据美国有线电视新闻网(CNN)查阅的新内部指南,移民海关执法局官员仅在完成相关培训课程后,方可开展车辆拦查行动,且必须确保执法车辆配备灯光和警报器。
该指南发布之际,多起引发争议的车辆拦查行动已造成致命及非致命枪击事件,同时特朗普政府内部就如何推进此类拦查行动存在分歧——政府将此类行动视为加强移民逮捕行动的关键手段。
根据该指南,只有“成功完成”该局六门培训课程之一的执法与驱逐行动部门官员,才能开展“传统车辆拦查以及通常被称为高风险或重罪车辆拦查的召回式车辆拦查”。
未完成上述课程的官员仅能以支援身份参与行动。
指南规定,所有现场执法人员“必须佩戴由机构配发并已激活的随身执法记录仪”。同时明确规定,“在任何情况下”,官员均不得在车辆拒不停车时展开车辆追逐,而是应记录信息以便后续调查。
美国国土安全部及移民海关执法局已就此事向CNN置评。
今年早些时候,特朗普因得克萨斯州和缅因州发生致命枪击事件后,ICE暂停大部分车辆拦查行动一事感到愤怒。特朗普最终推翻了暂停令,但该决定随即遭到其政治基础的反对,他们认为这是政府在移民镇压行动上态度软化的表现。

在特朗普的第二任期内,车辆拦查一直是联邦官员与他们试图拘留的移民以及美国公民之间多次冲突的焦点。多起涉及逃逸嫌疑人或被指控“冲撞”联邦官员的抗议者的撞车事件被视频记录下来。
今年早些时候,美国公民蕾妮·古德在明尼阿波利斯驾车抗议ICE官员时,被一名ICE探员开枪击毙。美国国土安全部最初称古德试图用车辆作为武器攻击探员,但视频和目击者证词对国土安全部的说法提出了质疑。古德的家人于周四就她的死亡提起了两起民事诉讼。

Immigration and Customs Enforcement officers will only be allowed to conduct vehicle stops if they have completed related training courses and must ensure that vehicles used for stops are equipped with lights and sirens, according to new internal guidance reviewed by CNN.
The guidance comes on the heels of multiple controversial vehicle stops that have resulted in fatal, and non-fatal, shootings and against the backdrop of internal tension within the Trump administration over how to proceed with the stops, which the administration considers a key tool as it ramps up immigration arrests.
According to the guidance, only Enforcement and Removal Operations officers, who have “successfully completed” one of six agency training courses, can conduct “traditional vehicle stops, and call-back vehicle stops commonly known as high-risk or felony vehicle stops.”
Those who have not completed one of those courses can only participate in a support capacity.
The guidance states that all officers on scene “must have an agency-issued and activated body worn camera.” It also states that “under no circumstances” are officers authorized to engage in vehicle pursuits in instances where people fail to pull over, but instead to take down information for further investigation.
CNN reached out to the Department of Homeland Security and Immigration and Customs Enforcement for comment.
Earlier this summer, Trump was furious over a pause on most vehicle stops conducted by ICE following fatal shootings in Texas and Maine. The decision to pause those stops, which Trump ultimately overturned, immediately received pushback from his political base, who believed it was a sign of the administration going soft on its immigration crackdown.
The new guidance doesn’t prohibit vehicle stops but lays out who is allowed to participate — and in what capacity — and how to perform them.
The guidance, for example, also weighs in on vehicle stops that involve the pinning of a vehicle and use of tire deflation devices. It describes pinning as using a vehicle or physical barrier to trap or stop a car.
Officers are permitted to pin a vehicle “for the safety of the suspected vehicle and its occupants, the ICE officers engaged in vehicle stops, and other motorists on the roadway.”
Throughout Trump’s second term, vehicle stops have been at the center of several interactions between federal officers and immigrants they are trying to detain, as well as US citizens. Several crashes involving fleeing suspects or protesters accused of “ramming” federal officers have been caught on video.
Earlier this year, a US citizen, Renee Good was fatally shot by an ICE officer in Minneapolis while driving her car and protesting ICE officers. The Department of Homeland Security initially said Good tried to weaponize her vehicle against the officer, but video and witness accounts called into question DHS’ version of events. Good’s family filed two civil lawsuits related to her death on Thursday.
In July, two immigrants, Lorenzo Salgado Araujo in Houston and Joan Sebastian Durán Guerrero in Biddeford, Maine, were fatally shot by ICE officers in separate incidents about a week apart. Those shootings and their fallout prompted DHS to direct ICE officers to briefly suspend most vehicle stops and coordinate more closely with local agencies when executing a criminal warrant on someone inside a vehicle.
And last month, an ICE officer shot and wounded a man from Venezuela who was working as a DoorDash driver in Austin, Texas.
