美国曼哈顿联邦地区法官约翰·克罗南驳回了X公司的主张,该公司称《停止隐藏仇恨法案》违反了美国宪法第一修正案,因为该法案要求X披露纽约州认定为“令人反感的高度敏感且具争议性的言论”,否则将面临诉讼和巨额罚款。

法官表示,要求X公司披露其内容审核政策的“纯粹事实性且无争议的信息”,与纽约州让民众对使用社交媒体做出知情选择的利益合理相关。
“企业在决定提供何种商品或服务时,始终会行使其自由裁量权、判断力和观点,”克罗南写道。“例如,汉堡王通常会提供比Sweetgreen热量更高的菜品,但卡路里信息的披露仍是纯粹的事实。本案亦是如此。”
此次驳回具有既判力,意味着X公司无法修改其诉状。

NEW YORK, Aug 26 (Reuters) – A U.S. judge on Wednesday dismissed a lawsuit by Elon Musk’s X seeking to void a New York state law requiring social media companies to disclose how they monitor hate speech, extremism, harassment, foreign political interference and disinformation.
U.S. District Judge John Cronan in Manhattan rejected X’s argument that the Stop Hiding Hate Act violated the U.S. Constitution’s First Amendment by exposing it to lawsuits and big fines unless it disclosed “highly sensitive and controversial speech” that the state found objectionable.

The judge said requiring X to report “purely factual and uncontroversial information” about its content moderation policies was reasonably related to New York’s interest in letting people make informed choices about using social media.
“Businesses always exercise their discretion, judgment, and opinions when deciding what goods or services to offer,” Cronan wrote. “Burger King chooses to generally offer higher-calorie items than, say, Sweetgreen, but the disclosure of calorie information remains purely factual. So too here.”
The dismissal is with prejudice, meaning X cannot amend its complaint.

X, formerly Twitter, is part of Musk’s rocket and satellite company SpaceX (SPCX.O), opens new tab. Neither lawyers for X nor SpaceX immediately responded to requests for comment.
The office of New York Attorney General Letitia James defended the law. It did not immediately respond to similar requests for comment.
Signed, opens new tab in December 2024 by Governor Kathy Hochul, the New York law required social media companies with at least $100 million of annual revenue to disclose how they eliminate hate on their platforms, and report their progress.
Civil fines can reach $15,000, opens new tab per violation per day. The law was written with help from the Anti-Defamation League.
In seeking a dismissal, James said the law helped consumers understand what to expect from social media, without blocking platforms from speaking out or exercising judgment when moderating content.
Musk scrapped Twitter’s content moderation policy after he bought that company in 2022. The world’s richest person has described himself as a free speech absolutist.
