美国检察官在周二晚公布的法庭文件中表示,科米的小说中,一名右翼播客主播使用加密语言煽动追随者针对政治对手,这与科米15个月前发布的一张海滩贝壳摆成“86 47”数字的帖文存在相似之处。

“就在发布一本讲述魅力公众人物公开传递信息、指示追随者‘铲除’政治敌人的新书仅数天前……科米发布了一条帖文,包括联邦和地方执法人员在内的众多观察者合理地将其解读为‘杀死特朗普总统’,”检察官在法庭文件中写道。
特朗普政府时期的司法部提出上述主张,同时敦促法官驳回科米以起诉存在报复性且侵犯言论自由为由要求驳回案件的申请。
2017年被特朗普解雇联邦调查局局长一职的科米否认存在任何不当行为。他被控威胁美国总统及传输威胁性通信。其律师辩称,此案是对科米批评特朗普的报复,且该帖文未达到暴力威胁的法律标准。
Instagram上的贝壳与俚语
科米2025年5月发布的Instagram帖文将意为“移除、驱逐”的俚语“86”与对第47任美国总统特朗普的指代结合在了一起。这一短语已被其他人用作反特朗普的抗议口号。
科米称,当时他与妻子在北卡罗来纳州海滩散步时发现了这个贝壳造型,并将其解读为一则巧妙的政治表态。该帖文引发争议后他将其删除,并表示自己不知道这组数字会与暴力行为产生关联。
科米的辩护律师提供了证据,显示联邦调查局曾试图证明科米在纽约起诉黑帮团伙案件的工作中,就已知晓“86”可能被赋予暴力解读,但未能成功。
联邦检察官还暗示,科米试图借该事件为其2025年5月出版的小说《罗斯福大道》造势。他们提及据称科米发给经纪人的一条短信,内容为“此事引发的关注并非我的本意,但如果能促进书籍销售,我也无妨”。

WASHINGTON, Aug 19 (Reuters) – The U.S. Justice Department has cited a legal thriller written by James Comey as evidence the former FBI director knew his social media post that featured the numbers “86 47” would be interpreted as a threat against President Donald Trump.
U.S. prosecutors, in court filings published late on Tuesday, said Comey’s novel, in which a right-wing podcaster uses coded language to encourage his followers to target political opponents, has parallels with Comey’s 15-month-old post that depicted seashells arranged on a beach to form the numbers “86 47.”

“Just days before releasing a book about a charismatic public figure who publicly conveys messages instructing his followers to ‘get rid of’ his political enemies … Comey posted a message that many observers, including federal and local law enforcement officers, reasonably interpreted to mean ‘kill President Trump,’” prosecutors wrote in the court filings.
Trump’s Justice Department made that claim as it urged a judge to reject Comey’s attempts to have the case thrown out as vindictive prosecution and a violation of his free-speech rights.
Comey, who was fired by Trump as FBI director in 2017, has denied wrongdoing. He is charged with threatening the U.S. president and transmitting a threatening communication. His lawyers have argued the case was brought as retribution for Comey’s criticism of Trump, and that the post did not meet the legal threshold of a threat of violence.
SEASHELLS AND SLANG ON INSTAGRAM
Comey’s May 2025 Instagram post combined the slang term “86,” meaning to remove or expel, with a reference to Trump as the 47th U.S. president. The phrase has been used by others as an anti-Trump protest slogan.
Comey has said he saw the shell formation while on a walk on a North Carolina beach with his wife and interpreted it as a clever political statement. He deleted the post after it generated controversy, saying he did not know the numbers could be associated with violence.
Comey’s defense lawyers have produced evidence that the FBI tried unsuccessfully to show that Comey was aware of a violent interpretation of “86” from his work prosecuting mob figures in New York.
Federal prosecutors have also implied that Comey sought to use the incident to drum up publicity for the novel “FDR Drive,” which was published in May 2025. They referenced a text that he reportedly sent to his agent saying attention from the incident was “not my intention, but I’ll be OK if it sells books.”
The novel tells the story of a federal prosecutor who seeks to build a case against the right-wing media personality accused of inspiring violent acts. It is one of several legal thrillers Comey has written.
