并推动落实“五点共识”。然而,这仅仅传达了区域层面对军政府的不满,并未产生足够影响力来改变军方的行为。

    缅甸军方始终无力控制全国许多地区,地方武装组织的影响力也有所扩大,导致人道危机不断恶化,难民流动、跨境犯罪和非法经济活动等问题越来越直接影响到周边国家。

    经过五年的冷对峙,亚细安近期对缅甸打开一扇沟通之门,却未向军政府敞开接纳的大门。泰国首相阿努廷星期二(4日)表态,“五点共识”仍是亚细安处理缅甸局势的指导框架,泰国始终主张对缅甸采取“经过审慎调整的重新接触方式”。

    “有限孤立”收效甚微 亚细安改变对缅策略

    亚细安政策出现调整,既与缅甸局势的变化有关,也因为亚细安过去的策略成效有限。

    澳大利亚昆士兰大学亚太保护责任中心高级研究员育云(Yuyun Wahyuningrum)接受《联合早报》采访时说,亚细安一些成员国或许认为,与缅甸维持最低限度的接触收效甚微,因此倾向于采取更务实的方式。

    “这是亚细安在策略上的调整,而非根本性的政策转变。部分成员国希望保持与缅甸的沟通渠道畅通,尤其是在人道援助、地震后的救灾应对、跨国犯罪,以及军方主导的大选筹备等方面。”

    军政府盼获合法性 亚细安缅甸生分歧

    然而,缅甸军政府希望从重新接触中获得的利益,与亚细安并不相同。自2021年以来,军政府一直寻求被亚细安认可,现在他们获得了一个被视为突破外交孤立、获得更大国际空间的契机。

    曾任美国和平研究所缅甸项目官员的福特(Billy Ford)受访时指出,军政府并不需要亚细安协助解决冲突,而是希望亚细安认可其所谓的政治合法性,并期待世界其他国家也随之接受这一点。

    他强调,敏昂莱曾在2021年出席亚细安领导人特别会议时,表示不反对“五点共识”并且还认为有帮助,只是为了缓解压力,根本无意遵守。实际上,敏昂莱近日再次批评“五点共识”,更指责亚细安歧视缅甸。

    “敏昂莱可能押注亚细安会认为缅甸冲突难以解决,因此最终会回归不干涉原则,把政变视为缅甸内部事务,并允许军政府重新获得亚细安会议桌上的位置。”

    如今,内比都针对平民的空袭仍持续升级,阻止人道援助进入,并拒绝释放政治犯,但缅甸代表却能到曼谷与亚细安外长举行非正式会晤。新加坡尤索夫伊萨东南亚研究院缅甸项目高级研究员莫杜扎(Moe Thuzar)受访时说,内比都期待“接触等于接受”,加上军政府公开拒绝“五点共识”,这是亚细安面临的最大挑战。

    缅甸问题实现持久的政治解决方案,离不开所有利益相关方展开对话。育云强调,亚细安的接触范围应扩大到军方之外,包括民族团结政府、地方武装组织、公民社会以及受影响的社区。

    同理,缅甸军政府高层重新坐回会议桌,并不代表真正的回归。亚细安与缅甸的重新接触是否成功,还须观察一些决定性指标。
